The Admissions Policy (E1) and Recognition of Prior Learning (RPL) Policy (E4) is available for viewing electronically on the student and staff interactive platform (ECI). Admission to Embury’s qualifications are subject to the following requirements:

HIGHER CERTIFICATE IN PRE-SCHOOL EDUCATION1-year Certificate (NQF 5) | 126 credits | Mode of delivery: Contact ModeMINIMUM ADMISSION REQUIREMENTSMatric obtained from 2008 onwards: • National Senior Certificate or NQF Level 4 National Certificate (Vocational) with an endorsement for entry into Higher Education studies or higher. • Minimum rating of 3 (40 – 49%) in 4 subjects from the designated list. • Minimum rating of 3 (40 – 49%) for English Home Language or a minimum of 4 (50 – 59%) for English at First Additional Language. | Matric obtained prior to 2008: • Senior Certificate with minimumof 50% for English.

Postgraduate Certificate in Education (PGCE) or a former Higher Diploma in Education (postgraduate). • A former Advanced Certificate in Education (Level 6 on the former 8-level

NQF) or a former Further Diploma in Education which follows a former professional teaching qualification or a former four-year Higher Diploma in Education; or • A new Advanced Certificate

(Level 6 on the current 10-level NQF) which followed a former Diploma in Education(including a National Professional Diploma in Education).

8.1 Admission procedure

Candidates that want to apply for Embury’s programmes need to followthe admission procedure outlined in the Admission Policy (E1).

Candidates should:8.1.1 All applicants must complete an Application Form and submit the form together with either their Grade 11, Grade 12 mid-term or Trial Results. Application Forms, course information and fee schedules can be obtained from the Student Recruitment Department or the website at: www.embury.ac.za8.1.2 Successful applicants are provisionally accepted on the basis of qualifications or requirements yet to be completed. Any student receiving provisional acceptance will also receive an Enrolment Contract, which provide further information about the terms and conditions once the applicant has accepted Embury’s offer. The Enrolment Contract is attached as an addendum. Final acceptance only takes place once the NSC Statement of Results becomes available.8.1.3 Applicants who have completed Grade 12 and are already in possession of a matric certificate will be accepted provided that they meet all admission and institutional requirements.

8.2 Recognition of prior learning

The Recognition of Prior Learning Policy (E4) is available for candidates seeking alternative methods of application.

General guidelines:8.2.1 Embury will apply the process of Recognition of Prior Learning (RPL) for access to a qualification or module.8.2.2 Embury recognises forms of prior learning and experience as equivalent to the prescribed formal minimum admission requirements or the award of advanced standing in particular programmes through exemption from modules.8.2.3 Applicants who do not hold a National Senior Certificate (NSC) with the appropriate exemption may be considered for access via the RPL route. The RPL application will be evaluated against the entry requirements of the qualification in question.8.2.4 Applicants who have prior learning and experience may be considered for award of advanced standing in particular programmes through exemption from modules at lower levels of the qualification programme. The RPL application will be considered against the module content, learning outcomes and assessment of specific modules and the overall programme outcome.8.2.5 The institution will not grant an individual exemption for more than 50% of the modules/ courses required for any particular qualification. A person must obtain 50% of the credits at Embury for a qualification that is awarded by Embury.8.2.6 The same set of prior knowledge may not be used for obtaining more than one qualification.8.2.7 Credits are not awarded for modules that are exempted in terms of the RPL process and the total number of credits will be less than the minimum number of credits required for the award of the qualification.

8.2.8 A student who, on the basis of RPL, is granted exemption from doing some modules or courses in a qualification programme will complete the qualification with a total number of credits that is less than the normally required number of credits for the qualification in question. RPL creates such an exception, and the student concerned should not be compelled to do more modules or courses to make up for the difference in the total number of credits.8.2.9 On successful completion of the programme and award of the qualification the official certificate will be awarded. The academic transcripts of those who were exempted from some modules will reflect exemptions achieved through the RPL process, but with no credit points attached.8.2.10 Not more than 10% of a cohort of students in a programme will be admitted through the RPL process.8.2.11 The assessment criteria for RPL will include the knowledge and skills gained in practices outside the higher education institution in terms of their value for the particular programme and/or modules.8.2.12 The relevant academic department will be responsible for setting the assessment criteria and assessing the learning achieved by RPL.

RPL Approval Process8.3.1 Students applying for access via RPL will have to undergo an assessment of prior learning as follows: 8.3.1.1 An RPL panel of assessors will be constituted by the Academic Board and chaired by the Head of the Faculty of Education. It will consist of the Head of the Faculty, the Head of Curriculum and Programme Development, the relevant Head of Programme and the relevant Head of Department. 8.3.1.2 The Head of the Faculty of Education will table the application at the Academic Board. Applications for RPL will considered by the Board and a decision made about the student’s admission to a programme and exemption from modules. 8.3.1.3 The Student Support Services Department will communicate the decision of the Academic Board to the applicant. 8.3.1.4 Applicants have a right to appeal the decision of the Academic Board. A letter of appeal and supporting evidence must be provided to the Student Support Services Department. The Student Support Services Department will table the application for appeal for consideration at the Academic Board. The decision of the Academic Board is final.

English is the medium of business, instruction and administration at Embury, unless the module is a non-English Home or Additional Language module. The language modules offered in Embury teacher qualifications are informed by government policy outlined in the Minimum Requirements for Teacher Education Qualifications (MRTEQ) (19 February 2015 Government Gazette No. 38487). 12. ACCREDITATION STATUS OF EACH REGISTERED PROGRAMME

All Embury programmes, as outlined in Point 11 (Details of Each Registered Programme) are accredited with the Council on Higher Education (CHE) and registered with the Departmentof Higher Education and Training (DHET) and with the South African Qualification Authority(SAQA) on the National Qualifications Framework (NQF).

13. RULES RELATING TO ASSESSMENT, ACADEMIC CREDIT ACCUMULATION AND TRANSFER, PROGRESSION AND QUALIFICATION

13.1 Assessment

Every Embury module has a clearly defined assessment strategy and assessment weighting method per mode of delivery. Embury uses both continuous assessment (CASS) – also referred to as formative assessment – and summative assessment to assess student competence. Certain Embury modules may have CASS and summative assessment in place, while others may use only CASS.

Formative and Summative Assessment:13.1.1 Formative assessment tasks take place to provide feedback to the students and lecturer during the teaching and learning process regarding the student’s progress. The formative assessment tasks do not contribute towards the final module assessment mark. 13.1.2 Summative assessment tasks take place at the end of a period of learning and measures student achievement. The summative marks contribute towards the final module assessment mark, for example, formal tests, assignments, presentations, portfolios, research projects, class tasks etc. Class tasks are activities that take place during the lecture that are assessed and count toward the DP Mark or final CASS mark, for example presentations.

13.2 Exemption from class tasks/tests/ exams/handing in of assignments

13.2.1 Students may apply to be exempted from writing a test or participating in a scheduled assessment due to the following: • medical reasons. • death of an immediate family member (parent, spouse, child, grandparent). • religious reasons. • representing the country or province in arts and culture or sport. • extraordinary circumstances.

13.2.2 Students must complete an application for exemption from the assessment (EIHE 012) which can be obtained from the Student Support Services Department. Based on the reason for the application the following will apply: 13.2.2.1 Medical reasons The student must submit the application together with a copy of the medical certificate within three working days of the termination period indicated on the medical certificate to the Student Support Services department. This may be done via email. 13.2.2.2 Death of an immediate family member The student must submit the application within 3 working days of the death of the family member. The application form must be submitted together with a certified copy of the death certificate. If the death certificate is not available at the point in time, the student may submit the death certificate within 3 working days of the date of issue on the death certificate. This may be done via email. 13.2.2.3 Religious reasons The application form may be submitted within three working days of the release of the assessment timetable. The student must provide an explanation on the form of the type of religious observe that he or she will be participating in. This may be done via email. In the case that this is submitted via email. 13.2.2.4 Representing the country or province in arts and culture or sport The application form may be submitted within 3 working days of the release of the assessment timetable. The student must provide an explanation on the form of the type of activity that he or she will be that he or she is participating in and must attached a letter confirming participation in such activity from the team coach. This may be done via email. 13.2.2.5 Extraordinary circumstances The application form may be submitted within three working days of the extraordinary circumstance occurring. The student must provide an explanation of the nature of the extraordinary circumstances and must provide supporting documents e.g. Police reports. This may be done via email.

13.2.3 Students who are granted permission to be exempted from a test or examination are granted permission with the understanding that they will be afforded an opportunity to write the test for which the exemption was granted during the next scheduled re- test day, and the lost opportunity for the primary exam for which exemption was granted, during the scheduled supplementary exam date. Module specific rules may apply with regard to re-tests.13.2.4 No further assessment opportunity will be granted after the re-test or supplementary exam has been written.13.2.5 No student may be exempted from any formal pre-set assessment periods based on reasons other than stated in this policy.13.2.6 Students who do not comply with the provisions set out in the assessment policy will be deemed to be absent without permission, and will, therefore, not be eligible for assessment on an alternative date.13.2.7 All students who qualify for a supplementary exam or re-test and choose to sit for this exam or re-test will be subject to an examination fee per module which is communicated via the Finance Department.

13.3 Admission to Primary Examination

13.3.1 The Duly Performed (DP) mark indicates that students have successfully completed the coursework and minimum attendance requirements of a module (if any, as per study letter), and may write the examination.13.3.2 Embury uses the marks achieved in tests and assignments (and lecture attendance in certain modules, as per the module study letter) to determine if a student has obtained a DP mark.13.3.3 Students have to obtain the minimum DP mark as indicated in the module study letter or assessment guide to gain entrance to the final examination.13.3.4 Students must present their DP Results at the entrance of the venue where the final examinations will be written in order to be allow entry. DP results are accessible from MyEmbury.

13.4 Eligibility for Primary Examination

13.4.1 Primary exam refers to the formal written 1st and 2nd Semester examinations conducted during any given academic year.13.4.2 Admission to the primary examination is dependent on obtaining the minimum DP mark for the module as indicated in the study letter.

13.5 Special concessions

Should a student other than those identified at registration request a special concession for tests and examinations such as extra time to write, the student must obtain and submit an Application for Special Concession (EIHE 013) to the Student Support Services Department. This application will be sent to the counselling department for a recommendation. The counselling department will make a recommendation to the Head of Quality Assurance. The Head of Quality Assurance makes a recommendation to the Assessment Office. The student is issued with a concession letter and captured onto the concession schedule by the Assessment Office.

13.6 Cheating in an Examination or Test

13.6.1 The scripts of students suspected of cheating or caught cheating will be confiscated by the invigilator. The student will be issued a new script and must continue from the last question that was answered.13.6.2 Disciplinary action will follow where a test or examination script has been confiscated by the senior invigilator.13.6.3 The Disciplinary Committee will consist of the following members at main campus: • Head: Assessment Office; • Head Quality Assurance; • Dean of the Faculty of Education; • Lecturer; • A counselling representative; and • Co-opted Members: i. Deputy Dean: Academics Gauteng; and ii. Academic Managers.13.6.4 The disciplinary committee will make a recommendation to the Chief Operating Officer with regard to the punishment that will be handed to the student. Punishment will be based on the severity of the offence and the history of the offender.13.6.5 The punishment measures are as follows: • Award a zero mark for the assessment; • First Written Warning; • Second Written Warning; • Final Warning; • Suspension; and • Expulsion.

13.7.2 The results of the supplementary exams will be calculated as follows:

Academic reasons: 13.7.2.1 If a student qualifies to write the supplementary exam (has a final mark between 40 and 49%), then the student will write the supplementary exam with the same DP as the primary exam. The final mark will be the combined average of the DP and the supplementary exam marks. 13.7.2.2 In the event that the student still fails the module after the supplementary exam has been written, the combined average mark obtained for the supplementary exam will apply, regardless if it is less than the original mark before the supplementary exam. Medical or compassionate reasons: 13.7.2.3 Should a student have missed the opportunity to write the primary exam for medical or compassionate reasons, then the supplementary exam result will serve as the only primary result, together with the DP mark in order to calculate a final mark (average of DP plus supplementary exam). 13.7.2.4 No further assessment opportunities will be afforded to the student. 13.7.2.5 No appeals for a supplementary examination based on medical and compassionate reasons will be accepted after a student has written the primary exam.

13.7 Supplementary Examinations

13.7.1 The term supplementary exam refers to an additional examination of equivalent duration, academic rigour, and content assessed during the primary exam. Embury may grant supplementary exams based on the following grounds:

REASONS SCOPE

Academic The student’s final result (DP + exam average) is within the 40-49% range, as well as achieving a sub-minimum of 30% in the primaryexam sitting.

Medical An illness or injury prevents a student attending an examination,or significantly impairs their exam preparation.

Compassionate Exceptional personal circumstances prevent a student attending an examination, or significantly impair their preparation for an exam.

13.8 Special Examinations

13.8.1 The term ‘special exam’ refers to a further opportunity for a student to write the exam. A special exam is a privilege and is awarded at the discretion of the Academic Board. A student will be considered to write the special examination should the student be a final year student that has one module outstanding in which the student has attempted and failed the final and/or supplementary examination with a mark between the 40 - 49 range that is preventing the student from graduating. Module specific requirements may apply with regard to special examinations.13.8.2 Embury may grant a special examination on the following grounds:

13.9 Progression

13.9.1 If a student fails a year of study, or chooses not to progress to the following year of study, and returns to repeat the failed modules, the student may be granted permission to register for modules from the following year of study provided the student takes a maximum of six modules in total for the year of study.13.9.2 A student who has failed five or more modules may not take any modules from the following year of study.

13.10 Pass Cum Laude and Summa Cum Laude

A student registered for the Embury degree qualifications and who passes the programme with an average mark

of 75% or above, will be deemed to have passed the programme Cum Laude. A student who passes each

module in the Embury degree qualifications (including Teaching Practice) with a mark of 75% or above, will be

deemed to have passed the Degree Summa Cum Laude. This status will be awarded for

degree qualifications completed withinthe minimum required duration.

REASONS SCOPE

Last course The student has failed (combined CASS and/or Examination average between 40-49%) in only one module that could complete his or her qualification.

Compassionate Exceptional personal circumstances prevents a student sitting for both the primary and supplementary examination, or significantly impairs their preparation for an examination. This is at the discretion of the Academic Board.

13.11 Credit Accumulation and Transfer (CAT)

13.11.1 The institution will facilitate the articulation of an applicant or existing student between programmes and/or institutions though it’s Credit Accumulation and Transfer process.13.11.2 Applicants may apply for credit transfer for courses/modules that they have completed at Embury or another institution.13.11.3 A maximum of 50% of the credits of a completed qualification may be transferred to another qualification.13.11.4 At least 50% of the credits of any qualification awarded by Embury must be completed at Embury.13.11.5 Embury students may apply for credit transfer for an incomplete qualification offered by Embury towards another programme.13.11.6 Applicants may apply for credit transfer for an incomplete qualification offered by another institution towards the same or a different qualification at Embury.13.11.7 Credits cannot be transferred to more than one qualification.13.11.8 Decisions on the transfer of credits is made on the comparability of module content, outcomes and assessment criteria.13.11.9 Credits may be granted for students who have studied in an international exchange programme with a partner institution.13.11.10 Current students who wish to take modules/ credits at another institution to be credited towards a programme at Embury must apply to do so and require approval from both institutions.13.11.11 Credits granted for study at another institution will be identified on the student academic record.13.11.12 Short courses which are non-credit bearing will not qualify for CAT. The learning acquired will be evaluated under the Embury Recognition of Prior Learning Policy.

13.12 Credit Accumulation and Transfer (CAT) application and approval process

13.12.1 At the time of application to the institution the applicant must complete the form for Credit Accumulation and Transfer (EITE009) which can be obtained from and returned to the Student Support Services Department. In addition, the applicant must supply an academic record and the official module/course curriculum outline for each module/ course in order for Embury to identify areas of the curriculum for which credits may be awarded. The relevant administrative fee must be paid.13.12.2 The Student Support Services Department will forward the application to the Head of the Faculty of Education who will provide the documentation to the relevant Head of Department(s). The HOD(s) and the relevant Head of Programme (HOP) will evaluate the application and provide a written recommendation with supporting evidence to the Head of the Faculty.13.12.3 The Head of the Faculty of Education will table the application at the Academic Board Committee meeting. Applications for CAT will considered by the Academic Board and a decision made about granting credits to the student.13.12.4 Student Support Department will communicate the decision of the Academic Committee to the applicant.13.12.5 Applicants have a right to appeal the decision of the Academic Committee. A letter of appeal and supporting evidence must be provided to the Student Support Department. Student Support will table the application for appeal for consideration at Academic Board. The decision of the Academic Board is final.

13.13 Progression and Certification

13.13.1 If a student fails a year, or chooses not to progress to the following year of study, and returns to repeat the failed modules, the student may be granted permission to register for modules from the following year of study provided the student: Takes a maximum of six modules in total.13.13.2 A student who has failed six or more modules may not take any modules from the following year of study.13.13.3 Students who require to pass only one outstanding module in order to complete a qualification may be afforded a final special examination opportunity.13.13.4 In order to gain admission to the examination for any module that a student is repeating, the following applies:

• The student must comply with all practical or written assignments, as well as test requirements for a particular module.

• Where class work is required, students who are repeating a module will be required to complete all class work assessments. The DP mark will be calculated based on the sum total of compulsory assignments, tests and class assessments that were conducted for the particular module. The ratification of student results and awarding of Higher Certificates, Diplomas and Degrees are subject to the following policy procedures:• All results will be ratified by the

assessment Board after they have been checked by the Dean of the Faculty of Education in collaboration with the Student Information Management System (SIMS) Manager in order to verify compliance with the full requirements for graduation; and

• No certificate will be issued to a student who has not obtained a module aggregate of 50% per module for the full programme that they enrolled for asregistered with SAQA.

13.13.5 Verification of results will be subject to the results schedule having been signed by the Dean Faculty of Education and Head of Programme, directly involved in the verification process.13.13.6 On receipt of the verified results, the Head of Student Support Services will liaise with the outsourced printers for all certificates to be printed.13.13.7 The completed qualification certificates will then be checked for correctness by the Dean of the Faculty of Education after which they will be validated by the Chief Operating Officer by means of an original signature.

14. FEES AND CHARGES INCLUDING REFUND(S) IN THE EVENT OF CANCELLATION OR WITHDRAWAL

If a student leaves Embury before his or her programme has ended in any particular academic year, the student must officially deregister from Embury. The following deregistration process must be followed:

1. The student must notify the Student Support Services Department in writing of his/her intention to de-register from Embury.2. A de-registration form will be forwarded to the finance department for processing of any outstanding fees and/or library books before being issued to the student.3. The Student Support Services Department will then issue the completed and signed deregistration form to the student which must be completed and signed by the student and all parties to the contracts as indicated on the de-registration form. Faxed or electronic copies of the de-registration form will not be accepted.4. The date on which the properly completed and signed de-registration form is received by the Student Support Services Department will be regarded as the start date of the de- registration process. De-registration will only be finalised once the completed and signed de-registration form has been submitted to the Student Support Services Department and all outstanding fees have been settled in full.5. Only students who have paid fees in advance for the academic year, may be entitled to a refund of part of the tuition fees as per conditions stipulated in the Enrolment Contract.6. All refunds due will be paid within 31 days of the finalisation of the de-registration process.7. Any disputes regarding payments or refunds must be forwarded to the Finance Department.

15. STUDENT FINANCIAL AID

Embury annually allocates funding towards four types of bursaries:

• Academic Excellence bursaries; • Financial Need bursaries; • New Student bursaries; and• Academic Merit bursaries.

A qualifying student can apply for more than one of the above bursaries in any given academic year, but will not be awarded more than one of the above bursaries in any given academic year (excluding Academic Merit bursaries).

16. STUDENT SUPPORT SERVICES

The following services are available to students:• The Centre for Student Success offers a free service to help improve students’ language mathematics skills, as well as offering general study support to students.• The Counselling Team provides emotional support to students in need.• The library is open during the week and on Saturdays to support the academic and research needs of students.• The student canteen serves fresh meals and snacks and offers ample space for students to relax and connect.• There is 24-hour campus security.• The entire campus is a Wi-Fi zone.

17. RULES OF CODE OF CONDUCT

Transgression of the following Code of Conduct may, at the discretion of the Disciplinary Committee, lead to suspension, warning or (in extreme cases) to expulsion:1. Show respect towards lecturers as mentors and figures of authority.2. Show respect towards fellow students as equal participants in the training programme who enjoy equal rights and privileges as may be offered or supplied by Embury.3. Show respect towards academic and administrative staff in day-to-day dealings with them.4. Show respect for the good name that Embury strives to maintain and develop through exemplary conduct at all times, and refrain from public statements that may tarnish the good image of Embury.5. Respect the property (fixed or movable) associated with Embury, as well as the physical surrounding by not maliciously damaging or callously interacting with equipment (including library books) that are deemed to be the property of Embury (rented, leased or owned).6. Show respect towards cleaning staff by ensuring that lecture rooms are kept tidy and clear of litter (bins are provided).7. Students have to conduct themselves in an exemplary manner during school-based teaching practicum and abide by the rules and policies of the hosting school during school-based practicum (the School-based Teaching Practicum Declaration signed by students applies).8. Under no circumstances may alcohol be consumed on the premises or may the student enter the premises under the influence of alcohol, or having consumed alcohol (regardless of quantity) during normal operating hours.9. Do not engage in any activity that may tarnish or bring the good name of Embury into disrepute.10. Do not knowingly transgress Embury’s rules and regulations aimed at preserving academic integrity (such as copyright infringement, or cheating in a test or exam) and the moral ethics of Embury (such as downloading information from, or accessing websites forbidden by Embury policies or regulations).11. Do not disregard a lawful instruction issued by Embury management or anybody delegated by management to issue such instruction (including instructions issued in writing and placed on the student notice board or in the respective lecture rooms).12. All students must be able to produce their student cards on request.13. All students must abide by the conditions set out in the Embury enrolment contract.14. The use of cell phones and any electronic devices in the lecture venues are for academic purposes only.

15. The following conduct may, at the discretion of the Embury Disciplinary Committee and after due process, lead to suspension or expulsion from Embury: a) Physical harm or act of violence brought on any person (student, staff, or visitor) while on the Embury premises or during school-based teaching practicum. b) Stealing property belonging to Embury (rented or owned), Embury staff, fellow students, visitors or staff associated with or employed by the schools where Embury students have been placed for school-based teaching practicum. c) Severe acts of vandalism. d) Personal drug abuse or dealing in narcotics of any kind. e) Entering the premises with a weapon of any sorts, regardless of the intended use or not thereof. f) Endangering the lives of others through negligent or reckless behaviour.16. No use of tobacco products including cigarettes and ‘spit tobacco’ or e-cigarettes is permitted within the facilities or on the property of Embury at any time.

• Physical Education Institute of SA (PEISA). As part of a joint venture Embury trains and develops teachers from across the country in physical education.• Dokkies Educational Trust. Dokkies subsidise the training of existing qualified and under- qualified teachers through the various Embury CPTD products.• Queen Maud University College, Norway. Embury partners with this Norwegian university, which specialises in Early Childhood Development, in a student exchange programme.• Stellenbosch University. Embury hosts examinations for Stellenbosch.• Open Learning Group. Embury utilises the administrative services of Open Learning Groups for assessment administration.

19. STUDENT ENROLMENT CONTRACT

An example of the student enrolment contract is attached as an addendum to this document.

20. POLICY AND PROCEDURES FOR HANDLING OF STUDENT COMPLAINTS

Students are free to raise complaints and grievances using the prescribed procedures and channels of communication without the threat of victimisation

for doing so. Complaints and grievances will, wherever possible, be handled with discretion, protecting confidentiality and privacy as and where deemed

appropriate. More information is available in the Student Grievanceand Assessment Appeals Policy (E10).

21. HEALTH AND WELLNESS POLICY

Health and Wellness forms part of the Counselling policy for the institution. Embury is committed to promote a welcoming atmosphere which is conducive to the student’s well-being, personal growth, and psychological health. Student counsellors are available to assist Embury’s students with any difficulties they may experience; interviews by counsellors for contact learning students would be face-to-face, and for distance learning students, interviews would be conducted telephonically. Providing student counselling and support is one of Embury’s responsibilities to inspire a culture of care and reflecting the values of integrity, dedication and compassion as the cornerstones of the institution. The aim of counselling is to provide the opportunity for students to empower themselves as future citizens in the world of work.

22. POLICY ON DISABILITY

No disabled student with a medical condition or learning disability whose needs can reasonably be accommodated will be excluded from participating in or denied access to any programme or co-curricular activity offered by Embury. Students must however disclose any disability or medical condition as required by the application process. More information is available in the Disability Policy (B3).

1. The Student agrees that all information provided to Embury on the application form as well as all supporting documents are true and correct. If such information is found to be incorrect, Embury may take appropriate action against the Student. In this regard, Embury has the right to verify information provided by the Student.

2. Embury shall keep the Student’s information confidential unless legally required to disclose such information or if it has obtained the Student’s consent. Embury shall be entitled to use the Student’s personal data for enrolment, examinations, results, issue of student cards, collection of fees, equal opportunity monitoring, reference checks, credit checks and the like.

3. The Student agrees to be responsible for the payment of the fees in respect of tuition, study material

including textbooks and other printed material, any software costs and e-Pub costs, as well as any relevant miscellaneous costs which may include (but are not limited to) field trips, entry to events, study visits, library card and penalties, security discs, and so on.

4. The Student remains responsible at all times for the payment of fees to Embury. The Student agrees to

make payment on time and in full as stipulated by Embury from time to time. If the Student does not pay his/her fees on time Embury shall be entitled to charge the Student interest at maximum percentage rate permissible in terms of the National Credit Act, from the date when the fees were due. In addition, Embury may refuse the Student entry to examinations, withhold the Student’s results, refuse to register the Student for any further modules or programmes, or withhold the Student’s qualification certificate if the Student’s account is not paid in full.

5. Any certificate issued under the signature of a duly authorised employee of Embury, or a duly authorised

representative, that purports to certify the amount due by the Student shall be accepted as prima facie proof of such indebtedness and shall have sufficient probative value to enable Embury to obtain summary judgment or provisional sentence against the Student in any competent court for the amount stated in such certificate.

6. Embury shall not be responsible for any harm that the Student or the Student’s property may come to

(including direct, indirect and consequential damages arising from the harm) whether or not the Student was on Embury’s property, participating in an activity relating to the Student’s studies at Embury and/or participating in a sport or using any other facilities at Embury. Embury shall ensure that its property, facilities and equipment are safe and that Students are given proper instructions or warnings for their use (in accordance with section 61 of the Consumer Protection Act 68 of 2008).

7. The Student will abide by all relevant codes, rules and regulations of Embury in existence during the

programme which relate to the activities of the students at Embury, or which may apply to the Student's particular programme option, these shall include (but shall not be limited to) the following: (i) Embury's Academic Regulations, and the Student Code of Conduct; (ii) Embury's relevant Health and Safety Regulations; (iii) Embury's Academic Standards and Quality Assurance Regulations; (iv) Embury's Acceptable Use of Information Technology Policy; and (v) All programme handbooks, codes, rules and regulations of any other relevant organisation or

institution, if required as part of the programme, as such codes and regulations are amended from time to time.

8. If the Student's studies with Embury are terminated as a result of disciplinary action taken against the

Student in accordance with the disciplinary procedures of Embury, this agreement shall end automatically without the need for any notice, unless Embury agrees otherwise in writing.

9. If the Student is expelled or dismissed from any institution or organisation other than Embury which

the Student is required to attend or be a member as part of the programme, Embury shall be entitled to end this agreement immediately by written notice to the Student.

10. Should Embury take legal action against the Student for any reason whatsoever the Student agrees to

pay all legal costs. 11. Embury shall own any intellectual property (IP) that the Student may develop as part of his/her studies

and/or research. IP includes copyright, patent rights, design rights, and all related know-how. 12. If a student decides to leave the institution prior to completion of the qualification that he/she was

registered for, the student must officially deregister from Embury by completing the De-Registration Form. The Student may be entitled to a refund of part of the Tuition Fees paid at Embury’s discretion.

13. Embury undertakes to take all reasonable steps to provide the programme and other educational

services with reasonable care and skill. Should industrial action or circumstances beyond the control of Embury interfere with its ability to provide the programme or other educational services, Embury undertakes to use all reasonable steps to minimise the resultant disruption to those services but takes no liability in this regard. Embury shall, at its discretion be entitled to alter the timetable applicable to the Student, to alter the number of classes relating to the programme, alter the methods by which the programme is delivered and to alter the location of delivery of the programme, to discontinue the programme or decide not to provide the programme or to merge or combine the programme with other programmes of study.

14. Where the Student is a minor, the Parent/Guardian hereby consents to the Student entering into this

agreement with Embury. 15. DEED OF SURETYSHIP

(i) I, ________________________________________, hereby bind myself as surety and co-principal debtor in respect of all monies payable, both at present and in the future, by the Student to Embury in respect of his/her Fees. My full particulars are contained on page 1 of this document; and

(ii) I confirm that this undertaking can only be cancelled or withdrawn with Embury’s written permission.

NOTE: A person signing in the capacity of surety and co-principal debtor accepts liability for all monies owed by the student and which are due and payable, or which may become due and payable at any date in the future, by the student to Embury and Embury may recover, at its discretion and in no specific order of preference, such monies in full from either the student or the surety and co-principal debtor, or in part from both the aforementioned parties. 1. The Principal Debt comprises a deposit (to be paid on or before enrolment) and either a single

additional settlement payment or ten (10) subsequent monthly instalments depending on the payment

2019 and subsequent instalments thereafter on the first day of each succeeding month until 01

November 2019 or until the full outstanding amount is paid.

3. If a Student leaves Embury before his/her Programme has ended in any particular academic year, the

Student may be entitled to a refund of part of the Tuition Fees actually paid for the Academic Year in

which they leave, in accordance with table below (refer to Annexure B).

Deregistration Fees
