Preamble

In accordance with paragraph 5.9 of the World Bank Procurement Regulations for IPF Borrowers' (July 2016) ( ProcurementRegulations') the Bank's Systematic Tracking and Exchanges in Procurement (STEP) system will be used to prepare. clear and updateProcurement Plans and conduct all procurement transactions for the Project

This textual pat along with the Procurement Plan tables in STEP constitute the Procurement Plan for the Project. The following conditionsapplyto all procurement activities in the Procurement Plan The other elements of the Procurement Plan as required under paragraph 4 4of the Procurement Regulations are set forth in STEP.

The Bank's Standard Procurement Documents: shall be used for all contracts subjectto internati onal competitive procurement andthose contracts as specified in the Procurement Plan tables in STEP.

National Procurement Arrangements: In accordance with paragraph 5.3 of the Procuremer nt Regulations, when approaching thenational market (as specified in the Procurement Plan tables in STEP), the countnrs own procurement procedures may be used.

Mandatory Provisions for Procurement under Bank-Financed Contracts

Subject to National Procurement Procedures

The procedures to be followed for Nationa Open CompffiI Bidinlsh ne tthose set forth in the Public Procurement Law of theBorrower (Law No 4734). as amended from time to time, with tf sateer amendment dated January 17, 2019 (the 'PPL ) notwithstandinganything to the contrary in the Borrower's Law on Public Procurement Cortracts (Law No. 4735), as amended from time to time, with thelatest amendment dated Januay 17, 2019. and subject to the following provisions:

A. Elibiliry

The eligibility of bidders shall be as defined under Section III of the World Bank Procurement Regulations for IPF Borrowers; accordingly, nobidder or potential bidder shall be declared ineligible for contracts financed by the Bank for reasons otherthan those provided in Section Ill ofthe Procurement Regulations

Bidding shall not be restricted to domestic bidders No restrictions in respect of eliqibilit to participate in bidding for contracts shall be placedon the basis of nationality of the bidder and/or the origin of goods otherthan those setforth in paragraph 3.23 of the Procurement Regulations.No restriction of any kind shall be applied to foreign bidders who wish to submit a bid.

Bidding shall not be restricted to pre-registered firms. and foreign bidders shall not be required to be registered with local authoritie s aseprerequisite for submitting bids

Participation shall be allowed from joint ventures on the condition that such joint venture partners will be jointly and severally liable under thecontract. Procuring entities shall use bidding documents agreed by the Bank, and included in the Project Operational Manual.

B. Fraud and Corruption

The request for bids/requestfor proposals document shall require that Bidders/Proposes submitting BidsfProposals present a signedacceptance at the time of bidding, to be incorporated in any resulting contracts, confirming application of, and compliance with. the Bank's Anti-Corruption Guidelines, including without limitation the Bank's rightto sanction and the Bank's inspection and audit rights.

C. Debarment

The Bank may recognize, if requested bythe Borrower, exclusion from participation as a result of debarment under the national system,provided that the debarment is for offenses involving fraud and corruption and further provided that the Bank confirms that the particulardebarment procedure afforded due process and the debarment decision is final.

Procurement of Second Hand Goods. Not ApplicableDomestic preference as specified underparagraph 5.51 of the Procurement Regulations (Goods and Works) . Not applicable.
