The subject waterright was formerly a component of the integrated water system of the Blue River Water District (the “District”). In 1996, the waterrights and the water system of the District were acquired by the Town of Breckenridge (“Breckenridge”), which took overresponsibility for providing water to the District’s service area. Accordingly, the subject water right is now a component of

The decree descriptions of Ruedi Reservoir’s water rights follow.Ruedi Reservoir was decreed in the Garfield County District Court in Civil Action No. 4613 for domestic, municipal, irrigation,industrial, generation of electrical energy, stock watering and piscatorial uses, with an appropriation date of July 29, 1957. Transit losses between the outlet of the Wolford Mountain Reservoir and thepoint of diversion are estimated to be ten percent (10%) of the potential annual augmentation requirements. Therefore, the totaldiversions of the wells estimated to equal 4.95 acre feet per year should be increased by a factor of 1.1 to 5.45 acre feet per year andthe annual consumption estimated to equal 1.805 acre feet per year should be increased by the same factor of 1.1 to 1.986 acre feet peryear. Depletions from the Neumayr Wells No. 1 and 2 will affect the Colorado River throughout the year. Although the NeumayrWells No. 1 and 2 water rights may be in priority during portions of the year, the Applicant plans to provide augmented water out ofWolford Mountain Reservoir to cover one hundred percent (100%) of the maximum annual depletions due to the diversions of thewell to adequately protect downstream vested water rights. Applicant recently filed an Application for WaterRights, Change of Water Rights, and Approval of Plan for Augmentation, in Case No. 00CW303, Water Division 5, to claim newwater rights and to accommodate the new, changed, and proposed uses on the Ranch. The conditional uses decreed to the fourWinegard Ponds that are the subject of this application continue to be an aspect of the integrated water development plans for the TYLRanch. They are one aspect of the water supply system for the ranch where water is put to a wide variety of uses under a number ofdifferent water decrees. The existing and proposed uses are most fully explained in the recent application submitted in Case No.00CW303. The ponds themselves are all flow through and interconnected in that water flows from Winegard Pond No. 1, then toPond No. 2, then to Pond No. 3, then to Pond No. 4. In furtherance of and to perfect the conditional irrigation use decreed to theWinegard Ponds in 94CW101, Applicant has installed extensive landscaping around the four Winegard Ponds, including new acres oflawn grass, trees, shrubs and flower gardens. Applicant plans to complete additional landscaping in this same area. Attached Figure 1illustrates the new and planned landscaped area around the four Winegard Ponds. The landscaping will occupy approximately 6.51acres in the vicinity of the four ponds at full build-out. Depletions associated with the irrigation of this landscaping will be more thanfully augmented by the augmentation plan decreed in 94CW101, and by the augmentation plan explained in Case No. 00CW303. Thecost of the landscaping completed to date is in excess of $500,000 dollars. Applicant has used water from the Winegard ponds on occasion for stock watering purposes, and maintains thespecific intent to continue to put the water to use for stock purposes when the planned equestrian improvements on the Ranch arecompleted. 5. Request to make absolute the irrigation purpose of use: Water from the four Winegard Ponds has already been used toirrigate some of the landscaped areas described above and depicted on attached Figure 1. Specifically, Applicant installed a pump andpump housing in Pond No. 1 that takes water out of the ponds and into a sprinkler system to irrigate the landscaped area around thefour Winegard Ponds. Applicant estimates that water from the Ponds has been applied to irrigate approximately 3.5 acres of lawn andlandscaping.
