III. LEPC BUSINESS ITEMS

Ron Mills reported that this was his last meeting and he thanked the members for their contributions to increasing public safety. Nominations Committee Chair David Peaton presented the nominations results for the LEPC:

Chair

• Shayne Morgan: 3 Nominations Vice Chair, Public Information

• David Peaton: 2 Nominations Vice Chair, First Responder

• David Knowles: 2 Nominations • Scott Garner: 1 Nomination • Dan Smith: 1 Nomination

David Knowles declined the nomination. No additional nominations were received

from the floor. Action: The following LEPC members were elected as Officers of

the North Central Florida Local Emergency Planning Committee: Chair: Shayne Morgan,

Vice Chair, Public Information: David Peaton, and Vice Chair, First Responders: Scott Garner.

Captain Dan Smith, Gainesville Fire Rescue was appointed as Training Task Force

representative. Scott Holowasko was appointed as LEPC representative on the Regional Hazmat Team Policy Board.

Each county reported on hazardous materials related activities and exercises that have

occurred since the last meeting. The Committee reviewed possible HMEP planning projects for the fiscal year starting

on October 1, 2015. The various options were reviewed and it was decided to conduct a commodity flow study with at least one count location in each county.

Action: It was moved by Shayne Morgan and seconded by Scott

Garner to select a Commodity Flow Study as the Hazardous Materials Emergency Preparedness planning project for the year. The motion passed unanimously.

IV. FIRST RESPONDERS ISSUES Next, the group discussed First Responder issues. The first responders training

program and classes were discussed. Additional classes are being scheduled and include using resources from the training trailers. The status of the Supplemental

-3-

Environmental Projects website and database was discussed next. It was reported that the website should be fully functional soon.

The Regional Hazmat Team reported that it was conducting a natural gas pipeline

tabletop exercise on December 7, 2015, at the Taylor County Emergency Operations Center. The exercise includes the following three modules: Initial assessments and notifications, Initial response from local responders and facility, and Sustained Regional Operations.

Dwayne Mundy gave an update on the hazards analyses process and said that the first half was due to the state on November 2, 2015. He said he submitted updates for Columbia, Hamilton, Lafayette, Madison, and Taylor Counties. The second half is due on March 2, 2016 and will include Dixie, Levy and Marion Counties. Mr. Mundy encouraged emergency management and fire departments to accompany him on the site visits. The Committee reviewed the training results for October 1, 2014, through September 30, 2015. A total of 19 classes were held which were attended by 270 students whom completed 4,266 hours of training. The soft match value of this training was $170,640. A hazmat training needs survey was reviewed. Additional classes to be added to the survey included: Operations Refresher, Chemistry, and PPE Selection. It was noted that we can no longer offer classes on clandestine drug labs or chemical suicides since these are not transportation related under HMEP Guidelines.

It was reported that the Regional Hazardous Responses Team meeting was being held

today at 1:00 p.m. here. The North Central Florida Regional Hazmat Response Team reported that the U.S. Department of Transportation, Pipeline and Hazardous Materials Safety Administration have awarded the Team a $43,600 Pipeline Technical Assistance Grant. The grant will improve preparedness, through enhanced planning, training, and exercising. Milestones include identification of areas and facilities vulnerable to pipeline releases, and conducting three tabletop exercises centered on pipeline compressor stations located in three counties.

Initial milestones in the grant include identifying out of date planning information

currently contained in the National Pipeline Mapping System and the Celeritas Identified Site Registry and to provide updated geospatial information. The Team will prepare and distribute to local media outlets a press release advising the public of steps being taken to enhance pipeline safety by emergency responders. This will include information on pipeline hazards and possible protective actions, where additional information is available, as well as contacts for local emergency management agencies.

A gap in the regional hazmat training program has been identified. There is a need for

pipeline response training beyond the current awareness level. This should include response to both leaks and the secondary consequences associated with the direct and indirect impacts of a pipeline leak. This will include building natural gas piping leak training props and a purchasing a second training trailer to transport this around the

-4-

District. These items will be used in training classes with instructors funded through the existing HMEP training grants.

The group discussed the CSX Rail Respond Online Response Tool available for

download at http://csxrailrespond.com. It was reported that this replace the previous app available for smart phones. Dan Smith reported on issues under consideration by the State Emergency Response Team Training Task Force. These include: Online training, memorandum of understanding with the Coast Guard on off-shore hazmat response, Field Operations Guide, tar ball response procedures, foam, and medical procedures. Joe Nelson from Palm Beach County was elected as Chair to replace Donnie Sessions.

V. PUBLIC INFORMATION ISSUES The LEPC participated with Alachua County Emergency Management on Saturday,

September 19, 2015, in “Alachua County Prepares Festival” as part of National Preparedness Month. The focus was on sheltering in-place education and decision making. One goal of the LEPC is to start offering Shelter In-Place Train-the-Trainer classes, with the first class to be held next quarter in Madison.

Annual facility outreach is scheduled for the next LEPC meeting. This supports the

goal to increase preparedness between facilities, fire departments, emergency management, hazmat teams and the LEPC. All facility emergency preparedness contacts are being invited to attend the February LEPC meeting which focuses on improving coordination. Emails from E-Plan are being used for invitations.

Also being invited are facilities with large fuel tanks registered with the Florida

Department of Environmental Protection that appear to not be exempt from Tier 2 reporting. Reportable facilities include those with aboveground retail tanks and non-retail storage locations which have fuel tanks greater than 2,000 gallons. Exempt facilities not invited include retail gasoline stations with underground tanks and fuel tanks at farms which are considered as routine agricultural use.

VI. OTHER BUSINESS AND INFORMATION REQUESTS Tim Smoak gave an update on innovative communication system

VII. NEXT MEETING DATE AND LOCATION

It was decided that the next meeting will tentatively schedule for February 18, 2016 at the Gainesville Regional Utilities Eastside Operations Center. The meeting was adjourned at 11:38 p.m.

EPA Marks 25th Anniversary of EPCRA

“This law is important to safeguarding our communities from chemical emergencies,” said EPA Administrator Lisa P.Jackson. “Twenty-five years after EPCRA was made into law, EPA continues to improve and advance our community right-to-know programs, so that we can ensure the best possible chemical safety protection for every community across thecountry.”

Public demand for information about chemical releases skyrocketed in the mid-1980s after a deadly cloud of highly toxicpesticide killed thousands of people in Bhopal, India. Shortly thereafter, a serious chemical release at a plant in WestVirginia hospitalized 100 people. These events led to the implementation of EPCRA in 1986.

Under EPCRA, Environmental Protection Agency (EPA) collects information on toxic releases through the Toxic ReleaseInventory program (TRI), a public database containing information regarding the industrial releases of over 600 toxicchemicals from more than 20,000 facilities throughout the nation. TRI was the first publicly available database in the worldthat contained information on pollutant releases. Many other countries have since followed EPA’s lead, recognizing the valueof making toxic chemical data readily available to the public. TRI information enables every American to make informeddecisions on the consequences of toxic releases and empowers communities to take action.

EPCRA has made the lives of every American safer from toxic emergencies by establishing emergency planning groups atthe state, tribal, and local levels. EPCRA brings together emergency responders from fire and police departments, medicalpersonnel, emergency planners, elected officials, environmental group representatives and local citizens to develop plans torespond to chemical emergencies.

16. local option

19.17. schools

There should be a continued good faith effort on behalf of the LEPC

chairperson to ensure that all of the occupational categories are

represented on the LEPC.

B. For the purpose of appointment, the State Emergency Response

Commission (SERC) has defined “Interested Citizen” as “a person who

SERC Policies for LEPCs – Page 2 of 7

resides in the emergency planning district for which appointment is sought

to the LEPC, and who is interested in the emergency planning process, but

who does not otherwise represent those groups or organizations designated

by state and federal law.”

C. For the purpose of appointment, Water Management District (WMD)

representatives can be staff or board members of the five established

WMDs. Membership in this category is limited to one member. An effort

should be made to encourage a separate representative for each LEPC.

D. Two types of appointments will be considered for the LEPCs:

1. Regular Appointments – Recommendations for appointments

of members and alternate members to an LEPC must be

directed to the Compliance Planning Section from the LEPC

chairperson. These recommendations must be made in

writing and/or submitted via electronic mail. LEPC

nominations will be considered at the next scheduled SERC

meeting. All appointments must be approved by the

SERC.

2. Fast-Track Appointments – The SERC chairperson, or

alternate chairperson, may fill vacancies on an “interim

basis” until the SERC has an opportunity to review and

approve the recommendations. However, this appointment

method shall only be used when extenuating circumstances

warrant. The recommendations can be made by telephone,

but will require written follow-up and/or may be submitted

electronically. The SERC chairperson, or alternate

chairperson, shall respond within ten days of receiving an

oral or written request for recommendation.

E. LEPC members and alternates shall be appointed for a two-year term.

1. In addition to regular appointments, the SERC will make

biennial appointments at its July quarterly meeting of the last

even year of each biennium for terms beginning July 1.

1. SERC will re-certify all existing LEPC memberships for

additional two-year terms each July of all even-numbered

years.

2. In the event the SERC does not act on biennial appointments

prior to July 1, all appointments will remain in effect until the

SERC takes official action.

SERC Policies for LEPCs – Page 3 of 7

3. All members may be re-nominated and re-appointed through

the SERC’s biennial appointment process.

F. A member may recommend an individual to serve as his/her alternate.

With the exception of the elected state officials category, the alternate

must represent the same occupational category as the primary member. A

member in the elected state officials category may recommend his/her aide

or a district staff member to serve as his/her alternate. The member’s

recommendation must be made in the form of a letter to the LEPC

chairperson. An LEPC chairperson shall recommend alternate

nominations to the SERC in the same manner as regular appointments.

All alternate nominations shall be accompanied by the primary member’s

initial written request. The SERC shall review and consider

recommendations for alternates at its next scheduled SERC meeting.

1. It will be the responsibility of the LEPC members to inform

the alternates of meeting dates, and to provide them with

pertinent meeting materials.

2. If both the member and the alternate are present at a meeting,

the member has one vote; the alternate has no vote.

3. When the member resigns, or is removed, so is the alternate.

3. If the primary resigns and is not immediately replaced, the

alternate becomes the primary member.

4. An alternate member may not serve as an officer of the

LEPC.

G. The LEPC chairpersons and vice-chairpersons shall serve a two-year term

and be elected in accordance with “Roberts Rules of Order.” New LEPC

chairpersons and vice-chairpersons shall be elected at the first

organizational meeting following biennial appointments. The former

chairperson shall serve as interim chairperson until said meeting is held

and elections can be conducted.

In the event that a chairperson resigns or is removed from the LEPC, the

vice-chairperson shall preside until a new chairperson can be elected.

H. The maximum size of the LEPC and the maximum size of the occupation

category is up to the discretion of the LEPC.

H. The maximum size of the LEPC will be thirty members; with no more

than three members per occupational category with the exception of the

WMD category. This category is limited to one member per LEPC.

Formatted: List Paragraph, No bullets ornumbering

SERC Policies for LEPCs – Page 4 of 7

1. The LEPC chairperson may petition the SERC to increase the

size of the LEPC for good cause.

2. The LEPC chairperson may petition the SERC to increase the

size of an occupational category for good cause.

3. Petitions for expansion of either an occupational category or

the overall size of the LEPC must be directed to the

Compliance Planning Section. Petitions must be made in

writing and/or submitted via electronic mail.

I. LEPCs can establish “Technical Advisory Workgroups” consisting of

volunteers that will provide assistance to the LEPC in a variety of areas

(i.e., planning, public outreach). Non-appointed workgroup members do

not have LEPC voting privileges.

J. Nine members constitute a quorum count.

K. There should be a continued good faith effort on behalf of the LEPC

chairperson to ensure district wide representation on the LEPC.

L. When an LEPC member changes occupational categories, he/she must

notify the LEPC chairperson. Upon doing so, the LEPC member’s

appointment will be reviewed. The LEPC chairperson may then

recommend to the SERC chairperson that the member be appointed to

another occupational category, if appropriate.

II. RESIGNATION AND TERMINATION PROCESS

A. When an LEPC member provides written notice of resignation to the

LEPC chairperson, or to the SERC, that member will be removed by the

SERC.

B. In the event written confirmation of a resignation is unobtainable, a verbal

confirmation from the member or the chairperson of an LEPC to the

SERC will be acceptable.

C. If an LEPC member, or his/her alternate, misses three consecutive

meetings, the member’s and alternate’s appointment is automatically

terminated.

C. Attendance and termination policies are at the discretion of the LEPC.

D. If a member is recommended for removal from an LEPC by the above

process, or for any other reason, the SERC will send a letter to that LEPC

member identifying the reasons for removal.
