2.2 Mattersto be Consideredby CouncilWhenanapplicationfor planningconsentis madewith respectto landwithin a Reserve,theCouncilshall haveregardto the ultimate purposeintendedfor the Reserveand the Council shall, in thecase of land reservedfor the purposesof a public authority, confer with that authority beforegranting its consent.

2.3 Compensation
2.3.1 Wherethe Council refusesplanning consentfor the developmentof a Reserveon the groundthat theland is reservedfor LocalAuthority purposesor for the purposeshownin the SchemeMap,or grantsplanningconsentsubjectto conditionsthat are unacceptableto the applicant,the ownerof the land may, if the land is injuriously affected thereby,claim compensationfor such injuriousaffection.
2.3.2 Claims for such compensationshall be lodged at the office of the Council not later than sixmonthsafter the dateof the decisionof the Councilrefusingplanningconsentor grantingit subjectto conditionsthat are unacceptableto the applicant.
2.3.3 In lieu of payingcompensationthe Council may purchasethe land affected by suchdecisionof the Council at a price representingthe unaffectedvalue of the land at the time of refusal ofplanning consentor of the grant of consentsubject to conditions that are unacceptableto theapplicant.
Part 3-Zones3.1 Zones

3.1.2 The zonesare delineatedand depictedin the SchemeMap accordingto the legendthereon.
3.2 Zoning Table
3.2.1 The Zoning Tableindicates,subjectto the provisionsof the Scheme,the severalusespermittedin the SchemeArea in the various zones, such usesbeing determinedby crossreferencebetweenthelist of useson the left handsideof theZoning Tableandthe list of zonesat the top of theZoningTable.
3.2.2 The symbolsused in the crossreferencein the Zoning Table havethe following meaning:
"P" meansthat the use is permittedprovided it complies with the relevant standardsandrequirementslaid down in the Schemeandall conditionsif any imposedby the Councilin granting planning consent.
"AA" meansthat the Council may, at its discretion,permit the use.
meansthat theCouncil may,at its discretion,permit the useafter noticeof the applicationhas beengiven in accordancewith Clause6.2.
3.2.3 Whereno symbol appearsin the crossreferenceof a use againsta zone in the Zoning Tablethat use is not permittedin that zone.
3.24 Where in the Zoning Table a particular use is mentionedit is deemedto be excludedfromany other use which by its more generalterms might otherwiseinclude suchparticular use.
3.2.5 If the use of land for a particular purposeis not specifically mentionedin the Zoning Tableand cannotreasonablybe determinedas falling within the interpretationof one of the usestheCouncil may:
a determinethat the use is not consistentwith the objectivesandpurposesof the particularzoneandis thereforenot permitted;or
b determineby absolutemajoritythat theproposedusemay be consistentwith the objectivesandpurposeof the zoneandthereafterfollow the advertisingproceduresof Clause6.2 inconsideringan application for planning consent,following which the Council may, at itsdiscretion, permit the use.
3.2.6 Notwithstandingthat a useis not permittedin a zonein the Zoning Table, the Council maywith the prior written authority of the Minister andsubjectto following the advertisingproceduresof Clause6.2, approveof the useof the land for that purposeif the Council is satisfiedby absolutemajority that:
a the proposeddevelopmentwill be consistentwith the orderly and properplanning of thelocality and the preservationof the amenitiesof the locality; and
b the use of the land for that purposewill not haveany adverseeffect upon the occupiersor usersof the developmentor upon property in or the inhabitantsof the locality or thelikely future developmentof the locality.

3.3 Additional Use
3.3.1 The portionsof the SchemeArea specifiedin Schedule2 are the subjectof Additional Usepermits.
3.3.2 Notwithstandingthat land the subjectof an Additional Use permit is within a zone the landor any building thereonmaybe usedfor the purposeset againstthat land in Schedule2 in additionto the other usespermitted in the zone in which the land is situated unlessany of theseusesisexcludedor modified by a conditionspecified in Schedule2. The useof the land is also subjecttoany other conditions consideredappropriate by the Council and stated oppositethe parcel inSchedule2.
3.4 Rural Residential Zone
The following provisions shall apply to all land included in a Rural ResidentialZone in additionto any provisionswhich are more generallyapplicableto such land under the Scheme:
a the objectiveof the Rural ResidentialZone is to selectareaswhereinclosersubdivisionwillbe permitted to provide for such usesas hobby farms, horse breeding,rural-residentialretreats,and also to make provision for retentionof the rural landscapeand amenityina mannerconsistentwith the orderly and properplanning of such areas.
b the provisions for controlling subdivision and developmentin specific Rural ResidentialZonesshall be as laid down in Schedule3 andfuture subdivisionwill generallyaccordwiththe plan of subdivision for the specified areareferredto in Schedule3 and such plan ofsubdivision shall form part of the Scheme.
c the minimum lot size for subdivisionin the Rural ResidentialZone shall be 2.0 ha unlessconnectionto a reticulatedwater supplyis madeavailable in which casethe minimum lotsize shall be 1.0 ha.

d before making provisionfor a Rural ResidentialZone, Council will prepare,or requiretheowners of the land to prepare, a submission supportingthe creation of the RuralResidentialZone and such submissionshall include:i a statementas to the purposeor intent for which the zoneis being createdandthe
reasonsfor selectingthe particular areathe subjectof the proposedzone.ii a plan or plansshowingcontoursat suchintervalsas to adequatelydepict thelandform
of the areaand physical featuressuch as existing buildings, rock outcrops,treesorgroupsof trees,creeks,wells and significant improvements.
iii information regardingthe method wherebyit is proposedto provide a potablewatersupply to each lot.
e the Scheme provisions for a specific Rural Residential Zone shall include a plan ofsubdivisionshowing, amongstother things;i the proposedultimate subdivisionincluding lot sizesand dimensions.
ii areasto be set aside for public open space, pedestrianaccessways,horse trails,community facilities, etc. as may be consideredappropriate.
iii those physicalfeaturesit is intendedto conserve.iv the proposedstagingof the subdivisionwhere relevant.
U in additionto theplan of subdivision,theSchemeprovisionsfor a specificRural ResidentialZone shall specify:i any facilitieswhich the purchasersof the lots will be requiredto providee.g. their own
potablewater supply, liquid or solid wastedisposal,etc..ii proposalsfor the control of land usesand developmentwhich will ensurethat the
purpose of intent of the zone and the rural environmentand amenities are notimpaired.
iii any specialprovisionsappropriateto securethe objectivesof the zone.3.5 FarmingZoneThe Council supportsthe continueduse of land in the FarmingZone for agricultural production.For land in the Farmingzoneoutside the Beverley andMawson townsites the Council will onlysupportan application for planningconsentwhere the proposeduse is consistentwith continuedviability of rural use,andwill be consistentwith rural characterand local amenities.
Part 4-DevelopmentRequirements4.1 Developmentof Land4.1.1 Subject to Clause4.1.2 a personshall not commenceor carry out developmentof any landzonedor reservedunder the Schemewithout first having applied for and obtainedthe planmngconsentof the Council under the Scheme.4.1.2 The planning consentof the Council is NOT requiredfor the following developmentof land:
a the use of land in a reserve,where suchland is held by the Council or vestedin a publicauthority:-i for the purposefor which the land is reservedunder the Scheme;or
ii in the caseof land vestedin a public authority, for any purposefor which such landmaybe lawfully usedby that authority;
b the erectionof a boundaryfence except as otherwiserequiredby the Scheme;
c a developmentin the FarmingZoneoutsidethe Beverleyor Mawsontownsiteswhere theuse is designatedwith the symbol "F’ or "AA" in the cross-referenceto the FarmingZonein theZoning Tableexceptwherethe developmentis on a lot which doesnot havefrontageto a constructedroad;
d the carryingout of any works on, in, over or undera streetor road by a public authorityacting pursuantto the provisionsof any Act;
e the carrying out of works for the maintenance,improvementor other alteration of anybuilding, being works which affect only the interior of the building or which do notmaterially affect the externalappearanceof the building; or
U the carryingout of works urgentlynecessaryfor public safetyor for the safetyor securityof plant or equipmentor for the maintenanceof essentialservices.
4.2 Discretion to Modify DevelopmentStandardsIf a development,other than a residentialdevelopmentor a developmenton a lot which doesnothave frontageto a constructedroad, the subjectof an applicationfor planning consentdoesnotcomplywith a standardor requirementprescribedby the Schemewith respectto that developmentthe Council may, notwithstandingthat non-compliance,approvethe applicationunconditionallyorsubject to suchconditionsas the Council thinks fit. The power conferredby this Clausemay onlybe exercisedif the Council is satisfiedthat:-
a approvalof the proposeddevelopmentwould be consistentwith the orderly and properplanning of the locality andthe preservationof the amenitiesof the locality;
b the non-compliancewill not have any adverseeffect upon the occupiersor usersof thedevelopmentor theinhabitantsof the locality or upon thelikely futuredevelopmentof thelocality; and

c the spirit and purposeof the requirementor standardwill not be unreasonablydepartedfrom thereby.
4.3 ResidentialDevelopment:ResidentialPlanningCodes4.3.1 For the purposeof the Scheme"ResidentialPlanningCodes"meansthe ResidentialPlanningCodes set out in Appendix 2 to the Statementof Planning Policy No. 1, togetherwith anyamendmentstheretohereinaftercalled the ‘R Codes’.4.3.2 A copy of the R Codesshall be kept and madeavailablefor public inspectionat the officesof the Council.4.3.3 Unlessotherwiseprovidedfor in the Schemethe developmentof landfor any of theresidentialpurposesdealt with by the R Codesshall conformto the provisionsof those Codes.4.3.4 The R Code densityapplicableto land within the residentialzoneshall be determinedbyreferenceto the R Codedensitynumberssuperimposedon the areaswithin that zoneshownin theSchemeMap as beingcontainedwithin the outeredgesof theblack bordersor, wheresuchan areaabutson anotherareahavinganR Code density,as being containedwithin the centrelinesof thoseborders.4.4 SpecialApplication of ResidentialPlanningCodesNotwithstanding anything elsewherecontainedin the Scheme, the Council may consideranapplicationto developa singlehouseon a lot existingat the gazettaldateandwhich doesnot complywith the requirementsof minimum area of land per dwelling and may grant approvalwith orwithout conditions, or may refusethe application.4.5 Developmentof Lots Abutting UnconstructedRoadsNotwithstandinganything elsewhereappearingin the Schemewhere an application for planningconsentis madein respectof land abuttingan unconstructedroad or a lot which does not havefrontage to a constructedroad the Council shall either:-
a refuse the application until the road has been constructedor accessby means of aconstructedroadis providedas the casemay be;
b grant the applicationsubjectto a conditionrequiring the applicantto pay a sumof moneyin or towardspaymentof the cost or estimatedcost of constructionof the road or partthereofand any other conditionsit thinks fit to impose;or
c require such other arrangementsare made for permanentaccessas shall be to thesatisfactionof the Council.
4.6 Flood ProneAreasNotwithstandinganythingelsewherecontainedin the Schemedevelopmentof land identified in theAvon River Flood Study adoptedby the WaterAuthority of WesternAustralia as within the extentof 100 year flood shall be subject to the following:
a in additionto a building licence,the Council’s prior approvalto commencedevelopmentisrequiredfor all developmentincluding a singlehouseandsuch applicationshall be madein writing to the Council and be subjectto the provisionsof Clause6.1 of the Scheme.
b in determininganapplicationfor planning consenttheCouncil shallconsultwith theWaterAuthority of WesternAustralia.
c the Council may determinea minimum finished floor level for any building subjectof anapplication for planning consent.
4.7 Site RequirementsThe sitebuilding requirementsfor land in various zonesshall be as set out in Table 2.

4.9 Town CentreDesign Control Area4.9.1 The land in theTown CentreZone is herebydesignatedas"Town CentreDesignControlArea".4.9.2 Developmentwithin the Town CentreDesign Control Area shall be subjectto the civic anddesign guidelines containedin this clauseandwhich are for the purposeof ensuringthat suchdevelopmentwill not affect local amenityandwill enhancethe characterof the land in the TownCentrezone.4.9.3 Site requirementsshall be as set out in Table 2 of the Scheme.4.9.4 Development shall not exceed 2 storeys in height except where Council considersthatparticularcircumstancesmay warrantan exceptionbeing madeandprovidedthe intentionsof thisClauseare not compromised.4.9.5 In consideringapplication for planning consent for a proposeddevelopmentincludingadditionsandalterationsto existingdevelopmentin the Town CentreDesignControlArea Councilshall haveregardto the following:
a the colour andtextureof externalbuilding materials;
b for all buildings fronting Vincent StreetCouncil mayrequirethe building facadeandsidewalls to a building depthof 3 m to be constructedin masonry;
c building size, height, bulk, roof pitch;d setbackand location of the building on its lot;e architecturalstyle and design details of the building;
U function of the building;
g relationshipto surroundingdevelopment;andh othercharacteristicsconsideredby the Council to be relevant.
4.9.6 Landscapingshall complementthe appearanceof the proposeddevelopmentand the towncentre.4.9.7 Layout of carparkingshall haveregardfor traffic circulationin existingcarparkingareasandshall be integratedwith anyexisting andadjoining carpark.4.10 Home Occupation4.10.1 The Council shall not grantplanningconsentto a homeoccupationunlessit is satisfiedthatthe use:
a will not prejudicially affect the amenityof the neighbourhoodby way of emissionsof anynature;
b will not occupyan areagreaterthan 20 squaremetres;
c does not require the provision of any essentialservicemain of a greatercapacity thannormally requiredin the zonein which it is located;and
d is compatiblewith the principal usesto which the land in the zone it is locatedmay beput and will not in the opinion of the Council generatea volume of traffic that wouldprejudicethe amenityof the area.
4.10.2 If an approvalto conducta homeoccupationis issuedto a specific occupierof a particularparcel of land, it shall not be transferredor assignedto any other person,and shall not betransferredfrom the land in respectof which it was granted.Should therebe a changeof theoccupier of the land in respectof which a home occupationapprovalis issued the approval iscancelled.4.10.3 If, in the opinion of the Council, a home occupationis causinga nuisanceor annoyancetoownersor occupiersof land in the locality the Council may rescindthe approval.4.10.4An approvalto conducta homeoccupationis issuedsubjectto an annualpermitwhich maybe renewedby applicationto the Council for planningconsent.4.11 Rural ResidentialZone4.11.1Developmentin a Rural ResidentialZone shall complywith therequirementsof thefollowing:
a in additionto a building licence,the Council’s prior approvalto commencedevelopmentisrequiredfor all developmentincluding a single houseandsuch applicationshall be madein writing to the Council andbe subjectto the provisionsof Clause6.1 of the Scheme.
b not more than one dwelling per lot shall be erected.
c in order to conservethe rural environmentor featuresof naturalbeautyall treesshallberetainedunlesstheir removal is authorizedby the Council.
d in orderto enhancethe rural amenityof the land in areasCouncil considersdeficientintreecover it may requireas a conditionof anyplanningapprovalthe plantingof suchtreesand/or groupsof treesand speciesas specified by the Council.
e any personwho keepsan animal or animals or who usesany land for the exerciseortraining of an animal or animals shall be responsiblefor appropriatemeasuresto preventdustpollution and soil erosionto the satisfactionof the Council. Where in the opimon ofthe Council the continuedpresenceof animalsis likely to contributeor is contributingtodustpollution or soil erosion,noticemaybe servedon the ownerof the land requiringtheremovalwithin the period specified in the notice of thoseanimals specifiedin the noticefor a period specifiedin the notice.

4.11.2 In consideringapplication for planning consentfor a proposeddevelopmentincludingadditionsandalterationsto existing developmentCouncil shall haveregardto the following:
a the colour and textureof externalbuilding materials;b building size, height, bulk, roof pitch;
c setbackandlocation of the building on its lot;
d architecturalstyle and design details of the building;
e relationshipto surroundingdevelopment;andf other characteristicsconsideredby the Council to be relevant.
4.12 Subdivision4.12.1 In the ResidentialZone theCouncil mayrequirepreparationof anOutline DevelopmentPlanbefore grantingand/or recommendingapprovalto any developmentwhich involves subdivision orfollows subdivision and the Outline DevelopmentPlan shall form the basis for subdivision.
a the Outline DevelopmentPlan shall include:
i the topographyof the area;ii the location and width of proposedroads;iii the location of recreation,open space,andpedestrianaccesswaysproposed;iv the layout of comprehensivedrainage;andv such other information as may be requiredby Council.
b if the Council resolvesto adoptthe Outline DevelopmentPlanit shall circulatethe OutlineDevelopment Plan to all owners of land within the area covered by the OutlineDevelopmentPlan with an invitation for, submissionsto be lodged with Council withintwenty-onedays.
c the Council shall considerobjections, if any, to the Outline DevelopmentPlanand may,if the applicantagrees,amendthe Outline DevelopmentPlan after such considerationofobjections.
d the Council may decidenot to proceedor may submittheOutline DevelopmentPlanto theCommissiontogetherwith the objectionsand requestthe Commissionto adoptthe plansubmittedas the basisfor approvalof subdivision within the areacoveredby the plan.
e any departuresfrom or alterationsto the Outline DevelopmentPlan may, subjectto theapproval of the Commission,be permitted if the Council considersthat the proposeddepartureor alteration will not prejudice the progressivedevelopmentof the areathesubjectof the Outline DevelopmentPlan.
4.12.2 In the FarmingZone thereshall be a presumptionagainstthe subdivision of land unlesstheCouncil is satisfied:
a the lots havealreadybeenphysically divided by significant naturalor man-madefeaturesunless adjoining land could be similarly subdivided and thereby, by the processofprecedent,leadto an undesirablepatternof land use in the areaor in lots too small forusescompatiblewith the prevailing use in the areaor in ribbon developmentalongsideroads;
b the lots are for farm adjustmentand the erection of dwelling housesis restrictedbymemorialson Titles;
c the lots are for specific usessuch as recreationfacilities and public utilities; ord the lots are requiredfor the establishmentof usesancillary to the rural use of the land,
or are requiredfor the travelling public andtourists suchas servicestationsandmotels.
Part 5-Non-ConformingUses.5.1 Non-conformingUse RightsNo provision of the Schemeshall prevent:
a the continueduse of any land or building for the purposefor which it was being lawfullyusedat the gazettaldate; or
b the carryingout of any developmentthereonfor which, immediatelyprior to that time, apermit or permits, lawfully requiredto authorizethe developmentto be carriedout, wereduly obtainedand are current.
5.2 Extensionof Non-conformingUseA personshall not alter or extenda non-conforminguse or erectalter or extenda building usedin conjunctionwith a non-conformingusewithout first havingappliedfor andobtainedtheplanningconsentof the Council underthe Schemeand unlessin conformity with any otherprovisionsandrequirementscontainedin the Scheme.5.3 Changeof Non-conformingUseNotwithstandinganything containedin the Zoning Table the Council may grant its planningconsentto the changeof use of any land from a non-conforminguseto anotheruseif the proposeduse is, in the opinion of the Council, less detrimental to the amenity of the locality than thenon-conforminguse and is, in the opinion of the Council, closerto the intendeduses of the zone.

5.4 Discontinuanceof Non-conformingUse5.4.1 Whena non-conforminguseof any land or building hasbeendiscontinuedfor a periodof sixmonthsor moresuchland or building shall notthereafterbeusedotherwisethan in conformitywiththe provisionsof the Scheme.
5.4.2 The Council may effect the discontinuanceof a non-conforminguse by the purchaseof theaffectedproperty, or by the paymentof compensationto the owner or the occupieror to both theownerandthe occupierof that property, andmay enterinto an agreementwith the ownerfor thatpurpose.
5.5 Destructionof Buildings
If any building is, at the gazettal date, beingused for a non-conforminguse,and is subsequentlydestroyedor damagedto an extentof 75% or more of its valuethe land on which the building isbuilt shall not thereafterbe usedotherwisethan in conformity with the Scheme,andthe buildingshall not be repaired or rebuilt, altered or added to for the purpose of being used for anon-conforminguse or in a manneror position not permittedby the Scheme.
Part 6-PlanningConsent6.1 Application for PlanningConsentEvery application for planning consentshall be madein the form prescribedby the Council andin accordancewith the directions thereon.
6.2 Advertising of Application6.2.1 Wherean application is madefor planning consentto commenceor carry out developmentwhich involvesan "SA" usethe Council shall notgrant planningconsentto that applicationunlessnotice of the applicationis first given in accordancewith the provisionsof this Clause.
6.2.2 Wherean application is madefor planning consentto commenceor carry out developmentwhich involves an "AA" use,or for any other developmentwhich requiresthe planningconsentofthe Council, the Council may give noticeof the applicationin accordancewith the provisionsof thisClause.6.2.3 Wherethe Council is requiredor decidesto give noticeof an application for planning consentthe Council shall causeone or more of the following to be carriedout:-
a noticeof the proposeddevelopmentto be servedon theownersandoccupiersof land withinan areadeterminedby the Council as likely to be affected by the granting of planningconsentstatingthat submissionsmay be madeto the Council within twenty-onedays ofthe serviceof such notice;
b notice of the proposeddevelopmentto be publishedin a newspapercirculating in theSchemeArea statingthat submissionsmaybe madeto theCouncil within twenty-onedaysfrom the publication thereof;
c a sign or signs displayingnoticeof the proposeddevelopmentto beerectedin a conspicuousposition on the land for a period of twenty-onedays from the dateof publication of thenotice referredto in paragraphb of this Clause.
6.2.4 After expirationof twenty-onedaysfrom the serving of notice of the proposeddevelopment,the publicationof notice or the erectionof a sign or signs,whicheveris the later, the Council shallconsideranddeterminethe application.
6.3 Determinationof Application
6.3.1 In determining an application for planning consent the Council may consult with anyauthority which, in the circumstances,it thinks appropriate.
6.3.2 The Council havingregard to anymatterwhich it is requiredby the Schemeto consider, tothe purposefor which theland is reserved,zonedor approvedfor the useunderthe Scheme,to thepurposefor which landin the locality is used,andto the orderlyandproperplanningof the localityand the preservationof the amenitiesof the locality, mayrefuseto approveany application forplanningconsentormaygrantits approvalunconditionallyor subjectto suchconditionsas it thinksfit.6.3.3 Wherethe Council approvesanapplicationfor planningconsentundertheSchemetheCouncilmaylimit the time for which that consentremainsvalid.6.4 DeemedRefusal6.4.1 Wherethe Council hasnot within sixty days of thereceiptby it of an applicationfor planningconsenteither conveyedits decisionto the applicantor givennoticeof theapplicationin accordancewith Clause6.2 the applicationmay be deemedto have,beenrefused.6.4.2 Wherethe Council hasgiven noticeof an applicationfor planningconsentin accordancewithClause6.2 and wherethe Council hasnot within ninety days of receiptby it of the applicationconveyedits decision to the applicant, the applicationmay be deemedto havebeenrefused.
6.4.3 Notwithstandingthatanapplicationfor planningconsentmaybe deemedto havebeenrefusedunderClauses6.4.1 or 6.4.2 the Council may issue a decisionin respectof the applicationat anytime after the expiry of the sixty day or ninety day period specifiedin those Clauses,as the casemay be.

6.5 Approval of Existing Development6.5.1 The Council maygive approvalof a developmentalreadycommencedor carriedout regardlessof when it commencedor was carriedout. Suchapprovalshall havethe sameeffect for all purposesas if it hadbeengiven prior to the commencementor carryingoutof the development,butprovidedthat the developmentcomplieswith the provisionsof the Schemeas to all mattersother than theprovisionsrequiringCouncil’s approvalprior to the commencementof development.6.5.2 The application to the Council for approvalunderClause6.5.1 shall be madein accordancewith the provisions of Clause6.16.5.3 A developmentwhich was not permissibleunderthe Schemeat the time it wascommencedor carriedout may be approvedif at the time of approvalunderthis Clauseit is permissible.6.5.4 The approvalby the Council of an existing developmentshall not affect the power of theCouncil to take appropriateaction for a breachof the Schemeor the Act in respectof thecommencementof the developmentwithout approval.6.6 Preservationof Buildings, Objects, or Places6.6.1 If the Council resolvesthat, in its opinion, a building, object, or place is of historical orarchitecturalinterestor of outstandingnaturalbeautythen,within fourteendaysafter the passingof that resolution,the Council shall give written notice thereofto the ownerof the building, object,or place.The notice shall set out the termsof this Clause,and requirethe owner to give writtennotice to the Council of anymaterialalterationor modificationproposedto be madeto thebuilding,object or place.6.6.2 No alteration or modification to any building, object, or place which is the subject of aresolution under Clause6.6.1 shall be commencedor carriedout, by any person,without havingobtainedplanning consent.6.6.3 Wherea developmentthe subjectof an applicationfor planning consentinvolves a materialalterationto, a materialmodification of, or the destructiontotal or partial of any building, object,or placethe subjectof a resolutionunderClause6.6.1,the Council,having regardto the desirabilityof retaining that building, object, or place,may refusethe applicationor approveof it subject tosuchconditionsas the Council deemsnecessaryto protector preservethe building, object,or place.6.6.4 Where the Council refusesapprovalfor the developmentof land on any ground set out inClause6.6.3 or grants approvalsubjectto conditionsthat are,unacceptableto the applicant, theowner of the land may, if the land is injuriously affected thereby,claim compensationfor thatinjurious affection in accordancewith the Act.6.6.5 Claims for compensationunderthis Clauseshall be lodgedat the offices of the Council notlater than six monthsafter the dateof the decisionof the Council refusingapprovalor grantingapprovalsubjectto conditionsthat are unacceptableto the applicant.6.6.6 In lieu of paying compensationthe Council may purchasethe land affectedby the decisionof the Council at a pricenot exceedingthe value of the land at the time of refusalof approvalorof the grantingof approvalsubjectto conditionsthat are unacceptableto the applicant.
Part 7-Mmiistration7.1 Powersof the SchemeIn implementing the Schemethe Council has, in addition to all other powers vested in it, thefollowing powers:
a the Council may enterinto any agreementwith anyowner,occupieror otherpersonhavingan interest in land affected by the provisionsof the Schemein respectof any matterspertainingto the Scheme.
b the Council may acquire any land or buildings within the District pursuant to theprovisionsof the Schemeor the Act.
c the Council may deal with or disposeof any land which it has acquiredpursuantto theSchemeor theAct in accordancewith law andfor suchpurposemaymakesuchagreementswith otherownersas it considersfit.
d an officer of the Council, authorizedby the Council for thepurpose,may at all reasonabletimesenterany building or land for the purposeof ascertainingwhetherthe provisionsofthe Schemearebeing served.
7.2 Offences7.2.1 A personshall not erect,alter or addto or commenceto erect,alteror addto a building oruse or changethe use of any land, building or part of a building for any purpose:
a otherwisethan in accordancewith the provisionsof the Scheme;b unlessall consentsrequiredby the Schemehavebeengrantedandissued;c unless all conditionsimposed upon the grant andissue of any consentrequired by the
Schemehavebeenand continueto be compliedwith; andd unless all standardslaid down and all requirements prescribedby the Schemeor
determinedby the Council pursuantto the Scheme.with respectto that building or thatuse of that part havebeenand continueto be complied with.
7.2.2 A personwho fails to comply with any of the provisionsof the Schemeis guilty of an offenceandwithout prejudiceto anyother remedygiven hereinis liable to the penaltiesprescribedby theAct.

7.3 Act7.3.1 Twenty eight 28 days written notice is herebyprescribedas the notice to be given pursuantto Section 10 of the Act.7.3.2 The Council may recoverexpensesunderSection 102 of the Act in a Court of competentjurisdiction.7.4 Claims for CompensationExcept where otherwiseprovided in the Scheme,the time limit for the making of claims forcompensationpursuantto Section 111 of the Act is six 6 monthsafter the date of publicationof the Schemein the GovernmentGazette.7.5 AppealsAn applicantaggrievedby a decisionof the Council in respectof the exerciseof a discretionarypowerunderthe Schememay appealin accordancewith the rules andregulationsmadepursuantto the Act.7.6 Power to Make Policies7.6.1 In orderto achievethe objectivesof theScheme,the Councilmay makeTown PlanningSchemePolicies relating to parts or all of the SchemeArea andrelating to one or more of the aspectsofthe control of development.7.6.2 A Town Planning SchemePolicy shall becomeoperativeonly after the following procedureshavebeencompleted:
a the Council having preparedandhaving resolvedto adopta draft Town PlanningSchemePolicy, shall advertisea summaryof the draft Policy oncea weekfor two consecutiveweeksin a newspapercirculatingin the SchemeArea giving detailsof wherethe draftPolicy maybe inspectedand where, in what form, and during what period being not less thantwenty-onedays representationsmay be madeto the Council.
b the Council shall review its draft Town Planning SchemePolicy in the light of anyrepresentationsmadeandshall thendecideto finally adoptthe draftPolicy with or withoutamendment,or to not proceedwith the draft Policy.
c following final adoption of a Town Planning SchemePolicy, details thereof shall beadvertisedpublicly and a copy kept with the Schemefor inspection during normal officehours.
7.6.3 A Town Planning SchemePolicy may only be alteredor rescindedby:a preparationandfinal adoptionof a new Policy pursuantto this Clause,specificallyworded
to supersedean existing Policy.
b publicationof a formal noticeof rescissionby the Council twice in a newspapercirculatingin the SchemeArea.
7.6.4 A Town PlanningSchemePolicy shall not bind the Council in respectof any application forplanningconsentbut before making its decisionthe Council shall takeinto accountthe provisionsof the Policy and objectiveswhich the Policy was designedto achieve.
