Polls open at 9:00 a.m. and close promptly at 2:00 p.m. Realtor® members can also vote in Queens at the Realtor Service Center in Jackson Heights. The LIBOR Nominating Committee, chaired by LIBOR’s immediate Past President Buddy Hoosein, met on Wednesday, September 8th in West Babylon. At the meetings conclusion, the following report was given: President-elect, Donald Scanlon, Queens Vice President, Laura Copersino, Nassau Vice President, Barbara Ford, Suffolk Vice President, Caroline Jemison, Treasurer, Moses Seuram and Secretary, Susan Helsinger. LIBOR members that would like to run for an office must submit a petition by Wednesday, October 6, 2010. She has been with Netter Real Estate in West Islip for 23 years. When not involved with all described below, Liz actively works with clients to help them "on to the next chapter in their lives" or "realize the American Dream of Homeownership". Liz has a B.A. with Honors in English from Adelphi and a Masters in Liberal Studies from SUNY Stony Brook. Currently Liz serves as LIBOR President- elect and held the office of LIBOR Suffolk Vice President for 2006 & 2007. In 2008, she served as LIBOR Secretary and was Treasurer in 2009. On the Chapter level, Liz served the Suffolk South Shore Chapter as President in 2002, Vice President in 2001 and served on her chap- ter's Board of Directors 1998- 2006. This year Liz was highly instrumental in establishing LIBOR's Young Professionals Network. In 2007, Liz was cho- sen LIBOR Realtor-Salesperson of the Year.     In the newspaper world, many timesthe headline tells the story. We havebeen covering the 100 year history ofthe Long Island Board of REALTORS�,Inc. this year, by publishing a series ofarticles broken out by decades thatfocus on the highlights and events thatoccurred in real estate during that peri-od of time. I find myself reading yearsand years of old “Realtor�”‰newspapersto get a flavor of what was happeningduring a certain period of time becauseI do not share the number of years in thebusiness as many of my co-workers.

    I thought it would be fun to share a fewof the headlines that ran in “TheRealtor�”‰ paper during the 90’s and per-haps some of these headlines will bringback memories of what was happeningat LIBOR and MLS during that time.

    August 1990 — 100%Computerization Planned for MLS —Computers will allow daily listing infor-mation to be delivered electronically,instead of by a driver during the night.

    November 1991 — New AgencyDisclosure Bill Signed into Law - Thislegislation requires all licensees to pro-vide written disclosure as to whom theyrepresent in a residential transaction aswell as an explanation of their obliga-tions to the buyer and seller.

    November 1992 — HUD RequiresWarning Notice About Lead-Based Paint— Home buyers must now be given aprescribed written notice about lead-

    based paint for houses built before 1978,and certain other circumstances as well.

    April 1993 — April is Fair HousingMonth — LIBOR Renews Fair HousingCommitment — HUD and LIBOR renewtheir commitment to provide all con-sumers with the opportunity for fair hous-ing. The Voluntary Marketing Agreement(VAMA) helped to ensure fair housingpractices in real estate and encouragedcooperation with community based fairhousing and civil rights groups.

    September 1994 — GovernorMario Cuomo Nixes (Vetoes) RealEstate Board Bill- Governor Cuomoclaiming that the structure of the billrequired further discussion. In theOctober issue of the paper the headlinereads “New York State GubernatorialCandidate George E. Pataki Meets withLong Island Board of REALTORS�”‰

    December 1994 — REALTOR�Service Center Opens in Queens — Thenew Realtor Service Center in Queenswas located at 176-60 Union Tpke in FreshMeadows and will serve Queens andwestern Nassau County Realtors�. Thecenter will offer computer training, licens-ing and other courses and programs.

    January 1995 — LIBOR/MLSNames Its Chief Executive Officer —Joseph E. Mottola. In an effort to consol-idate services and reduce expenses, thetwo organizations agree to appointJoseph Mottola as chief executive officer.

    September 1995 — Departmentof State Offers REALTORS� ReceptiveMeeting — LIBOR leadership gets anopportunity to meet with Secretary of

    State Sandy Treadwell and discuss anumber of positions taken by the DOSincluding the process of DOS respond-ing to public complaints against brokers.

    Jan/Feb 1996 — New DOS Offers“Business Friendly‰ Improvements” —Secretary Treadwell initiates a newprocess for complaints that allows realestate licensees the opportunity to com-municate with the Division of Licensingas the complaints are being evaluated.

    June 1996 — MLS Goes Global —www.MLSLI.com makes its debut at the8th Annual Education Conference. Thiswebsite provided Realtors� with worldwide exposure for their residential list-ings and at no additional charge.

    December 1997 — MLSChanges Fee Structure — New monthlyflat fee eliminates a per listing‰ fee andnow includes the entry of unlimited list-ings which would hopefully encourageRealtorsr to list everything on MLS.

    September 1998 — LIBOR toDebut Website at General MembershipMeeting – LIBOR launches REALTORONLY website at www.lirealtor.com thatwill offer an additional means of com-munication for members.

    Overwhelmingly, Realtor® agents areIndependent Contractors. What might bemore accurate, however, is that they areindividuals owning and running an inde-pendent business. As such, the dues andfees of belonging to a professional tradeassociation, and the fees tosubscribe to a multiple listingsystem, are the legitimatecosts of being in your ownbusiness.

    No one wants an increasein one’s business expenses,be it auto insurance, E & Oinsurance, cell phone expens-es, or advertising costs.However, the choice to remain in busi-ness is a personal one and grounded inone’s perceived ability to be successful inthe real estate profession.

    The Association wants to providemeaningful support to our professionalbase and has taken steps in recent years toaccomplish this. We changed the billingcycle where we went from billing whenclosings were lowest, to the time of yearthat’s historically the highest. In addition,the Board chose to subsidize the Board’sand your actual expenses from Reservesthat were designed for a “rainy day”.

    Experienced Realtors®, Economistsand a host of others knew that thesales/pricing trend could not be sustainedand individuals running businesses wouldhave to make adjustments in their market-ing and resources.

    The dilemma that faced the Board andMLSLI budget planners was that innova-tive tools and programs are most neededfor Realtors® when markets are lessrobust and when businesses look to cur-tail expenses. The decision was to con-tinue to provide and in fact amplify the

    range of services and tools to better ser-vice the professional working agent andnot the borderline agent.

    One example of this would be whenbroker-owners may have to trim theiragent training budgets. The Board has

    just put in place a top notchagent training programgeared to this group whichruns one day a week for fiveconsecutive weeks. It’s mar-keted as “Systems andStrategies for Success,” costs$175.00 and earns you 15 CEcredits. It’s a career educa-tional bargain.

    It is estimated that one third of agentshave zero transaction sides. Interestinglythis is a rather commonly accepted num-ber across the country. Realtors® holdlicenses for many reasons but certainlyamong them is the belief that they may beinvolved in at least one transaction, whichwould cover their Board and MLSLIinvestment for being in business for theforeseeable future. Another reason couldbe that it presents options for individualsto easily move in and out of a business sothey may tailor their commitment towhat’s going on in their lives at any giventime. And I’m sure that some people justwant to be able to say “I’m in real estate.”

    The Board has prepared a brief onlinevideo on the value of the goods and ser-vices of membership and MLS participa-tion which your dues and fees enable us toprovide. It can be viewed on the STRA-TUS Info Center and LIRealtor.com. Thehousing market doesn’t determine therange of programs and services. Rather itdetermines where the Board and the MLSplace the emphasis to maximize theireffectiveness.

    ARTICLE IV - MEMBERSHIP

    There shall be seven classes of Membersas follows:

    SECTION 1. REALTOR� MEMBERS

    REALTOR� Members, whether primary orsecondary shall be:

    a) Individuals who, as sole proprietors,partners, corporate officers, or branchoffice managers, are engaged actively inthe real estate profession, including buy-ing, selling, exchanging, renting or leas-ing, managing, appraising for others forcompensation, counseling or financing,building, developing or subdividing realestate, and who maintain or are associat-ed with an established real estate office inthe State of New York or a state contigu-ous thereto. All persons who are partnersin a partnership, or all officers in a corpo-ration who are actively engaged in the realestate profession within the state or a statecontiguous thereto shall qualify for REAL-TOR� membership only, and each isrequired to hold REALTOR� membershipin a Board of REALTORS� within the stateor a state contiguous thereto unless other-wise qualified for Institute AffiliateMembership as described in section 1(b)of Article IV.In the case of a real estate firm, partner-ship, or corporation, whose businessactivity is substantially all commercial,only those principals actively engaged inthe real estate business in connection withthe same office, or any other offices withinthe jurisdiction of the Board in which oneof the firm�s principals holds REALTOR�membership, shall be required to holdREALTOR� membership unless otherwisequalified for Institute Affiliate Membershipas described in Section 1(b) of Article IV.

    ARTICLE V - QUALIFICATION ANDELECTION

    SECTION 4. CONTINUING MEMBERCODE OF ETHICS TRAINING:

    Effective January 1, 2001, throughDecember 31, 2004, and for successivefour year periods thereafter, each REAL-TOR� member of the association(with theexception of REALTOR� members grant-ed REALTOR� Emeritus status by theNational Association) shall be required tocomplete quadrennial ethics training ofnot less than two hours and thirty minutesof instructional time. This requirement willbe satisfied upon presentation of docu-mentation that the member has complet-ed a course of instruction conducted bythis or another association, the StateAssociation of REALTORS�, the NATION-AL ASSOCIATION OF REALTORS�, orany other recognized educational institu-tion or provider which meets the learningobjectives and minimum criteria estab-lished by the NATIONAL ASSOCIATIONOF REALTORS� from time to time. REAL-TOR� members who have completedtraining as a requirement of membershipin another association and REALTOR�members who have completed the NewMember Code of Ethics Orientation duringany four year cycle shall not be required tocomplete additional ethics training until anew four year cycle commences.

    Failure to complete the required periodicethics training satisfy the requirementshall be considered a violation of a mem-bership duty. for which REALTOR� mem-bership shall be suspended until suchtime as the training is completed.Failure to meet the requirement will resultin suspension of membership for the firsttwo months (January and February) of theyear following the end of any four yearcycle or until the requirement is met,whichever occurs sooner. On March 1 ofthat year, the membership of a memberwho is still suspended as of that date willbe automatically terminated.

    ARTICLE VIII - USE OF THE TERMREALTOR� AND REALTORS�

    SECTION 1.

    Use of the terms „REALTOR�‰ and „REAL-TORS�‰ by members shall, at all times, besubject to the provisions of theConstitution and Bylaws of the NATIONALASSOCIATION OF REALTORS� and to theRules and Regulations prescribed by itsBoard of Directors. The Board shall havethe authority to control, jointly and in fullcooperation with the NATIONAL ASSOCI-ATION OF REALTORS�, use of the termswithin its jurisdiction. Any misuse of theterms by members is a violation of a mem-bership duty and may subject members todisciplinary action by the Board ofDirectors after a hearing as provided for inthe association�s Code of Ethics andArbitration Manual.

    ARTICLE X - DUES, FEES ANDFINANCE

    SECTION 1. APPLICATION FEE

    The Board of Directors may adopt anapplication fee for REALTOR�Membership in reasonable amount, notexceeding three times the amount of theannual dues for REALTOR� Membership,which shall be required to accompanyeach application for membership, andwhich shall become the property of LIBORupon final approval of the application bythe Board of Directors. The fee may be indiffering amounts for each class of mem-bership, except Institute Affiliate mem-bers, who may not be charged an appli-cation fee (see Article IV). The Board ofDirectors, for a sufficient reason in itsjudgment, may vary the fee from time totime, in a particular area of the Board. Aportion of the application fee, to coveradministrative costs, may be retained byLIBOR, in the event an applicant shouldwithdraw his/her application for member-ship.

    SECTION 2. DUES

    a) The annual dues of all members shall beestablished by the Board of Directors andset forth in a separate schedule showing thecategories and the corresponding dues.

    b) The annual dues of each REALTOR�member shall be in such amount as estab-lished annually by the Board of Directors,plus an additional amount to be establishedannually by the Board of Directors times thenumber of real estate salespersons and

    licensed or Certified Appraisers who (1)are employed by or affiliated as indepen-dent contractors, or who are otherwisedirectly or indirectly licensed with suchREALTOR� Member, and (2) are not REAL-TOR� members of any Board (the NationalAssociation definition of REALTOR� applieshere; if said other board shall have a defini-tion in conflict with the NationalAssociation�s definition of REALTOR�Member, the National Association�s defini-tion shall control) in the state or a state con-tiguous thereto or Institute Affiliate Membersof the Board. In calculating the duespayable to the Board by a DesignatedREALTOR� Member, non memberlicensees shall not be included in the com-putation of dues if the Designated REAL-TOR� has paid dues based on said non-member licensees in another Board in thestate or a state contiguous thereto, provid-ed the Designated REALTOR� notifies theBoard in writing of the identity of the Boardto which dues have been remitted.

    1. An individual shall be deemed to belicensed with a Realtor if the license of theindividual is held by the Realtor or by anybroker who is licensed with the Realtor orby any entity in which the Realtor has adirect or indirect ownership interest andwhich is engaged in other aspects of thereal estate business (except as providedfor in Article X Section 2 b hereof) providedthat such license is not otherwise includedin the computation of dues payable by theprincipal, partner, corporate officer, orbranch office manager of the entity.

    c) In the case of a Designated REALTOR�

    Member in a firm, partnership, or corpora-tion whose business activity is substantial-ly all commercial, any assessments fornon-member licensees shall be limited tolicensees affiliated with the DesignatedREALTOR� (as defined in (1) and (2) ofthe above paragraph) in the office whereDesignated REALTOR� holds member-ship, and any other offices of the firmlocated within the jurisdiction of thisboard.

    For the purpose of this section, a REAL-TOR� member of a Member Board shallbe held to be any member who has aplace or places of business within thestate or a state contiguous thereto andwho, as a principal, partner, corporate offi-cer, or branch office manager of a realestate firm, partnership, or corporation, isactively engaged in the real estate profes-sion as defined in Article III, Section 1 ofthe Constitution of the NATIONAL ASSO-CIATION OF REALTORS�.     In addition to reading what was writtenduring the 90’s, three women who heldactive leadership roles for LIBOR andMLSLI and in two cases — both organiza-tions, commented on what they remem-ber about real estate in the 90’s.

    Marian Fraker Gutin — Served asLIBOR President in 1994 and again in2005 — Currently serves as LegislativeChairperson and Vice Chairperson of theLIBOR 100th Anniversary Committee —“When I think about the 90’s, I think aboutthe conscientious effort that was put forthduring that time, to develop a strongerpolitical presence and legislative influ-ence for LIBOR. This is the time that weformed our Government Affairs depart-ment, which started with the hiring ofRandy Kaplan, who was tasked withstarting and continuing dialogue aboutRealtor issues with our Legislators. Ibelieve our efforts have been paying offand the public perceives us more today,as housing advocates who are fightingfor common interests like lower taxesand property rights.”

    Marian further adds that she wasinstrumental in the Strategic Planning thattook place in the middle 90’s which result-ed in consolidating services and feesbetween MLS and LIBOR to reduce costs.One of the most significant changes

    made was the naming of Joseph Mottolaas CEO of LIBOR and MLS.

    Barbara Frechter — Served as 1999LIBOR President and currently serves asQueens Vice Chairperson of theLegislative Committee — Barbara recallsthe 90’s as a time when the co-op busi-ness started to take off. She recalls thatco-ops were starting to sell more becausethe governing Boards only required 10%down in many cases, instead of the tradi-tional 20%, making co-ops an affordablesolution. Barbara recalls working withmany young people who were in the mar-ket for co-ops because they were beingtold by their accountants to invest in realestate so they would have a tax deduction.

    Audrey Livingstone — Served asMLS President in 1996 and as LIBORPresident in 2001. Audrey currentlyserves as the Chairperson of the LIBOR100th Anniversary Committee - Audreyrecalls how she felt when MLS launchedMLSLI.com at the Education Conferencein 1996. That is the same time when I hadmy first experience with the Internet aswell. I had a web page created throughthe MLS site and when you clicked onmy listing it said “Hi, I’m Audrey and I’mon the Internet” and it had a picture of mesmiling. At the time, we had no idea howfar we would come, but the MLS knewthe possibilities were endless...and wewere right.

    While it is debatable whether it is home-ownership itself or a general feeling of “res-idential stability” associated with owning ahome that leads to children’s improvedschooling performance, studies have shownhigher educational achievements amongthe children of homeowners. It is believedthat certain behavioral qualities and lifemanagement skills associated with owninga home and managing a mortgage arepassed down from parents to children.

    Owning a home can protect one fromcriminal activity. The report says this mayhave to do with homeowners acting asdeterrents to crime, as crime in neighbor-hoods can adversely affect property values;hence, homeowners have extra incentive toimplement crime prevention programs andneighborhood watches.

    Since the expiration of the home buy-ers’ tax credit, most of us have experi-enced a slowdown in buyer activity as itappears that buyers are more hesitant tomake those offers. And we’re notdone yet! Through a link in Stratus agentsand offices can elect to create electronic“Just Listed” online announcements byusing professionally created templates thatself populate. With just a few clicks of yourmouse you can customize your announce-ment card along with multiple photos, prop-erty description and contact info to send toyour entire contact database and you caneasily load this announcement on your facebook page with the link provided for addedvalue in your efforts to “stay connected”.It’s really as easy as that.

    Q. The homeowner would like toextend the expiration date of hislisting. Does the extension have to be inwriting and must I submit the paperworkto MLS?

    A. The answer to both of you ques-tions is Yes. You should fill outthe Report of Change Form (#5) with thenew expiration date and have theowner(s) sign it. According to MLS

    Rules (#607), the form should be signedbefore the present expiration date and bepostmarked within 48 hours of the datesigned, but no later than 24 hours afterthe expiration date.

    Please Note: The owner must signanything changing the terms of the list-ing agreement and a copy of the changeshould be mailed into the MLS within 48hours of signing.

    MLSLI Reports $380,000 LongIsland Closed Median HomePrice in AugustPrice reflects a 1.3% decline from ayear ago.

    The Multiple Listing Service ofLong Island, Inc. (MLSLI) releasedAugust Long Island housing data forNassau, Suffolk, and Queens.MLSLI reported a monthly closedmedian home price of $380,000 forAugust 2010 and a total of 2,098closed transactions. Last August,MLSLI reported a Long Island medi-an home price of $385,000 with2,543 closed sales.

    Nassau County reported 783closed sales with a closed medianhome price of $445,000, which repre-sents a 6.7% increase from $417,000reported a year ago. In SuffolkCounty, there were 778 closed salesfor August with a reported $328,250closed median home price. This rep-resents a decline of 4.9% over$345,000 last August. Queensreported 537 closed sales with amedian home price of $345,000

    which represents a 10.4% drop fromAugust 2009.

    Traffic to MLSLI.com RemainsStrong

    Although consumer activity hastapered off since the tax creditexpired earlier this year, visitors ses-sions on mlsli.com, home of theMultiple Listing Service of LongIsland, has remained robust.

    In August 2010, web reports show24,680 daily visitor sessions to thesite. This represents an increase of23.7% over last August. Additionally,the monthly web report shows RentalProperty Searches in August 2010were up 45% compared to a year ago.

    MLSLI.com drives thousands ofleads to members. The Augustreport shows that 11,520 leads wereforwarded that month from listingsposted on mlsli.com.

    Find your signal. Hold down theALT button and type N M L L. Your sig-nal bars will be converted to numerals toshow you precisely how strong your cov-erage is.

    Reboot. To quickly restart yourdevice, hold the ALT key while pressingthe CAPS and Delete button at the sametime.

    Punctuate. Press the space bar twiceand your device will exchange thosespaces for a period and space. While in e-mail mode, if you press space instead of@, your Blackberry will convert it intothe symbol.
