This was the thrust of a high level public procurement forum which took place in Johannesburg, South Africa from 3 to 5 April this year under the theme “Harnessing Public Procurement for Socio- Economic Growth in Africa”. PPRA Chief Executive Officer, Dr. Laurent Shirima, who was a panelist at the forum, told TPJ that some experts had issues with com- pliance as “it does not tell what results one wants to archive.” “Even the use of templates and models such as world bank procurement guidelines and UNCITRAL Model Law was not sufficient to enable one to tell how the results would be achieved,” said Dr. Shirima. He added that the forum participants advanced the view that procuring entities must clearly specify their needs first then choose the most appropriate method to use in order to meet the objec- tives. “The focus of reforms in public procurement should [among others] be quality of service delivery, governance and private sector develop- ment,” Dr. Shirima said, adding that with regard to procurement proceedings, what was required was its effective administration in order to realize savings and minimize losses. Mr. Amour Hamad Amour, who is leading the Uhuru Torch race, was supposed to launch the project as part of the race activities in the district recently, but poor workman- ship of the project put him off. “I cannot open this project because it does not represent value for the money con- tributed by the villagers,” remarked the vividly irked Mr. Amour, calling upon authori- ties in the district to redo the project. Mr. Amour, who was scheduled to open a house meant to accommodate the head teacher at Nzoka Primary School, said the project was disappointing and against directives of the Government in ensuring value for money in all public projects. The Momba District Executive Director, Mr. Adrian Jungu, conceded that the building was not up to stan- dards and that it would have to be redone. He, however, did not reveal if any action would be taken against culprits. In a move to ensure gov-ernments attain bestvalue for money in pub-lic procurement, practi-

tioners have been challengedto think beyond compliance,TPJ has learnt.

This was the thrust of ahigh level public procurementforum which took place inJohannesburg, South Africafrom 3 to 5 April this yearunder the theme “HarnessingPublic Procurement for Socio-Economic Growth in Africa”.

Mamlaka ya Rufaa ya Zabuni zaUmma (PPAA) imetupilia mbalirufaa ya Muhanna Limited dhidi ya

Mfuko wa Taifa wa Bima ya Afya (NHIF)kwani haikukatwa ndani ya muda uliowek-wa na sheria, TPJ imebaini.

Hayo yamebainishwa na uamuzi uliotolewana PPAA tarehe 6 Aprili mwaka huu, juu yarufaa ya Muhanna Limited, kuhusu zabuni yautoaji ushauri wa kitaalam kubaini vihatar-ishi kabla ya kuwekeza, iliyokuwa imeitish-wa na NHIF.

Kwa mujibu wa uamuzi wa PPAA, MuhannaLimited ilikuwa miongoni mwa wazabuniwatano walioshiriki mchakato wa zabunihiyo, ambapo NHIF ilitoa barua ya kusudio lakutoa tuzo kwa mmojawao, AlexanderForbes, na pia kuwaeleza wengine sababu zakuenguliwa kwao.

Mlalamikaji alipinga uamuzi wa kuenguliwa,akisema ulitokana na tathmini ambayo

haikuwa imezingatia matakwa ya nyaraka zazabuni.

Baada ya kusikiliza madai na hoja zote, PPAAilibaini kwamba hapo awali mrufani alipele-ka malalamiko NHIF na kupokea majibuyake tarehe 22 Februari. Mamlaka pia ilibainikwamba mrufani hakuridhishwa na majibuya NHIF na kwamba aliamua kukata rufaaPPAA. Hata hivyo, ilidhihirika kwambawakati mrufani alitakiwa kuwasilisha rufaniyake ndani ya siku saba za kazi, yaani kablaya tarehe 3 Machi, yeye alifanya hivyo tarehe8 Machi.

Aidha, PPAA ilijiridhisha kwamba mrufanihakuzingatia suala la muda wa kukata rufaana kwamba rufaa yake ilikuwa imekatwa njeya muda uliopangwa kisheria.

Hivyo, PPAA iliyokaa chini ya mwenyekitiwake Jaji (Mstaafu) Vincent Lyimo, ilitupiliambali rufaa hiyo na kuagiza kila upandeubebe gharama zake.

Bodi ya Wakurugenzi ya PPRA imeziagiza taasisi nunuzi kuwajengeauwezo watumishi wanaohusika na michakato ya manunuzi kwakuwawezesha kupata mafunzo maalum kuhusu sheria ya manunuziya umma hususan kwenye maeneo ambayo yalibainika kuwa naudhaifu wakati wa ukaguzi wa manunuzi ya umma yaliyofanyikamwaka wa fedha 2015/16. Baadhi ya maeneo hayo ni usimamizi wamikataba, utumiaji wa nyenzo na mifumo ya manunuzi na utunzaji wakumbukumbu za manunuzi.

Agizo hilo linafuatia kukamilika kwa zoezi la kusikiliza maelezo yawakuu wa taasisi nunuzi 20 ambazo baadhi yake zilibainika kupatawastani wa chini ya asilimia 78 ambalo lilikuwa lengo kwa mwaka2015/16 na nyingine kushindwa kutekeleza maagizo ya Bodi ya PPRAyaliyotokana na ukaguzi wa mwaka 2014/15.

Taasisi hizo zinatakiwa kuandaa utaratibu wa kupatiwa mafunzohayo na wataalam kutoka PPRA yatayojikita zaidi kwenye maeneoambayo taasisi zilifanya vibaya kutokana na matokeo ya ukaguzi.Wahusika wa mafunzo hayo ni pamoja na wakuu wa taasisi hizo,wajumbe wa bodi za zabuni, idara tumizi (user department) na idaraza usimamizi wa miradi. Aidha, kwa upande wa halmashauri,mafunzo hayo yatahusisha kamati za madiwani zinazohusika nausimamizi wa miradi.

Katika hatua nyingine, kwa taasisi ambazo zilibainika kufanya malipoyenye utata zimeagizwa kuwasiliana na wazabuni husika ili kurejeshafedha hizo, na kutakiwa kuwasilisha PPRA uthibitisho wa vielelezovya marejesho ya fedha hizo wakati wa zoezi la uhakiki.

Thetraining program has been designed to equip participants with requisite knowledge of PPA 2011 and PP (amendment) Act2016 and its regulations and Procurement Management Information System (PMIS).

The participation fee for each training is TShs. 550,000.00 to cover the cost of training materials, certificate of attendance,facilitation, lunch and refreshments during the sessions. Each certificate will bear CPD hours. Confirmation will be throughremittance of a fee to PPRA, Account No. 20110006721 - NMB Bank, Bank House - Dar es Salaam and PPRA, Account No.01J1043009600 - CRDB Bank, Tower Branch – Dar es Salaam and submission of payment evidence.

The training, whose registration is limited to 50 participants per session, will be conducted in Dodoma according to thefollowing program:
