I. APPELLANTS' CONTENTIONS

On March 2, 1999, after a public hearing, the Manhattan Beach City Council approved with conditions Local Coastal Development Permit No. 99-4 for the Manhattan Beach Open Volleyball Tournament to be held August 28-29, 1999, with set-up starting on August 25th (Exhibits #4-6). The general public may view the proposed event on a first-come, first-served basis. There is no admission fee for spectators. Participation in the competition is restricted to AVP players and a limited number of qualifying teams. Non-AVP competitors are subject to a tournament entry fee.

On March 19, 1999, William Victor, Harry Ford and Yury Gurvich submitted an appeal of the City's approval of Local Coastal Development Permit No. 99-4 to the Commission's office in Long Beach (Exhibit #7). The appellants contend that the locally approved permit: •

1. Violates the City of Manhattan Beach certified Local Coastal Program (LCP). 2. Violates the California Environmental Quality Act (CEQA). 3. Destroys the use of the beach for normal non-privileged beach goers. 4. Prevents public use of 24 volleyball courts. 5. Does not require adequate noise control. 6. Blocks the beach. 7. Does not comply with City standards. 8. Contains no remedies for failure to comply. 9. Allows commercial use of public parking lots without mitigation.

II. LOCAL GOVERNMENT ACTION

According to the City's staff report dated March 2, 1999 (Exhibit #6), the AVP submitted in November of 1998 a proposal to the City of Manhattan Beach to co-sponsor a pro beach volleyball tournament in the tradition of the Manhattan Beach Open. The City Council reviewed the proposal and responded to the A VP proposal with the following directives: a) delete the request for paid seating at the. event; b) pay for all of the City's direct costs for the event; and c) scale back the size and scope of the event, specifically the bleachers, noise, music, number of parking spaces required, and tents. •

On February 12, 1999, the AVP submitted to the City a revised request for the proposed event (including an application for a coastal development permit} that addressed the prior directives of the City Council.

On March 2, 1999, after a public hearing, the Manhattan Beach City Council approved with conditions Local Coastal Development Permit No. 99-4 for the Manhattan Beach Open Volleyball Tournament (Exhibit #5}. The proposed 1999 event includes:

1. No paid seating. 2. Reduction in the total number of bleacher seats to a maximum of 1,500. 3. Use of 45 parking spaces in the lower pier public parking lots. 4. Reduction in the number of tournament days from three to two. 5. Reduction in the number bf days needed for set-up (3) and take-down (1}. 6. Six tents less than the 1996 event. 7. An A VP agreement to pay the City's direct costs for the event.

The proposed event would be held August 28-29, 1999, with set-up starting on August 25th. The event is proposed to be located on the south side of the Manhattan Beach Pier in a sandy area that is currently occupied by approximately 24 volleyball courts {Exhibit #4). The proposal includes the reservation of 45 of the 71 parking spaces located in the lower south and lower north public beach parking lots for use by A VP equipment trucks, television equipment and event personnel {Exhibit #3).

At the March 2, 1999 public hearing, the City Council heard the testimony of fifteen speakers both supporting and objecting to the proposed event. Some of the speakers supported the event but expressed concerns over the operation of past volleyball tournaments. Concerns over noise impacts from loudspeakers and pollution were expressed by several speakers. The public hearing was closed and the City Council approved the local coastal development permit finding that the proposed event would not block or prohibit public access to the pier and/or shoreline, and is consistent with the certified LCP (Exhibit #5). The action by the City Council was final and not appealable at the local level.

On March 5, 1999 the City's Notice of Final Local Action for Local Coastal Development Permit No. 99-4 was received in the Commission's Long Beach office. The Commission's ten working day appeal period was then established and noticed. On March 19, 1999, the last day of the appeal period, the Commission received the appellants' appeal of the City's approval {Exhibit #7). The public hearing on Appeal A-5-MNB-99-111 was opened and continued at the Commission's April 13, 1999 meeting in Long Beach.

Ill. APPEAL PROCEDURES

After certification of Local Coastal Programs, the Coastal Act provides for limited appeals to the Coastal Commission of certain local government actions on coastal development permits.

Developments approved by cities or counties may be appealed if they are located within th. mapped appealable areas, such as those located between the sea and the first public road paralleling the sea or within three hundred feet of the mean high tide line or inland extent of any beach or top of the seaward face of a coastal bluff. Furthermore, developments approved by counties may be appealed if they are not designated "principal permitted use" under the certified LCP. Finally, developments which constitute major public works or major energy facilities may be appealed, whether approved or denied by the city or county [Coastal Act Section 30603(a)].

Under Section 30603(a)( 1 ) of the Coastal Act, the proposed project site is located in an appealable area by its location on the beach (between the sea and the first public road).

Section 30603(a)(1) of the Coastal Act states:

(a) After certification of its Local Coastal Program, an action taken by a local government on a Coastal Development Permit application may be appealed to the Commission for only the following types of developments:

( 1) Developments approved by the local government between the sea and the first public road paralleling the sea or within 300 feet of the inland extent of any beach or of the mean high tide line of the sea where there is no beach, whichever is the greatest distance. •

The grounds for appeal of an approved local Coastal Development Permit in the appealable area are stated in Section 30603(b)(1 ), which states:

(b)( 1) The grounds for an appeal pursuant to subdivision (a) shall be limited to an allegation that the development does not conform to the standards set forth in the certified Local Coastal Program or the public access policies set forth in this division.

The action currently before the Commission is to find whether there is a "substantial issue" or "no substantial issue" raised by the appeal of the local approval of the proposed project. Section 30625(b)(2) of the Coastal Act requires a de novo hearing of the appealed project unless the Commission determines that no substantial issue exists with respect to the grounds for appeal.

If Commission staff recommends a finding of substantial issue, and there is no motion from the Commission to find no substantial issue, the substantial issue question will be considered moot, and the Commission will proceed to the de novo public hearing on the merits of the project. The de novo hearing will be scheduled at the same hearing or a subsequent Commission hearing. A de novo public hearing on the merits of the project uses the certified LCP as the standard of review. In addition, for projects located between the first public r. and the sea, findings must be made that any approved project is consistent with the publi

access and recreation policies of the Coastal Act. Sections 1311 0-1 3120 of the California Code of Regulations further explain the appeal he~ring process.

If the Commission decides to hear arguments and vote on the substantial issue question, proponents and opponents will have three minutes per side to address whether the appeal raises a substantial issue. The only persons qualified to testify before the Commission at the substantial issue portion of the appeal process are the applicants, persons who opposed the application before the local government (or their representatives), and the local government. Testimony from other persons must be submitted in writing.

The Commission will then vote on the substantial issue matter. It takes a majority of Commissioners present to find that no substantial issue is raised by the local approval of the subject project.

IV. STAFF RECOMMENDATION ON SUBSTANTIAL ISSUE

The staff recommends that the Commission determine that no substantial issue exists with respect to the conformity of the project with the City of Manhattan Beach certified local Coastal Program and the public access policies of the Coastal Act, pursuant to Public Resources Code Section 30625(b)(2) .

MOTION: Staff recommends a YES vote on the following motion:

I move that the Commission determine that Appeal No. A~5-MNB-99-111 raises NO substantial issue with respect to the grounds on which the appeal has been filed.

V. FINDINGS AND DECLARATIONS

The Commission hereby finds and declares:

A. Project Description and History

The Association of Volleyball Professionals (AVP), in cooperation with the City of Manhattan Beach, proposes to conduct the 1999 Manhattan Beach Open Volleyball Tournament on August 28~29, 1999, with set-up starting on August 25th. The general public may view the proposed event on a first-come, first-served basis. There will be no admission fees for spectators.

The proposed event is located on the south side of the Manhattan Beach Pier in a sandy a. that is actually owned by Los Angeles County. The event area is currently occupied by approximately 24 volleyball courts (Exhibit #4). Although the beach is actually owned by Los Angeles County, it falls within the City limits of Manhattan Beach, and therefore, falls under the coastal development permit jurisdiction of the City pursuant to the certified Manhattan Beach LCP. As property owners, the Los Angeles County Department of Beaches and Harbors regulates the special events on the beach. The proposed 1 999 Manhattan Beach Open is one of several volleyball tournaments and other special events approved by the County on the beach during the summer {Exhibit# 9, p. 1 4).

The annual Manhattan Beach Open Volleyball Tournament has a long tradition that dates back to 1960. The first coastal development permit approval for the event, however, did not occur until 1997 when the City approved Local Coastal Development Permit No. 1 0-97. Prior to 1997, the City did not believe that the event fell under the definition of development as defined in the certified LCP1

• That all changed in 1 997 when the A VP proposed to charge admission fees to spectators of the Manhattan Beach Open Volleyball Tournament.

On March 18, 1997, the City of Manhattan beach approved Local Coastal Development Permit No. 1 0-97 for the 1997 Miller Lite Manhattan Beach Open Volleyball Tournament. The City's approval would have allowed the A VP to sell tickets to all of the seating for the final matches of the tournament. Subsequent to the City's approval, three appeals of the local coastal development permit were submitted to the Coastal Commission. The primary gro. for the appeals was that the proposed event, with admission fees for spectators, was inconsistent with the certified LCP's Open Space (OS) land use designation for the beach. The certified OS land use designation permits "sporting events for which no admission is charged", but does not permit sporting events for which admission is charged.

On May 13, 1997, the Commission found that a substantial issue existed with respect to the grounds of the three appeals (See Appeal A-5-MNB-97-84). Also on May 13, 1997, the Commission held a public hearing on a City of Manhattan Beach LCP amendment request" that would have added "sporting events for which admission is charged" to the OS permitted use list (See LCP Amendment Request No. 1 A-97). That day, the Commission rejected Manhattan Beach LCP amendment request No. 1A-97, and approved the de novo permit for the proposed event on appeal {See Exhibit #8: Appeal A-5-MNB-97-84). The Commission's action on May 13, 1997 approved a coastal development permit for the proposed event, but denied the City's and the A VP' s request to charge admission fees to spectators. Ultimately, Coastal Development Permit A-5-MNB-97-84 was never issued, and the 1997 Manhattan Beach Open was cancelled.

In its action on Appeal A-5-MNB-97-84, the Commission found that, pursuant to the certified LCP, a coastal development permit was required for the proposed event because it falls within the definition of development contained in Section A.96.030 of the certified LCP and Section

30106 of the Coastal Act ("Development" means ... the placement or erection of any solid material or structure; ... change in the intensity of use of water, or of access thereto; ... }, and that the certified LCP contains no provision for the exclusion or exemption of the proposed event. Furthermore, admission fees for spectators may not be charged for sporting events on the beach because such a use is not permitted by the certified LCP.

In October of 1997, the City submitted LCP amendment request No. 3~97 to the Commission in an attempt to insert new provisions into the certified LCP to permit and exempt temporary events on the beach. As stated above, there are currently no provisions in the LCP that allow temporary events on the beach, regardless of size or type of event, to be exempted from permit requirements. On February 3, 1998, the Commission approved LCP amendment request No. 3-97 with suggested modifications that would have laid out specific LCP standards for the exempting and permitting of temporary events on the beach. The City, however, declined to accept the Commission's suggested modifications and the Commission's action on LCP amendment request No. 3-97 has lapsed.

For this year's proposed event, the 1999 Manhattan Beach Open Volleyball Tournament, the City and the A VP have significantly scaled down its size and scale from prior years, and have eliminated all spectator admission fees. The proposed August 28-29, 1999 event, approved by City of Manhattan Beach Local Coastal Development Permit No. 99-4, includes:

1. No paid seating. 2. Reduction in the total number of bleacher seats to a maximum of 1 ,500. 3. Use of 45 parking spaces in the lower pier public parking lots. 4. Reduction in the number of tournament days from three to two. 5. Reduction in the number of days needed for set-up (3) and take-down (1). 6. Six tents less than the 1996 event. 7. An A VP agreement to pay the City's direct costs for the event.

Participation in the competition is restricted to A VP players and a limited number of qualifying teams. Non-A VP competitors are subject to a tournament entry fee. Set-up for the proposed event will start on Wednesday, August 25th, and take-down must be completed on Monday the 30th. The proposal includes the reservation of 45 of the 71 parking spaces located in the lower south and lower north public beach parking lots for use by A VP equipment trucks, television equipment and event personnel (Exhibit #3). Public access to the pier and along the water will not be blocked by the event, and the bicycle path will be kept open. Bicyclists may, however, be required to walk their bikes past the pier if the area becomes too congested.

The City-approved site plan for the proposed event includes two sets of bleachers and a main stage and scoreboard around a main center court (Exhibit #4). The area behind the proposed stage and scoreboard (below the pier) is a fenced area with several tents for players, medics, food, referees, and the media. There will not be a fence installed around the perimeter of the event area. Several outer courts (with no seating provided) are proposed to be used for the

event's preliminary matches. The proposed event also includes an interactive area below t. pier for event sponsors' booths where free merchandise samples may be distributed to the general public (Exhibit #4). Two inflatable sponsor ads are also shown on the City-approved site plan. In total, the City-approved site plan for the proposed event covers approximately 150,000 square feet of beach area (Exhibit #4).

In order to enhance beach access for event visitors and other beach goers, the City approval states that the A VP will be providing a shuttle service to and from the proposed event on Saturday and Sunday (August 28-29, 1999).

B. Substantial Issue Analysis

As stated in Section Ill of this report, the grounds for appeal of a coastal development permit issued by the local government after certification of its Local Coastal Program (LCP) are specific. In this case, the local coastal development permit may be appealed to the Commission on the grounds that it does not conform to the certified LCP or the public access policies of the Coastal Act. The Commission must then decide whether a substantial issue exists in order to hear the appeal.

In this case, the appellants contend that the City's approval of the proposed event does not conf~rm to the certified LCP. In addition, the appellants contend that the locally approved. perm1t:

1. Violates the City of Manhattan Beach certified Local Coastal Program (LCP). 2. Violates the California Environmental Quality Act (CEOA). 3. Destroys the use of the beach for normal non-privileged beach goers. 4. Prevents public use of 24 volleyball courts. 5. Does not require adequate noise control. 6. Blocks the beach. 7. Does not comply with City standards. 8. Contains no remedies for failure to comply. 9. Allows commercial use of public parking lots without mitigation.

The certified Manhattan Beach LCP contains specific policies that apply to all development located within the City's coastal zone. The proposed event does fall within the definition of development that is contained in Section A.96.030 of the certified LCP and Section 30106 of the Coastal Act (11Development" means ... the placement or erection of any solid material or structure; ... change in the intensity of use of water, or of access thereto; ... ). Because the certified LCP contains no provision for the exclusion or exemption for temporary events on the beach, the proposed event must obtain a coastal development permit. All development approved within the City's coastal zone, including the proposed event, must comply with the policies of the certified Manhattan Beach LCP. •

First, the proposed event must qualify as a permitted use within the Open Space (OS) land use designation of the beach. Secondly, the proposed event must comply with the following relevant LCP policies:

POLICY 1.A.2: The City shall encourage, maintain, and implement safe and efficient traffic flow patterns to permit sufficient beach and parking access.

POLICY I.A.S: The City shall maintain visible signage to El Porto accessways and beach parking, along Highland Avenue.

POLICY 1.8.1: The City shall encourage public transportation service to mitigate excess parking demand and vehicular pollution. All transportation/congestion management plans and mitigation measures shall protect and encourage public beach access.

POLICY I. 8.3: The City shall encourage pedestrian and bicycle modes as a transportation means to the beach.

POLICY 1.8.6: The Strand shall be maintained for non-vehicular beach access.

POLICY I.C.2: The City shall maximize the opportunities for using available parking for weekend beach use.

POLICY I.C.3: The City shall encourage additional off-street parking to be concentrated for efficiency relative to the parking and traffic system.

POLICY I.C.9: Use of existing public parking, including, but not limited to, on-street parking, the El Porto beach parking lot, and those parking lots indicated on Exhibit #9 (in the certified LCP), shall be protected to provide public beach parking ...

POLICY: The beach shall be preserved for public beach recreation. No permanent structures, with the exception of bikeways, walkways, and restrooms, shall be permitted on the beach.

PROGRAM II.A.6: Consider the establishment of alternative transportation systems and park-mall facilities, including a shuttle service to the El Porto beach area.

PROGRAM 11.8.13: Improve information management of the off-street parking system through improved signing, graphics and public information and maps .

PROGRAM II.B. 1 4: Provide signing and distribution of information for use of the Civic Ce. parking for beach parking on weekend days.

In addition, the proposed event must conform to the following public access policies of Chapter 3 of the Coastal Act:

Section 3021 0 of the Coastal Act states:

In carrying out the requirement of Section 4 of Article X of the California Constitution, maximum access, which shall be conspicuously posted, and recreational opportunities shall be provided for all the people consistent with public safety needs and the need to protect public rights, rights of private property owners, and natural resource areas from overuse.

Section 3021 1 of the Coastal Act states:

Development shall not interfere with the public's right of access to the sea where acquired through use or legislative authorization, including, but not limited to, the use of dry sand and rocky coastal beaches to the first line of terrestrial vegetation.

Section 30212 of the Coastal Act states, in part:

(a) Public access from the nearest public roadway to the shoreline and along the coa­shall be provided in new development projects ...

Section 30213 of the Coastal Act states:

Lower cost visitor and recreational facilities shall be protected, encouraged, and, where feasible, provided. Developments providing public recreational opportunities are preferred. ··

The staff recommends that the Commission determine that the proposed event does comply with the City of Manhattan Beach certified LCP and the public access policies of the Coastal Act, and find that no substantial issue exists with respect to the grounds of the appeal.

First, the proposed event is a permitted use within the Open Space (OS) land use designation. The certified OS land use designation specifically permits .. sporting events for which no admission is charged". The proposed volleyball tournament is a sporting event. Local Coastal Development Permit No. 99-4, issued by the City of Manhattan Beach specifically states that: "the tournament is free and open to the public, with no admission for entry to the event" and "access to the main court area (bleachers) will be open to the public and based upon a first­come, first-served basis" (Exhibit #5, p.2). Therefore, the proposed event complies with the LCP and has avoided the issue that has caused so much controversy in the past two year.

• Secondly, the proposed event also complies with the policies of the certified LCP and the public access policies of the Coastal Act by ensuring that public access to the pier and shoreline will "remain open and unobstructed during the duration of the proposed event" (Exhibit #5, p.2). The City-approved site plan does not permit any development in the public accessways that provide access to the pier, water and bike path (Exhibit #4). The proposed event will occupy a 300-foot wide portion of the approximately 450-foot wide beach area that exists between the bike path and mean high tide line (MHTL). Therefore, there will be a 150-foot wide open area preserved along the shoreline for lateral public access. The Commission's approval of Coastal Development Permit A-5-MHB-97-084 for the 1997 Miller Lite Manhattan Beach Open included similar conditions for the protection of public access (Exhibit #8, p.4).

Additionally, the proposed event will provide the public with a free recreational opportunity in the form of a professional sporting event with free public admission. Although approximately 24 public volleyball courts will be occupied by the six-day event, the displacement will be temporary, and unrestricted public use of the public volleyball area will resume after one day of take-down activities. The Commission's approval of Coastal Development Permit A-5-MHB-97-084 for the 1997 Miller Lite Manhattan Beach Open also required that the event take-down be completed in one day (Exhibit #8, p.5).

As required by the certified LCP, the City approval encourages public transportation service to the event in order to mitigate excess parking demand and vehicular pollution. The City approval states that the A VP will be providing a shuttle service to and from the proposed event on Saturday and Sunday (August 28-29, 1999). The event's impacts on the public parking supply have been reduced by minimizing the number of parking spaces that can be reserved for use by A VP equipment trucks, television equipment and event personnel. The City approval permits the reservation of 45 of the 71 parking spaces located in the lower south and low,( north public beach parking lots for use by A VP equipment trucks, television equipment and event personnel (Exhibit #3). The City's approval of the 1997 Manhattan Beach Open included the reservation of 55 public parking spaces.· Although, the reservation of 45 public parking spaces will temporarily use public beach parking spaces, the City's approval has minimized the amount of reserved parking for the event. The 50 public parking spaces in the two upper pier lots and the on-street parking along Manhattan Beach Boulevard will be available for public use on a first-come, first-served basis. By minimizing the amount of reserved parking, the proposed event is consistent with the LCP policy that requires the City to maximize the opportunities for using available parking for beach use.

The Commission's approval of Coastal Development Permit A-5-MHB-97-084 for the 1997 Miller Lite Manhattan Beach Open required the applicants to implement a very specific public transportation program (Exhibit #8, p.2). The proposed 1997 event, however, was proposed as a much larger and heavily promoted event with paid admission and over 6,800 bleacher seats. The heavy promotion and many pre-event advertisements in 1997 was part of the

AVP's attempt to generate funds by selling tickets to the 1997 Manhattan Beach Open2 ••

anticipated impacts on public parking for the 1997 event were different than this year's scaled-down event with only 1 ,500 bleacher seats, although many people may attend because it is free. The shuttle service is required by the City to maximize the availability of parking for public access to the beach and the event. Therefore, the City's requirement for the A VP to provide a shuttle service to and from the proposed event on Saturday and Sunday (August 28-29, 1999) is consistent with the LCP.

While noise control is not an issue addressed by certified LCP policies, the appellants have raised it as an issue. Specifically, the appellants assert that the local approval does not require adequate noise control. The City staff report dated March 2, 1999, states, "Staff will work with the A VP to direct the speakers away from houses and businesses on the east side of the Strand, thereby cutting down on noise near beach residents". Therefore, the City has·· addressed noise-control as an issue, and has directed its staff to take measures to cut-down on the noise. The Commission's approval of Coastal Development Permit A-5-MHB-97-084 for the 1 997 Miller Lite Manhattan Beach Open did not contain any conditions that addressed the issue of noise control.

The appellants' assertion that the local approval does not contain any remedies for failure to comply is incorrect. The City approval contains a specific provision entitled "Compliance with the Law". Furthermore, the standard enforcement mechanisms of the City Municipal Code could be applied to any instance of non-compliance with a City code or condition. •

In conclusion, the proposed event and the City's coastal development permit for the proposed event are in compliance with the City of Manhattan Beach certified LCP and the public access policies of the Coastal Act. The appellants have not provided any evidence that the proposed event violates the California Environmental Quality Act (CEQA). The proposed event, as approved and conditioned by City of Manhattan Beach Local Coastal Development Permit No. 99-4, will not have a significant effect on coastal access or coastal resources. Furth~rmore,

the City's approval of the proposed event is consistent with prior Commission actions. There are no feasible alternatives or feasible mitigation measures available which would substantially lessen any significant adverse effect which the activity may have on the environment. Therefore, the Commission finds that the appeal raises no substantial issue.

On March 2. 1999 the City Council of the City of Manhattan Beach conducted a public hearing and granted to the Association of Volleyball Professionals (Applicant) this permit for the temporary event described below, subject to the attached Standard and Special conditions.

Site: Beach Area south of the Manhattan Beach Pier

Description: Manhattan Beach Open Volleyball Tournament ·to be held August 28 and 29, south of the Manhattan Beach Pier and will include: a Pro-Am Men's Two Person Volleyball Tournament; a women's Pro Two Person Volleyball Tournament; and, a Junior Two Person Amateur Tournament. The Qualifier for the Pro-Am Men's Tournament will be held on August 27th. Set up for the tournament will take place from August 25-27. All equipment is to be removed within 24 hours of the close of the tournament. The first 28 seeded spots of the Pro-Am Men's Tournament will be for AVP players with the four top teams from the Qualifier playing in the event. The AVP will guarantee the appearance of 15 of the top 20 AVP rated teams (to include 3 of the top 5 AVP rated teams, barring injury) for the Men's Pro-Am Tournament.

Written findings are required for all decisions on Coastal Development Pennits. Such findings must demonstrate that the project, as described in the application and accompanying material, or as modified by any conditions of approval, confonns with the certified Manhattan Beach Local Coastal Program.

A. That the project, as described in the applicant and accompanying materials, as modified by any conditions of approval, conforms with the certified Manhattan Beach Local Coastal Program:

(Finding): The event will provide a total of 1,500 bleacher seats with ancillary equipment and facilities. The tournament is free and open to the public,

with no admission for entry to the event. Based upon the description provided above (Page 1 ), there is nothing to suggest that this event will be • inconsistent with the goals and policies of the Manhattan Beach Local Coastal Program.

B. The temporary event is in conformity with the public access and recreation policies of Chapter 3 of the Coastal Act of 1976 commencing with Section 30200 of the Public Resources Code, specifically:

(Finding): The event does not physically block or prohibit access to the Pier and I or . shoreline by the general public. All existing access points to the Pier will remain open and unobstructed during the duration of the proposed event. Access to the beach areas near the Pier will also remain open and unobstructed. Access to the main court area (bleachers) will be open to the public and based upon a first come -first served basis.

Standard Conditions:

1. Notice of Receipt and Acknowledgment. The permit is not valid and the temporary event shall not commence until a copy of the permit, signed by the permittee or authorized agent, acknowledging receipt of the permit and acceptance of the terms and conditions, is returned to the Community Development Department.

2. Expiration. The Coastal Development Permit shall expire if not implemented during the approved dates scheduled for the temporary event. The City Council may grant a reasonable extension of time for due cause. Said time.· extension shall be requested in writing by the applicant or authorized agent prior to the expiration of the permit.

3. Compliance. All activities associated with the temporary event must occur in strict compliance with the proposal as set forth in the application for permit, subject to any special conditions set forth below. Any deviation from the approved plans must be reviewed and approved by the Director of Community Development.

4. Interpretation. Any questions of intent or interpretation of any condition will be resolved by the Director of Community Development.

5. Terms and Conditions are Peroetual. These terms and conditions shall be perpetual, and it is the intention of the Director of Community Development and the permittee to bind all future owners and possessors of the subject property to the terms and conditions.

SUBJECT: A Public Hearing to Consider an Application for a Coastal Development Permit by the City of Manhattan Beach and the Association of Volleyball Professionals to Stage the Manhattan Open to be Held on August 27-29, 1999.

RECO:MMENDATION It is recommended that the City Council conduct the public hearing, approve issuance of a voluntary Coastal Development Permit and authorize the City Manager to execute the attached agreement with the Association of Volleybal1 Professionals (AVP) to co-sponsor the 1999 Manhattan Beach Open August 27-29.

BUDGET IMPLICATION Under the tenns of the attached contract, the A VP will reimburse the City for all of its direct costs associated with the event. The A VP will retain the proceeds from the top 28 seeded teams and the City will retain all other entry fees.

BACKGROUND ln November 1998, the A VP submitted a proposal to the City of Manhattan Beach for the co-sponsorship of a pro-am beach volleyball tournament. The City Council and staff reviewed the proposal and responded to the A VP with the following direction:

1. Delete request for paid seating at the event. 2. Pay for all of the City's direct costs for the event. 3. Scale back the size and scope of the event. Specifically scale back bleachers,

noise, music, number of parking spaces required, and tents.

PROPOSED EVENT In February, the A VP submitted a revised proposal which staff feels addresses the Council's prior concerns.

No paid seating. Reduction in the number of bleacher seats from 4,346 in 1996 to a proposed 1,500 for this year's event. Use of only one parking lot instead of four. Reduction in the number of tournament days from three to two. Elimination of two full days for set up and tear down. Elimination of six tents from the 1996 event. Agreement to pay for all City expenses that are incurred.

The proposed 1999 Manhattan Beach Open will be held August 28 and 29, south of the Manhattan Beach Pier and will include a Pro-Am Men's Two Person Volleyball Tournament, a women's Pro Two Person Volleyball Tournament and a Junior Two

The City will permit advertising and promotion of the event within the City for a minimum of three weeks prior to the tournament. This commitment includes banners • {hung no more than two weeks prior to the event) provided by the AVP, placed on the two major arteries of the City (PCH and Manhattan Beach Boulevard), two inflatable advertisements placed at the southwest and northwest locations of the event, distribution of storefront posters and local news releases. Additionally, the AVP will be allowed to sell AVP and event merchandise on the pier, however, the City shall retain the right to sell event consumables {food and beverage) and retain the proceeds. The A VP must seek the City's approval to sample products. The AVP will provide for the television broadcast of the Manhattan Beach Open, highlighting and promoting the City of Manhattan .. Beach in a three-minute special feature.

Bleachers for the event will be placed parallel to the ocean facing the Strand so as not to obstruct the spectator's view. Staff will work with the A VP to direct the speakers away from the houses and businesses on the east side of the Strand, thereby cutting down on the noise near beach residents. There will be a Center-Court stage with television towers placed at the south and east sides. The City will provide any necessary services required for the event such as Police, Fire, Recreation and Public Works. The estimated costs for these services must be paid 30 days prior to the event. Also, the A VP will be providing the shuttle service to and from the event on both Saturday and Sunday. The A VP will be responsible for securing all County and City permits.

Environmental Review The proposed temporary event is exempt from the provisions of the California Environmental Quality Act (CEQA). Per the CEQA Guidelines the event is exempt pursuant to the following provisions: Section 15304 (e), "Minor Alterations to Land"; Section 15311 (c), "Accessory Structures"; and, Section 15323, "Nonnal Operations of Facilities for Public Gatherings".

The proposed event is a temporary activity being conducted on the public beach in which there are no mature trees which could be potentially affected. Additionally, the event will not result in any degradation or alteration to the condition of land, water or vegetation. Based upon past events of this nature, no pennanent environmental effects are anticipated.

Coastal Development Permit The Beach area is located within the "OS" (Open Space) district ofthe City's Zoning Code, and is regulated by the provisions ofthe City's certified Local Coastal Program (LCP). The Open Space District allows "Sporting events for which no admission is charged" as a permitted use subject to a temporary use permit. Additionally, given the location and nature of the event the Community Development Department has determined that a Coastal Development Permit is required for the tournament.

Consistent with the regulations of Chapter A.96 of the LCP, an application was filed by the Association of Volleyball Professionals. Community Development Department staff have reviewed the application and prepared a Coastal Development Permit for the event. The Permit is attached as Exhibit 3 .

ALTERNATIVES 1. To authorize the City Manager to execute an agreement with the A VP for the

1999 Manhattan Beach Open August 27-29 with modifications to the agreement. 2. Deny the request. 3. Discuss and redirect staff.

NOTICE OF INTENT TO ISSUE PERMIT

On 13 May 1997, the California Coastal Commission granted to Association of Volleyball Professionals (AVP) Coastal Development Permit A-5-MHB-97..084, subject to the attached conditions, for development consisting of: the 1 997 Miller Lite Manhattan Beach Volleyball Tournament on June 1 2-15. More specifically described in the application file in the Commission offices.

The development is within the coastal zone in Los Angeles County at Beach area south of Manhattan Beach Pier, City of Manhattan Beach.

The actual development permit is being held in the Commission office until fulfillment of the Special Conditions imposed by the Commission. Once these conditions have been fulfilled, the permit wiJI be issued. For your information, all the imposed conditions are attached.

STANDARD CONDITIONS

1. .l'l.otice of Receipt and Acknowledgment. The permit is not valid and development shall not commence until a copy of the permit, signed by the permittee or authorized agent, acknowledging receipt of the permit and acceptance of the terms and conditions, is returned to the Commission office.

2. Expiration. If development has not commenced, the permit will expire two years from the date on which the Commission voted on the application. Development shall be pursued in a diligent manner and completed in a reasonable period of time. Application for extension of the permit must be made prior to the expiration date.

3. Compliance. All development must occur in strict compliance with the proposal set forth in the application for permit, subject to any special conditions set forth below. Any deviation from the approved plans must be reviewed and approved by the staff and may require Commission approval.

4. Interpretation. Any questions of intent or interpretation of any condition will be resolved by the Executive Director or the Commission.

5. Inspections. The Commission staff shall be allowed to inspect the site and the project during its development, subject to 24-hour advance notice.

6. Assignment. The permit may be assigned to any qualified person, provided assignee tiles with the Commission an affidavit accepting all terms and conditions of the permit.

7. Ierms and Conditions Bun with the Land. These terms and conditions shall be perpetual, and it is the intention of the Commission and the permittee to bind all future owners and possessors of the subject property to the terms and conditions.

SPECIAL CONDITIONS: 1. Parkjng/Traffjc Management Plan

Prior to the issuance of the Coastal Development Permit and May 30, 1997, the applicant shall submit a Parking/Traffic Management Plan, for the review end approval of the Executive Director. The approved plan shall be implemented by the applicant and shall include the following components:

Jots and on the street for the car display, and provide parking to meet the increased demands generated by the proposed event. The replacement parking shall not include any parking Jots that are identified as public beach parking supplies by the certified LCP. The applicant shall provide a valid lease agreement for each Jot indicating its number of spaces and location. The 1 ,080 required parking spaces shall be available for use by all members of the public on Saturday and Sunday (June 14-15, 1997) between the hour• of 7 a.m. to 7 p.m.

The applicant shall be responsible. for the provision of a free shuttle service, In· order to provide free public transportation between the remote parking lots and the event and beach area. The applicant shalf 1;

provide a valid agreement with a shuttle operator, shuttle routes and · operating schedule to provide such a shuttle service, as follows: the shuttle service shall run continuously to provide free public beach transportation between the beach area and the remote parking areas on Saturday and Sunday (June 14-15, 1997) between the hours of 7 a.m. to 7 p.m.; the .. headway" time between shuttle service pick­ups shall not be more than 15 minutes; and, the free shuttle service shall be available for both the general public and event spectators.

c) The plan shall include conspicuously posted on-street informational signs and banners to direct visitors to the remote 11:1.1 parking areas and 11:1.1 shuttle stops. The signs and banners shall also inform the public of availability of a free bus shuttle for both event customers and the general public. No fewer than ten informational signs shall be placed along major intersections leading into the City i.e., Manhattan Beach Boulevard, Highland Avenue, Manhattan Avenue, Valley Drive, Ardmore Avenue, and Aviation Boulevard. The signs and banners shall be no smaller than 2' x 3'.

d) The applicant shall provide no fewer than eight radio announcements within the Los Angeles county area informing the public of the availability of remote parking. These stations shall represent all diverse ethnic and cultural Los Angeles radio markets and shall include Spanish language, youth and news stations.

e) Interim traffic control shall be provided at the intersection of Manhattan Beach Blvd. and Manhattan Ave. and at other points along those streets, as appropriate, to avoid the need to close the upper pier parking lots due to lack of traffic circulation and potential gridlock at that intersection and around the event site. The traffic control plan coupled with the signage program should direct traffic away from the

and avoid significant traffic congestion on streets surrounding the event site to the maximum extent possible.

f) The parking/traffic management plan shall include provisions for monitoring and evaluating the effectiveness of the approved plan. The monitoring must document the adequacy of off-site parking by identifying the percentage of lots, or number of spaces, occupied during the time of highest attendance each day; the condition of traffic flow along Manhattan Beach Blvd., Manhattan Ave. and Highland Ave., in the vicinity of the event and along the proposed shuttle routes (i.e., free-flowing but moving, congested, gridlock, etc.); and the effectiveness of signage, traffic officers, etc., based on the applicant's observations and feedback from the public and City of Manhattan Beach. Following the event, the monitoring program shall be summarized in a written report which shall be submitted to the Executive Director on or before July 31 , 1997. The report should identify any problems that occurred and make recommendations for improvements in the future. The report shall be retained in the file and used in the review of future permit applications for the AVP volleyball tournament or similar events .

The permittee shall undertake the development in accordance with the approved parking/shuttle program. Any significant changes to the approved plan should be reported to the Executive Director. No change to the plan shall occur without a Commission-approved amendment to the permit unless the Executive Director determines that no such amendment is required. The applicant shall provide the required parking spaces, signs and free shuttle service as approved by the Executive Director.

Pier. Bicycle Path and The Strand

The event shall not interfere with the public's use of the pier, bicycle path and The Strand, a public walkway that parallels the beach. The pier, bicycle path and The Strand shall remain open and unobstructed. No fences, trucks or other structures shall be placed on the bicycle path or The Strand, or block access to the pier. The applicant shall monitor The Strand and bicycle path in order to prevent any encroachments by event sponsors and vendors.

3. Public Access to and Along the Water

The proposed event, and all associated development, shall not encroach any closer than 50 feet to the highest water mark.

4. Removal of Temporary Improvements

All temporary improvements permitted herein shall be removed in their entirety and the site restored to its pre-existing condition by no later than 8:30p.m. Monday, June 16, 1997.

5. Conformance with the Lee

Approval of the proposed charge for admission is conditioned upon the Coastal Commission's certification of City of Manhattan Beach Local Coastal Program amendment No. 1 A-97. Accordingly, after compliance with all other conditions of approval and upon issuance of the coastal development permit, the applicant shall be permitted to stage the event as herein approved. However, the permittee shall not require a ticket or otherwise · ~ charge a fee for admission to or seating at any match unless the City of Manhattan Beach Local Coastal Program amendment No. 1 A-97 has been certified by the Commission.

(Note: City of Manhattan Beach Local Coastal Program Amendment No. 1 A· 97 was rejected by the Commission on May 13, 1997. Therefore; the permittee shall not require a ticket or otherwise charge a fee for admission to or seating at any match.]
