I. INTRODUCTION

1. The Regional Roads Development Project (RRDP) is being implemented in four provinces of Indonesia, namely West and North Kalimantan; Central and East Java – envisaged to address important national or strategic road corridors in northern Kalimantan and southern Java to encourage economic growth in these less developed and poorer areas of Indonesia. The rehabilitation, capacity expansion and new construction of roads will improve connectivity and access to services. Specifically, improved road infrastructure in southern Java is necessary for increased economic growth to improve access to markets and to attract investment in that area. Road network development in Kalimantan will ensure that economic development will occur in less developed and remote areas.

2. The Project is a four-year undertaking by the Director General of Highways (DGH or Ditjen Bina Marga) of the Ministry of Public Works and Public Housing (MPWPH) purposely to rehabilitate, improve or newly construct about 476 km of roads and bridges where of the 476 km subproject roads, about 3,860 m will involve rehabilitation or replacement of bridges and 40 km will be construction of new roads in agricultural areas with existing earthen tracks in some sections.

3. Project financing is with the Asian Development Bank (ADB) and the Islamic Development Bank (IDB) as approved 24 November 2011 by the ADB Board. The Government of Indonesia and ADB signed the loan agreement on 07 May 2012. The ADB-financed component covers 399 km of road (3,390 of which are bridges) while the IDB-financed component includes 77 km of road (470 m of which are bridges).

1.1. Backgrounder

4. RRDP is divided into eleven (11) construction packages. Land Acquisition and Resettlement Plans (LARP) were prepared in October 2011 and uploaded on to the ADB website (Table 1).

Note: Packets 2 and 3 have minimal impacts, if at all at time of LARP preparation thus simple LARPs were developed for straightforward implementation and compliance.

5. Per Loan Agreement,

Schedule 5, Para 5: The Borrower shall, and shall cause the Project Executing Agency to ensure that any involuntary resettlement and/or activities impacting ethnic minorities be carried out in accordance with the agreed LARAPs, ADB Safeguard Policy Statement (SPS), and the Borrower’s relevant laws. In case of differences between Borrower’s laws and regulations and the SPS, the SPS shall prevail. In case of such involuntary resettlement, the Borrower shall ensure (a) the Project Executing Agency shall be responsible for internal monitoring of resettlement activities, including engagement of an external monitoring agency 1 month before commencement of the resettlement activities. The internal and external monitoring reports shall be submitted to ADB every quarter and uploaded on DGH's website within 2 weeks of their submission; and such monitoring and reporting activities shall be carried out until resettlement has been completed; and (b) the timely provision of counterpart funds for resettlement in order to satisfy the requirements and objectives of resettlement.

Schedule 5, Para 8: The Borrower shall, and shall cause the Project Executing Agency to ensure that ADB’s SPS requirements are applied and implemented for all Project components regardless of financing source.

6. As such, internal monitoring reports are prepared to determine the extent the LARP documents have been implemented in the field and identify constraints and problems encountered during the implementation process. Specifically, this report intends to cover the following concerns:

Compensation and/or other entitlements are provided as per Final LARP, with no discrimination according to gender, vulnerability, or any other factor;

Livelihood restoration measures are designed and implemented including modifications in the programs and provision of additional cash and in-kind assistance to the participating affected households as and when necessary;

Public information, public consultation and grievance redress procedures are followed as described in the Final LARP;

Capacity of APs to restore/re-establish livelihoods and living standards. Special attention given to severely affected and vulnerable households.

Affected public facilities and infrastructure are restored promptly; and

The transition between relocation or site clearing and commencement of civil works is smooth and that sites are not handed over for civil works until affected households have been satisfactorily compensated, assisted and relocated.

1.2. Timelines

7. Key timelines (Table 2) are pertinent to note under social safeguards as Project management transitions to more relevant and comprehensive documentation of forthcoming monitoring periods.

1.3. Land Clearance/Civil Works Schedules

8. Table 3 provides a summary of affected households as monitored viz land clearing/civil works being conducted within the Project sites during the monitoring period. With the 2 Draft LARPs, it will be noted that an additional 333 AHs have been added: 245 for Aruk and 88 for Tanjung Harapan. Thus the total AHs for the project changed from 2,017 in the previous monitoring periods to 2,350 in this current monitoring period. The numbers will be finalized once the new LARPs for West Kalimantan are approved and implemented.

1.4. Funds Availability and Sourcing and Limitations to LARP Implementation

9. Table 4 summarizes availability and source of funds for LARP implementation and the associated cost. LARP budget is drawn from national budget. In both Kalimantan and Java provinces, timely release of funds was a constraint despite assurances from local governments.

10. In Central Java Lot 2 – CW-02 (Griwoyo-Duwet) is currently experiencing constraints that may impinge on progress of civil works inasmuch as 7 AHs refuse to accept the compensation package now kept with the court. Two packages in West Kalimantan require the preparation of LARPs as these were not covered in the original LARPs produced in 2011.

11. This report covers the period September to November 2016. For this monitoring period, a total of 3 nationals constituted the CTC Social Safeguards Team: 2 Community Development Specialists and 1 Social Impact Specialist. The two Specialists were joined by a new one midway this monitoring period.

12. The International Specialist was engaged towards the latter part of November 2016 as home support.

II. GENERAL PROGRESS IN LARP IMPLEMENTATION

2.1 LARP Preparation

13. Aruk. A LARP for whole length project for 30-RCP-03 (CW-07) had been completed on October 2011, but did not cover widening to 4 (four) lanes road pavement for segments STA 40 + 800 to STA 46 + 423 (5.623 KM). Thus on November 10 to 19, 2015, the Safeguard team conducted a field survey that began in STA.40-800 s / d STA. 46 + 423 (5,623 KM). The survey results are in the process of data processing, for the preparation of the LARP. The Draft LARP was submitted for review and discussed with the Safeguard Officer (Resettlement) ADB and PMU at ADB Office Jakarta on 27 January 2016. The revised Draft LARP was submitted unofficially to ADB 0n 24 June 2016, but document completion awaits final decisions from the Ministry of Forestry associated with landuse change from protection forest to APLThis was kept hanging during this monitoring period awaiting for decisions from top management as there was stale mate in the arrangement for compensation coming from the Ministry of Forestry.

14. Tanjung-Harapan - Missing Link. Originally, the road section connecting Sambas-Tanjung Harapan in West Kalimantan located between packages CW-06 and CW-07 was not included under the Project as this was intended to be implemented under RRDP II. However, to ensure connectivity of the road sections in West Kalimantan, this section was subsequently proposed to be included under the current RRDP. ADB therefore approved the inclusion of this section under a contract variation of package CW-06 on 15 June 2016. The completion of this Resettlement Plan (RP) is a precondition for signing of the contract addendum under Package CW-06. Under RRDP II, Draft RP was prepared in January 2014. This RP takes off from the 2014 Draft RP to ensure all APs along the road section of Sambas–Tanjung Harapan are fully compensated in line with the ADB SPS 2009. To finalize the LAR{, the Detailed Measurement Survey (DMS) was carried out from 2 – 5 August 2016 by the Core Team Consultant (CTC) safeguard team in collaboration with the local government. Draft LARP was submitted to ADB on 11 October 2016. ADB give response on 24 October 2016 included some comments. Revision of Draft LARP Sambas-Tj. Harapan was submitted to ADB on 7 November 2016. Based ADB request, on 9 November 2016 was carried ot discussion with ADB, PMU-RRDP and CTC, ADB asking related depreciation cost that apllied in structure price. ADB request to meet the MAPPI for advice. Currently ongoing finalization of the LARP document.

2.2 LARP Implementation

2.2.1 East Java

15. No monitoring conducted and status remains the same as the previous monitoring period. CTC focus on 2 LARP preparation in West Kalimantan.

2.2.2 Central Java

16. Compensation Payment. On 5-6 November 2016, CTC conducted a site visit to Giriwoyo – Duwet to determine terms and conditions for involuntary resettlement and the reasons as to why AHs refuse. Of the 8 AHs, 7 AHs remain to collect their compensation payment from the District Court office for Package 24-RCP-02 (CW-02). Figure 1 indicates thee location of the AHs relative to the project. Table 5 on the other hand provides information on the the affected area, compensation value, and comments of the AHs. Appendix 1 is a photodocumentation of the losses.

17. Income Restoration. No monitoring conducted and status remains the same as the previous monitoring period.

2.2.3 North Kalimantan

18. As of this monitoring period, there has still been no hand over from the Bulungan LG to the DGH as regards LARP Implementation. CTC similarly has not included monitoring activities for Bulungan and Nunukan this monitoring period – both for compensation and income restoration.

2.2.4 West Kalimantan

19. Activities related to IRP was not monitored within this period as focus was on the verification and preparation for Aruk LARP and start of preparations for the CW-6 LARP. Discussions on IRP still have to be made and DGH with CTC to follow through.

20. Aruk. Continuous improvement if the Aruk LARP was done. A total of 245 households will permanently be affected by the 4-lane subproject of which more than half are found in Desa Kaliau, followed by those from Desa Tapang (30%) and Desa Sanatab (11%). There are four general types of losses or impacts under this RP: (i) loss of land, (ii) loss of structure, (iii) loss of trees and crops, (iv) loss of business income, and (v) high risk of impoverishment or vulnerability.

21. Tanjung Harapan. The detailed measurement survey (DMS) for all potential AP losses due to the project was conducted from 02 - 04 August 2016 by the Core Team Consultant (CTC) in collaboration with the local government personnel of District Bina Marga (DGH), Sambas District, Bappeda, Satker, and PPK. Data was processed and completed during this monitoring period. There are four general types of losses or impacts under this RP: (i) loss of structure, (ii) loss of trees, (iii) loss of business income, and (iv) high risk of impoverishment or vulnerability. A fifth potential impact is the temporary loss of land during civil works. A total of 88 AHs or 428 persons will be affected by the partial or total loss of structures (main and secondary) and footbridges, while the local government will lose a police outpost and 71 trees.

III. OUTSTANDING ISSUES ON RESETTLEMENT, CORRESPONDING PLAN OF ACTION, AND STATUS

3.1. Central Java

22. Outstanding issues from Central Java subprojects for this monitoring period are summarized in Table 6 with corresponding follow up actions, status and comment/s.

Compensation for land loss. For Package 24-RCP-02 (CW-02): In Giriwoyo – Duwet, there are still 7 APs from 8 APs of people who have not taken their land compensation payment from District Court office.

CTC engaged with the AHs and secured details about IR and reasons for not agreeing to project terms.

Still unresolved though court already decided in favor of the government project. Discuss with DGH.

Empowerment of vulnerable groups and seriously affected.

Allowance for vulnerable groups, transition allowance, and deduction of depreciation compensation: The Public Works office of Kebumen, on behalf of Kebumen Regency, said that they can not pay the (1) transition allowance and vulnerable group, (2) Income restoration, and (3) Deduction of depreciation

No follow up action done CTC to present verification findings to LG and DGH. CTC to assist DGH and Dinas to develop social programs to incorporate AHs towards income restoration. CTC to follow up developments.

Payment of transition allowance for the relocation AHs and stall owners affected (could take the form of cash or in kind).

Compensation payment for lost land; Further, compensation for lost lands acquired for the project located are in the existing ROW, forest areas, and state land used by peoples for farming without legal evidence.

Assistance to vulnerable groups. APs that require relocation/fixed of shops/ structures should be provided easier access to materials and provision of labour, as needed. Assistance may be in cash or in kind.

CTC followed up. Per LG, while there is no program addressing income restoration from LG to AHs, the Bulungan LG is committed to addressing income restoration.

Requires further discussions and follow up by CTC. Review verification data of AHs and suggest programs as aligned with LG programs.

Nunukan

The Mission reminded that any losses (affected land, buildings, and trees/crops) should be compensated at replacement cost either in cash or in kind agreed by the affected HHs prior to the land clearing commencement.

The DGH was committed to settle the outstanding compensation payment by end of 2015.

3.4. West Kalimantan

25. Resettlement impacts have been verified for Package 6 - the Tebas-Singkawang (Section 1) of West Kalimantan Province and incorporated in the September – November 2015 monitoring report. Table 9 provides the summary outstanding issues, follow up actions and status for this monitoring period.

IV. OTHER CONCERNS AND NOTATIONS

5.1. Internal and External Monitoring

26. External monitoring is still a concern and DGH has to coordinate the different units tasked with this undertaking.

27. With respect to internal monitoring, it is currently being addressed by DGH and reports from 2016 being completed, this report being the last save the quarter bridge for 2016-17.

5.2. Disclosure, Consultation, Participation, and Grievance

28. The Project Information Booklets developed at IOL stage for the 2 new LARPs will have to be updated and circulated for West Kalimantan; PIBs for North and West Kalimantan to be updated yet to incorporate results of the verification process.

5.3. Gender Mainstreaming

29. No movement with respect to LARP concerns on Gender Mainstreaming.
