Our most cost-effective type of shipment is used
to distribute journalistic reporting, i.e., any
magazine or newspaper in Germany that provides
information on current affairs, is distributed in
return for payment, and does not have any direct
commercial interest. Inserts can be included in the
shipment at low cost.
PRESSESENDUNG (standard periodicals)
The content design options for PRESSESENDUNG
(standard periodicals) items, which are mainly for
business information and entertainment
purposes, are even more flexible: key dialog
instruments are sent out cost-effectively in the
form of customer/investor and employee
magazines. PRESSESENDUNG (standard
periodicals) items may contain inserts in addition
to advertising.
STREIFBANDZEITUNG (wrapper-packed newspaper)
Whether for print runs below 1,000 copies or for
the shipping of individual copies: the WRAPPER-
PACKED NEWSPAPER is low in cost, easy to ship,
and delivered the next day.

center on the day of publishing, Deutsche Post

routing region.
Overnight: next-day service
For just a few cents more, you can delay your
editorial deadline. The next-day service is ideal for
cross-regional daily newspapers and magazines
containing the latest information. They are
delivered within one day of posting.
Cost-effective: second-day service

pages (at least 9 cm × 14 cm) which consist of
a unit through folding or bookbinding pro-
cessing n are produced in identical duplication using
a standard print technology; they must be
accessible to everyone and appear perio-
dically – at least once every quarter n show the title and the number or the des-
criptor “Sondernummer” (special issue number)
on the title page (the day of publication or an
appropriate descriptor relating to publication
frequency can also come from the title page
or from the masthead)
Content criteria that must also be met for
dispatch
The press product must serve to inform the public
on daily events, current affairs, and trade matters
by way of editorial reporting containing no
business advertisements (journalistic reporting).
Variety in terms of articles, topicality, publicity as
well as continuity must also be provided.
Guidelines for distribution
Press products that are to be sent as POSTVER-
TRIEBSSTÜCK (preferred periodicals) items must
be distributed in return for payment. This means
that the portion distributed in return for payment
must amount to at least 10% of the print run.
Neither business advertising nor paid advertise-
ments may appear in the portion distributed free
of charge.

Simply frank the items with FRANKIT,
IT franking, a franking mark, or Frankierservice
(franking service), download the posting list at
streifbandzeitung.de, fill it in, and print it out. Then
pack the items in letter trays and hand them in at
your retail outlet or bulk mail acceptance office
(for more than 500 items, always use the bulk mail
acceptance office). Or you can purchase dispatch
labels (Internet or product stamps) from the
eFiliale online shop (www.eFiliale.de) – simply print
them out, stick them on and place your items in a
Deutsche Post collection box.
What happens if the recipient is on vacation,
has relocated, or is unknown?
If a valid redirection request exists, the STREIFBAND-
ZEITUNG (wrapper-packed newspaper) is redirected
automatically. We will, of course, comply with senders’
instructions such as “Do not redirect” or “Return to
sender with new address if the recipient has moved.”
If the mail recipient cannot be located from a redi-
rection request, the item is returned to the sender.
Have all the requirements been met?
Closed items may be opened for checking purposes.
Acceptance can be refused if the STREIFBANDZEITUNG
(wrapper-packed newspaper) item does not meet
the dispatch requirements. Items which have already
been posted can be returned to the sender in order
to rectify defects.
Please note: For prepayment of mail volumes
of fewer than 5 items, please use dispatch stamps
(Internet or product stamps). The minimum quantity
to be posted with the remaining prepayment types
is 5 items.

Requirements for sending inserts
Inserts in POSTVERTRIEBSSTÜCK (preferred periodicals) and PRESSESENDUNG (standard periodicals) items increase attractiveness
Weight
The carrying object must be the main dispatch
item. The total weight of the inserts must not ex-
ceed the weight of the carrying object itself. Only
in exceptional cases may the weight of all inserts
combined outweigh the actual carrying object by
a maximum of 10%. The total weight of both the
periodical and its inserts may not exceed 1,000 g.
Format
The size of the items, including inserts, may not
exceed the DIN B4 format (353 mm × 250 mm) or
exceed 50 mm in height. Objects may not be
higher than 30 mm. If the inserts are larger than
the actual carrying object, the item must be
wrapped and dispatched in a way that is safe for
transport.
What you need to look out for n Inserts must generally have the same content. n It is also possible to include inserts in only
a portion of the run.
Billing
The shipment charges are generally based on
weight. The weight is determined as follows:
on the basis of the specimen copy, including
wrapping and all other components of the item.
Additional surcharges apply to invoices,
preprinted payment transaction forms used for
subscription fee purposes and to objects between
3 mm and 30 mm in height. Please refer to the
“Charges” section for more details.

Printed matter inserts n Printed matter inserts include, amongst other
things, advertising pamphlets, subscription
advertisements, calls for charity donations and
corresponding pre printed payment transaction
forms, postcards, and press products without
a Presse Distribution agreement. n Printed matter inserts are included in the
carrying periodical either loosely or directly
adhered to it. n Invoices and pre printed payment transaction
forms that are sent with the periodical
(carrying object) with exclusive regard to the
subscription fee payment are allowed as per
agreement. The amount named must be
identical with the actual subscription fee. They
are included loosely, directly adhered, or
bound.
Objects n Objects with a maximum height of 2 mm,
such as sample and trial items, CDs or DVDs
in cardboard covers, books, etc.. n If the objects are adhered to the outside
of the carrying object (magazine/newspaper),
the item must be wrapped and dispatched
in a way that is safe for transport. n Objects between 3 mm and a maximum of
30 mm in height, such as promotional items,
books, and giveaways, must be securely
attached to the item to prevent slipping. The
items must be packaged in a secure wrapper
that is safe for transport. n Please consult the responsible customer adviser
from Deutsche Post regarding inserts with
liquid, gel, or powder contents, as special
packaging or additional agreements are
necessary in these cases.

How often you can use WERBEVERSAND (promo-
tional mailing) depends on the publication frequency
of your magazine. WERBEVERSAND (promotional
mailing) can only be used to gain new subscribers
in this case. This means that regular or occasional
purchasers cannot be recipients. An additional
dispatch volume must therefore be posted.
Newly acquired subscriptions must be transported
and delivered via Deutsche Post’s Presse Distribution.
Each item must contain a response form for gaining
new subscribers.

Section 1 Scope(1) These General Terms and Conditions (GT & C) shall apply to agreements
with Deutsche Post AG – hereinafter referred to as Deutsche Post – on the transportation and delivery of magazines and sample extracts as POSTVERTRIEBSSTÜCK (preferred periodicals) items which are sent solely to acquire subscriptions (WERBEVERSAND – promotional mailing).
(2) Unless otherwise specified by means of legal provisions, written agreements in isolated cases, and the conditions below, the General Terms and Conditions of Deutsche Post AG for Presse Distribution National (GT & C PrD National) (AGB PrD National) shall apply.
(3) The sender shall supply the subscriptions acquired through WERBEVERSAND (promotional mailing) as POSTVERTRIEBSSTÜCK (preferred periodicals) items under the terms and conditions applicable to this and the charges at Deutsche Post. On request, the sender shall notify Deutsche Post of the number of subscribers gained.
(4) WERBEVERSAND (promotional mailing) is oriented exclusively at recipients who are not regular or occasional purchasers (various recipients from address pool). WERBEVERSAND (promotional mailing) requires a PrD agreement with a term of at least 6 months or the posting of at least 4 issues of the magazine. WERBEVERSAND (promotional mailing) is permitted where the current volume posted for regular mailing equals at least the average volume for the last 4 regular postings. In the case of new PrD agreements, the average volume is to be based on the last 6 months’ postings if there have not yet been 4 postings in this period. The number of possible agreements for WERBEVERSAND Postvertriebsstück (promotional mailing for preferred periodicals) is based on the frequency of publication of the periodical (maximum of half-yearly publication frequency).
(5) WERBEVERSAND (promotional mailing) may not be used when: – in spite of WERBEVERSAND (promotional mailing), in the long term
the number of regular/occasional sales remains the same, – WERBEVERSAND Postvertriebsstück (promotional mailing
for preferred periodicals), is continually, more than three consecutive times, sent to the same recipient,
– WERBEVERSAND Postvertriebsstück (promotional mailing for pre-ferred periodicals) exceeds this regular/occasional mailing more than three consecutive times by a disproportionate amount (by 200% or more).
Section 2 Conditions for posting(1) With regard to the magazine to be advertised, a PrD agreement must
be in place with Deutsche Post for posting as POSTVER- TRIEBSSTÜCK (preferred periodicals).
– Individual mailing: A copy of the magazine to be advertised is sent to a potential subscriber together with a separately enclosed new subscriber letter and a response form.
– Double mailing: Together with their regular copy or at a different time, subscribers receive an additional copy of the title with a letter and response form to be passed on to a potential subscriber.
– Cross-selling mailing: Together with their regular copy, the subscribers receive a copy of another title with a letter and response form.
The minimum quantity for posting as a WERBEVERSAND (promotional mailing) product is 1,000 copies. The provisions in the transport conditions of GT & C PrD National shall be observed here, in particular.
(2) The object of WERBEVERSAND (promotional mailing) can be the magazine to be advertised itself (original magazine) or a sample extract. Both must contain a response form.
(3) If the object of the WERBEVERSAND (promotional mailing) is a sample extract, this must be in the form of a periodical issue and must be at least eight pages in DIN A5 format. At least 30% of the content must consist of journalistic reporting and – in particular with regard to the cover – largely correspond to the magazine to be advertised. The remaining 70% may consist of self-promotion (PR, advertisements) for the magazine to be advertised. The press product ID (ZKZ) of the magazine to be advertised and the information “Special Issue” may appear on the cover of the sample extract.
(4) The sender shall notify the responsible customer adviser about the WERBEVERSAND (promotional mailing) at least 10 working days before the intended posting or pick-up on the “Vereinbarung Werbeversand PVSt” [Promotional mailing for preferred periodicals agreement] form. The contracting party shall receive a confirmation or rejection of this agreement within 3 working days.
Section 3 Services provided by Deutsche Post Deutsche Post shall transport the magazines and sample extracts using
WERBEVERSAND (promotional mailing) and deliver them to the recipient using the address specified by the sender. The service shall be offered in the “second-day service” and, for the shipping of original magazines also in the “next-day service.”
Section 4 Charges and billing(1) The sender shall be obligated to pay the WERBEVERSAND
(promotional mailing) charges for the services provided by Deutsche Post. If mail items are posted as WERBEVERSAND Postvertriebsstück (promotional mailing for preferred periodicals) but do not meet the requirements for WERBEVERSAND or are not permissible in the aforementioned sense, they shall be billed as a fully paid POSTVERTRIEBSSTÜCK (preferred periodical) item.
(2) Billing via direct debit shall take place separately from the magazine to be advertised, based on the posting list, using the billing numbers for WERBEVERSAND (promotional mailing):
– For original periodical as “second-day service” 60 – For original periodical as “next-day service” 61 – For sample extract as “second-day service” 62
Section 5 Other provisions(1) The parties shall inform each other immediately of any changes or
supplements (e. g., loading point) that may affect the performance of services and the contractual relationship (e. g., account details, change of name).
(2) Amendments and additions to agreements on WERBEVERSAND (promotional mailing) must be made in writing.
(3) For every magazine issue, a WERBEVERSAND Postvertriebsstück (promotional mailing for preferred periodicals) agreement must be concluded.

Terms and conditions of billing
Determination of weight for
POSTVERTRIEBSSTÜCK (preferred periodicals) and
PRESSESENDUNG (standard periodicals) items
The shipment charges are generally based on
weight, and in the case of POSTVERTRIEBSSTÜCK
(preferred periodicals) items they are also based
on the frequency of publication. The weight is
determined as follows: Sample copy including
wrapping and all other components of the item.
Weight band-widths are defined in increments of
10 g to determine the item charge due. The
weight bandwidths and their associated charges
can be found in the price tables for
POSTVERTRIEBS-STÜCK (preferred periodicals) and
PRESSE-SENDUNG (standard periodicals) items.
Additional surcharges apply to invoices,
preprinted payment transaction forms used for
subscription fee purposes, and to objects between
3 mm and 30 mm in height. See page 42 for insert
charges. The commercial rounding rules will be
applied when determining the dimensions.
Dimensions of 0.5 mm and over will be rounded
up, dimensions less than 0.5 mm will be rounded
down.
Charge differentiation according to tariff zones
The charges for standard POSTVERTRIEBSSTÜCK
(preferred periodicals) and PRESSESENDUNG
(standard periodicals) items will be reduced by
25 % for conurbations and increased by 8 % for
rural areas. The item charges remain unchanged if
they are destined for intermediate zones. This
generally applies if the following criteria are met:
1. The average postal circulation per issue of a
title with the same newspaper reference
number (ZKZ) was at least 100,000 items in the
previous six months.
2. When using charge differentiation according
to tariff zones, at least 100,000 items per issue
must be posted per title with the same
newspaper reference number (ZKZ).
3. A complete electronic data record for posting
notification is transmitted as the basis for
billing for the title concerned
Your Deutsche Post customer adviser will be able
to answer any additional questions you may have
concerning the differentiation of charges.

Invoice
An invoice will be issued for each individual
posting or partial posting. The assignment of a
number in terms of time as regards the calculation
of charges is based on the date of posting.
Charges will fall due upon receipt of the invoice.
The payment term normally amounts to seven
days and always commences on the date of
posting (date of service provision). Charges will be
collected by SEPA core direct debit.
Legal requirements such as obtaining a mandate
and sending advance notification (pre-notification
period) for a direct debit will be observed. Daily
newspapers will be invoiced once a week based
on the available accounting documentation
(posting lists and sample copies of the main and
sub-issues of each day of publication) for the past
week. Accounting documents received late will be
invoiced on the day of receipt.

Pick-up of shipments in the second-day service and the next-day service abroad(European mainland).
Pick-up is free of charge for shipment volumes from 5 t (ELN) or from 1,000 copies (SLN) if the distance from the loading point to the next border crossing is less than 100 kilometers. For every additional km, (from the 101st km), a charge amounting to EUR 1.74* per km is to be paid for each truck. Transportation from the border to the acceptance point is free of charge. With a shipment volume of < 5 t (ELN) or < 1,000 copies (SLN), the charge of EUR 1.74* is to be paid for every km starting from the 1st km from the loading point to the border crossing. Transportation from the border to the acceptance point is to be covered by the amount specified above.

PREMIUMADRESS is a contractual product. By labelling the shipment accordingly, an order is
placed for the provision of chargeable services. You can see the charges for POSTVERTRIEBSSTÜCK

Error rate calculation If, for example, you send 1 million items per ZKZ (press product ID) a year and receive 4,000 address notifications for this ZKZ per year, the error rate is calculated as 0.4%: 4,000/1 million × 100 = 0.4 %.

General Terms and Conditions (GT & C) of Deutsche Post AG for Presse Distribution National
46 General Terms & Conditions
1 Scope(1) These General Terms and Conditions (GT & C) shall apply to
agreements with Deutsche Post AG, hereinafter referred to as Deutsche Post, on the transport and delivery of press products within Germany without substantiation of the whereabouts of the individual items. For items to be sent abroad, the GT&C MAIL INTERNATIONAL (AGB BRIEF INTERNATIONAL) shall also apply as well as the “International mail dispatch” brochure.
(2) The items, including inserts, must not exceed a weight of 1,000 g and a height of 50 mm. Special surcharges shall apply if these are exceeded. See page 45 for these and other special surcharges.
(3) The terms and conditions specified in the “Presse Distribution: be a hit with your readers” product brochure and the “Presse Distribution Handling: all ready for shipment” brochure are constituent components of these GT&C.
The GT&C MAIL NATIONAL (AGB MAIL NATIONAL) shall apply with regard to
– excluded goods (Section 2(2)), – Handling items in the event of non-compliance with the
GT & C PrD National (Section 2 (3)), – Liability of the sender (Section 3 (5)). The above-mentioned GT & C are available for inspection at all
Deutsche Post offices.
2 Contractual relationship (1) The agreement shall be concluded by means of a written offer
(order) on a form from the customer and subsequent accept-ance by Deutsche Post. Orders are accepted upon receipt of the confirmation e-mail (order confirmation) by the customer.
(2) Only one agreement shall be concluded for each press product. In such case as a press product is published in a number of sub-issues that differ in content, each of which may be obtained separately, a separate agreement must be concluded for each issue. A current sample of the printed product shall be attached to the annexe to the Presse Distribution National agreement.
(3) Termination or modification of the contractual relationship shall require the written form (text form).
(4) The parties can terminate or modify the Presse Distribution agreement with a notice period of four weeks to the end of the month.
(5) Termination by the sender pursuant to Section 415 of the Ger-man Commercial Code (Handelsgesetzbuch, HGB) after hando-ver/acceptance of the shipment into Deutsche Post’s custody shall be excluded.
3 Obligations of the contracting party(1) The contracting party undertakes to label the items and group
them together for transportation as per the shipping condi-tions (see “Presse Distribution Handling: all ready for ship-ment” brochure).
(2) The contracting party undertakes to determine a suitable authorized agent (form) if it cannot meet the obligations to a sufficient extent.
(3) The responsible organizational unit for sales at Deutsche Post must be informed immediately in writing of any changes con-cerning the content and scope of the contractual relationship.
4 Services provided by Deutsche Post Deutsche Post undertakes to transport and deliver copies
of the press product, which is the subject matter of the Presse Distribution agreement, including the inserts, under the agreed conditions. Delivery shall be within the standard transit times named in Section 4.2 and in the shipping conditions (see “Presse Distribution Handling: all ready for shipment” bro-chure), provided the agreed posting offices and times have been complied with. Deutsche Post reserves the right to handle shipments differ-ently in accordance with Section 4.3 of these GT&C and Sec-tion 4 of the GT & C MAIL NATIONAL (AGB BRIEF NATIONAL) (alternative delivery/notification/pick-up). If delivery is not pos-sible, Deutsche Post shall proceed as per Section 4.3(2) and (3) (non-delivery/notification of new address).
4.1 Requirements placed on press products(1) Press products are newspapers and magazines that have a con-
sistent internal and external design.(2) Press products predominantly comprise double-sided printed
pages (at least 9 cm x 14 cm) with the same format. They are grouped together into a unit by folding or by a bookbinding process.
(3) Press products must be created as identical copies in a standard press printing process, be accessible to everyone and appear periodically – at least once a quarter.
(4) The title page of the press products must include the title and issue or the “Sondernummer” (special issue number) designa-tion. The day of publication or a designation appropriate to the frequency of publication may also be evident from the title page or the publication details

4.1.1 PRESSESENDUNG (STANDARD PERIODICALS)4.1.1.1 Aim of publication/aims of publication that preclude a
Presse Distribution agreement(1) Press products that are to be sent as PRESSESENDUNG
(standard periodicals) must be published for the purposes of publically distributing information or entertainment.
(2) The aim of publication in paragraph 1 is, in particular, not met by the following print products:
1. Brochures, promotional mailing (direct mail), or order catalogs
2. Compilations whose text is largely not comprehensible in itself
4.1.1.2 Minimum posting volume The minimum posting volume per issue number is 1,000 copies.
4.1.2 POSTVERTRIEBSSTÜCK (PREFERRED PERIODICALS)4.1.2.1 Aim of publication/aims of publication that preclude a
Presse Distribution agreement(1) Press products that are to be sent as POSTVERTRIEBSSTÜCK
(preferred periodicals) must be published for the purpose of informing the public about daily events, current affairs, or special topics through editorial contributions which do not contain any commercial advertising (journalistic reporting). They must show a diversity of contributions, topicality, publicity, and continuity.
(2) The aim of publication in paragraph 1 will not be met by print products which demonstrate through their editorial concept that they have direct commercial interests. Evidence of this could be:
1. Advertising language 2. Articles clearly contributed by companies 3. Purchasing recommendations, order tips, and order numbers 4. Catalog-type presentations of products or services with or
without contact details 5. The content of the printed product comprises less than 30%
journalistic reporting.(3) Printed products with direct commercial interests are
particularly those 1. whose title pages contain the names of businesses
or products, company or brand names serving the interests of these companies, or
2. are customer or employee magazines.(4) Print products in the form of compilations whose text is not
comprehensible in itself may not be sent as POSTVERTRIEBSSTÜCK (preferred periodicals) items.
4.1.2.2 Distribution(1) Press products that are to be sent as POSTVERTRIEBSSTÜCK
(preferred periodicals) items must be distributed in return for payment. The percentage of the circulation which is sold must be at least 10% of the printed circulation.
(2) Press products that are to be sent as POSTVERTRIEBSSTÜCK (preferred periodicals) items and delivered free of charge may contain neither commercial advertising nor paid advertisements.
4.1.3 Special issue numbers Special issue numbers of press products with a Presse
Distribution agreement must meet the requirements in Sections 4.1 and 4.1.1. and/or 4.1.2. POSTVERTRIEBSSTÜCK (preferred periodicals) items in breach of the agreement shall be billed as PRESSESENDUNG (standard periodicals). PRESSESENDUNG items (standard periodicals) in breach of the agreement shall be billed as press products without a Presse Distribution agreement.
4.1.4 Inserts(1) Inserts (printed products and objects) can be sent with the
carrying object. The carrying object must be the main dispatch item. The item must be packaged suitably for transportation and securely. Inserts shall be billed based on the weight of the item. For objects with a height of 3 mm to 30 mm, additional charges shall apply. Objects must not exceed a height of 30 mm. Inserts must generally have the same content.
(2) nvoices and payment slips sent with carrying objects that only concern the reference charge for the carrying object are in accordance with the agreement. They must show the same amount and shall be billed at an additional charge.
4.1.5 STREIFBANDZEITUNG (WRAPPER-PACKED NEWSPAPER) Contractual partners of Deutsche Post Presse Distribution and
commercial press sales outlets can send POSTVERTRIEBSSTÜCK (preferred periodicals) and PRESSESENDUNG (standard periodicals) items as STREIFBANDZEITUNG (wrapper-packed newspaper) items.

48 General Terms & Conditions
4.2 Service offer Deutsche Post offers the transport and delivery of press
products as second-day service, next-day service and same-day service.
4.2.1 Second-day service (Express logistics network – ELN) Delivery shall take place as a standard service on the second
working day after acceptance of the shipments.
4.2.1.1 Pick-up(1) The pick-up volume can comprise various press titles. (2) A supplementary agreement must be concluded for the pick-up
of press shipments by Deutsche Post abroad.
4.2.1.1.1 Pick-up free of charge Palletized shipments with a minimum total weight of 5 metric
tonnes per posting can be picked up free of charge. This is subject to notification of the posting using an electronic data record 2 working days (Mon.-Sat.) before the actual posting.
4.2.1.1.2 Pick-up for a charge Shipment volumes of less than 5 metric tonnes per posting can
be picked up for a charge. When collecting titles of several contracting parties from a service provider, a supplementary agreement with the latter is required.
4.2.1.2 Posting Shipments that are not picked up shall be posted by the
contracting party at the agreed bulk mail acceptance office of a Deutsche Post mail center at the agreed time by prior arrangement with the responsible organizational unit for sales at Deutsche Post.
4.2.1.3 Additional charges(1) If the agreed pick-up is canceled for reasons attributable to the
contracting party, the pick-up charge shall be invoiced as a flat-rate charge. The one-way distance between the depot and the agreed pick-up point shall apply.
(2) If the agreed pick-up time is exceeded for reasons attributable to the contracting party, demurrage charges shall be invoiced.
(3) If the agreed transit time is not complied with for reasons attributable to Deutsche Post, the contracting party shall be informed immediately. Deutsche Post shall take all commercially viable measures to ensure the delivery of shipments within the agreed transit time where possible.
4.2.2 Next-day service (high-speed network – SLN) This Deutsche Post service can only be rendered subject to
logistical availability.
4.2.2.1 Pick-up Shipment volumes of over 1,000 copies per shipment shall be
picked up free of charge. Shipment volumes of less than 1,000 copies can be picked up for a charge.
4.2.2.2 Posting Shipment volumes of less than 1,000 copies per shipment shall
be posted by the contracting party at the agreed depot site at the agreed time by prior arrangement with the responsible organizational unit for sales at Deutsche Post.
4.2.3 Same-day service (regular network) In the local and regional area, delivery shall take place as
a standard service on the day of acceptance of the shipments in the routing region.
4.2.3.1 Posting Posting shall be carried out by the contracting party at the
agreed mail center for the respective target region at the agreed times by prior arrangement with the responsible organizational unit for sales at Deutsche Post.
4.3 Delivery(1) PRESSESENDUNG (standard periodicals) and POSTVER-
TRIEBSSTÜCK (preferred periodicals) items shall be delivered as ordinary letters in accordance with the GT & C MAIL NATIONAL (AGB BRIEF NATIONAL).
(2) Undeliverable items shall neither be returned nor redirected, even if a valid redirection order from the item recipient exists. Instead, the items shall be destroyed. Pressepost items may be opened to facilitate the proper and environmentally-friendly disposal thereof.
(3) Notification of non-delivery, address errors, and new addresses shall only be provided to senders who use the electronic address notification procedure PREMIUMADRESS. Sealed items may be opened for the purposes of address notification. New addresses shall not be notified if the recipient of the item has objected in writing to address notification to third parties.

5 Charges/billing(1) The contracting party undertakes to pay charges for the
services provided by Deutsche Post in accordance with the Presse Distribution price list.
(2) Dispatch fees shall be calculated on the basis of a sample copy that must be made available free of charge to the accounting office at Deutsche Post Presse Distribution. The address of the accounting office should be included in the contracting party’s database of subscribers/buyers, so that the sample copy is dispatched as a POSTVERTRIEBSSTÜCK (preferred periodicals) or PRESSESENDUNG (standard periodicals) item in regular mailing. The dispatch list must be presented immediately to the Deutsche Post Presse Distribution accounting office if billing is carried out via AM.portal or a paper posting list. An electronic data record must be created for IT-based accounting.
(3) The sample copy (for the total print run or parts thereof) must match the copies to be sent. In the event that parts of print runs vary in weight and have inserts due to split runs, additional sample documents must be sent or submitted.
(4) POSTVERTRIEBSSTÜCK (preferred periodicals) and PRESSESENDUNG (standard periodicals) items sent as “multiple copies” (Mehrfachversand) shall be billed individually according to the category of item. This may consist of multiple copies of one or various press products with the Presse Distribution agreement. Billing shall take place to the account of the carrying object.
(5) The contracting party undertakes to provide correct notification of the shipments including inserts. Correct notification has been provided when shipments are notified to Deutsche Post two working days (Mon.-Sat.) before posting, giving correct information concerning weight, quantities and variants. Correct information concerning the weight shall be deemed to have been provided if the weight indicated by the contracting party is within the price and weight category of the sample copy. In such case as the prior notification is incorrect, a processing charge shall be applied.
(6) A processing fee shall be charged if a reminder is sent due to delayed or incomplete presentation of billing documents. This shall be collected four days after the reminder and if the billing documents are still incomplete.
(7) Payment is due upon receipt of the invoice. The payment period is seven days and generally begins with the day of posting (date of provision of service). Charges shall be collected by SEPA core direct debit.
(8) In the case that a SEPA core direct debit is dishonored, handling charges and the return fee of the relevant bank shall be added to the charge, should they be incurred.
(9) In certain cases (e. g., initiation of judicial dunning procedure) Deutsche Post can request an appropriate advance payment to protect its claims for compensation.
(10) If the contracting party cannot provide an advance payment in accordance with (8), Deutsche Post shall be entitled to refuse the acceptance of shipments.
(11) The contracting party is under the obligation to produce proof of the completeness and correctness of the billing documents in the case of doubt. If, to the detriment of Deutsche Post, the sample copy differs from the copies sent, the charge to which Deutsche Post is entitled based on these GT & C shall be applied to the entire run.
(12) Packaged Presse Distribution shipments may be opened for checking purposes.
6 Liability(1) Without regard to the limitations on liability set forth below,
Deutsche Post shall be liable for damage caused by an action or omission performed by itself, one of its employees, or another vicarious agent (Section 428 of the German Commercial Code (Handelsgesetzbuch, HGB)) either intentionally or carelessly and in the knowledge that damage would be likely to occur. In cases of damage resulting from the conduct of its employees or vicarious agents, this shall only apply insofar as such persons have acted within the performance of their duties.
(2) In all cases other than those named in paragraph 1, Deutsche Post shall assume no liability unless required to do so by binding legal provisions. This shall also apply to claims resulting from the violation of collateral obligations and extracontractual claims.
(3) Claims according to paragraph 1 shall expire if the sender or recipient does not notify Deutsche Post in writing of partial loss, damage, or other breach of obligations within 21 days after delivery. This shall not apply to damage that is attributable to intentional behavior. Section 438(5) HGB shall not apply.
(4) An item shall be considered lost if it has not been delivered to the address within 14 days after posting and its whereabouts cannot be determined.
7 Statute of limitations All claims within the scope of validity of these GT & C shall be
limited to a period of one year. Claims pursuant to Section 6(1) shall be subject to a limitation period of three years. The limitation period shall begin at the end of the day on which the shipment was posted.
8 Other provisions(1) Claims against Deutsche Post can neither be assigned nor
pledged. Claims for damages and for compensation of service fees which can be assigned but not pledged are an exception to this rule.
(2) The place of jurisdiction in the event of a legal dispute against Deutsche Post shall be the registered office of the responsible organizational unit for sales at Deutsche Post.
(3) Deutsche Post is subject to the conditions in the German Postal Services Data Protection Ordinance (Postdienste-Datenschutzverordnung) when using the saved data.
(4) Forms and address labels shall be created by the contracting party at its own expense. The design thereof must correspond to the samples shown in the “Presse Distribution Handling: all ready for shipment” brochure.
