Scope of ServicesThe Project is a group of buildout projects to design and construct the buildout of shell space inthe new South Terminal Complex (STC) for approximately 20 different occupants, includingairlines, concessionaires, service providers and other users.

• The Project will consist of the design and construction, within existing STC shell space, ofmultiple buildout projects including, but not limited to airline ticket offices, baggage serviceoffices, airline and ground transportation support areas, janitorial support areas, commissaryareas and other spaces required to support airlines, operations, security, service providers,tenants and other users.

• The buildout projects will include, but not be limited to, the addition of interior finishes (floor,wall and ceiling) to existing base building shell space, new indoor partition walls, additionaland/or adjustment to existing door openings, and extension of all systems (mechanical.electrical, plumbing, fire protection, fire alarm, access control, communication, etc.) includingextensions of MCO legacy systems.

• The projects will be on various levels of the new STC, including the Landside Terminal, AirsideConcourses and the Ground Transportation Facility.

• The required Services are for Design/Build (D/B) Contractors to design and construct theprojects, which include, but are not limited to concept development; detailed design services;permitting; construction; move-in support; and other related services necessary for theprojects.

Include Proposer’s Statement of the following:

a) The name and address of the legal entity that will contract with the Aviation Authority ifawarded the Agreement for the Services.

b) Name, address, Email address and telephone numbers of one (1) individual to whom allfuture correspondence and/or communications will be directed until the AviationAuthority has completed evaluation and selection of the successful Proposers, if any.

c) A statement declaring the type of business relationship the Proposer will use (i.e., asingle company, joint venture or other form of business relationship to perform theservices for the Projects). If a joint venture, please also state whether the entity iscurrently in existence is being formed specifically for this project, or whether it will beformed upon award. 2. Executive Brief

Explain why Proposer should be selected for the Projects, which includes:

a) A comprehensive project approach to provide the required Services for the Project. TheServices to design and construct the buildout of the tenant spaces are required to occurconcurrently with the completion of construction of the STC shell space andinfrastructure by others (the Aviation Authority’s construction managers at risk (CMARs).Therefore, the Project work must not only be closely coordinated with the ongoing workby the Aviation Authority’s CMARs but also will likely be on the critical path for theopening of the new STC. The selected Proposers will be required to develop andmaintain schedules for each project in Primavera P6 in a form that will be integrated intothe existing overall STC Program schedule. The project approach shall include adescription of how Proposer intends to work within these constraints to timely deliver thecompleted tenant buildout projects without delaying the opening of the new STC.

b) An organization chart showing the proposed Key Subconsultants and, to the extentknown at this point, Key Subcontractors comprising the proposed D/B Team; theproposed Key Personnel; and the role of both the firms and the Key Personnel.Specifically identify a team member that is qualified to sign and seal design documentsin the State of Florida. It is anticipated that the Key Subconsultants will includeProposer’s lead design firm and all major design disciplines; Key Subcontractors willinclude only those firms considered to have a key role in ensuring successful completionof the Services, if any.

c) A narrative explaining the proposed role for each proposed Key Subconsultant and KeySubcontractor comprising the D/B Team; a summary of each firm’s expertise and priorexperience for their proposed role; and examples where the proposed team has workedtogether on other similar projects.

e) A statement confirming Proposer’s understanding and agreement that, for necessaryextensions of certain key systems (including, but not limited to, Fire Alarm, PagingSystem (ECS) and Radio Cellular Distribution System (DAS), it will be required forProposers to use specific subcontractors identified by the Aviation Authority in order toprotect warranties already in place for these existing systems.

f) Identification of the major challenges expected on this type of project and how thesechallenges will be successfully resolved.

g) A narrative outlining the Proposer’s approach to incorporating sustainable designprinciples into the Service.

h) A description, not exceeding two (2) pages, of the Proposer’s quality control program forproviding the proposed Services. Include the proposed method for communication andcoordinating with the Aviation Authority, its other consultants and other interestedgovernmental agencies.

3. Qualifying Experience

Proposers and their key personnel must be experienced in performing similar services forprojects of a scope and nature comparable to the Project. It is preferred that Proposers have:

• a minimum of 5 years prior experience as a prime contractor, architect or engineer; and

• successfully completed, as the prime contractor, a minimum of 2 similar design/buildprojects within the past 10 years that included, in order of decreasing preference: thebuildout of airline and/or tenant spaces at the Orlando International Airport; the buildout ofairline and/or airport spaces at other airports; and the buildout of tenant spaces forcommercial or public facilities; at least 1 of which had a minimum construction value of notless than $1,000,000, and

• prior experience working together with the proposed D/B Team on similar design/buildcontracts.

Include the following information that substantiates the experience and qualifications of the Proposerand its Key Personnel to perform the Work, including all of the following:

a) A USGSA Form 330 which includes the following information:

1. Clearly identify and provide details on the scope and cost for each qualifying project andfor additional, similar projects which best represent the Proposer’s skill and experience onprojects similar to the size, type and complexity of the advertised Project.

2. Clearly identify the proposed Key Subconsultants, Key Subcontractors, and their roles, ifany, that were involved on each of the qualifying and similar projects.

3. Clearly identify the proposed Key Personnel and their roles, if any, that were involved oneach of the qualifying and similar projects.

4. Proposer and their key personnel should have prior experience coordinating with andmeeting the requirements of applicable federal, State of Florida and City of Orlandocodes, regulations and laws, specifically identify recent experience with the City ofOrlando Permitting (if any). Clearly identify those specific projects which best demonstratethis experience.

5. For each qualifying project, provide the name, title, address, Email address andphone numbers for a reference contact person of the Proposer’s client, preferablythe owner of the facility, who is familiar with the Proposer’s role on that project.Reference checks will be conducted on those projects and may also be conductedon other projects.

b) A brief narrative for each of the qualifying projects including an explanation of Proposer’srole on each project; the type of contract; whether Proposer was in a prime or sub-contracting role; and a summary of the scope, phasing, construction delivery methods andlessons learned on the project that are considered to be relevant to these Projects.

4. MWBE/LDB/VBE Requirements

All Proposers for non-federal and non-State of Florida funded projects are hereby notified thatthey must comply with:

1) the Minority and Women Business Enterprise (MWBE) Project requirement as defined inthe Authority’s MWBE Policy, and

2) the Local Developing Business/Veteran Business Enterprise (LDB/VBE) Projectrequirement as defined in the Authority’s LDB/VBE Policy.

4. MWBE/LDB/VBE Requirements (continued)The Proposer shall submit a written statement committing to meet the MWBE and LDB/VBEparticipation goals for the Projects. The Proposer shall also submit a written action plan thatdemonstrates the Proposer’s understanding of the MWBE and LDB/VBE participationProjects and which demonstrates how the Proposer intends to achieve the MWBE andLDB/VBE participation goals during the design and construction phases of the projects.

For this Project, the Aviation Authority has established the following participation goals:

• MWBE Participation Goal: 20% of total Contract Cost• LDB/VBE Participation Goal: 5% of total Contract Cost

5. Insurance RequirementsInclude evidence of the Proposer’s ability to provide the following insurance coverage, either bymeans of an existing policy, or other verifiable proof (Agent/Broker commitment letter):

a) Professional Liability: Minimum of $1,000,000 per claim and annual aggregate with maximumdeductible or self-insured retention in an amount not exceeding $100,000. Any deductible or self-insurance retention should be indicated on the Proposer’s certificate of insurance.

i. Proposer shall carry and be the policy holder for the Professional Liability insurance onall contracts exceeding $5,000,000.

ii. If Proposer is unable and/or unwilling to carry and be the policy holder for theProfessional Liability insurance, Proposer may be considered for contracts less than$5,000,000 where Proposer’s Design Subconsultant carries and is the policy holder forthe Professional Liability insurance.

b) Commercial General Liability (CGL): Minimum of $1,000,000 per occurrence and annualaggregate, with maximum deductible or self-insured retention in an amount not exceeding$100,000. The Policy shall include Completed Operations Coverage for 10 years followingcompletion per the period of Florida statutory liability (Florida Statutes §95.11), with no ISO Form2294 Rider or other subcontractor error exclusion. Any deductible or self-insurance retentionshould be indicated on the Proposer’s certificate of insurance.

5. Insurance Requirementsb) Automobile Liability: Minimum of $1,000,000 per occurrence with maximum deductible or self-

insured retention in an amount not exceeding $100,000. Any deductible or self-insuranceretention should be indicated on the Proposer’s certificate of insurance.

c) Worker’s Compensation - (statutory limit) and,Employer’s Liability: $500,000 - each accident

$500,000 disease - policy limit$500,000 disease - each employee

Policy terms must be acceptable to the Aviation Authority and must comply with the Aviation Authority’srequirements for insurance.

6. Bonding CapacityThe Surety must be rated no less than “A-” as to management and no less than “VIIl” as tostrength, by the latest edition of Best’s Insurance Guide, published by A.M. Best Company,Post Office Box 1107, Summit, New Jersey 07901. Information shall be provided by the Suretyon behalf of the Proposer. Provide an acknowledgement by the Proposer’s Surety of:

a) Proposer’s ability to provide 100% Performance and Payment Bonds for a minimum of$2,000,000 for a single project.

b) Proposer’s maximum single project bonding capacity for 100% Performance and PaymentBonds. The maximum individual project value in this Project may exceed $15,000,000 andthe Proposer’s ability to bond a project of this size will be considered during ranking andselection.

c) Proposer’s aggregate bonding capacity.

7. LicensureProposer shall be a design/build firm, which is defined as a partnership, corporation or other legalentity that:

• is certified under Florida Statute 489.119 to engage in contracting through a certified orregistered general contractor or a certified or registered building contractor as the qualifyingagent; or

• is certified under Florida Statute 471.023 to practice or to offer to practice engineering; orcertified under Florida Statute 481.219 to practice or to offer to practice architecture; orcertified under Florida Statute 481.319 to practice or to offer to practice landscape architecture.

The following must be included:

a) Copies of current, active Florida Professional Registration Certificate and/or current,active contracting license issued by the State of Florida for the Proposer, KeySubconsultants, Key Subcontractors and Key Personnel proposed for the Project; and

b) Copy of Proposer’s Florida Secretary of State Certification.

8. Violation of Laws

Identify all instances within the past 5 years where the Proposer or its team members havefailed to comply with or have been the subject of an investigation of an alleged violation ofstate or federal laws related to permitting, environmental, or equal employment regulations,safety issues or contract crime (involving fraud, bribery, collusion, conspiracy, or materialmisrepresentation).

• Following submission, The Aviation Authority’s Professional Services Committee (PSC) willselect a short list of responsive and qualified Proposers based upon its evaluation of the SOQsreceived, which will include consideration of the responses to the inquiries set forth above;bonding capacity; professional liability insurance; level and quality of proposed small businessparticipation; and, in decreasing order of preference, past experience with airline and/or tenantbuildout projects at the Orlando International Airport; past experience with airline and/or airporttenant buildout at other airports; and past experience with commercial or public facility buildoutprojects. The Aviation Authority reserves the right to solicit from available sources relevantinformation concerning a Proposer’s past performance and may consider such information inits selection.

• Shortlisted Proposers will be scheduled for an interview, presentation or both. Followingshortlisting, interviews and/or presentations, the PSC will rank the short listed Proposers inorder of preference based upon this published evaluation criteria and the results of theinterviews and/or presentations. Depending upon the number and content of SOQs received,and the number of shortlisted Proposers, it is anticipated that the PSC will recommendselection of the most highly qualified 4 to 6 Proposers.

• Upon Aviation Authority Board approval of the PSC’s proposed ranking and recommendedselection, the Authority will provide a Design Criteria Package (DCP) for the project that has thehighest estimated cost to the highest ranked Proposer; will provide a DCP for the next highestestimated cost project to the second highest ranked Proposer, etc., until all of the projectpackages have been assigned.

• It is anticipated that each D/B contract will be negotiated in phases, with the design fees beingnegotiated initially based on the requirements of the DCPs. Following completion, or somesignificant portion, of design, the construction cost will then be negotiated with each D/BContractor. Each D/B contractor will remain responsible and provide Services for its assignedarea and/or occupant through design, construction and move-in.

• The Aviation Authority intends, but is not obligated, to enter into a non-exclusive agreementwith each selected Proposer to perform the design and construction Services for the projects.The Aviation Authority shall have the right, but not the obligation, to award all or any portion ofthe work on the projects to one or more Proposers. The Aviation Authority reserves its right toaward any or all of the projects subject to the availability of funding.

• The Aviation Authority reserves the right to waive any informality in the Statement ofQualifications, to reject any and all Statements of Qualifications, to re-advertise for Statementsof Qualifications or to elect not to proceed with any portion or all of the Projects for any reason.

• All recommendations and decisions regarding award of the Projects will be made at openpublic meetings in accordance with the requirements of Florida Statute 286.011, and allinterested parties are invited to attend such meetings. In accordance with Florida Statute287.055 (10), the Aviation Authority declares that all or any portion of the documents and workpapers prepared and submitted pursuant to this invitation shall be subject to re-use by theAviation Authority.

Additional Information• Pursuant to Florida Statute 287.055 (9) (b), Schenkel Shultz Architecture, the Design Criteria Consultant

(DCC) that prepared or assisted with the preparation of the DCPs) for this Project, is not eligible to renderdesign/build contract services for these projects and, therefore, may not be included on the Proposer’s team.

• Proposer’s personnel will be required to meet the Aviation Authority’s requirements for security backgroundchecks. All personnel requiring unescorted access to a secure or sterile area of the airport must undergo aCriminal History Records Check (CHRC) and are subject to the requirements of Title 49 of the Code forFederal Regulations Part 1542 or 1544 and the Airport Security Improvement Act of 2000.

• Proposers are hereby advised that individuals, who conduct lobbying activities with Aviation Authorityemployees or Board members, must register with the Aviation Authority each year prior to conducting anylobbying activities. A statement of expenditures incurred in connection with those lobbying instances shouldalso be filed prior to April 1st of each year for the preceding year. As of January 16, 2013, lobbying anyAviation Authority Staff, who are members of any committee responsible for ranking Statements ofQualifications and thereafter forwarding those recommendations to the Board and/or Board Members, isprohibited from the time that a Request for Qualifications is released to the time that the Aviation AuthorityBoard makes an award. As adopted by the Aviation Authority Board on September 19, 2012, lobbyists arenow required to sign-in at the Aviation Authority offices prior to any meetings with Staff or Board members.
