th The 16 meeting of the Forum of Pakistan th Ombudsman (FPO) was held on 19 October, 2016 at Islamabad Club, Islamabad. Mr. Abdur Rauf Chaudhry, Federal Tax Ombudsman, who is also the President of the FPO, chaired the meeting which was attended by the Federal and Provincial Ombudsmen. After opening remarks by the Chair, the agenda items were taken up one by one for consideration of the participants. A presentation on agenda items was made by Mr. Abdul Khaliq, Secretary FPO. After detailed discussion following decisions were reached: The Forum was apprised on the Working Paper sent to the IOI General Secretariat for evolving a common strategy in the forthcoming meetings of IOI BoD and the General Assembly scheduled in Bangkok. The Event was important for Pakistan as we had proposed Agenda items for increasing the number of directors from three to five on IOI Board from Asia Region as well as election of the IOI President on rotation basis. Secondly, Ombudsman Sindh was contesting for the post of President for Asia Region to replace Wafaqi Mohtasib Pakistan. Hon'ble Ombudsman AJK apprised the Members that Government of AJK is considering a proposal for merger of Ehtisab Bureau, AJK Mohtasib Office and Anti Corruption Establishment. The Forum resolved to take up the matter with AJK President, Prime Minister and other high ups about the necessity of Ombudsman institution as a separate entity. Concluding on an Agenda Item it was appreciated that 'Single command' of the Secretariats of the three Associations (FPO, AOA and IOI) has performed quite effectively. The Forum decided that managing the FPO, AOA, IOI Asian Region and OICOA Secretariats should continue under the supervision of Mr. Abdul Khaliq as Secretary FPO; FTO will provide necessary personnel support to the FPO Secretariat. thOmbudsman (FPO) was held on 19 October, 2016 at Islamabad Club, Islamabad. Mr. Abdur Rauf Chaudhry, Federal Tax Ombudsman, who is also the President of the FPO, chaired the meeting which was attended by the Federal and Provincial Ombudsmen.

After opening remarks by the Chair, the agenda items were taken up one by one for consideration of the participants. A presentation on agenda items was made by Mr. Abdul Khaliq, Secretary FPO. After detailed discussion following decisions were reached:

The Forum was apprised on the Working Paper sent to the IOI General Secretariat for evolving a common strategy in the forthcoming meetings of IOI BoD and the General Assembly scheduled in Bangkok. The Event was important for Pakistan as we had proposed Agenda items for increasing the number of directors from three to five on IOI Board from Asia Region as well as election of the IOI President on rotation basis. Secondly, Ombudsman Sindh was contesting for the post of President for Asia Region to replace Wafaqi Mohtasib Pakistan.

Hon'ble Ombudsman AJK apprised the Members that Government of AJK is considering a proposal for merger of Ehtisab Bureau, AJK Mohtasib Office and Anti Corruption Establishment. The Forum resolved to take up the matter with AJK President, Prime Minister and other high ups about the necessity of Ombudsman institution as a separate entity.

Concluding on an Agenda Item it was appreciated that 'Single command' of the Secretariats of the three Associations (FPO, AOA and IOI) has performed quite effectively. The Forum decided that managing the FPO, AOA, IOI Asian Region and OICOA Secretariats should continue under the supervision of Mr. Abdul Khaliq as Secretary FPO; FTO will provide necessary personnel support to the FPO Secretariat.

Conference, was held in Bangkok (Thailand) from 14 – 19 November, 2016. The theme of the Conference was “ The Evolution of Ombudsmanship”. The Coference was diveded in eight Breakout Sessions, where following sub-themes were discussed;

Assessment and evaluation of Ombudsman work.

Human rights based approach to the Ombudsman's work.

Multiple jurisdictions of Ombudsman offices.

Innovative ideas in the Ombudsworld.

Challenges due to multiple mandates.

Collobaration with civil society - benefits and challenges.

Freedom of information and the Ombudsman.

Ombudsmen in times of crises or under threat. On Invitation of the IOI and host of the World Conference, Office of the Ombudsman Thailand, Mr. M Salman Faruqui, Federal Ombudsman of Pakistan, also President IOI Asia Region, delivered his address on Speedy Complaint Resolution (SCR) in a plenary session of the Conference.

While, highlighting the salient features of the system the Hon'ble Federal Ombudsman said that in order to perform our functions in a scientific manner, we have refined and fine-tuned a state-of-the art Complaint Management Information S y s t e m ( C M I S ) . A c o m p l a i n t c a n b e l o d g e d

online, in person, by post, through e-mail or through dedicated telephone line and is immediately registered through this System. This CMIS tracks each case, through all its stages, from first registration to final disposal; it juxtaposes each stage against its stipulated time-line and alerts delays through a colour-coded warning system. The CMIS can be accessed by the complainant and the Agency. Thus, there is instant check-back in real time and full transparency. This CMIS keeps everyone on the straight and narrow. The complainants get SMS alert at the time of registration of complaints, scheduling of hearing and final disposal of their complaints. The CMIS has been shared with some other Ombudsman institutions as well the Supreme Court of Pakistan and its Arabic and French version has been offered for sharing with the OIC countries.

While, further elaborating the SCR, he said that we have taken a fundamental and far reaching new initiative. We notify Grievance Officers in all the agencies of the Federal Government from amongst the senior officers working in the respective Agencies nominated by their heads to instantly investigate and redress complaints of maladministration within their respective agencies. They have the authority under the Ombudsman's laws to informally conciliate, amicably resolve, stipulate, settle or ameliorate, without written memorandum and without the necessity of docketing, any complaint or issuing any official notice. Our experience has been most encouraging. On-the-spot complaints - without any docketing let alone the other formal procedures - are being resolved instantly. We tried these at all international airports in Pakistan by establishing One Window Facilitation Desks having representation from all the concerned Agencies. The Civil Aviation Authority of Pakistan has informed us that 85% of complaints of overseas Pakistanis were instantly resolved during the last six months.

The Federal Ombudsman of Pakistan Mr. M Salman Faruqui appointed five Commissioners for prompt redressal of Business Community complaints. These Commissioners will hear the complaints in the provincial headquarters' offices of the Federation of Pakistan Chambers of Commerce and Industries (FPCCI). He announced this initiative in a ceremony held on December 1, 2016 in the headquarter office of FPCCI at Islamabad. Mr. Faruqui emphasized on the Government to cooperate and provide every possible facility in resolving the business community problems. He also emphasized on the business community to obtain representation in the World Trade Organization (WTO) for strengthening the national economy.

During the ceremony Hon'ble Mr. Abdur Rauf Chaudhry, Federal Tax Ombudsman, President FPCCI Mr. Abur Rauf Alam, senior officers of the offices of Wafqi Mohtasib and the Federal Tax Ombudsman and other office holders of FPCCI were present. On this occasion, an MOU between Federal Ombudsmen and FPCCI was also signed. According to MOU, cooperation will be enhanced between the Mohtasib institutions and the FPCCI. Thus business community will be able to lodge their complaints directly as well as through FPCCI and other Chambers of Commerce. MOU was signed by Hon'ble Federal Ombudsman of Pakistan Mr. M Salman Faruqi, Hon'ble Mr. Abdur Rauf Chaudhry, the Federal Tax Ombudsman and President FPCCI Mr. Abur Rauf Alam.

IOI Board of Directors Meeting th

IOI Board Meeting was also held in Bangkok on 14 November, 2016 where in, upon recommendations of Regional President, the Board decided to recommend to the IOI General Assembly for ratification of IOI membership to the following Members;-

a. Syed Pir Ali Shah, Provincial Ombudsman

Sindh for Protection against Harassment of

Women at Workplace.

b. Mr. Mumtaz Hussain Naqvi, the

Ombudsman of Azad Jammu & Kashmir-

Pakistan.

c. The Ombudsman (Commission) of Gangwon

Province , Republic of Korea.

During the IOI Board of Directors meeting, Mr. M Salman Faruqui as Asian Region President presented the IOI Asian Region Report for the last four years. He gave Presentation on “Expansion of IOI Asian Region”. A proposal was also placed for appointment of IOI President on rotational basis , on the anology of the United Nations.

At its Bangkok meeting held on 17 November 2016, the IOI Board of Directors held elections to the Executive

Committee of the IOI. Newly elected Officers of the IOI Executive Committee are as follows: IOI President: Mr. Peter Tyndall (Ireland) IOI 1st Vice-President: Ms. Diane Welborn (USA) IOI 2nd Vice-President: Mr. Chris Field (Australia) IOI Treasurer: Mr. Viddhavat Rajatanun (Thailand)

During the meeting the elections of the Regional President were also held and Mr. Asad A s h r a f M a l i k , t h e P r o v i n c i a l Ombudsman Sindh was elected as IOI Asian Region President for next four years.

Commenting on the Withholding Tax, he said that the 18th constitutional amendment had empowered the provinces to levy taxes on service sectors. He said he was fully aware of the problems being faced by the business community.

He announced that FTO regional offices would soon be established at Sialkot and Gujranwala for providing early relief to the local exporters/complainants at local level within a stipulated period of 60 days.

In a Q & A session the members of the SCCI and Tax Bar showed concern about the pendency of refund cases. They urged the Hon'ble FTO to take up such cases with the highups and resolve the concerns and issues of Sialkot exporters at the earliest.

� At the end Acting SCCI President Mr. Adnan Arshad Sethi thanked the hon'able FTO and other participants of the meeting and presented a commemorative shield of SCCI to him.

� Other participants were Former President of SCCI Dr. Muhammad Aslam Dar, Chairman Department Committee SCCI Chaudhry Ahmed Zulfiqar Hayat, Former Senior Vice President SCCI and Senior SCCI Member, Mian Muhammad Anwar, Chairman Readymade Garments Association Mr. Ijaz Ahmed Khokhar, President Sialkot Tax Bar Association Mr. Shakeel Ahmed Khan, Former Vice President SCCI Mr. Malik Naseer Ahmed, Senior SCCI Member and Former Senior Vice President SCCI Mr. Ayub Khan and Members of Tax Bar Mr. Arshad Nawaz and Mr. Akram Raza.

� During his visit to Sialkot the Hon'ble Federal Tax Ombudsman Mr. Abdur Rauf Chaudhry and his team also visited the FBR Regional Tax office Sialkot and have an update knowledge about the operation of the regional tax office.

In order to get awareness of the problems and issues being faced by the industrialists and exporters and developing more interaction with them the Hon'ble Federal Tax Ombudsman Mr. Abdur Rauf Chaudhry and his team visited Sialkot Chamber of Commerce and Industry (SCCI) on October 5, 2016. The other team members were Chief Coordinator Mr. Abdul Khaliq, Advisor (I&M) Mr. Muhammad Siddique, Advisors Incharge, FTO Lahore Regional Office, Mr. Munir Qureshi, and Advisor Customs and Sales Tax, Mr. Omer Farooq.

Advisor (I&M) Mr. Muhammad Siddique gave introductory presentation about the working mechanism of the FTO office. He shed light on the historical perspective and working of the Ombudsman office.

Acting SCCI President Mr. Adnan Arshad Sethi demonstrated the the development of Sialkot industry and its contribution in the national exchequer in terms of exports and revenue generation through a documentary. He remarked that the Sialkot exporters were the “roaming ambassadors” who had been playing vital role in strengthening the economy by earning foreign exchange to the tune of US$2 billion annually.

Acting SCCI President also demanded early exemption of the Sialkot's export industries from Withholding Tax recently levied by the Punjab Revenue Authority. “It is to be noted that export industry is exempted from sales tax.” He demanded exemption of Sialkot export industry from Withholding Tax. The Hon'ble FTO assured the Sialkot exporters that their

tax-related problems would be solved on priority. He told the meeting

that there was substantial decline in smuggling between Pakistan

and Afghanistan due to the effective measures taken by the FTO

Pakistan, which was a great success indeed.

Out of 6,091 complaints, 1217 were formal (submitted after adopting the procedure as laid down in the law), while 4,874 complaints were informal.

52% of formal complaints were granted, 28% declined, and 2% were rejected while 18% reported pending at the year-end. As on December 31, 2015, 220 formal and 155 informal complaints were outstanding, which have since been disposed off by the time of the issue of the Annual Report.

The report recommends to establish a clear mechanism to ensure meticulous compliance of the guidelines of State Bank as well as Security Exchange Commission Pakistan in terms of sale of Third Party Products/ Bancassurance so that the customers with zero appetite for the products are saved from the losses caused due to mis-selling.The report also includes fifteen case-studies based on some of the leading decisions of Banking Mohtasib.

The Banking Mohtasib (Ombudsman) Pakistan has issued the eleventh Annual Report for the year ending December 31, 2015.

The highlights of the report are as under: The total number of complaints received by the

Banking Mohtasib Pakistan Secretariat stood at 6,091 in 2015 as against 4,506 in 2014, showing an overall increase of 35%.

An in house “Orientation and Training Program” was arranged at Banking Mohtasib Pakistan, Karachi secretariat for Investigation Officers and new inductees. The topics covered during the course included introduction to the institution of Banking Mohtasib Pakistan, Complaint Management supported by various case studies specifically related to Parallel Banking & Credit Card Disputes, Internet Banking Fraud, Bancassurance and ATMs.

In addition to above, various facets of Banking sector and its legal and regulatory environment were also discussed. The session was inaugurated by the Hon'ble Banking Mohtasib, Mr. Anisul Hassnain and conducted by Sr. Advisors/ Advisors. The training program included presentations from the participants ending with a snap test. The participants were awarded certificates by the Hon'ble Banking Mohtasib at the closing ceremony.

Mr. M Salman Farouqi, Hon'ble Federal Ombudsman Pakistan and Mr. Abdur Rauf Chaudhry, Hon'ble Federal Tax Ombudsman visited the Office of the Ombudsman Punjab on 04.10.2016. Detailed discussions were held on matters of mutual understanding and interests. The Hon'ble Ombudsman Punjab expressed his heartfelt gratitude to the guests for their valuable support regarding operationalization of the Complaint Management Information System, being used in the Ombudsman Punjab Office.

During the meeting Hon'ble Ombudsman Punjab Mr. Najam Saeed apprised that he besides knocking-off the pendency, has taken some important policy decisions and initiatives to further strengthen the complaint handling process of this Office aiming at establishing 'Public Friendly' working atmosphere in the larger public interest. A 'Compendium' containing Law, Regulations, Guidelines and Instructions has been compiled for consistency in processing of cases resulting into facilitation of the complainants. This important document is being finalized and will be issued to the Advisors and staff shortly.

Awareness Campaign through SMS

Federal Ombudsman Secretariat has launched awareness campaign through Short Messaging Service (SMS) about filing of complaint through 'Online Complaint System' which is already functioning and available at www.fos-pah.gov.pk. Through this campaign, there have approximately 50,000 awareness messages in English and Urdu language been sent to the working force including Teachers, Lawyers, Bankers, University Students, Entrepreneurs and Federal Government Employees of Pakistan.Development of the Tele Voice Commercials for Federal Ombudsman Secretariat

Thirty seconds Tele Voice Commercials (TVCs) have been developed for Federal Ombudsman Secretariat. The purpose of these TVCs is to create awareness among all the citizens of Pakistan about the Protection Against Harassment of Women at Workplace Act 2010, and the Complaint Management and Tracking Information System (CMTIS) which is available at FOS-PAH's official website (www.fos-pah.gov.pk). CDs of the developed TVCs are provided to Pakistan Electronic Media Regulatory Authority (PEMRA) and Ministry of Information Broadcasting and arrangements are being made to make sure that these TVCs are aired at prime time on every TV channel of Pakistan. Launching ceremony will be conducted by the FOS in which all the stakeholders along with personals from electronic and print media will be invited and the copies of the TVCs will be handed over to all concerned.

by this office. Under the guidance and supervision of the Ombudsman, a total of 2100 organizations were made to make compliance of Section 3 and Section 11 of Act IV of 2010, legislated by The Senate of Pakistan, whereby constituting a requisite three member Inquiry Committee, inclusive of a female member, designating a Competent Authority and display of a Code of Conduct.

thOn 25 November, 2016, Hon'ble Ombudsman and his

team addressed a Seminar at Mehran University of Engineering and Technology to mark the “International Day to end Violence against Women”. Hon'ble Ombudsman told the audience about the Act IV of 2010 and its effective implementation since 2012. He defined the sections of the Act IV of 2010.Moreover he told the audience the main objective of this office in terms of providing safe and secure working environment to women so that they can contribute their share in order to strengthen the economy of the country and to improve the quality of their lives as well. Hon'ble Ombudsman also shared the contents of few cases to clarify the concept of harassment.

Hon'ble Ombudsman PHWWP, Sindh, Syed Pir Ali Shah presented a consolidated performance report of 4 years to the Honorable Chief Minister Sindh. During the four year tenure as a Provincial Ombudsman for Protection against Harassment of Women at Workplace, a total of 255 aggrieved women complainants were provided with justice across the province of Sindh. To expand the outreach of the Ombudsman Institution and to promote the concept of justice at the door step, Ombudsman AJK Honorable Syed Mumtaz Hussain Naqvi along with Secretary Ombudsman Secretariat and other members of the staff visited District Kotli and its Sub-divisions Charohi and Sehnsa. During the visit he disposed of a large number of cases then and there in presence of the representatives of the various Government Agencies and the complainants through short orders.

The most important feature of the outreach was the special visit of the District Jail, Kotli Azad Kashmir. The visit was meant to assure and ensure the human rights of the prisoners. � In order to resolve the identified problems during the visit of Dstrict Jail, a special report was prepared and submitted to the President. Azad Jammu & Kashmir and the Chief Secretary, Azad Government of the State of Jammu and Kashmir for necessary action.

To further facilitate the complainants, especially those living in the far flung areas of the province; office of the Ombudsperson Punjab launched its official website sometime back. An “Online Registration of Complaint System” has also been launched which is accessible through the website, www.ombudsperson.punjab.gov.pk. For postal filing of complaints, our address remains: 174-Shadman II, General Sarfraz Road (Service Road) Canal Bank, Lahore. �The present facility is an important step towards ensuring protection of women against harassment at workplace.

Hon'ble Mr. Şeref Malkoç, has been elected

as the new Chief Ombudsman of the

Republic of Turkey by 300 votes in the 550-

seat Grand National Assembly. He took oath

of his office. Mr. Şeref Malkoç served as Chief

Adviser to the President of the Republic of

Turkey from December 2015 onward.

He also remained Member of the Turkish Parliament from 1996 to

2002.

The Conference is being held to serve as a platform for OIC Ombudsmen and like institutions to exchange valuable experiences and best practices in Public Service delivery of Ombudsman and like institutions in the OIC Member States. � The proposed theme of the Conference, is “Ehtisab” and Evolution of Modern Ombudsman which has been divided into the following sub-themes:
