    61. A proposal form issued by the insurance company contained a questionnaire. The insureddid not disclose in the proposed form a fact that they had undergone a caesarean operationsome time before she had taken a policy of insurance. Based on the proposal form a lifeinsurance policy was issued by the insurance company. On the death of the insured (policyholder) a claim was made to recover the compensation. But the insurance company wants todeny the claim. Argue on behalf of the insurance company and decide.

    62. Mr. Kiram entered into a service agreement with a company which manufactured andmarketed textiles, whereby he was appointed managing director of the company for a period of5 years. The agreement provided:

    I. Mr. kiram would not disclose or use any confidential information or trade secretsbelonging to the company which came into possession while he was in its service, and,

    II. That during his appointment he would not without the companys consent engages inany business other than the companys business. When the service agreement hadtwo years to run, Mr. Kiram wrote a letter to the companys chairman purporting toresign as managing director and there after carried on business in competition withthe company. But, the company did not accept the resignation and brought an actionagainst Mr. Kiram to restrain him from disclosing of using any confidentialinformation or trade secrets of the company. Mr. Kiran argued that the serviceagreement had been terminated by him unilateral repudiation of it and that therestriction of disclosure of confidential information and trade secrets after terminationdid not thereby restrict the use of such material.     IV. Immediately after making the offer, before Manoj could start running, J. P. Singh revokedthe offer.

    Whether a contract is formed between Mr. Manoj Yadav and Mr. J. P. Singh, if so at what response and why not at other responses?

    66. As Mr. Pankaj Kumar was in need of money and he sold his vehicle to Mrs. Kanyaka for Rs.15 lakhs. He could have easily sold it for Rs. 16 lakhs. Before the vehicle was delivered on the duedate the necessity for the money had gone away. Therefore, Mr. Pankaj Kumar refused to deliverthe vehicle. How can the parties be remedied as per the provisions of the Indian contract Act,1872 and case law?

    68. A technician came to maintain the only tractor owned by Mr. Shyam who was carrying onlocal transport business. The tractor was functioning but some spare parts should be changed.The technician intimated to the business man that it would take two days to change the spareparts and would cost him Rs. 10,000. The technician opened the tractor and did his work for theday. He was supposed to come the next day but he turned up the third day. Consequently, Mr.Shyam suffered loss. How do we provide a remedy to Mr shyam as per the provision of the Indiancontract Act and leading case?

    70. Mr. Rangarajan, a 15 years old boy lent his cycle to his friend for 5 days for a per day rentalof Rs.40.     A. Promptly after receipt of notice by an indemnified party under section 1(g), 8 (a) or 8 (b)hereof of notice of commencement of any action, such indemnified party shall, if a claim inrespect thereto is to be made against an indemnifying party under such section, give noticeto the indemnifying party of the commencement thereof, but the failure so to notify theindemnifying party shall not relieve it of any liability that it may have to any indemnifiedparty except to the extent the indemnifying party demonstrates that the defense of suchaction is prejudiced thereby. While giving meaning to a legislative text, is it mandatory to argue that the meaning to beascribed to the text is one which was explicitly within the contemplation of the legislature whileenacting the legislation or is it sufficient to argue that the meaning to be given is the logicalextension of the intention of the legislature as deciphered from the legislative text. Criticallyexamine the given statement with the help of suitable illustrations.

    3. What do you understand by the implied content of speech? Explain the limits of presuppositionapplication in the law. Is it fair to conclude that because our Constitution in Article 72 expresslycontemplates the exercise of pardoning power by the President of India and Governor of a Stateeven in respect of death penalty, therefore, the constitutionality of death penalty gets proven byway of what is implied in the text of Article 72?
