The Story of Priya Puri and AmEx tell us that all confidential information or undisclosed information may not qualify as a trade secret.As we saw from the story AmEx filed a suit against Priya Puri that she had illegally detained the confidential information of the AmEx i.e. the customer details including their investment accounts and contact details. The court rejected the plea of AmEx since this kind of information could be extracted from other sources such as public directories like PHDCCI and information available in public domain cannot be qualified as trade secret. Therefore the story helps us in understanding the theme BTW, What is so Confidential?".The various stories under this theme discusses about what information is a trade secret and what is not. The story of priya puri highlights on the information available in public domain is not a trade secret on the other hand story like Citibank and shivraj Puri, the story of Biswamoham Pani discusses about how employees stole and misused company data for personal gains.In the class we had discussion about why did AmEx terminated Priya Puri when she had already resigned from the job and was serving her notice period. We had several conjectures on this and came to the conclusion that AmEx wanted to create trouble for her so that she cannot join other competitive firms. We also discussed that if the allegations on Priya Puri were correct then apart from her Amex should have also charged Shikha Sharma and Vasanth Pathuri who helped her in getting the confidential data.If I were to do this activity once again I would have provided with more conjectures on why did AmEx went against and terminated Priya Puri when no clear evidence for her illegal possession of confidential information was available.
