New Patient Consent to Receive Psychotropic Medications for TCU

NEW Patient Consent to Receive Psychotropic Medications for theTorrance Memorial Medical Center Transitional Care Unit (TCU)

This form is in accordance with Title 22 CCR section 72528. The following changes are a requirement from the recent October 2016 Department of Health and Human Services/CMS Licensing Survey.

The form is now 2 pages, with the first page being the same verbiage as the previous consent forms.

The second page lists the medications in a table format with the additions of "Indication" and "Clinical Manifestations".

All sections are required to be completed.

As with the previous form - the physician, patient, and witness must sign prior to admission to TCU. Any doses of a psychotropic medication given without a completed consent are in violation of Title 22 section 72528. Exceptions are only allowed in emergency situations with documentation that it was medically necessary.

Situation: In 2016, TMMC had 27 CAUTIs. Background: CAUTIs are a hospital-acquired patient harm event and are COMPLETELY preventable. EBP guidelines have helped other facilities achieve ZERO CAUTIs. Recommendation: Follow EBP guidelines & TMMC Policy & Procedures to reduce CAUTIs

INDICATIONS FOR INDWELLING CATHETER:

1. Chronic history of indwelling catheter 2. Neurogenic bladder 3. Actively titrating vasoactive medications 4. Stage III, IV or unstageable sacral pressure ulcer AND

incontinence 5. Acute urinary retention or obstruction 6. End of life care 7. Patient undergoing urological surgery 8. Obstetric regional anesthesia (NEW!) 9. Patient requires complete

immobilization 10.Immobilized pre-surgery with

Protecting PHI FAQ

QUESTION: Is it a HIPAA violation / privacy breach of unauthorized use or disclosure of Protected Health Information (PHI) if: 1. A patient, family member or visitor overhears hospital staff members discussing patient PHI in public areas such as the cafeteria, hallways, elevators, parking areas? Answer: Yes, this is a HIPAA violation / patient privacy beach. 2. A staff member obtains patient PHI from another staff member or from viewing or accessing the patient record for personal

reasons and then discloses the patient PHI to others. Answer: Yes, this is a HIPAA violation / patient privacy breach. 3. A patient, family member or visitor overhears a conversation between hospital staff members and the patient and / or family

member, in which patient PHI is being discussed? Answer: No, this is not considered a HIPAA violation with the condition that staff has adhered to reasonable safeguards

in protecting the privacy and confidentiality of the patient. 4. A patient, family member or visitor overhears hospital staff members discussing patient information during unit rounds or shift

change? Answer: No, this is not considered a HIPAA violation. In the event unit rounds or shift change is taking place in the patient room, be sure to ask visitors (family members, etc.) to step out prior to discussing patient PHI.

5. The Nursing Unit electronic “white” boards display a partial patient name? Answer: No, the electronic boards on the units are only used for health care operations. Our staff utilizes the tracking boards

to communicate important information relating to patient care. To protect patient PHI, the boards do not display the full name of patients and only display partial names of patients requesting to be a confidential. The boards do not display the patient age, medical information, procedures or the diagnosis of the patient.

Preventing HIPAA Privacy Violations & Breaches

The following is a list of tips to safeguard and help prevent a HIPAA violation. Everyone is responsible in the prevention of a HIPAA Privacy violation / breach. 1. Keep documents, forms, papers, etc. with Protected Health Information (PHI) face down or covered. Do not leave anything

with PHI visible or unprotected. Unauthorized individuals, patients, family members, visitors and vendors walk throughout our hospital on a daily basis, leaving anything with PHI visible or in public areas (Café, Gift Shop, Restroom, etc.) is a risk and a potential HIPAA Privacy violation and reportable breach.

2. Dispose of documents, labels, notes, reports, wrist bands and anything else containing PHI in shredding bins. Never place

items with PHI in a trash can. If you cannot peel off labels from IV bottles, use a permanent marker to black out the patient information.

3. When your job responsibilities include carrying patient documents (with PHI) within or outside the hospital you should protect

the PHI by placing documents in an envelope or sealed container if taking them outside of hospital / office. 4. Select the correct printer when printing patient results / charts from Power Chart or any other electronic medical record

applications. When selecting your printer queue, be sure you have selected the printer in your area / department. Printing to the wrong printer can result in a HIPAA violation of “carelessness” and a California Law violation. 5. Do not share, discuss, disclose, email, text or post any patient information or use personal electronic devices to take, post or

share photographs of patients with anyone or on social networking sites.
