D R A F T .

A N ORDINANCE TO AMEND T H E MUNICIPAL CORPORATIONS ORDINANCE , 1934.

Be it enacted by the High Commissioner for Palestine, with the advice of the Advisory Council thereof :—

1. This Ordinance may be cited as the Municipal Cor­porations (Amendment) Ordinance, 1938, and shall be read as one with the Municipal Corporations Ordinance, 1934, hereinafter referred to as the principal Ordinance.

2. Section 115 of the principal Ordinance shall be amended bv the addition of the following subsection thereto, as subsection (4) :—

"(4) Where any rate is leviable under the provisions of this Ordinance upon the owner of any building or land and such building or land is owned in undivided shares, such rate may be collected from any one or more of the co-owners, and the person or persons from wThom the rate is collected shall have a right of contribution from the other co-owner or co-owners in the proportion of their respective shares and may attach the revenue from such building or land till he has recovered the amount due from the other co-owners."

Amendment of section 115 of the principal Ordinance.

O B J E C T S A N D R E A S O N S .

Under the Municipal Corporations Ordinance, 1934, municipal property rate is leviable upon the owners of buildings or land. In the case of a building or land which is owned in undivided shares, howrever, the Ordinance contains no provision enabling the rate to be collected from any one or more of the co-owners, and rates have in consequence fallen considerably into arrears owing to it being often im­possible to ascertain the name and share of every co-owner in such cases. This Ordinance accordingly adds a new subsection to section 115 of the principal Ordi­nance providing that in cases of ownership in undivided shares the rate may be collected from any one or more of the co-owners, who may recover from the other co-owners in proportion to the respective shares of the latter. The new subsection corresponds to the similar provision contained in section 6(3) of the Urban Property Tax Ordinance.
