About this bookletThis booklet is a Product Disclosure Statement (PDS) and is also the PolicyWording. Other documents may comprise the PDS and we will tell you if thisis the case in the relevant document.
This booklet has two (2) parts: Important Information to help you understandthe insurance, and the Policy Wording, which sets out terms and conditionof the cover provided. It is up to you to choose the cover you need. Anyadvice in this booklet is general in nature only and has not considered yourobjectives, financial situation or needs.You should carefully consider theinformation provided having regard to your personal circumstances to decideif it is right for you.

Choose your type of coverYour QBE Policy insures you for an incident occurring in Australia.
You can choose the level of cover you need from the options available:
Comprehensive – covers accidental damage to your vehicle as well asdamage to third party property, or if your vehicle suffers damage froma fire or theft.Third party, fire & theft – only covers damage to your vehicle if it is aresult of fire or theft, as well as damage to third party property causedby you.Third party only cover – no cover for damage to your vehicle, cover onlyfor damage caused to the property of a third party.

Duty of disclosure
New business
What you must tell us
When answering our questions, you must be honest and you have a dutyunder the law to tell us anything known to you, and which a reasonableperson in the circumstances would include in answer to the questions. Wewill use the answers in deciding whether to insure you and anyone else tobe insured under this insurance and on what terms.
Who needs to tell us
It is important that you understand you are answering our questions in thisway for yourself and anyone else who is an insured under this insurance.
If you do not tell us
If you do not answer our questions in this way, we may reduce or refuse topay a claim, or cancel your insurance. If you answer our questionsfraudulently, we may refuse to pay a claim and treat the insurance as neverhaving worked.
Renewals, variations, extensions and reinstatements
Once your insurance is entered into and is no longer new business thenyour duty to us changes.You are required before you renew, vary, extendor reinstate your insurance, to tell us everything you know and that areasonable person in the circumstances could be expected to know, is amatter that is relevant to our decision whether to insure you, and anyoneelse to be insured under this insurance, and if so, on what terms.
You do not have to tell us about any matter:
that diminishes the risk to be undertaken by us;that is of common knowledge;that we know or should know or, in the ordinary course of our business,we ought to know;as to which compliance with your duty is waived by us.
Non-disclosure
If you fail to comply with your duty of disclosure, we may be entitled to reduceour liability under the insurance in respect of a claim or may cancel theinsurance.
If your non-disclosure is fraudulent, we may also have the option of avoidingthe insurance from its beginning.

You must disclose to us all previous claims
You are asked at the time you take out this insurance to give us full andcorrect details concerning any:
renewal or insurance policy declined, cancelled or refused, or whereany excess was imposed;claim refused by an insurer;claim made;criminal conviction or finding of guilt for an offence,
in relation to you and your family because any of these may affect thepremium and extent of insurance.
For example, we may be entitled to:
charge you an additional premium;impose (back-dated) restrictions including declining your insurance backto when this information should have been provided;decline to insure your building, contents or valuables;refuse a claim.
When renewing your Policy with us you must also advise us of any changesto your:
claims;insurance; orcriminal history.
We will notify you in writing of the effect a change may have on your renewal.
Changes to the information you have givenusIt is important to advise us of any charge to the information you have givenus, otherwise your QBE insurance may be affected. Changes would include:
a change to the ownership of your vehicle;a change of address;a change to the vehicle you wish to be insured by this Policy;a new regular driver of your vehicle;a modification to your vehicle;the addition of a non-standard accessory.
If you wish to insure any fitted non-standard accessory or modification, eachone must be advised to us for our acceptance, which we will confirm byissuing an alteration advice.
Please note that we may require you to pay an additional premium as aresult of any of these changes.

You need to disclose all driversYou are asked at the time you take out this insurance to give us full andcorrect details of all drivers who are likely to use your vehicle once a monthor more, including:
driving or riding related traffic offence, conviction or any loss of driverslicence;renewal or insurance policy declined, cancelled, refused, or where anyexcess was imposed;claim refused by an insurer;claim made;motor vehicle or motor cycle accident, theft or fire; andcriminal conviction or found guilty of an offence.
Any of these situations may affect the premium and extent of insurancecover provided. Providing this information may result in:
an additional premiuma particular driver being declined insurance cover;a claim being refused.
When renewing your QBE Policy with us you must also advise us of anychanges to the driving, claims, insurance or criminal history of all drivers.We will notify you in writing of the effect such changes may have on yourrenewal.
Privacy PromiseAll companies in the QBE Group are committed to safeguarding your privacyand the confidentiality of your personal information. QBE collects only thatpersonal information from or about you for the purpose of assessing yourapplication for insurance and administering your insurance policy, includingany claim made by you. QBE will only use and disclose your personalinformation for a purpose you would reasonably expect.We will request yourconsent for any other purpose.
Without this personal information we may not be able to issue insurancecover, administer your insurance or process your claim. Our aim is to alwayshave accurate and up-to-date information. When you receive a PolicySchedule, Certificate of Insurance, Renewal or other document from us, youshould contact us if the information is not correct.
QBE uses the services of a related company located in the Philippines toprovide Call Centre sales and claims handling, accounting and administrationservices to QBE in Australia.
QBE or our authorised agent may collect or disclose your personalinformation from or to:
any person authorised by you;a mail house, records management company or technology servicesprovider (for printing and/or delivery of mail and email, including secure

storage and management of our records). These companies may belocated or the records stored using 'Cloud' technology overseas,including in India, Ireland, USA or the Netherlands;a financier whose name appears on your Policy Schedule (for thepurpose of confirming the currency of your Policy or when you have aclaim and the insured property is a total loss, to confirm if the financierhas a current interest);an organisation that provides you with banking facilities (for the purposeof arranging direct debit or other payment transactions or confirmingpayments made by you to us);a financial services provider or our agent who is arranging your insurance(for the purpose of confirming your personal and insurance details);another person named as a co-insured on your Policy (for the purposeof confirming if full disclosure has been made to us);another insurer (to obtain confirmation of your no claim bonus or toassess insurance risks or to assist with an investigation);our reinsurer that may be located overseas (for the purpose of seekingrecovery from them);a dispute resolution organisation such as the Financial OmbudsmanService (for the purpose of resolving disputes between QBE and youor between QBE and a third party);a company to conduct surveys on our behalf for the purpose of improvedcustomer services; andan insurance reference bureau (to record any claims you may makeupon us).
In addition to the above, in the event of a claim, QBE or our authorised agentmay disclose your personal information:
to a repairer or supplier (for the purpose of repairing or replacing yourinsured items);to an investigator, assessor (for the purpose of investigating or assessingyour claim);to a lawyer or recovery agent (for the purpose of defending an actionby a third party against you or recovering our costs including your excessor seeking a legal opinion regarding the acceptance of a claim);to a witness to a claim (for the purpose of obtaining a witness statement);to another party to a claim (for the purpose of obtaining a statementfrom them or seeking recovery from them or to defend an action by athird party).
Personal information (about you) may also be obtained from the abovepeople or organisations.
In addition we will:
give you the opportunity to find out what personal information we holdabout you and when necessary, correct any errors in this information.Generally we will do this without restriction or charge; andprovide our dispute resolution procedures to you, should you wish tocomplain about how we handle your personal information.

Your premiumWhat is premium?
Premium means any amount we require you to pay under the Policy andincludes government charges.
You pay the premium - We insure you
Provided we receive the premium, we will insure you as set out in this Policyand the Policy Schedule in respect of an incident occurring during the periodof insurance. When you apply for this insurance, you will be advised of thepremium. If you choose to effect cover, the amount will be set out in thePolicy Schedule.
How your premium is calculated
We take various factors into consideration when calculating your premiumincluding:
the sum(s) insured;the type of cover you have chosen;the year, make and model of the vehicle being insured;your residential address;any no claim discount to which you may be entitled;the age of the main driver and any other drivers, as well as their drivingand insurance history;the cost of any optional benefits you have selected;the level of excess you choose to pay;the frequency with which you choose to pay your premium.
Ways to reduce your premium
You may be eligible for the following discounts we offer:
No Claim Bonus
No Claim Bonus is a premium discount awarded for not making a claim.A No Claim Bonus discount increases each year that you remain claimfree until you reach our maximum discount. Based on the claims lodgedduring the period of insurance, your Policy’s No Claim Bonus will beadjusted when you renew your Policy and this can either:
increase (up to our maximum No Claim Bonus),decrease, orremain the same.

If your vehicle is involved in an incident your No Claim Bonus will notbe affected if we decide the incident was not your fault and you provideus with the name, current residential address and vehicle registrationof the person who caused the event.
If you make a claim and we decide that you are at fault, your No ClaimBonus will be affected and may be reduced when you renew your Policy.
Multi Policy Discount
If this Policy insures your vehicle and you also hold a buildings and/orcontents policy through the same financial institution, we may provideyou with a multi policy discount.You may also be entitled to the samediscounts on other household insurance products. For more information,contact your financial institution.
Security Discounts
If you have fitted extra security devices to your vehicle then you maybe eligible for a discount. This will depend upon the type of securitydevices you have fitted.
Other ways you can help reduce your premium:
Choose a higher excess
You can choose a higher excess for a reduced premium.Your PolicySchedule will indicate the excess applicable in the event of a claim.Please refer to ‘Your excess’ for more information on excess options.
21 day cooling off periodIf you want to return your insurance after your decision to buy it, you maycancel it and receive a full refund. To do this we must receive your requesteither in writing or via email: [email protected] within twenty one (21) daysof its commencement.
This cooling off right does not apply if you have made or are entitled to makea claim. Even after the cooling off period ends, you still have cancellationrights. However, we may deduct certain amounts from any refund (see 'Howyour Policy may be cancelled – Refund of premium').
Dispute resolutionWe will do everything possible to provide a quality service to you. However,we recognise that occasionally there may be some aspect of our service ora decision we have made that you wish to query or draw to our attention.We have a complaints and dispute resolution procedure which undertakesto provide an answer to your complaint within fifteen (15) working days.
If you would like to make a complaint or access our internal dispute resolutionservice please contact your nearest QBE office and ask to speak to a disputeresolution specialist. If you are not happy with our answer, or we have taken

more than fifteen (15) working days to respond, you may take your complaintto the Financial Ombudsman Service (FOS), an ASIC approved externaldispute resolution body.
FOS resolves certain insurance disputes between consumers and insurersand will provide an independent review at no cost to you. QBE is bound bythe determination of FOS but the determination is not binding on you.
The General Insurance Code of PracticeQBE Insurance (Australia) Limited is a signatory to the General InsuranceCode of Practice.
The Code aims to:
promote more informed relations between insurers and their customers;improve consumer confidence in the general insurance industry;provide better mechanisms for the resolution of complaints and disputesbetween insurers and their customers; andcommit insurers and the professionals they rely upon to higher standardsof customer service.
Financial Claims SchemeThis Policy is a protected policy under the Financial Claims Scheme (FCS),which protects certain insureds and claimants in the event of an insurerbecoming insolvent. In the unlikely event of QBE becoming insolvent youmay be entitled to access the FCS, provided you meet the eligibility criteria.

POLICY WORDING
InsurerThis Policy is underwritten by QBE Insurance (Australia) LimitedABN 78 003 191 035, AFS Licence No. 239545 of 82 Pitt Street, SydneyNSW 2000.
Our agreement with youThis Policy is a legal contract between you and us.You pay us the premiumand we provide you with the cover you have chosen as set out in the Policy,occurring during the period of insurance shown on your Policy Schedule orany renewal period.
The limits of cover applying to the cover selected by you and the amount ofany excess that applies to your Policy, is shown on your Policy Schedule.
Your PolicyYour Policy consists of the Policy Wording in this booklet and the PolicySchedule we give you. Please keep them in a safe place for future reference.
Please check the Policy Schedule details to ensure it accurately states whatyou have insured. Be sure to check that the sum insured for the variousareas of cover are adequate.
If you need any further information about any part of your Policy, please askus or your financial services provider.
Paying your premiumAnnual premium
Paying your premium on time is important because it affects your insurance.If you are paying your premium annually in one payment, and you have notpaid by the due date or your payment is dishonoured, this Policy will notoperate and there will be no cover.
Instalment payments
If you are paying your premium by instalments, we will specify on your PolicySchedule when we will deduct the first instalment. Thereafter, instalmentpayments will be debited on the date or frequency you have nominated. Ifyou are paying your premium in instalments by direct debit from your creditcard or financial institution account, you must tell us if these details changeno later than seven (7) days before your next instalment is due. We will notpay a claim under this Policy if, at the time the claim occurred, any premiuminstalment has remained unpaid for one (1) month or more.

If any instalment of premium has remained unpaid for one (1) month, wemay cancel this Policy. However, we will send you a notice confirming theaction we intend to take and when any cancellation will become effective.
At renewal
If you have been paying your premium by instalment, we will continue todeduct instalments for your Renewal Policy on the same day of the monthat the new premium level unless you tell us otherwise.
If any instalment of premium has remained unpaid for one (1) month, we willcancel this Policy. We will send you a reminder setting out our intention totake two (2) instalments on the next payment date. If payment is not receivedafter this reminder, we will send you a notice telling you of the date the Policywill cease unless payment is received.We send a notice to confirm the Policyhas been cancelled.
Adjustment of premium on renewal
If a claim occurs in the previous period of insurance and you do not notifyus until after the premium for the current period of insurance was calculated,then you must pay any additional premium that would have been calculatedhad you told us about the claim on the day that the claim occurred. Thiscondition does not affect any other rights that we have, including the rightsthat we have under 'Your duty of disclosure'.
If your payment details change
If the direct debit arrangements you use to pay by instalment changes, suchas you are issued a new credit card or change your bank arrangements, youmust tell us. You should do this at least seven (7) days in advance of yournext payment date.
Preventing our right of recoveryIf you have agreed not to seek compensation from another person who isliable to compensate you for any loss, damage or liability which is coveredby this Policy, we will not cover you under this Policy for that loss, damageor liability.
Other party's interestYou must tell us of the interest of all parties (e.g. financiers) who will becovered by this insurance. We will protect their interests only if you havetold us about them and we have noted them on your Policy Schedule.
Changing your PolicyIf you want to make a change to this Policy, the change becomes effectivewhen:
we agree to it; andwe give you a new Policy Schedule detailing the change.

Policy comes to an end on total lossIf you have a claim that results in QBE declaring you have a total loss, thePolicy terms have been met by QBE and the Policy comes to an end.
If you paid an annual premium no refund is due to you.
If you were paying by instalments, we will deduct the premium outstandingfor the period of insurance from our settlement payment to you.
Definitions (The meaning of some words)Some words and expressions in this Policy have a specific meaning whichis given below.
MeaningWord or term
the amount shown on your Policy Schedule wehave agreed to insure your vehicle for.
Agreed value
a licence or permit to drive that is in force and heldby you or an insured person at the time of theincident and is current for the class of your vehicle.
Driving licence
spouse or partner, a parent, grandparent, brother,sister, child or grandchild (including in each casehalf, step, or adopted relationships) of an insuredperson.
Family
the person or entity with a security interest in yourvehicle.
Financier
any event which results in a claim on this Policy.Incident
you and any other person who has your permissionto drive your vehicle.
Insured person
the cash purchase price of a vehicle of the sameage, type and condition, in your local area, butexcluding costs and charges for registration, stamp
Market value
duty transfer and any dealer warranty costs. Toassist in determining the market value we may alsouse 'The Red Book' price guide, 'Glass's DealerGuide' or other available information.
any alteration to your vehicle’s standard body,interior, engine, suspension, wheels, tyres orpaintwork which could affect its value, safety,performance or appearance.
Modification

MeaningWord or term
There is no cover for any modification that is notshown on your Policy Schedule. Modifications notinsured could include; mag or alloy wheels, wideor special tyres, a fairing, a spoiler, an air scoop,special paintwork, decals, murals, a pop-top,campervan fittings, a rally-pack, LP gas conversion,a turbo conversion, a sun-roof.
any fitted items owned by you, which are not astandard accessory fitted to the model of yourvehicle. Examples can include a:
Non-standardaccessory
blue tooth kit, sunroof, mag wheels, bull baror permanently fixed global positioning system(GPS);audio visual equipment;rear parking sensors.
There is no cover for any fitted non-standardaccessory unless it is shown on your PolicySchedule.
essential daily items such as clothes, glasses andluggage. Personal items do not include:
Personal items
mobile phones, portable Global PositioningSystems and electronic devices;cash, cheques, credit cards and negotiableinstruments;tools of trade.
any amount we require you to pay under the Policyand includes government charges.
Premium
any child’s booster seat, baby capsule or fireextinguisher owned by you.
Removable safetyequipment
Schedule the Policy Schedule; orthe renewal notice you have paid; orthe alteration advice sent to you.
Important note:You should check to ensure thatall the information is correct in the Policy Schedule.If anything is wrong, contact us immediately.

Standard accessories are automatically insured aspart of the vehicle and therefore are not requiredto be specified.

Sum insured
when we determine that repairs to your vehicle areuneconomical and includes where the repair costsand salvage value when added together are likelyto exceed the sum insured of your vehicle.
Total loss
use of your vehicle for one (1) of the following:Use
private use, which means for:social, domestic, pleasure purposes andtravel to and from work; plusa small amount of time being spent usingyour vehicle for business or work purposes;
business use, which means for:private use; plusthe majority of normal working hours beingspent using your vehicle for business orwork purposes;
commercial use, which means for:private use; plususe in a business:
where your vehicle is licensed for thecarriage of goods; oras a primary producer.
Important note: Insurance is limited for some typesof business or commercial use. Please refer to'When you are not insured - The use of yourvehicle'.

a replacement motor vehicle if insured by usunder the change of vehicle benefit;a substitute vehicle as described under 'Drivinganother vehicle' (page 36);your trailer for the purpose of the insuranceexclusions under 'When you are not insured'(page 37).
Cover typesYou can select one (1) of the following QBE cover types:
Comprehensive; orThird party, fire and theft; orThird party only.
The type of cover you have selected will be noted on your Policy Schedule.
ComprehensiveThis Policy is designed to cover you for theft or damage to the insured vehiclewhich occurs during the period of insurance up to the amount of the suminsured or other specified maximum limit. We also cover your (and certainother person’s we specify) legal liability as a result of damage caused toanother persons property by your vehicle up to the limit shown on your PolicySchedule.

Driver option for comprehensive cover
30 plus nominated driver comprehensive cover
If you choose this option, we will calculate your premium on the basis thatyour car will be driven by no more than two (2) nominated drivers who arethirty (30) years of age or over. The drivers you nominate will be listed onyour Policy Schedule.
The cover provided by this Policy is restricted to your vehicle being drivenby an insured person (as shown on your Policy Schedule) who;
(a) is thirty (30) years of age and over, and;(b) holds a current driving licence.
If at the time of the incident your vehicle is being driven by a person otherthan an insured person (a nominated driver as shown on your PolicySchedule), you will have to contribute towards the cost of the incident bypaying us an undeclared driver excess, as shown on the Policy Schedule.
The undeclared driver excess will not be applied where you can prove to usthat your vehicle was driven:
(i) without your consent;(ii) by a person, in the motor trade who was servicing or repairing it, or
was an attendant parking it, or who used it because a serious medicalemergency had arisen.
In these circumstances you will have to pay all the excesses which wouldnormally apply to the Policy.
Third party, fire and theft coverThird party, fire and theft provides insurance for your legal liability as a resultof damage caused to another person's property by your vehicle up to thelimit shown on your Policy Schedule. This Policy does not cover loss to yourvehicle except in the event that the damage to your vehicle was caused byor arising from fire, theft or attempted theft or in the circumstances describedunder the uninsured motorist benefit in the standard benefits section in thisPolicy on page 25.
Third party only coverThird party only cover provides insurance for your legal liability as a resultof damage caused to another person’s property by your vehicle up to thelimit shown on your Policy Schedule. This Policy does not cover damage toyour vehicle except in the circumstances described under the uninsuredmotorists benefit noted under the standard benefits section in this Policy onpage 25.

Legal liability for damage to another person's property
If you become legally liable for damage to another person's property directlycaused during the period of insurance by:
a part of your vehicle or your trailer attached to it;goods falling from your vehicle or your trailer attached to it, where youhave taken reasonable measures to secure them;the loading or unloading of your vehicle or your trailer attached to it;
then we will pay:
the reasonable cost of the damage for which there is liability; orthe amount awarded by a court in Australia;
up to the limit of liability shown on your Policy Schedule.
Legal liability for injury or death to another person (Gapcover)
If you become legally liable for bodily injury or death to another person directlycaused during the period of insurance by:
a part of your vehicle or your trailer attached to it;goods falling from your vehicle or your trailer attached to it, where youhave taken reasonable measures to secure them;
where you:
have Compulsory Third Party insurance but that insurance does notcover the liability, ordo not need Compulsory Third Party insurance and in the case of yourvehicle it is not being driven at the time of the incident;
then we will pay:
the reasonable amount for which there is liability; orthe amount awarded by a court in Australia;
up to the limit of liability shown on your Policy Schedule.
But we will not pay if you are declined insurance under your 'CompulsoryThird Party Policy' because of some failure by you.
Important Note: There are limits to this insurance – Please refer to Legalliability under the heading 'When you are not insured – Legal liability' onpage 39.

Driving another vehicle
We will insure you under this section when you drive a substitute motorvehicle because your vehicle is being repaired or serviced. This does notinclude a hire car.
But we will not pay for any damage to the substitute vehicle.
Passengers
QBE's legal liability covers damage caused to another person’s property bya passenger who is lawfully travelling in or getting in or out of your vehicleor a substitute motor vehicle.
Other people driving your vehicle
We will also insure under this section an insured person driving your vehicleor the driver of the substitute motor vehicle who is in charge of that vehiclewith your permission.
We will not insure that driver if you knew or should reasonably have knownthat they had been refused:
motor vehicle or motor bike insurance; orthe renewal of motor vehicle or motor bike insurance.
Principals indemnity
We will insure your employer, business partner or principal for legal liabilityincurred following an incident in which your vehicle (other than a substitutevehicle owned by your employer, business partner or principal) is involvedprovided that your vehicle was driven by you or was under your control.
Maritime liability
If your vehicle is being transported by sea between ports within Australia,we will pay your contribution in respect of your vehicle for general averageand salvage charges incurred by a shipowner where necessary for the safetyof the ship and cargo, provided you are liable to contribute under MaritimeLaw.
Legal costs
We will pay all legal costs reasonably incurred with our written consent arisingfrom a claim for which you are insured under this section.
Limit of liability
We will not pay more than the limit shown on the Policy Schedule for ourtotal liability under this section in respect of all claims arising out of oneincident or series of related incidents, including all costs, charges, expensesand legal costs. Any excess payable by you is included in the liability limit.

When you are not insured
You are not insured for:
For example, but not limited to:Theft or damage to your vehicle
Vehicle left unlocked at asupermarket car park.
When you or an insured personleave your vehicle unattended andunlocked in a public place.
Having a secret agreement withanother person to steal your vehicleor your trailer.
When the theft is by a person actingwith the express or implied consentof you or an insured person.
When your vehicle is stolen by afriend or prospective buyer afteryou have given them permission touse it.
When the theft is by a person towhom you have lent your vehicle,but this will not apply if the incidentis theft by deception and you havekept the driving licence or otherform of legal identification of thatperson.
When the damage is: (i) wear and tear of your vehicleor trailer resulting fromageing or loss of valuethrough ordinary use.
(i) the result of normal wear andtear, rust or corrosion to yourvehicle.
(ii)(ii) we would not pay to repairrust damage, a worn out
structural failure, electrical ormechanical breakdown.
engine, old radiator andwater hoses or a faultyelectrical system.
(iii)(iii) putting unleaded petrol in avehicle that runs on diesel.
a result of using a type of fuelthat is not intended for thespecific make and model ofyour vehicle and engine.
When your vehicle is stolenbecause it was left at the scene ofan accident when it could havebeen readily towed to our holdingyard or another place of safety.
When you or an insured personhave not taken all reasonable stepsto protect your vehicle from beingstolen or further damaged after ithas been involved in an incident.
Damage to tyres caused by theapplication of the brakes or bypunctures, cuts or bursting.
When the damage is to the tyres ofyour vehicle unless it was causedin the incident.

If the incident is caused by:lawful seizure, repossession orother operation of law;invasion, war, civil war orrebellion;nuclear weapons, nuclear fuel,waste or material;acts of terrorism where suchact is directly or indirectlycaused by, contributed to by,resulting from, or arising out ofor in connection with biological,chemical, or nuclear weapons,pollution or contamination.
Sanction limitation and exclusion clause
You are not insured under any section of this Policy where a claim paymentbreaches any sanction prohibition or restriction under United Nationsresolutions or the trade or economic sanctions, laws or regulations ofAustralia, the European Union, United Kingdom or United States of America.

Making a claim
What you or an insured person must do
Prevent further loss or damage by taking all reasonable stepsto reduce the loss or damage and prevent any further loss ordamage.
Inform the Police immediately following theft or maliciousdamage or where you are required by law to do so.
At the scene of the accident take full details of all vehicles,drivers and witnesses. This information will be required toprocess your claim. Make a note of:
The accident:
date and time,road conditions (wet or dry),location,if appropriate, sketch map of what actually happenedincluding the direction of travel of the vehicles involved,details of any obstacles and names of the streets.
Other drivers and vehicles:
name of driver,driver's address,driver's phone number,make of vehicle,registration number,name of owner,owner's address,owner's phone number,owner's insurance company.
Witnesses:
name,address,daytime phone number.
Call us on 1300 734 728 as soon as possible when you discoverthat an incident likely to result in a claim has occurred. We willexplain the claims process so you understand what you needto do next.

What you or an insured person must do
The person calling to notify us of a claim must be listed as aninsured person on the Policy. If the person calling is not a listedinsured person, we must obtain written authority from the listedinsured before lodging a claim.
Complete a claim form, if we require it.
Return the completed claim form promptly together with allletters, documents, valuations, receipts or proof of ownershipthat you have been asked to provide, otherwise we cannotprocess the claim.
Assist us with your claim. Before we will pay anything underthis Policy, you and any relevant insured person, must havecomplied with all the requirements of this section and continueto give us any information we request and provide reasonableassistance throughout the claim or any proceedings.
At our request, we may need you to:provide written statements under oath;be interviewed about the circumstances of the claim;allow us to inspect (and if we wish) take possession of yourvehicle.
Pay your excess – Refer to page 49 for more information onyour excess and when you are required to pay an excess.
Provide every notice or communication from another party.Youor any relevant insured person must provide us as soon aspossible with every notice or communication receivedconcerning a claim by another person or concerning anyprosecution, inquest or other official inquiry arising from theincident.
What you or an insured person must not do
Admit guilt or fault (except in court or to the Police).
Offer or negotiate to pay a claim.
Admit liability.
Dispose of any damaged items without first seeking ourapproval.

What you or an insured person must not do
Authorise repairs. Except for essential temporary repairs, see'standard benefits' on page 28, you are not authorised tocommence repairs without our approval.
Delay contacting us whenever possible to notify us of an incidentwhich could lead to a claim on this Policy.You may have tocontribute towards your claim if your late notification results inhigher costs for us or harms our investigation opportunities.
Provide us with false or misleading information. We may denypart or all of your claim if you or an insured person are nottruthful and frank in any statement made in connection with aclaim or if a claim is fraudulent or false in any respect. We willreport any suspected fraudulent act to the Police for furtherinvestigation.
Where more than one (1) person is insured
If more than one (1) person is insured under the Policy, we will treat astatement, act, omission or a claim by an insured person as having beenmade by all of them.
How a claim affects your sum insured
If we pay a claim:
on a total loss basis, your Policy with us ends (see 'How your Policymay be cancelled' on page 51),for the cost of repairs to your vehicle, your sum insured remains thesame as it was before the claim.
For example, if your sum insured is $20,000 and we pay a claim for $3,000,your sum insured remains at $20,000.
Important note: Following a claim on a specified item such as a CD playeryou should make sure that the replacement item is added to your PolicySchedule.
What happens when your vehicle is a total loss
At QBE, where we decide your vehicle is a total loss, and we agree to payyour claim, your Policy comes to an end. How your claim is settled will dependon whether you have taken out an agreed value policy or a market valuepolicy.
If a security interest is registered over your vehicle, we will:
pay the financier the sum insured, up to the amount required to dischargeyour loan or finance agreement; andif applicable, pay you the remaining balance of the sum insured.

If no security interest is registered over your vehicle, we will:
pay you the sum insured; orreplace your vehicle, provided:
you are the original owner and have insured your vehicle with us fromnew, andyour vehicle is less than two (2) years old and has been driven lessthan 20,000kms, andyour vehicle was originally insured for the purchase price
if a similar make and model is available.
Discharging a security interest
You must take the necessary steps we require to remove any security interestin your vehicle after your loan or finance agreement has been discharged.
Premium after a total loss
If you have paid your Policy in full there is no refund of
premium
as we have fulfilled our contract to you.
If you pay your Policy in instalments we will deduct any unpaid instalmentamount up until your Policy renewal date from the total sum insured.
If you purchase another vehicle, a new insurance policy is required.
Vehicle salvage
If we have replaced your vehicle or paid your sum insured, your vehiclebecomes our property. If you choose to keep your vehicle in its damagedcondition then the salvage value will be deducted from your sum insured. Ifwe are replacing your vehicle you will need to pay us the salvage value first.
We will receive any vehicle registration refund, in states where we are entitledto do so.You will provide us with a signed written authority to enable us torecover this refund.
How claims administration and legal proceedings areundertaken
When a claim is lodged under this Policy, we have the right at our discretionto exercise all the legal rights of an insured person relating to the incidentand to do so in their name.
We will take full control of the administration, conduct or settlement of theclaim including any recovery or defence that we may consider necessary.
We will also report any suspected fraudulent act to the Police for furtherinvestigation.

Contribution
Where the incident insured by this Policy is also insured elsewhere and wehave paid more than our reasonable share of your claim, we may exerciseour right to seek contribution from the other insurer or insurers.
How GST affects any payments we makeThe premium payable for this Policy is subject to GST.When we pay a claim,your GST status will determine the amount we pay.
When you are:
not registered for GST, the amount we pay is the sum insured/limit ofliability or the other limits of insurance cover including GST;registered for GST, we will pay the sum insured/limit of liability or theother limits of insurance and where you are liable to pay an amount forGST in respect of an acquisition relevant to your claim (such as servicesto repair a damaged item insured under the Policy) we will pay for theGST amount.
We will reduce the GST amount we pay for by the amount of any input taxcredits to which you are or would be entitled if you made a relevantacquisition. In these circumstances, the Input Tax Credit may be claimablethrough your Business Activity Statement (BAS).
You must advise us of your correct Australian Business Number and TaxablePercentage.Your Taxable Percentage is your entitlement to an Input TaxCredit on your premium as a percentage of the total GST on that premium.
If you don’t tell us your correct GST status, any GST liability is yourresponsibility.
Where the settlement of your claim is less than the sum insured/limit ofliability or the other limits of insurance cover, we will only pay an amount forGST (less your entitlement for Input Tax Credit) applicable to the settlement.This means that if these amounts are not sufficient to cover your loss, wewill only pay the GST relating to our settlement of the claim.
We will (where relevant) pay you on your claim by reference to the GSTexclusive amount of any supply made by any business of yours which isrelevant to your claim.
If, after we have assessed your claim, you are required to enter into a contractwith a third party to replace or reinstate lost or damaged items that we haveagreed to pay under this Policy, you will enter into that agreement with thethird party as our agent unless advised otherwise.
GST, Input Tax Credit (ITC), Business Activity Statement (BAS) andAcquisition have the same meaning as given to those expressions in A NewTax System (Goods and Services Tax) Act 1999 (Cth) and related legislationas amended from time to time.

Repair information
Choice of repairer
If you lodge a claim and we agree to repair your vehicle we can refer you toa QBE accredited repairer or you may nominate a repairer of your choice.
You must not authorise the repair of your vehicle without our written authority.
Where we recommend our accredited repairer
We will:
provide you with the names of two (2) repairers for you to obtain quotesfrom;need to inspect your vehicle prior to authorising repairs; andpay the cost of repairs directly to the repairer we authorise.
Where a QBE assessment centre is available to you we will advise of thisprocess.
Where you nominate a repairer
You must:
obtain a quote from a repairer of your choice who is appropriatelylicensed, however if you do we may require you to obtain a second quotefrom a repairer of our choice; andallow us to assess your vehicle prior to authorising repairs.
We will:
pay the reasonable costs, as determined by us, to have your vehiclerepaired, directly to the repairer we have authorised to carry out therepairs.
In determining reasonable costs we consider a number of factors including:
the advice of an experienced motor vehicle assessor that we appoint;a quote from another repairer of our choice; andany adjustment allowing for method of repair.
In the event that repairs are carried out without our authority we will notprovide our lifetime guarantee (see page 19) on repairs and where permittedby law will pay only what we determine to be the reasonable cost of repairs.

Replacement of damaged parts
Within Manufacturers Standard New Car Warranty period
If your vehicle is covered under the Manufacturers Standard New CarWarranty (not including an extended warranty period) we will only usemanufacturers approved parts in repairing your vehicle. In the event that thepart is a windscreen or a body glass then Australian Design Rule compliantparts may be used.
Outside Manufacturers Standard New Car Warranty
We may use new, recycled or reconditioned parts when repairing vehicleswhich are no longer covered under the Manufacturers Standard New CarWarranty. Where the use of recycled or reconditioned parts is requested wewill only use the parts if they are equal to or exceed the quality of the partbeing replaced.
You may have to contribute towards the cost of repairs
We are entitled to require you to contribute towards the cost of repairs wherethe condition or appearance of your vehicle improves as a result of replacingold parts with new parts or repainting more than the damaged area.
Contribution
Where the incident insured by this Policy is also insured elsewhere and wehave paid more than our reasonable share of your claim, we may exerciseour right to seek contribution from the other insurer or insurers.
If parts and accessories are not available
Where parts and accessories are not available locally we will only pay:
the cost of parts and accessories of an equivalent make and model ofmotor vehicle listed in the latest suppliers list within the State or Territoryin which repairs are being carried out; andsurface freight costs of getting parts to the repairer.
We will not pay the extra cost of specially made parts for your vehicle whenthe parts or accessories required for repair are not readily available.
Excess.The amount you pay towards aclaimAn excess is the amount which you may have to pay each time you makea claim. Each excess is printed on the Policy Schedule. If following an incidentmore than one (1) excess applies, you will have to pay the total of all theexcesses that apply to you. If we determine your claim comprises of morethan one (1) incident, you will have to pay the applicable excesses for eachincident.

This is the first amount you have to pay, allvehicles carry a standard excess.
A standard vehicleexcess
If the driver at the time of the incident is within thespecified age group shown on your PolicySchedule.
An age excess
This excess does not apply when:
the only damage to your vehicle is to thewindscreen or window glass; orthe incident is a result of fire, explosion,lightning, flood, theft or where your vehicle isdamaged while parked.
This applies when the Policy Schedule has nameddrivers listed and your vehicle is being driven bya person who is not named on the Policy Scheduleas a driver.
An undeclareddriver excess
It is your responsibility to notify us of drivers ofyour vehicle because your premium or excesscould be affected.
This is an excess we may require under yourPolicy. We would not have accepted you or yourvehicle for insurance without this excess.
An imposed excess
If an imposed excess has been applied it will beshown on the Policy Schedule.
This is an excess that you have elected to haveto reduce your premium. A voluntary excess ispaid in addition to your standard excess and anyother applicable excesses.
A voluntary excess

If your vehicle is damaged in a collision with another vehicle, you will nothave to pay any excess if all of the following apply:
we agree that the other driver involved in the collision was totally at fault;you can give us the name and address of the other driver and theregistration number of the other vehicle, andthe other driver is not a family member.
How your Policy may be cancelled
Cancellation by you
You may cancel this Policy at any time by giving us notice in writing.
Cancellation by us during the period of insurance
We may cancel this Policy on any of the grounds set out in the InsuranceContracts Act 1984 (Cth) and we will always put this in writing to you.
When your vehicle is a total loss
Where we have paid a claim on a total loss basis your Policy with us isdeemed to have been fulfilled and:
there is no refund of any premium, orif you have been paying your premium by instalments we will deductany unpaid instalment amount up to your Policy renewal date from thetotal sum insured.
Cancellation by us on expiry of this Policy
We may cancel this Policy at the end of the period of insurance. If this isabout to happen we will tell you in writing within the terms set out in theInsurance Contracts Act 1984 (Cth).
Refund of premium
On cancellation, a refund of the premium will be calculated equal to theunexpired period of this Policy less an administration fee and anynon-refundable government charges.
