The EEOC is setting its sights beyond legislation to shape workplace conduct. Enforcement Guidelines are being promulgated to expand the scope of regulation which has in turn prompted legislative and judicial scrutiny. Many issues are raised. For example, how far must employers go to accommodate and protect pregnant workers? What are best practices for compliance with the complexities of the ACA regarding wellness programs? How should employers attempt to reconcile EEOC restrictions on the use of background checks when an employer’s failure to perform background checks could result in negligence claims? When a client claims his or her lawyer committed malpractice, attorneys reach out to theirfirm’sgeneral,ethicsorclaimscounseltodiscusstheirprofessionalobligations. These communications often occur during the representation and some courts have ruled that attorneys cannot assert the attorney-client privilege or work product doctrine due to their ethical responsibilities. Other courts have concluded that attorneys can assert the privileges. This program addresses the developing law and also the risk management, malpractice exposure and ethical issues that arise from intra-firm communications, and communications with brokers and insurers.

Fee for the seminar for early registrants is $599.00 for PLDF members and $699.00 for non-members. After September 10, 2015, the fee is $649.00 for PLDF members and $749.00 for non-members. The manner in which state CLE accreditation rules determine the number of credits available from this seminar willvary,astheydoforallseminars.Wedoexpecteachpresentationofferedatthisseminarwillreceivecredit.Inasmuch as written materials or presentation slides frequently are not produced until shortly before the seminar, and some states wish to review the materials as part of the credit evaluation process, we will alert members from such states when the credits are determined after the seminar. We will receive many credit approvals in advance of the seminar and will have that information available to attendees at the meeting. We expect to receive approximately nine CLE credits for this program, including at least one ethics credit we will apply for.
