    Administrative Services consists of seven primary sections: Human Resources, Budget, Finance,

    Purchasing, General Services, Investigation/Audit Unit, and Information Technology. Provides

    administrative support and fleet management for the agency. Livestock Market Auditors monitor,

    license, and audit the custodial accounts of the livestock markets in the state. The investigators

    inspect vehicles transporting livestock and are the first defense in finding animals infected or

    exposed to various diseases that could devastate Oklahoma's livestock industry.

    Please describe the purpose of this program, including a description of what you intend to

    Agriculture employees are served by Human Resources when inquiring about merit protection rules,

    applying for state jobs and insuring that benefits are administered correctly and that all employees

    understand benefits coverage. Governor, Legislators, and Executive Office are served with up-to-date

    information on funding, budget and fiscal impact on pending legislation. Other divisions are served by

    providing payroll, payables, receivables, and other financial services, fleet management, including

    vehicle maintenance and repair, and by data processing operational and programming support. Citizens

    of the State of Oklahoma are served as they deal with payment for licenses, fees, and requestinformation on programs administered by ODAFF. Assurance to the public regarding the health of

    livestock imported or exhibited and the quantity of agricultural commodities stored in public

    To protect Oklahoma's water and environment from possible contamination from animal waste. The

    citizens of Oklahoma receive protection from possible water pollution from animal waste because of the

    Poultry and CAFO inspectors and Agricultural Environmental Management Services (AEMS) staff's

    enforcement of the laws and rules pertaining to Concentrated Animal Feeding Operations (CAFO), Swine

    Feeding Operations, Poultry Feeding Operations, Poultry Waste Applicators, Agricultural Compost and

    animals.

    To ensure all laws and rules are met prior to issuing licenses and to allow land owners within

    specified distances of CAFOs to request hearings and present evidence for denial of licensure.

    Consequently, citizens' rights are heard and Oklahoma's waters and environment are protected from

    possible animal waste contamination.

    GOALS: 1) To assure a proper balance is maintained between the need for production agriculture to

    exist and the need to protect Oklahoma waters and environment from possible pollution from animal

    wastes. 2) Conduct complaint/discharge investigations on animal feeding and poultry operations.

    Complete and file investigative reports. Conduct follow-up investigations on animal feeding and

    poultry operations. Complete and file investigative reports. Levy fines when violations occur. 3)

    Perform National Pollutant Discharge Elimination System (NPDES) unannounced annual inspections of alllicensed CAFO/LMFOs. 4) Perform annual inspections of all poultry operations and provide technical

    assistance and outreach education on feeding operations and laws and rules dealing with animal wastes.

    5) To conduct soil and/or water sampling when required to complete an investigation of

    complaint/discharge or of an inspection. 6) To collect and test samples from all Licensed Managed

    Feeding Operations (LMFO) monitoring wells, evaluate the test results and assure that the LMFOs are in

    compliance with all statutes and rules. 7) To collect LMFO animal unit fees and CAFO license renewal

    fees annually by July 1. 8) To register all poultry feeding operations annually by December 31.

    9) To conduct CAFO pre-site inspections, carcass disposal inspections, inspections during and after

    construction and provide technical assistance. 10) Enforce the poultry waste applicator regulations.

    11) Technically review LMFO/CAFO applications for completeness and accuracy according to the statutes

    The following staff reductions/eliminations were required for FY 12 budget due to state-mandated cuts:

    Environmental Programs Manager III position eliminated; Administrative Assistant II - position not

    being refilled; Environmental Specialist position was eliminated; Hydrologist Soil Scientist - $36,250

    less; two Soil Scientist positions were eliminated from state-funded positions; N Aldridge - $59,112

    less. Additionally, FY 12staff reductions included: Professional Engineer - $36,000 less; two Soil

    Scientists - $53,000 less and a secretary's position was not filled - $36,498 less. From FY 06

    through FY 11, the AEMS Division reducted five techincal staff contracts due to reduced funding.

    Those reduced contracts totaled $155, 476 and were as follows: Ed Abernathy - $27,000 less; R.C.

    Brinless - $26,000 less; H.J. Thung - $36,000 reduction and position not filled; Jim Shirazi - $46,260

    less; Harold Springer - $20,226 less; and Danny Hodges - position eliminated. Senate Bill 965

    appropriated $115,000 to ODAFF AEMS to write Animal Waste Management Plants (AWMP) for poultry growers

    in FY 2001. Consequently, two part-time soil scientists and two AWMP assessors were hired under

    contract to compose and assess AWMPs. The AWMPs will assist in protecting Oklahoma's waters from

    excessive poultry waste runoff and are required by the Poultry Act. The 2002 Legislature did not

    approve this funding, but AEMS maintained contracts with these two soil scientists until June 30,

    2003. These two part-time contracted soil scientists wrote 264 AWMP's in eighteen months. These

    part-time soil scientist's contracts were renewed again on July 1, 2004 and they have written an

    additional 614 plans. The legislature did not appropriate funding for these two critical positions

    for FY 2011 AND FY2012.

    In 1993, the Oklahoma Legislature passed the Oklahoma Pollutant Discharge Elimination System

    Act authorizing the Oklahoma Department of Environmental Quality (ODEQ) to seek delegation from

    the Environmental Protection Agency (EPA) to administer the National Pollutant Discharge

    Elimination System (NPDES) for all point and non-point source discharges within its

    environmental jurisdiction. The next year, the Oklahoma legislature passed 27A O.S. Section 1-

    3-102 that directs the Department of Agriculture to seek this delegation from EPA to administer

    any and all of the NPDES programs for agricultural point and non-point source discharges. With

    the creation of the Oklahoma Agriculture Pollutant Discharge Elimination System Act approved in

    House Bill 1467 in 2005, ODAFF took a necessary step in the process toward receiving this

    delegation.

    With the NPDES delegation status, ODAFF would be the agency named to implement and enforce the

    federal Clean Water Act for Concentrated Animal Feeding Operations (CAFOs) wastewater

    discharges. ODAFF would then enforce both EPA's federal standards and Oklahoma's laws and

    rules for CAFOS. The 2009 Oklahoma Legislature appropriated funding to ODAFF, AEMS for the

    start-up of the EPA NPDES Delegation Program.

    The purpose includes state autonomy. The ODAFF will regulate wastewater discharges from CAFOS

    and egg washing, and storm water discharges for forestry silviculture, pesticide application,

    etc. for the federal government and for the state. There are 275 licensed CAFO's, with 138 of

    these possessing CAFO permits with EPA. It is estimated that more CAFOs may need EPA permits,

    The negative impact of not having an ODAFF AEMS Division would be no effective enforcement of

    regulations of animals, CAFOs or LMFOs or poultry operations. This could result in polluted water with

    an increase of disease in humans and animals and a resulting loss of recreation areas. No program =

    increased pollution of waters from animal and poultry waste. Also, the statutes would not be enforced.

    The ODAFF, AEMS Division has assessed $1,085,808 (one million dollars plus) in fines to animal and

    poultry operations for compliance violations.

    The ODAFF, AEMS Division is required by the Statutes to annually investigate and lab analyze samples

    substantial increases of nitrate-nitrogen and electrical conductivity to ODAFF that included their

    proposals to make assessments and evaluations of causative affects. Some of the multi-year submitted

    evaluation plan, included, but are not limited to the following: Static water level measuring; isotopic

    analysis; potentiometer surface mapping; site specific hydrologic reporting; utilization of a

    resistivity imaging system; N-15 ratios of dissolved ions, trace elements, organic compounds and fecal

    coliform; bacteria ribotyping; micorbial strain tracing using phenotypic micro-array technology;

    fingerprinting using Trilinear and Stiff diagrams; Box and Whiskers plots using Sanitas WQ Stat Plus;

    evaluations of antecedent land use; direct push technique ground water investigations and numerousadditional remediation actions have been required. This is part of enforcement and NPDES Delegation.

    New cooperative agreements with USDA-APHIS VS have been initiated. Surveillance has begun with our

    licensed aquaculture operations. Restaurants, cafeterias, and schools are being contacted about food

    waste for swine feeding. The National Animal Identification System (NAIS) project is fully functional

    and currently registering premises. We currently have three Avian Influenza cooperative agreements.

    All are called "Notifiable AI" NPIP; Live Bird Market (LBM); Upland Game Bird. There has been an

    increase in Swine Health Plan inspections, Scrapie Inspections, and individual Ewe genotyping.

    Incident command system training is ongoing project, after successful completion five ICS 420 Commandand General Staff courses; the state of Oklahoma now boosts two additional Type 2 USDA certified

    incident response teams. The Farm Cervidae act was enacted by the 2006 State Legislative session. This

    act gave the Department of Agriculture direct oversight of Farmed Cervidae. The Feral Swine Control Act

    was enacted in 2007 State Legislative session. This Act gave ODAFF direct oversite of feral swine

    control.

    contracts, grants and cooperative agreements. CPS has a contract with the FDA to inspect 150

    animal feed manufacturing facilities for compliance with federal regulations regarding ruminant

    animal feed; 49 County of Origin Labeling Inspections; a grant with EPA for pesticide applicator

    training, certification & enforcement, pollution prevention programs, surface water and groundwater

    protection; cooperative agreements with USDA for insect pest and plant disease survey work.

    During FY11 we filled 2 positions left vacant by employees that left the agency and did not fill 2

    vacancies because of anticipated budget cuts. The Africanized Bee (otherwise known as Killer Bee) in

    Oklahoma continues to be an unfunded program and requires four employees part time in order to help

    control this pest for public safety. The Musk Thistle program remains unfunded by the legislature even

    though there are increasing consumer complaints, 15 in FY11, to be investigated and resolved by

    pesticide inspectors. Information regarding Musk Thistle control is mailed to landowners with thistle

    problems. The CPS overall revenue budget for FY-11 exceeded our projections by $622,562.00. The

    divisions appropriated budget was cut by 4% or $39,398.00 for FY2012.

    Dairy is responsible for inspecting milk and milk by-products from the farm through all phases of

    production and for supervising sanitary practices in each phase of the process, also permitting of

    facilities involved in milk and milk product production and the sampling of milk and milk products as

    well as the water supplies and captive water systems utilized by the dairy industry. Determinations

    are made to assure only safe and wholesome unadulterated products that meet regulatory requirements

    are available to the consumers. Provide consultation and advise dairy farmers, plant personnel and

    the industry in general regarding construction standards, materials, and compliance with federal and

    state regulations. Provide input on proposed changes in existing regulations to assure the state and

    dairy industry are represented. Ratings are performed on listed producers and processors enabling

    them to market their products interstate.

    of the budget reductions in the Food Safety Division have been absorbed by the Meat Inspection

    Section.

    Meat and poultry inspection provides continuous oversight of meat and poultry plants in the state by

    performing antemortem inspection of all animals before they are slaughtered and in-depth postmortem

    inspection on every animal slaughtered. Palpation, observation and incision of internal organs and

    other carcass parts are used to eliminate any harmful pathogenic contaminated meat from being

    processed and entering food channels. During processing all operations are observed and various

    laboratory samples are taken to assure compliance with product standards, and to detect any harmful

    biological or chemical residues. Finally, all product labels are checked for accuracy and that each

    label truthfully identifies all ingredients used during formulation to prevent adulteration andconsumer fraud. The compliance program extends regulatory functions carried out in inspected

    slaughter and processing plants to the meat and poultry allied industries. Prevention, detection, and

    resolution of violations of meat and poultry inspection laws are primary objectives of compliance.
