    To exclude the subject property from the Agricultural Land Reserve. The applicant intends to subdivide the property into eight (8) residential parcels in accordance with the minimum parcel size in the existing CR-1 (Country Residential) Zone.

    ALC STAFF COMMENTSIt is recommended that the Commission consider the following:- According the CLI Mapping, The improved ratings of the agricultural capability for the majority of the property are identified as prime (70% Class 3 with the limitation of moisture deficiency and 30% Class 1) A small portion of the property (approximately 10% is improvable to Class 4 and Class 6 with limitations of moisture deficiency and stoniness.-There was also a report submitted by a professional Agrologist, Bob Holtby who indicates that after doing a site inspection on the subject property his opinion is that the soil is not suited for forage production and is not capable of supporting soil based agriculture. Mr. Holtby also cites a letter from James Ross, another Agrologist whose letteraccompanied the previous exclusion application on the subject property which stated that the soils had low fertility and indicated that “this soil should be rated 90% class 7 and 10% Class 6 with subclass s applicable to undesirable soil structure, low fertility, moisture deficiency, and stoniness. Improvements of this land is not feasible in part due to the natures of the land and also because farm implements cannot be operated on this type of land.”-The aerial photograph of the property demonstrates that the land cleared, and that properties north and west of the subject property are used for agriculture. -The property borders non ALR land on three sides, to the east, south and the west (due to the presence of a river).- There have been four previous applications on the subject property. Three have been subdivision applications, of which only #12995(1981) was approved and created the subject property in its current size. There was also an exclusion application #37156 (2007) which was refused as the Commission believed that the proposal would adversely impact agriculture and that the property was appropriately designated as ALR. -The applicants have owned the property since July 2007.-The Council forwarded this application with the recommendation to approve the application. The District of Barriere is in the midst of drafting a new OCP for this area which they recently acquired from the TNRD, the current OCP for the area is thus inherited from the TNRD. Within their new OCP the District of Barriere is proposing to designate this property as residential. The Commission will likely be reviewing this OCP concurrently to this application during its October meeting. -While onsite, the Commission could consider not only if it is appropriate to exclude the land from the ALR, but alsowhether the any subdivision of the property would be appropriate.
