PLANNING ACT SUBDIVISION AND DEVELOPMENT REGULATIONS

AMENDMENT

(Approved by His Honour the Lieutenant Governor in Council dated September 17, 2013.)

Pursuant to sections 8 and 8.1 of the Planning Act R.S.P.E.I. 1988, Cap. P-8, Council made the following regulations:

1. Subsection 42(1) of the Planning Act Subdivision and Development Regulations (EC693/00) is amended

(a) in clauses (a), (b) and (c) by the deletion of the word “or” after the semicolon;

(b) in clause (d), by the deletion of the period and the substitution of the words “; or”; and

(c) by the addition of the following after clause (d): (e) for use as senior citizens housing, where the buildings or structures are grouped in accordance with all other requirements of these regulations and connected to a central municipal sewer system prior to and during occupancy.

2. Subsection 42(2) of the regulations is amended by the deletion of the words “Notwithstanding subsection (1), one” and the substitution of the word “One”.

3. Subsection 63(4) of the regulations is amended by the addition of the following after clause (e):

(e.1) for use as a cemetery;

4. These regulations come into force on September 28, 2013.

EXPLANATORY NOTES SECTION 1 permits more than one dwelling to be located on a lot or existing parcel of land where the dwellings are for use as senior citizens housing.


SECTION 2 removes wording that makes subsection (2) notwithstanding subsection (1), as the two subsections are meant to work together. SECTION 3 permits an existing parcel of land located in the Stratford Region, Charlottetown Region, Cornwall Region and Summerside Region special planning areas to be subdivided into one lot for use as a cemetery. SECTION 4 provides for the commencement of these regulations.
