waste and, when feasible, apply m ethods for therecycling o f was te .

4) Any person who causes any pollution shall bereq uired to clean u p o r p ay th e co st o f clean in g u p th epolluted environm ent in such a m anner and w ithinsu ch a p erio d as sh all b e d eterm in ed b y th e A uth orityo r b y th e relev an t reg io nal en viro nm en ta l a gen cy.

5) W hen any activity poses a risk to hum an health or tothe environment, the Authority or the relevantr eg iona l env ironmen ta l agency sha ll take any neces -sary m easure upto the closure or relocation of anyen terp rise in o rd er to p rev en t h arm .

4. Management of Hazardous Waste, Chemical andRadioactive Substance1) T he generation, keeping, storage, transportation,

/.tr ea tmen t o r d isposa l o f any hazardous was te withou ta p erm it fro m th e A uth ority o r th e relev an t re gio na lenvironmenta l agency is prohib ited .

2) Any person engaged in the collection, recycling,tran sp ortatio n, treatm en t o r d isp osal o f any hazar-dous waste shall take appropriate precaution to

p rev en t any d am ag e to th e en viro nm ent o r to hu manhealth or well -be ing .

3) The im portation, m ining, processing, keeping, dis-trib utio n, sto ra ge, tran sp orta tio n o r u se o f rad io ac -tiv e su bstan ces sh all b e su bject to a perm it fro m th ecompetent agency.

4 ) T he im po rtatio n, p rep aratio n, k eep in g, d istrib utio n,storage, transportation or use of a chemicalcatego rized as hazardous o r o f r es tr ic ted use , sha ll besu bject to a p erm it fro m th e A uth ority o r th e relev an tregional environm ental agency or from any othercompetent agency.

5. Management of Munic ipal Waste1 ) A ll u rb an ad min istratio ns sh all en su re th e co llec tio n,

tran sp orta tio n, an d, a s ap plO pria te , th e rec yclin g,treatment or safe disposal of municipal waste

th ro ug h th e institu tio n of an in tegrated m un icip alwas te managemen t sys tem.

2 ) In co llab oratio n w ith th e relev ant reg io nal env iron -mental agency, the Authority shall m onitor andevaluate the adequacy of municipal wastem an ag em en t sy stem s an d ensu re th e effectiv en essof their implementation.

3) A ny person responsible for the m aintenance of anyprem ise to w hich the public has access shall, at alltim es, ensu re th at ad eq uate an d su itable toilets an dcon ta iner s and o ther r equir ed fac ilitie s a re p rovided

fo r th e d is po sa l o f w aste.

PART T HR EEEnvironmenta l S tandards

6. Envi ronmenta l S tandards1) In consultation with competent agencies, the

Authori ty sha ll formula te pract icable environmentalstandards based on scientific and environm entalp rin cip les. T he secto rs th at req uire stand ard s sh allinclude a t leas t the following:(a) Standards for the discharge of effluents into

w ate r b od ie s an d s ew ag e s ystem s.(b) A ir quality standards that specify the am bient

air quality and give the allow able am ounts ofemission for both stationary and mobile airpollut ion sources.

(c) Standards for the types and am ounts of substan-ces that can b e ap plied to th e so il o r b e d isp osedof on or in it.

(d ) S tan dard s fo r n oise p ro vid in g fo r the m ax im umallow able noise level taking into account theset tlement pat te rns and the availabi lity of scien-tif ic and techno logical capac ity in the countty.

(e) Waste management standards specifying the

lev els allo wed and th e m eth ods to b e u sed in th egenera tion, handling, s to rage , tr ea tment, tr ans-po rt an d d ispo sal o f th e v ario us ty pes o f w aste.

2) Sources of noxious odour shall be regulated so thatthe nuisance they cause is p revented.

3 ) T he A uth ority m ay prescribe d ifferent en viro nm en -tal standards for different areas as it may findneces sa ry to p ro tect o r r ehab ilita te the env ironment.

4) N atio nal reg ion al states m ay, b ased o n th eir sp ecificsituation, adopt environm ental standards that arem ore strin ge nt th an th ose d eterm in ed at th e F ed eral

leve l. However, they sha ll not adopt s tandards wh icha re le ss r igorous than those dete rmined a t the Federallevel.

5) The Authority may, for a fixed period of time,au th oriz e th e w aiv er o f th e d uty to c om ply w ith so mereq uire men ts o f sp ec ified e nv iro nm en ta l sta nd ard sin o rd er to p ro mo te p ub lic b en efit.

PART F OU REnvironmental Inspectors

7. Environmental Inspectors1 ) E nv iro nm en tal in sp ecto rs (h erein after referred to as

"inspecto rs") sh all b e assign ed b y th e A uth ority o rby the relevant regiona l env ironmen ta l agency.

2) Inspectors shall exercise due diligence and im par-tiality in the discharge of their pow ers and dutiesunder this Proclamation.

8. Power s and Du tie s of Inspectors1) Inspectors shall have the following powers and

duties:(a) ensure com pliance w ith environm ental stan-

dards and rela ted requirements;(b) w ithout prejudice to Sub-A rticles (3) and (6) of

this A rticle, enter any land or prem ises at anytim e w hich seem s ap pro priate to th em w ith ou tp rio r n otice o r co urt o rd er;

5) W henever a sam ple is to be taken, the proprietor hasthe rig ht to b e p resen t or to sen d his rep resen tativ eand he sha ll be in fo rmed accordingly.

6) W hen an inspector on duty visits an undertaking, hesh all n otify th e p ro prieto r u nless h e co nsiders th atsu ch n otificatio n m ay b e p re ju dic ia l to th e e fficien tp erfo rm an ce o f h is d uty.

9. R ig ht to A pp ea l1) Any person dissatisfied with any of the measures

taken b y the in specto r m ay ap peal to th e H ead o f th eA uth ority o r th e relev an t reg io nal env iro nm entalag en cy, as th e case m ay b e, w ith in ten day s fro m th ed ate on w hich th e m easure w as tak en .

2) Any person dissatisfied because no decision hasb ee ll g iv en as p ro vid ed u nd er S ub -A rtic le (1 ) o fth isArticle, or feels that the decision given is inap-propriate, m ay institute a court case w ithin thirtydays from the date on which the decision wasg iv en o r th e d ead lin e fo r d ecisio n h as elap sed .

10. Incentives1) Incentives for the introduction of methods that

. enable the prevent ion or mini rn izatin of po llutionin to an ex is tin g u nd ertak in g sh all b e d eterm in ed b yregulations issued hereunder.

2) Importation of new equipment that is destined tocontrol pollution shall, upon verification by the.A uthority, be exem pted from paym ent of customduty.
