Documents Reviewed: 100% Design Plans (32 pages) - submitted by Town of Cary, received electronically on May 15, 2017 (“100% Plan Submittal”)

Dear Mr. Shultes:

Arcadis has performed a review of the above preliminary engineering submittal materials to determine the project’s compliance with CSXT requirements and impact to railroad operations. We take no exceptions to these plans but offer the below comments and information.

1. The directional bore for the proposed traffic signal conduit under CSXT was

approved by CSXT Real Property, Inc. on 2/27/17.

2. A draft construction agreement was provided to you for advanced review. A revised copy that includes the approved FAE and revised Pre-emption language in Section 24.1 is included with this letter. Please note CSXT does not approve the addition of the proposed language in Section 11, as indicated on 4/26/17.

No work may be performed within CSXT right-of-way until the below items have been completed, received, and performed.

• The Construction Agreement has been fully executed and advance payment received,

• CSXT has been authorized in writing to support construction activities, • CSXT participates in a preconstruction or onsite “kick-off” meeting, • Contractor insurance is approved by CSXT, • A detailed construction schedule is received by CSXT, along with receipt of regular updates, • Railroad flagging protection has been scheduled and arranged for work within CSXT right-of-way.
