EVENT PRODUCTION ADD-ONS

SPECS

1. CONTRACT AND DEPOSIT: A signed Private DiningContract and a 20% of total cost of the eventdeposit is required to guarantee the space. Pleasenote that the 20% deposit will be used as a creditto the bill the night of the event. This deposit will benon-refundable after seven (7) days prior to theevent.

2. ROOM CONDITIONS: In order to rent our full diningroom, a minimum of $5,000 for five (5) hours during weekends, holidays and special event days mustbe met. During the week (Monday to Wednesday)a minimum of $3,000 for five (5) hours is required.

3. CANCELLATIONS: For all cancellations of eventsmade after seven (7) days prior to function date,the deposit is forfeited.

4. MENU SELECTION: For all functions, Mojitobar musthave your selected menu seven (7) days prior tothe function date. Mojitobar reserves the right tosubstitute an entrée of equal or greater value atthe client’s expense if the guest number increases.Mojitobar will charge for the guaranteed numberof guests, or the total number served, whicheveris greater. Our private dining menu offers pre-setdining options from which you can choose thedesignated number of items from each course.Prices reflect a group discount since there is asavings in labor.

5. GUEST GUARANTEE: For all functions, Mojitobarmust have a guest number confirmation seven (7)days prior to function date. Mojitobar will considerthis number the guarantee, and it will not besubject to reduction. If no guaranteed number isreceived within seven days prior to function date,Mojitobar will consider the original expected guestnumber on page five of this contract as the finalguest count.

6. PRICING: The prices quoted herein for any functionwhich takes place within ninety days after the dateof execution of this contract are firm. The prices forany function taking place more than ninety (90)days after the date of execution of this contractare subject to change without notice; however,Mojitobar guarantees that food and beverage price increase that impact already signed contractswill not exceed 10%. Our Private Dining Client mustconfirm menu prices with our manager one week inadvance of their planned event.

7. FOOD AND BEVERAGE: All Food and Beverages must be purchased and prepared through Mojitobar.All food and beverage must be consumed on thepremises. Left over Mojitobar food from no showscannot be boxed and taken home. Absolutely NOALCOHOLIC BEVERAGES may be brought unto thepremises, as this is a VIOLATION TO THE DEPARTMENT OF BUSINESS AND PROFESSIONAL REGULATION DIV OFALCOHOLIC BEVERAGES & TOBACCO.

8. FINAL PAYMENT: Private Dining Client agrees to paythe current menu price as quoted by manager one week in advance. Final payment for the functionmust be made at the completion of the function.Payment can be made by cash, debit or creditcard. We accept all major credit cards.

9. HOURS: All lunch events may use our Indoors DiningArea from 11:00 a.m. to 3:00 p.m. All evening dinnerevents scheduled on Sunday through Thursdaymay use the Indoors Dining Area from 5 p.m. until11:00 p.m. All evening dinner events on Friday andSaturday my use the Indoors Dining Area from 5p.m. until 10:00 p.m.

10. TAX AND GRATUITY: A 18% service fee and 7% Florida sales tax are added to all Private Dining functions.

11. ENTERTAINMENT: No loud entertainment of any kindwill be permitted to be brought into Mojitobar bythe Client or his/her guests or invitees without priorwritten consent of Mojitobar management. DJs andloud bands are not permitted.

12. QUALITY STANDARDS: Mojitobar reserves the rightto enforce its quality standards, concerning dressand decorum, at all functions. Mojitobar reservesthe right to refuse serving any person who in thejudgment of its management is under the influence of alcohol or any controlled substances, or to request that such a person leave the premises. Mojitobarreserves the right to ask for proper identificationprior to serving any alcoholic beverages to anyperson requesting such service. Mojitobar reservesthe right to close the bar before the designatedending time should we deem it necessary.

13. DECORATIONS: Decorations must be approvedby Mojitobar management. All display exhibitsand decorations must conform to fire and safetycodes. The Client is responsible for taking down allapproved decorations before leaving. Confetti isnot permitted. If confetti is brought in, an additional $150 clean up fee will be charged. If ice sculpturesare brought in by the party, they are responsiblefor set-up and removing the ice sculpture andwater associated with it at the end of the event, ora $150 charge will be assessed.

14. PARKING: Parking is available in any lot surrounding the Sawgrass Mills Mall.

15. Mojitobar is not responsible for damages to or thetheft of parked automobiles or contents there ofduring the scheduled event.

16. Mojitobar is not responsible for any lost or stolen items.

17. The Client assumes responsibility for any damagethat may occur on the premises: this includesany damage of walls, carpet, wood flooring, etc.Mojitobar management reserves the right toassess a service charge for any damages and/orexcessive clean-up beyond the expected normalrange of a planned function.

18. The Client agrees to ensure that the eventscheduled and any persons in attendance willconduct no illegal activities.

19. Mojitobar shall not be liable for non-performanceof this contract when such nonperformance isattributable to labor troubles, disputes or strikes,accidents, government (Federal, State andMunicipal) regulations of, or restrictions upontravel or transportation, non-availability of food,beverage or supplies, riots, national emergencies,acts of God an other causes whether enumeratedherein or not, which are beyond the reasonablecontrol of Mojitobar preventing or interfering withthe restaurants performance of its obligationsunder this contract.
