The undersigned corporation is the general contractor with respect to the construction of the Makakilo Golf Course. For reasons of economics, the construction has come to a temporary halt. As the general contractor, and considering that the developer of the golf course is without any agents in Hawaii, we have taken it upon ourselves to do whatever that has come to our attention as being in need of keeping the project viable.

One of the critical elements in the development and operation of a golf course, needless to say, is water. Our attention was invited to a letter dated September 8, 1992 written by Rae M. Louie indicating that the permit to draw water from the above referenced well would expire on March 8, 1993.

In view of the foregoing, we hereby request on behalf of the developers and the owners of the golf course to have the permit extended for another six (6) months from and after March 8, 1993. The reason for needing this extension is predicated upon the fact that all parties are presently exerting their collective efforts in trying to complete the construction of the golf course and until such time as any affirmative efforts are abated, the status quo with respect to water needs to be maintained.

WATER USE: Well 2004-03 (Makakilo Golf Course) .. Dust control

STATUS: 1. June 12, 1991 Makakilo GC requested permission to test Fort Barrette Well for 6 months.

2. June 18, 1991 request granted by Chairman. 3. Feb. 27, 1992 Makakilo GC requested for 6 mo. extention. 4. May 20, 1992 request denied by Deputy Director. 5. June 23, 1992 Makakilo GC submitted water use permit for

6 to 12 months. 6. August 19, 1992 request was granted by the Commission for 6

months temporary water use only. Extention of up to 6 months may be granted by the Chairman.

WELL DESCRIPTION: The well was drilled 1941 by the U.S. Navy. Since drilled in 1941 no well completion report or as-built were submitted or found. According to the well index and verified in field the well has a 12" casing, and from the Well Index, the total depth 190', ground elevation 175' bottom of solid casing -7'. Chloride reading 243 ppm.

PUMP DESCRIPTION: Pump through sight verification is a 40 hp 3535 rpm motor. Water from the well flows to a 4" CI metered pipe then to a 20,000 gallon metal reservoir located in the golf course construction area. Water trucks uses the water from the reservoir primarily for dust control. On a typical construction day Darrel Ikeda said they use about 40,000 gallons.

Today the golf course construction has been halted due to money problems. Water is not being used from the well. Makakilo Golf Course manages to irrigate the lower end (Pearl City Side) of the golf course, by purchasing water from Oahu Sugar Company's Waihole Ditch System. Water is pumped from the ditch through an 8" pipeline that empties into an open reservoir near the 18th hole. The chloride contents from the ditch system is said to be 10 ppm. Once construction is over Fort Barrette Well will be sealed.

NOTE: Makakilo Golf Course also applied ground water use for Wells 1904-02 and 1904-03. The wells are located 1.1 mile below Farrington Hwy. on the right side of Barbers Pt. Access Road. Both wells has been field checked and water is not being used.

o Wells 1904-02 & 03 will be the primary wells for the Makakilo Golf Course Desalting Plant. Water will then be pumped to the main open reservoir and gravity flow to 3 other open reserviors on the golf course via 10" pipeline. The Ft. Barrette Well will be sealed after construction is over. We need to sent the proper fonn for well sealing.

SUMMARY: 1. Temporary Water Use Permit issued Aug. 19, 1992. 2. Water to be used primarily for dust control. 3. We do not have any well completion report, as-built drawings, and

pumpage data. 4. Using water from Waihole Ditch to irrigate a

portion of the golf course. 5. Need to send proper fonn for well sealing Ft. Barrette Well.

The Conunission on Water Resource Management approved your request for a temporary water use pennit at its meeting on August 19, 1992. You are permitted to use 360,000 gallons of water per day for construction water, dust controL and the initial grow­in period of the golf course, subject to the following conditions:

1. The pennit shall be for a period of six months from the date of this letter. An extension of up to six months may be granted by the Chairperson upon showing of good cause. Modification of any other permit condition shall be approved by the Commission.

2. The applicant shall comply with all applicable laws, rules, and ordinances.

3. The applicant shall provide and maintain an approved meter or other appropriate device or means for measuring and reporting total water usage. Water usage shall be measured on a monthly basis and reported to the Conunission.

4. The proposed use shall not adversely affect existing or future legal uses of water in the area, including any surface water or established instream flow standards. This permit shall not constitute a determination of correlative water rights. The permittee is notified and by this provision understands that the quantity of water taken from the well could be reduced by the Conunission in the future. This pennit is not a committment that the pump capacity permitted here or even some lesser amount is guaranteed in the future.

Mr. Cox asked if it was possible to complete the project in the two-year time frame if the work is to be done only during the summer/dry months.

Mr. Yuh said they would try to meet the conditions proposed by the staff. They may have a problem with working only during the summer months but will check with the contractor and get back to the staff. Ms. Loui said the reason the project was limited to the summer/dry months (June, July, August) is that the aquatic species spawn in the early winter.

Mr. Cox understood that the BWS did an environmental assessment eEA) and asked if staff comments on EAs. Ms. Loui said staff tries to comment on most EAs. Ms. Samuels added that comments were made on this environmental assessment.

Mr. Nakata asked how the chlorinated water discharge would be handled.

Mr. Hiu said BWS and DOH would be meeting to discuss this matter. He understood that the regulation would come into effect on October 1st. They may be allowed to put the water directly into the wastewater sewer line which goes directly into the sewer treatment plant, not discharged as run-off. Conditions will need to be worked out between BWS, DOH, and the City. In areas where there are no sewer lines, the water will be treated to de-chlorinate the water before discharging.

In terms of crossing each of the streams, Mr. Cox asked how long it would take the contractor to install the pipes.

Mr. Yuh said he could not give exact numbers but depending on the length of the stream and if it's dry, it should not take too long.

Mr. Martin asked if specific precautions or contingencies were made if flood flows occur during construction (written testimony also provided). \

Mr. Yuh replied that they would have to meet with the contractor to work within the plans if those conditions should occur. At this point, there is no specific contingency.

Mr. Cox suggested that the applicant request an extension early on in the project if they find that the project cannot be completed in two years.

Mr. Fujimura asked for clarification regarding the condition that the water applied to the golf course be 200 mg/l or less.

Mr. Sakoda stated that was the condition on the caprock well after it is desalted. Mr. Tom Nance, representing the applicant, added that the other source being used

is water purchased from 200 mg/l.

Chairperson Paty asked what phase the Course was in. Mr. Bob Imose replied that they were ready to plant. Planting had been delayed for about six months due to a lack of water. Trees have been planted and are being watered by hand.

NHAC submitted written testimony. Mr. Martin also asked for clarification on the process of approval or written permission given for test pumping or water use because he was unaware of such specific procedures. He felt the applicant also requires a temporary pump installation permit to proceed with the project and he did not notice any such reference in the submittal.

Mr. Sakoda said that the request for a temporary water use permit assumes that a pump will be installed. Mr. Martin stated they were concerned with the staff giving approval for pumping without Commission approval. Mr. Nance added that the well had been abandoned and filled in with mud well above the water table. Mr. Martin understood about perhaps overlooking the pump installation permit but it still did not address his concern about staff giving permission to do the test pumping as it occurred in Items 3 and 4. He felt the Commission should address applying appropriate procedural control over the process.

Mr. Fujimura commented that Mr. Martin's point is well taken but if Mr. Martin went further down the cruonology he would notice tha,t at the point of extension corrective measures were taken.

Mr. Fujimura inquired if 316,000 mgd was enough for a startup on a golf course. Mr. Nance replied that water is also being used from Oahu Sugar as well as water from the well.

Mr. Fujimura said there has been a request that the Commission confer administrative approval to the permit if the applicant is unable to meet the timeframe for reasons beyond their control. He asked Mr. Tam if this could be done. Mr. Tam replied that the Chairman could be granted that option.

Mr. Fujimura amended the Condition to provide that

"should(~)time of up to~;~~~·)e needed, it would be within the discren6n-of the Chairman to extend· this permit if for reasons beyond the applicant's control the initial 6-month time frame cannot be met."

Mr. Cox also asked that the following condition be added:

"The proposed uses shall not adversely affect existing or future legal uses of water in the area, including any surface water or established instream flow standards. This permit or the authorization to pump water from the wells shall not constitute a detennination of correlative water rights. The permittee is notified and by this provision understands that the quantity of water taken from the wells could be reduced by the Commission in the future. This permit is not a commitment that the pump capacities permitted here or even some lesser amount are guaranteed in the future."

Background: Fort Barrette Well (Well No. 2004-03) was drilled in 1941 and develops fresh (235 to 240 mgll chlorides) basal water from the Ewa-Kunia Aquifer System. It is one of the wells to be. used as a monitor well for the Department of Health's monitor plan for the golf course. In June 1991 the applicant requested and received written pennission to test pump the well for six to tUne months to gather hydrologic data and to use the water for dust control In February 1992 the applicant requested a six-month extension to continue pumping. Staff recommended that the applicant formally apply for a temporary water use permit. The applicant stopped using the well and is requesting a six to twelve month temporary use of the well until their desalting plant is built. The applicant has a water use permit from the Commission to use 1.15 mgd of brackish caprock water from Makakilo Golf Course Well (Well No. 1904-02) located about a mile south of the golf course. Because the golf course is situated over the basal aquifer, the applicant was required to build a desalting plant to treat the water. The chloride content of the water applied to the golf course is to be 200 mg/l or less.

Action Requested: Approval of a temporary (6 to 12 months) water use permit to use 360,000 gallons per day (0.36 mgd) from Fort Barrette Well for construction water, dust contro~ and the initial grow-in period of the golf course.

Source of Water Supply: Pearl Harbor Sector, Ewa-Kunia Aquifer System, Pearl Harbor Ground Water Management Area.

Public Notice: In accordance with DLNR Administrative Rules, a public notice was published in the Star Bulletin on July 3 and 10, 1992. In addition, copies of the public notice were sent to the Mayor's office, the County Council, the Department of Health, the Department of Hawaiian Home Lands, the Office of Hawaiian Affairs, the State Historic Preservation Division, the Honolulu Board of Water Supply, and to other interested parties. Written comments to the proposed permit were to be submitted to the Commission by July 22, 1992. There were no objections to the application.

RECOMMENDATION:

That the Commission approve the issuance of a temporary water use permit to Makakilo Golf Corp. to use 360,000 gallons per day of water for construction water, dust control, and the initial grow-in period of the golf course, subject to the following conditions:

1. The permit shall be for a period of six months from the date of issuance. Modification of any permit condition shall be approved by the Commission.

ACTION TAKEN

The Commission issued a well construction permit to Finance Realty Company to drill and test Makakilo Golf Course Well (Well No. 1904-02) in the brackish caprock aquifer.

The Commission approved the issuance of a water use permit to Makakilo Golf Corp. to use 1.15 mgd of brackish caprock water for golf course irrigation use from the Makakilo Golf Course Well. Conditions:

1. Chloride Content of the water used on the Makakilo Golf Course shall be 200 ppm or less;

2. The development of the ground water source shall be completed within 24 months from the date of permit issuance.

Note: Though the Commission approved the issuance of the water use permit, technically, the actual permit was never issued since it is still "under review" by the Attorney General.

Makakilo Golf Corp. submitted an application for a well construction permit to construct and test a stand-by well to act as a backup source for the primary brackish, caprock well.

The Commission approved the well construction permit for the Makakilo Golf Course Standby Well (Well No. 1904-03).

The request was denied by letter from the Deputy Director.

Makakilo Golf Corp. submitted a water use permit application to use 0.36 mgd from the Fort Barrette Well for 6 to 12 months until the construction of the 1 mgd desalination plant is completed.

Commission scheduled to act on temporary water use permit.

It can be argued that Makakilo Golf Corp.'s water use permit has expired since one of the conditions, that "the development of the ground water source shall be completed within 24 months from the date of permit issuance", has not been met. Water from the brackish, caprock well cannot be used on the golf course until the desalting plant is completed. Makakilo Golf Corp. will be sending a letter soon requesting an extension of the water use permit. The matter will be taken ~o the Commission for action.

Enclosed is our water use permit application for well No. 2004-03, commonly known as the Fort Barrette well. Our proposed use would be for 360,000 GPD during the interim period until the construction of our 1,000,000 GPD desalination plant is completed. The desalination plant (a supplemental equipment to maintain irrigation water at or below 200 ppm chlorides, a requirement of the Water Commission) is scheduled for installation and completion by the end of the 4th quarter,1992. The Fort Barrette source, along with Waiahole Ditch water purchased from Oahu Sugar Company (OSCo), would be used for construction purposes and the initial landscape grow-in period of Makakilo Golf Course.

Recent studies have established that the direction of ground water flow in this portion of the Waianae Aquifer is to the west. If there is any return flow to the aquifer of water pumped from Fort Barrette Well, the only well that may possibly be affected would be BWS's Makakilo well, State No. 2004. We have written to the BWS outlying our proposal as presented to the you in this correspondence and as the enclosed letter from BWS indicates, it has no objection to our proposed use for the period indicated.

As you are aware, we have been testing Fort Barrette Well since September 1991 and utilizing the discard water for golf course construction purposes. During that time, water quality from the well has remained steady between 235 to 240 ppm chlorides and no adverse effect at BWS's Makakilo Well has occurred. Based on this, we would like to continue our present use of the well pending further action by the Water Commission on our application.

,.. o o Our proposed usage of the well water is as follows:

1. During the construction stage and for dust control purposes, (mainly on the south half of the golf course), the contractor will utilize the water from the Fort Barrette well sparingly and primarily on the areas of excavations and along paths traversed by the construction vehicles. It will also be used to suppress the origination of dust and minimize its migration from the project site onto the adjacent properties. The water will not be utilized to wet the entire project site with frequent drenching, but rather will be used for controlled surface spraying of the disturbed areas requiring treatment with enough water to keep the dust from rising. Because of the climate and especially the wind conditions at the area, a crust forms rather rapidly over the soil. This crust will minimize the dust from those areas, and we will then be able to concentrate on the disturbed areas for dust control. We believe the temporary use of this well water for dust control purposes will not harm or cause any degradation to the underlying basalt aquifer.

2. For the initial grow-in period on the north portion of the golf course (holes 1-7 and part of hole 18), we will use the Waiahole Ditch water exclusively. This water has a negligible chloride content (less than 10 ppm) and is fed into the lake at hole #2, which is a part of the irrigation system. We are currently in the process of constructing a 10 inch pipeline from Lake #2, across the golf course to the Lakes #9/10 complex, which is also under construction. The pipeline, when completed, will be used to transfer the Waiahole water to Lake #10 and allow us to blend the two sources of water and thus conform to the 200 ppm requirement imposed by the Water Commission. The blended water will then be used for the grow-in period on the south side of the golf course (See Map attached).

We have tried to obtain other sources of water for the project but all our efforts have been in vain. The complete lack of other sources of water on the south side of the golf course compels us to petition the Water Commission to allow us the use of Fort Barrette Well. Since our request is for the temporary use of Fort Barrette well and our need to obtain a source of water is very urgent, we additionally request that our application be processed expeditiously. Your concurrence and approval of our request would be greatly appreciated.

Thank you for your letter of May 29, 1992 requesting support for your proposal to use 350,000 gallons a day from the Fort Barrette Well.

We have no objections to your proposal to temporarily use the water from the well for dust control and irrigation until the desalting plant is completed in about 7-10 months.

Our Makakilo Well is located about 1,200 feet downgradient of the golf course, but the water from the Fort Barrette Well has chloride ranging between 235 to 240 ppm, which is slightly below the chloride of our Makakilo Well.

We do not anticipate any long-tenn adverse problems to our Makakilo Well due to the short-tenn use of the water from the Fort Barrette Well.

Your request to extend the pumping test period for Fort Barrette Well No. 2004-02 has been denied for the following reasons:

1. Two conditions specified by the CWRM Chairperson were that you: 1) notify the Commission when pumping would commence; and 2) submit monthly pumpage reports. Neither of these conditions has been met despite intermittent pumping since September '91 totalling 21 million gallons.

2. We have had reports that the pumped water is being used for dust control at the Makakilo Golf Course site. On March 15, 1990, the CWRM approved your water use permit for the caprock golf course wells with the condition that water used on the course shall be 200 ppm or less. Although it is wise to put the pump test water to use, the chloride concentration from the Fort Barrette Monitor Well (230+ ppm) is in excess of 200 ppm and it would be inconsistent for us to allow the monitor well quality water to be applied in the golf course area. The reason for this is that BWS has a well (State No. 2004-04) downgradient of the golf course site which is already experiencing chloride levels in excess of 200 ppm.

3. Since this well is to be used for monitoring purposes it is unclear how further pumping will improve upon data already gathered. Ideally, monitor wells should not even be pumped but, rather, sampled "in-situ" by lowering specialized containers to gather water at specified depths.

We wish to inform you that the test data we have accumulated from the monitoring well can only be deemed inconclusive because of "9.~i~rlt weather , ~Jl{lditiol1~ and contrary to instructions, the well was not pumped consistently, but on an intermittent basis. This was caused by an unreliable power source (portable generator) prior to hook-up of Hawaiian Electric Company electrical power lines. We believe the hydrologic data obtained may be distorted.

We would like to request that the test period be extended for an additional 6 months. Your immediate attention to this matter will be greatly appreciated.

We respectfully request your permission to test the Fort Barrette monitor

well for a period of Six (6) to Nine (9) months commencing from the date of

approval. We propose to install a temporary pump of 250 gpm capacity to

gather hydro-geologic data for this well. The data will be used to determine

design criteria for selecting permanent measuring devices necessary for the

monitor well.

Action Requested: Approval of a water use permit to use 1.15 million gallons per day (mgd) from Makakilo Golf Course Well (Well No. 1904-02) for irrigation of the Makakilo Golf Course.

Source of Water Supply: Caprock aquifer, Pearl Harbor Water Management Area.

Project Location: The well is located along the access road to Barbers Point Naval Air Station, Honouliuli, Ewa, Oahu.

Proposed Water Use: Golf course irrigation, Makakilo Golf Course. Brackish water from the caprock well will be desalted before being applied to the golf course.

Water Availability and Impact on Surrounding Wells: The well is located in the Kapolei Sector of the Caprock Aquifer. Sustainable yield under current conditions is estimated at 5 mgd. There are no other caprock wells being used in the Kapolei Sector at this time. Brackish caprock water from the well will be desalted then applied to the golf course. The golf course is situated over the Waianae Basal Aquifer. The Navy's Barbers Point Shaft and the Board of Water Supply's Makakilo Well both tap the Waianae Basal Aquifer and are within a mile of the golf course. The Board of Water Supply, the Department of Health, and the Navy have expressed their concern that brackish water not be allowed to be used over the basal aquifer. Concerns have also been expressed concerning the possibility of contamination of the basal aquifer by pesticides, herbicides, and fertilizers applied over the recharge area. The Department of Land Utilization approved Finance Realty's application for a Conditional Use Permit for the Makakilo Golf Course on February 14, 1989. A condition of the permit is that the owner/developer establish a ground water monitoring plan to be approved by the Department of Health. Condition 6 of the Conditional Use Permit states that "should data from the monitoring wells indicate the presence of the measured compound and! or the increased level of such compound, the DOH can require the owner/developer or subsequent owner to take immediate mitigative action to stop the cause of contamination. Subsequently, the developer/owner or subsequent owner shall mitigate any adverse effects caused by the contamination."

Public Notice: In accordance with DLNR Administrative Rules, a public notice was published in the Star Bulletin on January 31 and February 7, 1990. In addition, copies of the public notice were sent to the Mayor's office, the Department of Health, the Honolulu BWS, the Navy, Oahu Sugar Company, and to The Estate of James Campbell. Written objections to the proposed pennit were to be submitted to the Commission by February 22, 1990. The Navy has expressed their concern that the iProposed Makakilo Golf Course may result in the contamination of the Barbers Point Shaft, which provides about 2.5 mgd of potable water for the Naval Air Station (NAS), Barbers Point. The Honolulu Board of Water Supply recommended approval of the application on the condition that the chloride content of the water applied to the golf course be 160 ppm or less. Oahu Sugar Company did not have any specific objection to the permit application but expressed their concerns regarding the administration of the aquifer and the importance of increasing recharge to the aquifer to maintain its present quality. No other concerns or objections have been submitted.

RECOMMENDATION:

That the Commission approve the issuance of a water use permit to the applicant to use 1.15 mgd of brackish caprock water for golf course irrigation use from Well No. 1904-02, subject to the following conditions:

General Conditions

(1) The water use authorized by the permit must be for the reasonable-beneficial use described in the permit.

(2) The use must not interfere with any existing legal use of water.

(3) Modification of any permit condition must be approved by the Commission.

(4) The applicant must comply with all other applicable laws, rules, and ordinances.

Additional Conditions

(1) The permit shall be subject to the Chairperson's approval of a water use plan recommending possible measures to prevent or minimize saltwater contamination of the Caprock Aquifer and establish courses of action to prevent the aquifer from becoming too saline. The applicant must comply with the approved plan.

(2) Chloride content of the water used on the Makakilo Golf Course shall be 160 ppm or less.

(3) An approved flowmeter must be installed to measure withdrawals and a record of the withdrawals must be kept and reported.

(4) The development of the ground water source shall be completed within 24 months from the date of permit issuance.
