SUbject: - Proposal for diversion of 0.99 ha of forest land in favour of Director Educatibn(HigherO Deptt., Agartala for setting up of Govt. Degree College at' TeliamJraunder District Forest Officer, Khowai _ I

. Pursuant to the Final approval issued by the Ministry of Environment and Forests,Regl?nal Of~cer, Sh~llong vide letter No.3- TRB 040/2011-SHII2194-95 dated 12.09.20/19and In complIance. with the order of the Hon'ble National Green Tribunal vide letter dafed24.07.2013, I am directed to state that after due consideration, the State Govt. approves handingove: of 0.99 ha of forest land in favour of Director, Education (Higher Deptt., Agartala r.orsetnng up of Govt. Degree College at Teliamura under District Forest Officer, Khowai in theState ofTripura with the following conditions:-

Item No-S- No labour camp shall be established on the forest land . IItem No-6- Sufficient firewood, preferably the alternative fuel, shall be provided b1' the

user agency to the labourer after purchasing same from the State FprestDepartment or the Forest Development Corporation or any other legal sourceof alternative fuel. . I

Item No-7- The boundary of the diverted forest land shall be SUItably demar~a:,~ onground at the project cost, as per the directions of the concerned DIVI~IOnal

Item No-13 _ The proposal will be implemented under the overall supervision of the

concerned Divisional Forest Officer.Item No-14 _ The land so diverted shall revert back to the forest Department in case it is not

needed for the above use after due restoration to its original status (as far as

possible and to the satisfaction of State forest Department)Item No-15- Violation of any of this conditions will amount to violation of Forest

(conservation) Act, 1980 and action would be taken as per the MoEF & CCguidelines F.No.11-42/2017-FC dated 29.01.2018, No.S-S/86-FC dated07.12.1999 and No. 2_1_51/2004/RONE/Vol-II13181-02 dated 28.12.2006.

Item No-16- This approval may be revoked if the above conditions of approval are notcomplied to the satisfaction of the North Eastern Regional Office, Shillong.

Item No-17- Any other conditions that North Eastern Regional Office, Ministry ofEnvironment, Forest & Climate Change may .stipulate from time to time inthe. interest of conservation, protection, and development of forests Scwildlife.

Copies of the Forest,,(;leanmce and this order should be ..submitted .to all head of localbodies, Panchayats and Municipal bodies etc. .for wide publicity.The District Forest Officer, Khowai is also requested to submit the monitoring report timeto time to the Nodal Officer, FCA ensuring compliance of all conditions.The handing over and taking over certificate is to be submitted to the Nodal Officer, FCAalong with GPS reading and polygon over the diverted land.

In this connection and on the basis of the compliance report furnished ~y the State

Government vide letter F.6-834/FC/For-l0/242-44 .dated 29.0.5.2019 and confirmation of Ad-hoc

CAMPA vide letter No. 1-32/20 14..CAMPA dated 08.08.2019 of compensatory levies amount, FinalI

Approval of the Central Government is hereby granted under Section-2 of the Forest (Sonservation)I

Act 1980 for diversion of 0.99 ha (2.45 acres) forest land in favour of Director, Education (Higher), I

Deptt., Agarta.la for setting up of Govt. Degree College at Teliamura under Telifmura Forest

Division subject to the following conditions:

1) Legal status of the forest land shall remain unchanged.

The compensatory afforestation shall be taken up by the Forest Department over 0.99 ha -2)non-forest land identified at Teliamura range of Teliamura Forest Division of WestTripura District at the cost of the user agency. As far as possible, a mixture of local

indigenous species shall be planted and monoculture of any species may be avoided ..

3) The user Agency shall obtain Environmental Clearance as per the provisions of the

Enviromnental (Protection) Act, 1986, if applicable.

4) The layout plan of the proposal shall not be changed without prior approval of Central

Government.

5) No labour camp shall be established on the forest land.

6) . Sufficient firewood, preferably the alternate" fuel, shall be provided by the User Agency

9) The forest land shall not be used for any purpose other than that specified in the project

proposal.

10) The User Agency and the State Government shall ensure compliance of all the COUlt

orders, provisions, rules, regulations and guidelines for the time being in force as

applicable to the project.

11) The forest land proposed to be diverted shall under no circumstances be transferred to"

any other agencies, department or person without prior approval of Govt. of India.

12) The User Agency shall take all possible precautions & care all the time not to impact

adversely the surrounding forests and forest land by their actions/activities.

13) The proposal will be implemented under the overall supervision of the concerned

Divisional Forest Officer.

14) The land so diverted shall revert back to the Forest Department in case it is not needed

for the above use after due restoration to its original status (as far as possible and to the

satisfaction of state Forest Deptt.).

15)Violation of any of these conditions will amount to violation of Forest (Conservation)

Act, 1980 and action would be taken as per the MoEF&CC letter F. No. 11-42/2017-FC

dt 29/0 1i20 18, No 5-5/86/FC dated 07.12.1999 and No 2-1-51/2004/RONENol II13181-02 dated 28.12.2006.

16)This approval may be revoked if the above conditions of approval are no complied to

the satisfaction of the North Eastern Regional Office, Shillong.

17)Any other condition that the Ministry of Environment, Forests & Climate Change may

stipulate from time to time in the interest of conservation, protection and de elopment offorests & wildlife.

This has the approval of Deputy Director General of Forests (Central).
