• Direct discrimination Occurs when a person is treated less favorably than other similarly situated by virtue of birth, sex, racial or ethnic origin, religion or belief, disability, age, sexual orientation or any other condition or personal or social circumstance.
• Indirect discrimination occurs when a law or regulation, agreement or contract clause, individual or unilateral decision, criterion or practic, can have adverse effects or particular disadvantage for one or more specific persons by virtue of birth, sex, racial or ethnicity, religion or belief, disability, age, sexual orientation or any other condition or personal or social circumstance, or even produce an incitement to discrimination.
