Notice is hereby given that on August 4, 2004 the Director of the Ohio EnvironmentalProtection Agency (“Ohio EPA”), pursuant to Ohio Revised Code (“ORC”) Chapter 3746and Ohio Administrative Code (“OAC”) Chapter 3745-300, issued a Covenant Not ToSue/Final Findings and Orders to Teleflex, Incorporated, for the property identified as theSermatech-Lehr Plant 1 property (the “Property”).
Teleflex, Inc., conducted a voluntary action at the approximately 9.7 acre Property locatedat 11230 Deerfield Road, Blue Ash, Hamilton County, Ohio. A no further action letter wassubmitted on September 30, 2002, to the Voluntary Action Program of the Ohio EPADivision of Emergency and Remedial Response on behalf of Teleflex, Inc., by MichaelWeinstein, a Certified Professional (No. CP 126), as defined in ORC 3746.01(E) and OAC3745-300-01(A)(8).
The issuance of the Covenant Not to Sue/Final Findings and Orders is a final action of theDirector. The action may be appealed to the Environmental Review Appeals Commission(“Commission”). The appeal must be in writing and set forth the action complained of andthe grounds upon which the appeal is based. The appeal must be filed with theCommission within thirty (30) days after notice or issuance of the action. (See ORC3745.04 and 3745.07). OHIO EPA ISSUES FINAL FINDINGS AND ORDERS TO
MILLENNIUM INORGANIC CHEMICALS, INC.
On August 2, 2004, Ohio EPA issued final Findings and Orders to Millennium InorganicChemicals, Inc. for its facility located at 2900 Middle Road, Ashtabula, Ohio 44004. Thisfacility transported unpermitted hazardous waste in a 40 cubic yard rolloff container. TheEPA I.D. number for this facility is OHD076741149.
Millennium Inorganic Chemicals, Inc. must achieve compliance with Chapter 3734 of theOhio Revised Code and all corresponding regulations according to the detailed complianceschedule which outlines civil penalties and payments. This final action was not precededby a proposed action and is appealable to the Environmental Review Appeals Commission.

This approval is based upon the Ohio EPA staff’s recommendations following a reviewconducted under applicable requirements of the assistance application materials and anyother information regarding the proposed activities. This approval and all financialassistance provided to Highland County Water Company from the WSRLA is conditionedupon successful completion, operation, and maintenance of the eligible activities.

The Director of the Ohio Environmental Protection Agency is providing notice of theapproval of an application for Water Pollution Control Loan Fund (WPCLF) financialassistance to the Northeast Ohio Regional Sewer District, for the following water qualityimprovement activity: this project consists of the construction of CSO floatables controlfacilities at five CSO outfall locations. A floating unit in open water will be installed atDugway Brook to control two outfalls in close proximity, an end of pipe unit will be installedat Gordon Park, and in-line facilities will be installed at Euclid Beach Park, Euclid Creekand Brookside Reservation.
This approval is based upon the Ohio EPA staff’s recommendations following a reviewconducted under applicable requirements of the assistance application materials and anyother information regarding the proposed activities. Why is Chemical Solvents, Inc. modifying its Permit?
Chemical Solvents, Inc. is permitted to operate hazardous waste container and tankstorage units at its facility. Chemical Solvents, Inc. wishes to add two additional tanktreatment units (less than 25% of facility capacity), include additional waste codes formanagement in containers, include additional waste codes for management in tanks, andadd a new hazardous waste storage pad for storing up to 11,000 gallons (less than 25%of facility capacity) . Public notice is hereby given that the Ohio Environmental Protection Agency (Ohio EPA)Division of Surface Water (DSW) has received an applications for, and has begun toconsider, whether to issue or deny, Clean Water Act Section 401 certifications for aproposed transportation project in Montgomery and Clark Counties, Ohio. The Applicantpresented three project alternatives, pursuant to the anti-degradation requirements in 3745-1-05 and 3745-1-54 of the Ohio Administrative Code (OAC). The alternatives are:Preferred Alternative, Minimal Degradation Alternative, and Non-Degradation Alternative.For the Preferred and Minimal Degradation Alternatives, the construction area begins inMontgomery County on I-70 at the western terminus and extends eastward to the easternterminus on the southwest border of Clark County, Ohio. The application was submittedby the Ohio Department of Transportation (ODOT), 1980 West Broad Street, Columbus,Ohio 43223. The Ohio EPA Public Notice Numbers for the project is (SWIMS #) 042037.The ODOT ID Number for the project is MOT-70-17.04, PID 22935.
The Preferred Alternative consist of the construction of a third traffic lane (approximately6.95 miles) in each direction of a portion of I-70 using the existing median. Additional workincludes modifying the vertical profile of the roadway, replacing mainline bridges, replacingculverts, and modifying the I-70/SR 201 Interchange. This alternative is estimated toimpact the Great Miami River, an Exceptional Warmwater Habitat (EWH), as well as sevenother jurisdictional streams, totaling approximately 515 linear feet of impacts. The MinimalDegradation Alternative is basically the same as the Preferred Alternative, including streamimpacts, except the existing pavement on the 6.95 mile portion on I-70 would not bereplaced. No construction or “No Build” is proposed for the Non-Degradation Alternative inorder to avoid impacting aquatic resources in the project area. The Applicant stated thisalternative would not meet the purpose and need of the project or correct existing safetyhazards.
The discharges from these activities, if approved, would result in degradation to, or loweringof, the water quality of jurisdictional streams in the Great Miami River Watershed (HUC05080001-200) and Mud Creek Watershed (HUC 05080001-190). The review of theapplication will be conducted in accordance with Chapters 3745-1, 3745-32, and otherapplicable provisions of OAC and the Ohio Revised Code (ORC). In accordance with OAC3745-1-05, an antidegradation review of the application will be conducted before decidingwhether to allow a lowering of the water quality. Other alternatives resulting in lesser or nodegradation or lowering of water quality, will be considered by Ohio EPA during the reviewprocess. No exclusions or waivers, as outlined by Paragraph 3745-1-05 (D) of theAntidegradation Rule (effective as of May 1, 1998), apply or may be granted by the Directorof Ohio EPA.

OHIO EPA ISSUES FINAL MODIFIED HAZARDOUS WASTE PERMIT
On August 3, 2004, Ohio EPA issued a final Class 2 modified Hazardous Waste FacilityInstallation and Operation Permit (Permit) to Systech Environmental Corporation for itsfacility at 11397 County Road 176, Paulding, Ohio 45879. The EPA Identification Numberfor this facility is OHD005048947.
Why is Systech Environmental Corporation modifying its Permit?
Systech Environmental Corporation is permitted to operate hazardous waste container andtank storage units at its facility. Systech intends to repair the secondary containment aroundOff-Load Tanks 1-4 by removing the existing floor of the containment, install a system ofdrainage tiles to remove groundwater from under the system, and replace the floor with botha new sump and an eight (8) inch concrete slab. This final modified permit will allow Systechto make the requested changes. To issue this final modified Permit, Ohio EPA determinedthat the modification application is complete and meets appropriate standards.
Can I appeal this final modified Permit?
Yes, if you are an officer of an agency of the state or of a political subdivision, acting in arepresentative capacity, or any person who would be aggrieved or adversely affected by thismodified Permit, you have the right to appeal this Permit decision to the EnvironmentalReview Appeals Commission (ERAC).
