PUBLIC NOTICE PROPOSED CONSENT ORDER

The Ohio Environmental Protection Agency (Ohio EPA) has entered into a proposed Consent Order with Cinnamon Lake Utilities Association, Inc., (Defendant), to resolve Ohio EPA’s complaint filed in the Ashland County Court of Common Pleas case number 14-CIV-053. The proposed Consent Order requires the Defendant to comply with all applicable provisions of Ohio’s Water Pollution Control Law, R.C. Chapter 6111 and Ohio Drinking Water laws, R.C. Chapter 6109 and the rules and regulations promulgated thereunder, and the terms and conditions of all plans, orders, schedules and/or permits issued to Defendants. The proposed Consent Order requires the inspection of the inflow and infiltration into the sanitary sewer system, the submittal of annual plans detailing the corrective actions initiated, and an approvable plan to complete the remaining repairs to eliminate excessive inflow and infiltration. The proposed Consent Order also requires the payment of a sixty thousand dollar ($60,000) civil penalty. Public notice is hereby given that the Ohio Environmental Protection Agency (Ohio EPA) Division of Surface Water (DSW) has received an application for, and has begun to consider whether to issue or deny, a Clean Water Act Section 401 water quality certification for a project conduct the routine dredging of the Ashtabula River Federal navigation channel. The application was submitted by the Buffalo District of the U.S. Army Corps of Engineers. The project is located in the Ashtabula River within the Federal Navigation channel. The Buffalo District Corps of Engineers Public Notice Number for this project is ASHTABULA-15. The Ohio EPA ID Number for this project is 144600. As required by the Anti-degradation Rule, 3745-1-05, of the Ohio Administrative Code (OAC), three alternatives have been submitted for the project. The applicant's proposed preferred alternative, if approved, would entail the dredging of an estimated 300,000 cubic yards of material, with placement of the dredged material at the existing, authorized open-lake placement area in Lake Erie. An estimated 62 acres of channel would be dredged under this alternative. The applicant's proposed minimal degradation alternative, if approved, would entail the dredging of an estimated 200,000 cubic yards of material, with placement of the dredged material at the existing, authorized open-lake placement area in Lake Erie. An estimated 41 acres of channel would be dredged under this alternative. This is the minimum amount of dredging required in order to maintain a passable channel for deep-draft commercial shipping. PUBLIC NOTICE Ohio EPA Finalizes Amended Decision Document

Green I Landfill Site, Logan, Ohio

On January 23, 2015, the Ohio Environmental Protection Agency (EPA) finalized an Amended Decision Document concerning the Green I Landfill located on Hunters Woods Road in Green Township, Hocking County, near the town of Logan, Ohio (Site). The original Preferred Plan for remediation of the Site was issued by Ohio EPA on February 9, 2010 (2010 Preferred Plan), followed by a Decision Document dated November 22, 2010 (2010 Decision Document). The Goodyear Tire & Rubber Company (Goodyear) and the General Electric Corporation (GE) appealed the 2010 Decision Document to the Environmental Review and Appeals Commission (ERAC). Based on the review of available information, including the information provided by Goodyear on January 16, 2013, and on the Ohio EPA approval on July 2, 2012, of Goodyear’s request for an exemption pursuant to Ohio Revised Code (ORC) 3734.02(G) to a number of landfill capping requirements, Ohio EPA has modified the selected remedial alternative included in the 2010 Decision Document. The approximately 10½ acre Green I Landfill began operations in 1970 and ceased accepting waste in 1974. The landfill accepted household, commercial and industrial wastes. Based on the information identified during the remedial investigation and feasibility study, the preferred remedial alternative in the 2010 Decision Document for the Site included: the construction of a multi-layer cap; the installation of a leachate (i.e., water that has come into contact with buried landfill wastes) collection system; dewatering and removal of sediments from an affected off-site pond; an environmental covenant establishing activity and use limitations for the Site property; and associated reporting. Based on the July 2, 2012, exemption request and subsequent approval by the Agency, the selected remedial alternative in the 2010 Decision Document was modified to include a composite cap system involving an impermeable flexible membrane liner, passive gas venting, a clay layer consisting of existing soils at the Site, a drainage layer, and a protective layer and vegetative cover. Additionally, based on the receipt and evaluation of information provided by Goodyear and GE on January 16, 2013, the dewatering and removal of sediment from the off-site pond required in the 2010 Decision Document was determined to be unnecessary. On December 31, 2013, Ohio EPA issued an Amended Preferred Plan outlining Ohio EPA’s preferred modified alternative to remediate contamination at the Site. A public meeting was held February 12, 2014, during which public comments on the Amended Preferred Plan were accepted. In addition, written comments on the Amended Preferred Plan were accepted through February 21, 2014. The comments received by the Agency at the public meeting and during the comment period are addressed in the Responsiveness Summary included in the Amended Decision Document.

The effective date of this final action is January 23, 2015. You are hereby notified that this action of the Director is final and may be appealed to the Environmental Review and Appeals Commission pursuant to Section 3745.04 of the Ohio Revised Code. The appeal must be in writing and set forth the action complained of and the grounds upon which the appeal is based. The appeal must be filed with the Commission within thirty (30) days after notice of the Director's action. The appeal must be accompanied by a filing fee of $70.00 made payable to “Ohio Treasurer,” which the Commission, in its discretion, may reduce if by affidavit it is demonstrated that payment of the full amount of the fee would cause extreme hardship. Notice of the filing of the appeal shall be filed with the Director within three (3) days of filing with the Commission. Ohio EPA requests that a copy of the appeal be served upon the Ohio Attorney General’s Office, Environmental Enforcement Section. The application was submitted by Martin Wargo, U.S. Army Corps of Engineers. The project is located in the Federal navigation channels of Toledo Harbor. The Buffalo District Corps of Engineers Public Notice Number for this project is TOLEDO-15. The Ohio EPA ID Number for this project is 144601. As required by the Anti-degradation Rule, 3745-1-05, of the Ohio Administrative Code (OAC), three alternatives have been submitted for the project. The applicant's proposed preferred alternative, if approved, would place 1.5 million cubic yards of material in Lake Erie. The applicant's proposed minimal degradation alternative, if approved, would place 1.1 million cubic yards of material in Lake Erie. The applicant's proposed non-degradation alternative, if approved, would have no direct impacts on waters of the state.
