RWITC FULL RACE DAY REPORTS DURING 2010-2011 MUMBAI SEASON http://www.destinycalling.net RE : APPEAL FROM JOCKEY D.K.ASHISH IN RESPECT OF SUSPENSION OF HIS JOCKEY’S LICENSE W.E.F. 14/11/2010 TO 21/11/2010 FOR CARELESS RIDING ON ‘RIVER GEM” IN RACE NO..224 – THE CLASSIC ROCK PLATE RUN ON SUNDAY, 17 TH OCTOBER, 2010 : The Board of Appeal at its Meeting held on 29 th October, 2010 considered appeal dated 20 th October, 2010 from Jockey D.K.Ashish and interviewed him and his Spokesman Mr.S.Kapoor. The Board of Appeal having studied all documents and papers that were submitted, including the Grounds of Appeal and having heard the submissions made by Jockey D.K.Ashish and his spokesman and having viewed the relevant portion of the race in question several times in normal as well as in slow motion and having deliberated on the mater at length and having applied their minds, decided to reject his appeal and forfeit the deposit. Accordingly, the decision of the Stewards of the Club stands. Further, Jockey D.K.,Ashish was warned to be more careful in the future. RE : ENQUIRY INTO THE RUNNING AND RIDING OF “LYRICAL SYMPHONY” IN RACE NO.190 – THE KANTHARA PLATE (1000 METRES) RUN ON 3 RD OCTOBER, 2010 : The Stipendiary Stewards reported that they had questioned Trainer M.K.Jadhav and Jockey R.Shelar in the above connection. Trainer M.K.Jadhav stated that it was only third run of LYRICAL SYMPHONY in Race No.190 and she is still green and has no knowledge of racing and also she does not have early speed. He said that this was a 1000 metres race and the filly was drawn-12 and he had instructed the Jockey not to start pushing from the word go since he has been called up several times in the past for traveling wide, therefore, he had told the Jockey to let the first lot of horse go ahead and then bring the filly in, start niggling and let her get into her stride in the first two furlongs and then start riding out and try to win the race. He said that he had accepted to race the filly in this race considering that it was a race for maiden 3 years old horses who have run and not placed 2 nd /3rd. Jockey R.Shelar confirmed the instructions and added that the filly did not show early speed and took time to come into her stride and started galloping only towards the end. When asked whether he had worked the filly before this race, Jockey R.Shelar said that this filly does not work on the track since she injures herself. To another question as why he did not start pushing a earlier when the filly came into her stride, Jockey R.Shelar said that he started niggling the filly from the 800 metres but the filly did not show early speed and was not comfortable, and hence he gave her time to come into her stride and then started pushing her. He said that the filly started galloping only in the last 100 metres. Trainer M.K.Jadhav confirmed that this filly has the peculiar habit of getting injured during work, before her previous run when she was spurted, she came back with an injury to her elbow and hence she is mostly kept on slow work or they run her in a Mock Race and she keeps improving from race to race. Trainer M.K.Jadhav produced his Work Log Book. The video recording of Race No.190 was viewed. Trainer M.K.Jadhav said that the Jockey had started niggling the filly from 800 metres onwards but the filly did not show early speed. Also, DISTANT PROMISE who was racing ahead, kept an erratic course and his Jockey was in two minds whether to come from the inside or outside. Trainer M.K.Jadhav felt that if the Jockey had started pushing earlier, probably the filly would have traveled wide round the bend. He said that the Jockey had ridden out the filly in the straight and even used the whip and he was satisfied with the Jockey’s riding. He said that even in the previous race i.e. Race No.155 run over 1400 metres, the filly had warmed up only towards the end. The Stewards considered the above report and the explanation tendered by the Trainer and Jockey was noted. RE : ENQUIRY INTO THE RUNNING AND RIDING OF “WILD IMAGINATION” IN RACE NO.190 – THE KANTHARA PLATE (1000 METRES) RUN ON 3 RD OCTOBER, 2010 : The Stipendiary Stewards reported that they had questioned Trainer Narendra Lagad and Jockey Sunny Chinoy in the above connection. Trainer Narendra Lagad stated that he had instructed the Jockey to try and hit the front and to do his best.

The video recording of the race was viewed and Trainer Narendra Lagad was questioned about his observation of the Jockey’s riding. Trainer Narendra Lagad said that the Jockey has pushed the filly all through the race to try and remain as close as possible to the front horse who was far ahead. He said that in Race No.190, it was the sixth run of the filly and she was still a maiden, having placed fourth twice earlier and this was the best run of the filly since she has run again after this race and has finished off board. He said that the Jockey had done his best and he was satisfied with the Jockeys riding. Jockey Sunny Chinoy confirmed the instructions and added that the filly did not have the initial speed to hit the front and therefore he settled her in 2nd/3rd position and did his best. He added that the filly was hanging out in the straight and he had used the whip in excess of the prescribed limit so as to correct her. The video recording of Race No.190 was viewed again and it was pointed out to Jockey Sunny Chinoy that when he used the whip with the left hand, he held the reins tight with the other hand and also kept using the whip continuously without giving the filly a chance to respond. If the filly was lugging out, he should have tried to pull her in and correct her instead of holding the reins tight. Jockey Sunny Chinoy stated that the filly was on her wrong leg and lugging out badly and despite using the whip with the left hand, she still did not come on the right leg. He said that if he had tried to pull her in at that stage, he may have lost further ground and hence he kept using the whip with the left hand and held the reins tight with the other hand so as to prevent her from shifting out further. He said that he had done his best. Trainer Narendra Lagad said that WILD IMAGINATION is a small filly and Jockey Sunny Chinoy being a tall boy, possibly found it difficult to ride her. To a further question, Tr.Narendra Lagad said that this filly did not have the habit of hanging in or out but in this particular race the filly was lugging out. The Stewards considered the above report and the explanation tendered by the Trainer and Jockey was noted. RE : RACE NO.25 – THE FAIR ALWAYS PLATE RUN ON 2ND DECEMBER, 2010 – APPRENTICE A.SANDESH, RIDER OF “EQUALITY” REPORTED TO THE STEWARDS FOR DROPPING HIS HANDS BEFORE PASSING THE WINNING POST : The Stewards at their meeting held on 5th December, 2010 considered a report from the Stipendiary Stewards on the captioned subject matter and having viewed the video recording of Race No.25 decided to caution Apprentice A.Sandesh for dropping his hands before passing the winning post. RE : RACE NO.26 – THE ENRICO PLATE (DIV.II) RUN ON 2ND DECEMBER, 2010 – APPRENTICE A.SANDESH, RIDER OF “SIOOUX CHIEF” REPORTED TO THE STEWARDS FOR CARELESS RIDING: The Stewards at their meeting held on 5th December, 2010 considered a report from the Stipendiary Stewards on the captioned subject matter and having viewed the video recording of Race No.25 decided to give App.A.Sandesh the benefit of the doubt for careless riding and directed the Stipendiary Stewards to take action against him for not keeping proper control over his mount. Accordingly, App.A.Sandesh was fined Rs.3000/- by the Stipendiary Stewards for not keeping proper control over his mount SIOOUX CHIEF in Race No.26, in that, he kept an erratic course in the straight and shifted out under use of the whip and bumped RIVER TERN (S.Zervan) in the final stages of the race. RE : STEWARDS ENQUIRY / OBJECTION IN RACE NO.33 – THE VALLABHDAS H.ADWALIA TROPHY (DIV.I) RUN ON 2ND DECEMBER, 2010 – APPRENTICE A.SANDESH, RIDER OF “STAR SYMPHONY” - CARELESS RIDING: The Stewards at their meeting held on 5th December, 2010 interviewed App.A.Sandesh, who was accompanied by his Master, Trainer Rehanullah Khan, in the above connection. Having heard the submission made by them and viewing the video recording of Race No.33, the Stewards held App.A.Sandesh guilty of careless riding on his mount STAR SYMPHONY in the above race. However, keeping in mind that App.A.Sandesh had admitted his mistake and apologized for the same, the Stewards took a lenient view in the matter and decided to suspend his Apprentice Jockey’s license for 23rd December, 2010 (permitted to ride work/mock race). RE : STEWARDS ENQUIRY / OBJECTION IN RACE NO.33 – THE VALLABHDAS H.ADWALIA TROPHY (DIV.I) RUN ON 2ND DECEMBER, 2010 – APPRENTICE D.AKKSHAY, RIDER OF “VISIONAIRE” - CARELESS RIDING:

The Stewards at their meeting held on 5th December, 2010 having reviewed the video recording of Race No.33, decided to give Apprentice D.Akkshay the benefit of the doubt. RE : ENQUIRY INTO THE RUNNING OF RACE NO.62 – THE P.D.BOLTON TROPHY RUN ON SUNDAY, 19TH DECEMBER, 2010 : The Stipendiary Stewards reported that they had questioned Trainer Rehanullah Khan and Jockey N.G.McCullagh regarding the running and riding of SAINTS N SINNERS in the above race. Trainer Rehanullah Khan said that he had specifically told the Jockey not to be in 1st/2nd position but to sit in 3rd/4th position, gradually improve and to do his best in the straight. When asked as to why he gave such instructions in a 1000 metres race, Tr.Rehanullah Khan explained that this horse has won all his races coming from behind. He said that in this particular race, there were two fast horses SUPERIOR QUEST and HIGHLAND MUSIC who normally hit the front and he had expected both these horses to fight for the lead and he wanted his horse to be settled behind them and in the straight he expected the front horses to tire out and his horse would be able to challenge and overtake them. The video recording of Race No.62 was viewed and when asked for his observation, Tr.Rehanullah Khan said that Jockey McCullagh settled the horse beautifully along the rails and was following the two danger horses, however, approaching the final bend, AFLATOON (Shrikant Kamble) rolled in and hence Jockey McCullagh had to steady his horse while negotiating the bend, otherwise Jockey McCullagh would have followed SUPERIOR QUEST much closer along the rails into the straight and thereafter pulled his horse out. He pointed out that SAINTS N SINNERS had overtaken SUPERIOR QUEST at one stage and thereafter packed up in the last 200 metres and had even lost the second place. had the Jockey sat closer, possibly the horse would have fizzled out much earlier. He said that the Jockey rode a perfect race and he was satisfied with his riding. He also pointed out that his horse had a handicap disadvantage of 2½ kgs. in this race vis-à-vis HIGHLAND MUSIC in Race No.216 run at Pune and yet was beaten by the same margin. Jockey N.G.McCullagh confirmed the instructions. He said that he was drawn 5 and if he wished to be a little closer after the start, he would have had to travel four horses wide and hence he decided to settle his horse along the rails and the horse settled beautifully and he was tracking the two danger horses SUPERIOR QUEST and HIGHLAND MUSIC, however, approaching the final bend, AFLATOON (Shrikant Kamble) rolled in whereby he had to switch his mount to the outside and thereafter when he made his move in the straight, the horse came well alongside SUPERIOR QUEST and thereafter fizzled out in the final furlong. The Stipendiary Stewards further reported that as directed by the Stewards they had scrutinized the betting of Race No.62. It was found that SUPERIOR QUEST was backed down whereas the favourite, HIGHLAND MUSIC, had drifted slightly. Also, the odds on SAINTS N SINNER drifted from 5/1 to 11/2. The matter was reported to the Stewards for such action as deemed fit. The Stewards at their meeting held on Sunday, 26th December, 2010 considered the above report and having deliberated on the matter, decided that no action was called for. RE : ENQUIRY INTO THE RUNNING AND RIDING OF “STERLING SILVER” IN RACE NO.69 – THE COLE GOLD TROPHY (DIV.I) (1000 METRES) RUN ON SUNDAY, 19TH DECEMBER, 2010 : The Stipendiary Stewards reported that they had questioned Trainer Narendra Lagad and Jockey D.K.Ashish in the above connection. Trainer Narendra Lagad said that he had instructed the Jockey to settle the filly in 3rd/4th position and to do his best in the straight. The video recording of the race was viewed and Tr.Narendra Lagad was asked for his observation of the Jockey’s riding. Tr.Narendra Lagad said that his filly jumped out awkwardly towards the outside and was knocked out thereafter RIVER CHIEFTAIN has tightened NATIVE LADY who in turn has shifted in and bumped his filly. Further, approaching 600 metres, the Jockey had to again steady the filly since CAPTAIN SMART, whose saddle had slipped, kept shifting in. Thereafter, the Jockey had pulled the filly out and rode a perfect race and he was satisfied with the Jockey’s riding. The video recording of the race was again viewed and it was pointed out to Tr.Narendra Lagad that soon after the start STERLING SILVER was in a good position and Jockey D.K.Ashish had started checking the filly even before the outside horses shifted in. Further, entering the straight, Jockey D.K.Ashish had unnecessarily changed course to make

his move from the outside thereby losing valuable ground. Trainer Lagad said that at the start the filly jumped out awkwardly towards the outside and was bumped and then the filly tried to go out and at the same time the outside horses were shifting in and seeing this, the Jockey tried to correct the filly when he was bumped by the outside horse. As regards changing of the course, he pointed out that before the bend the filly was knocked 3 to 4 times and also there was a wall of horses ahead and therefore the Jockey did the right thing by switching the filly to the outside to give her a clear run and also the Jockey did not check the filly at any stage but moved out along with the filly’s rhythm. Jockey D.K.Ashish confirmed the instructions. The video recording of the race was viewed and when asked as to why he had checked the filly at the start, he said that the filly tried to go out and when he tried to control her, the outside horse shifted in and bumped the filly and passing 600 metres, CAPTAIN SMART shifted in and caused him interference. Thereafter he pulled the filly out to give her a clear run and did his best. The matter was reported to the Stewards for such action as deemed fit. The Stewards at their meeting held on Sunday, 26th November, 2010 interviewed Trainer Narendra Lagad and Jockey D.K.Ashish in the above connection and having heard the submissions made by them and viewing the video recording of the race decided to give Jockey D.K.Ashish the benefit of the doubt in this case and warned him for the future. RE: ENQUIRY INTO THE RUNNING AND RIDING OF “ARSHAVIN” IN RACE NO. 90 – THE VICTORY MARCH PLATE RUN ON SUNDAY, 26TH DECEMBER 2010 : The Stewards at their meeting held on Thursday, 30th December, 2010 considered the evidence obtained by the Stipendiary Stewards in the above enquiry. They interviewed Trainer Faisal A.Abbas and Jockey S.Sunil and having considered the submissions made by them and having viewed the video recording of Race No.90, the Stewards were not satisfied with the explanation tendered by Jockey S.Sunil in the subject case and held him guilty of not allowing his mount ARSHAVIN to run on its merits in the above race. In that, he waited for too long to make his move in the straight. Thereafter, when his horse shifted wide out under use of the whip, he stopped the use of whip and corrected the horse and despite the horse travelling 8 to 9 horses wide at that stage, and Jockey S.Sunil having all the chance to change his whip hand, he did not do so and resumed using the whip with his right hand thereby further aggravating the outward movement of the horse thus losing valuable ground at a crucial part of the race and lost the race by half a length. The Stewards noted that there was a considerable drift in the odds on ARSHAVIN. Therefore, taking an overall view, the Stewards decided to suspend his Jockey’s license w.e.f. 16th January, 2011 to 27th March, 2011 (both days inclusive) (Not permitted to ride work/mock race). RE: ENQUIRY INTO THE RUNNING AND RIDING OF “DOI MOI” IN RACE NO. 46 – THE SIR RAHIMTOOLA CHINOY TROPHY RUN ON THURSDAY, 9TH DECEMBER 2010: The Stewards at their meeting held on Thursday, 30th December, 2010 considered the evidence obtained by the Stipendiary Stewards in the above enquiry. They interviewed Trainer Nosher Cama and Jockey Neeraj Rawal and having considered the submissions made by them and having viewed the video recording of Race No.46, the Stewards decided to give Jockey Neeraj Rawal the benefit of the doubt in the subject case. However, he was warned to use better judgement in a race in the future. RE: ENQUIRY INTO THE RUNNING AND RIDING OF “STRATEGIC CHANGE” IN RACE NO. 85 – THE NAWABZADA RASHIDUZZAFAR KHAN TROPHY RUN ON SUNDAY, 26TH DECEMBER 2010 : The Stipendiary Stewards reported that they had questioned Trainer S Padmanabhan and Jockey Neeraj Rawal with regard to the caption subject matter. The Jockey was instructed to go to the front and if someone chases then to sit well up and not to cut pace. When asked for the observation of the Jockey’s riding, Trainer Padmanabhan stated that soon after the start, STARTEGIC CHANGE was racing on the inside of STAR ALLIANCE and then the Jockey chose to drop out and sit 2nd. The Trainer was of the opinion that the running of the horse did not have an effect on the end result of the race. Jockey Neeraj Rawal confirmed the Instructions. When asked about the reason for dropping out about 100 metres after the start, the Jockey stated that his mount was slow and he had brushed to move up in the field and had eased up once

he realized that he could cut pace with STAR ALLIANCE. He added that he had followed the second part of the Instructions which were to be well up and he had been in touch with STAR ALLIANCE who was racing in front. The matter was reported to the Stewards for necessary action. The Stewards at their meeting held on 30th December, 2010 considered the above report. They interviewed Jockey Neeraj Rawal and having heard him and having viewed the video recording of Race No.85, decided that no action was called for in the matter. RE: MERCY PETITION IN RESPECT OF EXCLUSION IMPOSED ON HIM FROM 25TH JULY 2008 TO 24TH JULY 2011 FOR ACCEPTANCE OF ILLEGAL RACE BETS AT THE MUMBAI RACE COURSE ON 12TH APRIL 2008 DURING MUMBAI RACES – MR. VIRENDRA SHANKAR KHEDEKAR : The Stewards at their meeting held on Thursday, 30th December, 2010 considered Mercy Petition from Mr.Virendra Shankar Khedekar in the above connection and having deliberated on the matter decided to allow the Mercy Petition. RE: ALLEGED ACCEPTANCE OF ILLEGAL RACE BETS BY MR. PRAVIN ROSHAN PATEL (R/o Palms, 2, Flat No.412, 4th Floor, R.K.Road, Goregaon (East) Mumbai – 400 065) AT THE MUMBAI RACE COURSE ON 4TH DECEMBER 2010 DURING CALCUTTA RACES : The Stewards of the Club at their Meeting held on 30th December, 2010 interviewed Mr.Pravin Roshan in the above connection. The stewards having considered all papers, documents, proceedings before them and having interviewed heard Mr.Pravind Roshan and not being satisfied with the explanation tendered by him, decided to exclude him from the premises of the racecourse and all other places under the control of the Stewards w.e.f. 31st December, 2010 to 30th December, 2015. RE : EXAMINATION OF “EXCELLATISTIC” WHO RAN IN RACE NO.90 – THE VICTORY MARCH PLATE RUN ON SUNDAY, 26TH DECEMBER, 2010 : Trainer Mansoor Shah had requested the Club’s Sr.V.O. to examine the filly EXCELLTASTIC before the race since it was reported to him that on the way from the stables to the saddling enclosure, the filly had picked up a nail. On examination, the Sr.V.O. found no bleeding injury and the filly was trotting sound. The filly was again examined at the Starting Gate by the Club’s V.O. and certified sound and hence permitted to race. The filly returned sound after the race. RE : ENQUIRY INTO THE COMPARATIVE PERFORMANCE OF “BORN DESTINY” IN RACE NO.99 – THE GIACOSA PLATE RUN ON SUNDAY, 2ND JANUARY, 2011 AS COMPARED TO ITS PREVIOUS RUN IN RACE NO.64 RUN ON 19TH DECEMBER, 2010 WHERE IT WAS UNPLACED: The Stipendiary Stewards reported that they had questioned Trainer Jayantilal K Gor with regard to the captioned subject matter. The Trainer explained that earlier this horse used to shift ground and therefore he ran him with Blinkers in this race and the Blinkers helped the gelding. He added that the horse had worked with the Blinkers and had shown improvement and therefore he had used them. He added that the instructions were same in all the races i.e. to be in 4th/5th position and to ride from the outside in the straight. Further, the previous run was in Class V but it was open company whereas this time the horse won in a race for horses 5 years old and over . Also, last time the horse had run over 1400 metres and the Jockey had suggested that a shorter trip would be better and therefore he had run him over 200 metres less than last time. To another question, he said that the gelding had won over 1400 metres but that was more than a year ago. He added that this time he had claimed an allowance and had put up a Jockey who was riding well. When questioned as to why he had run the horse within 14 days, he stated that there was no race restricted for the age group for a long time and therefore he had run the horse in this race. The explanation tendered by Trainer Jayantilal K.Gor was noted.

RE : ENQUIRY INTO THE RUNNING AND RIDING OF “BECKET” IN RACE NO.89 – THE ROHAN LIFESCAPES MAHARAJA JIWAJIRAO SCINDIA TROPHY (GR.3) RUN ON SUNDAY, 26TH DECEMBER, 2010 : The Stewards at their meeting held on Thursday, 6th January, 2011 questioned Trainer S.Padmanabhan and Jockey David Allan in the above connection. Trainer S.Padmanabhan was specifically asked about his observation of the Jockey’s riding in the straight. Trainer S.Padmanabhan said that BECKET has an excellent turn of foot but he needs to be contained as much as possible and ridden out only in the last 300 to 350 metres. He said that in the past whenever the Jockey has made his move early, the horse lost the race and in the race in question the Jockey did the right thing by not switching him to the outside at the top of the straight, however, thereafter the Jockey was unlucky not to get the opening at the right time and had to pull the horse out near 200 metres and lost the race by a short-head. He further explained that the pace in the early part of the race was slow as a result when the horses entered the home straight, the front horses, instead of tiring and dropping back, all kicked on at the same time and there was a wall of horses ahead and Jockey David Allan was unlucky not to get the opening. He further explained that his other runner POLISH PATRIOT has won most of his races being upfront and previously he has run only 3 ¼ lengths behind BECKET at level weights and in the race in question POLISH PATRIOT had 10 kgs. handicap advantage over BECKET and hence had a chance to win the race but he had fancied BECKET in this race. When questioned, Jockey Davind Allan said that turning for home there were horses on his outside and if he wished to take his horse out at that stage, he would have had to travel from the wide outside therefore he came the shortest way and passing 400 metres there was a gap ahead which he wanted to take but at the same time CLAIRON CALL who was racing on his inside leaned outwards and closed the gap and therefore he had no option but to make his move from 200 metres where he was able to him out and he lost the race by a short-head. He said that he had done his best. After viewing the video recording of the race and deliberating the matter, the Stewards decided to give Jockey David Allan the benefit of the doubt and no action was initiated in the matter. RACE NO.7 (79) – THE SNOW DEW PLATE RUN ON 23RD DECEMBER 2010 – FAILING TO FULFILL HIS RIDING ENGAGEMENT – JOCKEY S.A. DE SOUSA (FLOODS OF FORTUNE) The Stipendiary Stewards reported that Trainer P Shroff had reported on 23/12/2010 that Jockey S.A. De Sousa, the declared Rider for FLOODS OF FORTUNE would not be able to fulfill his riding engagement. Jockey S.A. De Sousa when questioned in the above connection, he stated that his flight had got delayed from Banglalore. In view of the above, no action has been initiated against anyone. RE : ENQUIRY INTO THE COMPARATIVE PERFORMANCE OF “GAMBA” IN RACE NO.103 – THE NEW YEAR TROPHY (DIV.II) RUN ON SUNDAY, 2ND JANUARY, 2011 WHERE THE MARE FINISHED SECOND, AS COMPARED TO HER PREVIOUS RUNS I.E. RACE NOS.17, 43 & 61 WHERE THE MARE WAS UNPLACED : The Stipendiary Stewards reported that they had questioned Trainer Faisal A.Abbas in the above connection. He said that he had given similar instructions in all the races i.e. to sit well up and to do the best. He explained that in the very first outing in Race No.17 GAMBA had finished fourth and thereafter the mare ran off Board in the next two outings. He said that in his opinion the mare had not shown improvement in Race No.103 but she looked good as the set of horses in this race was mediocre, except for STERLING SILVER, the other horses had no form and RIVER GEM who was also fancied had finished about 15 lengths behind the winner in its earlier run whereas GAMBA had finished only 6 lengths behind in Race No.61.. Also, if STERLING SILVER had not hung out in the straight, GAMBA would have finished behind the actual verdict. He added that if this race had not been divided, than the winner STERLING SILVER and GAMBA may not have finished in the first six. Further, if GAMBA was in Div.I, she may not have figured on Board as the time clocked by STERLING SILVER was 1 Min 13.51 seconds and the winner of Div.I CAPE FERRAT clocked 1 Min 12.52 seconds and the horse who finished 6th in Div.I clocked 1 Min 13.42 seconds whilst GAMBA clocked 1 Min 13.54 seconds. He said that he has run GAMBA over different distances to get the best out of the mare but she has not shown any form and she was available at longer odds in this race. RE : ENQUIRY INTO THE POOR PERFORMANCE OF “LADY GENEREUSE” IN RACE NO.115 – THE FRIDA KAHLO PLATE (1200 METRES) RUN ON FRIDAY, 7TH JANUARY, 2011 : The Stipendiary Stewards reported that they had questioned Trainer Adil Dajee and Jockey Amyn Merchant in the above connection. Trainer Adil Dajee said that LADY GENEREUSE is a well bred filly, however, she has no past form, she ran six times in Pune, in most races finishing in the rear bunch and her best performance was in her last run in Pune over 1000 metres where she had finished fifth, about 10 lengths from the winner. However, after coming from Pune the filly had become much fitter and was working well and on the basis of her work outs and considering that the field was very poor with no horse having any past form, he as also the Jockeys who worked her, had fancied her to win this race and had informed the Owner and their friends and even the Time Keepers had tipped her to win this race and possibly that was the reason she ran an On Money favourite. However, the filly ran a very disappointing race, she did not produce her work outs in the race and even Jockey Amyn Merchant was shocked at her performance. Tr.Dajee said that looking at her breeding he now feels that probably she may need a longer trip. To a further question, he said that on the advice of his Jockeys, he had used a Tongue Strap on this filly since she has the habit of playing with the bit and had also used Blinkers since she had worked well with Blinkers. He said that the filly is absolutely sound, however, after the race in question he felt that the filly was slightly sore and had requested the Club’s Sr.V.O. to examine her, however, the Sr.V.O. has certified the filly sound. When questioned, Jockey Amyn Merchant said that the filly had shown no form in Pune, however, after coming to Mumbai she had worked well with Tongue Strap and Blinkers and considering that the field in this race was very poor, he had expected her to win this race. He said that the filly ran a disappointing race, she did not reproduce her work outs in this race and he has no explanation as to why she ran poorly. The matter was reported to the Stewards for such action as deemed fit. The Stewards at their meeting held on 13th January, 2011 considered the above report and decided to keep the enquiry open. RE : ENQUIRY INTO THE RUNNING AND RIDING OF “ENDLESS HORIZON” IN RACE NO.116 – THE M.D.PETIT PLATE (DIV.II) (1000 METRES) RUN ON FRIDAY, 7TH JANUARY, 2011 : The Stipendiary Stewards reported that they had questioned Trainer P.Shroff and Jockey Stephane Pasquier in the above connection and not being satisfied with the explanation tendered by Jockey Stephane Pasquier with regard to the handling of his mount in the straight, the matter was reported to the Stewards for such action as deemed fit. The Stewards at their meeting held on Thursday, 13th January, 2011 considered the above report and interviewed Trainer P.Shroff and Jockey Stephane Pasquier. The video recording of the race was viewed in the presence of Trainer P.Shroff and Jockey Stephane Pasquier. When questioned, Jockey Stephane Pasquier said that the Trainer had told him that this filly has the habit of jumping out slow from the gates and he should try to take a good start and get a good position and to do his best. He said that the filly was slightly slow out of the gate and near 800 metres she suddenly became keen and he did not wish to travel wide at that stage as it was too early, therefore, he settled her behind the other runners and after entering the straight pulled her out at the 400 metres and did his best. When again asked to explain his riding effort in the straight and why he had not use the whip, Jockey Stephane Pasquier said that he had followed the good horses into the straight and pulled the filly out at the 400 metres and ridden her out. He said that he uses the whip very sparingly on horses as he believes that whipping is not the only medium to get the best out of the horse and he uses the whip mainly as a corrective measure on horses who tend to hang in a race. When questioned, Trainer P.Shroff confirmed that Jockey Stephane Pasquier uses his whip sparingly and concentrates more in pushing. He said that the Jockey has ridden out the filly and also tapped her on the shoulder felt that the filly was possibly choking under pressure as she has soft pallet displacement problem and he had even had her scoped after the race. He added that she was a well bred filly but she has shown nothing and he was planning to retire her. He said that he was satisfied with the Jockey’s riding. The explanation tendered by the Trainer and Jockey was accepted. The Stewards at their meeting held on Thursday, 13th January, 2011 considered the above report and interviewed Trainer Magansingh P.Jodha and Jockey C.S.Jodha. The video recording of the race was viewed in the presence of Trainer Magansinhg P.Jodha and Jockey C.S.Jodha. Tr.Magansingh P.Jodha stated that he had instructed the Jockey to settle the horse in 3rd/4th position and coming into the straight to make his move from the outside and do his best. He said that the Jockey has followed his instructions in the early part, however, entering the straight he has remained on the inside instead of pulling the horse out due to which he was pocketed and the horse was pulled out near 200 metres and thereafter the Jockey has ridden out the horse and also DISTANT PROMISE who was in front kept an erratic course. Tr.Magansingh Jodha felt that if the Jockey had made his move from the outside at the right time probably he would have run closer but may not have been able to beat the winner. He said that MAGICAL MANTRA was a 6-year-old horse and he was at longer odds Jockey C.S.Jodha confirmed the instructions and added that after entering the straight there was a horse on his outside who he felt will drop back and he would get an opening, however, the outside horse kept going and therefore he had no option but to pull his horse out near 200 metres and thereafter he did his best. When asked as to why he did not take the gap along the rails near 200 metres, Jockey C.S.Jodha said that he was aware that his horse was pocketed and he had already made up his mind to pull him out at that stage so as to give him a clear run. Also, when the gap appeared the outside horse was inclined to shift in and therefore he made his move from the outside. When asked as to why he did not make use of the whip in the last 50 metres, he said that he did change his whip hand but before he could use the whip the outside horse shifted in and he had no place to go. The explanation tendered by the Trainer and Jockey was noted. RE : ENQUIRY INTO THE RUNNING AND RIDING OF “HIGHLAND MUSIC” IN RACE NO.119 – THE T.M.GOCULDAS PLATE (1000 METRES) RUN ON FRIDAY, 7TH JANUARY, 2011 : The Stipendiary Stewards reported that they had questioned Trainer H.J.Antia and Jockey R.Hughes in the above connection and not being satisfied with the explanation tendered by Jockey R.Hughes with regard to the handling of his mount in the final stages of the race, the matter was reported to the Stewards for such action as deemed fit. The Stewards at their meeting held on Thursday, 13th January, 2011 considered the above report and interviewed Trainer H.J.Antia and Jockey R.Hughes. The video recording of the race was viewed in the presence of Trainer H.J.Antia and Jockey R.Hughes. When questioned, Jockey R.Hughes said that he rode the horse in the same way as he did in the previous run i.e. Race No.62 which he won. He pointed out that in Race No.62 HIGHLAND MUSIC carried 55.5 kgs. and clocked 59.70 seconds whereas in Race No.119 the horse carried 61.5 kgs. and yet bettered his own time having clocked 58.87 seconds thus showing improvement over his previous run. Further, he pointed out that the course record stands in the name of ARES who carried 50 kgs. and clocked 57.84 seconds but HIGHLAND MUSIC carried 11.5 kgs. extra which in theory mean almost 1.5 seconds off the Track record. Jockey R.Hughes said that he believes that a Jockey cannot make a horse go faster and has to concentrate more on balancing the horse. Also, if he feels that the horse is giving his 100%, there was no need to use the whip. He said that when he first rode the horse in Race No.62, Trainer Antia had told him before the race that this horse has the habit of drifting out and in that race he had to use his whip 2 or 3 times to prevent him from going out but in this race the horse was travelling straight and he was giving his 100%, therefore he did not use the whip and the horse got beat only in the last 50 metres. He further pointed out that his horse had done last 200 metres in 11.13 seconds and he felt that his horse could not have done better than that. He said that he had done his best in Race No.119. When questioned, Trainer H.J.Antia said that his horse had bettered his own performance considerably from the last start and he felt that the horse had run such a good race only because of Jockey R.Hughes’ handling. He said that he took no exception to the Jockey’s riding. The explanation tendered by the Trainer and Jockey was accepted.

RE : APPEAL FROM JOCKEY SHRIKANT KAMBLE IN RESPECT OF SUSPENSION OF HIS JOCKEY’S LICENSE W.E.F. 7TH JANUARY, 2011 TO 6TH FEBRUARY, 2011 FOR DANGEROUS RIDING ON “ARES” IN RACE NO.54 – THE JACQUELINE TROPHY RUN ON 12TH DECEMBER, 2010, - JOCKEY SHRIKANT KAMBLE WAS GRANTED A STAY ON THE PUNISHMENT : The Board of Appeal at its meeting held on 12th January, 2011 considered letter dated 11th January, 2011 withdrawing his appeal dated 25th December, 2010 which he had preferred to the Board of Appeal against the decision of the Stewards of the Club. The Board was convinced that in the endeavor to win the race that too when he was in the close proximity to the winning post, the jockey did not want to change the whip hand at this crucial juncture and jeopardize his move especially since his contention was that he was not very comfortable in using the whip with his left hand. Trainer S.K.Sunderji attributed the poor performance of RIVER GEM in Race No.56 to the following reasons :- 1) In Race No.56 the field was much stronger as compared to Race No.103; 2) In Race No.103 the winner clocked 1 Minute 13.51 seconds as compared to Race No.56 where the winner clocked 1 Minute 11.94 seconds i.e. 1.53 seconds faster; 3) In Race No56, it was the first run of the gelding in Mumbai and the horse has shown slight improvement thereafter; 4) The common horse UPROAR finished behind RIVER GEM in both the races. After viewing the video recording of both the races, the explanation tendered by the Trainer and Jockey was noted. RE : COMPARATIVE PERFORMANCE OF “ADALLIA” (PLACED THIRD) IN RACE NO.114 – THE COLUMBUS PLATE (DIV.I) (1200 METRES) RUN ON 6TH JANUARY, 2011 AS COMPARED TO HER PREVIOUS RUN IN RACE No.80 – THE ALVARITA PLATE (1200 METRES) RUN ON 23RD DECEMBER, 2010 WHERE SHE WAS UNPLACED The Stipendiary Stewards reported that they had questioned Trainer Imtiaz A.Sait in the above connection. Trainer Imtiaz A.Sait attributed the poor performance of ADALLIA in Race No.80 to the following reasons :- 1) In Race No.80 it was the first run of the horse in Mumbai and she had the disadvantage of being drawn on the extreme outside i.e. Draw -14; 2) In Race No.80 his instructions to Apprentice M.A.Roushan were to be in forward position. However, immediately after the race the Jockey reported that the horse did not show initial speed as such he was unable to follow the instructions; 3) In Race No.114 he had declared a stronger rider i.e. Jockey Imran Chisty who managed to ride the filly in a much better fashion, followed the instructions and the mare managed to finish third;

4) On both the occasions, ADALLIA was available at 20/1. After viewing the video recording of both the races, the explanation tendered by the Trainer and Jockey was noted. RE : APPEAL FROM TRAINER NIRAD KARANJAWALA IN RESPECT OF THE DECISION OF THE STEWARDS OF THE CLUB (AS REGARDS ENQUIRY IN RESPECT OF SALE OF b c LIBOR / DIAMOND DREAMS (MOUNTAIN KING) TAKEN AT THEIR MEETING HELD ON SUNDAY, 12TH DECEMBER, 2010 TO SUSPEND HIS TRAINER’S LICENSE W.E.F. 30/12/2010 TILL THE END OF THE MUMBAI MEETING 2010/11 AND THEREAFTER SHOULD HE APPLY FOR A TRAINER’S LICENSE UNDER THE RULES OF THIS CLUB FOR THE SEASON 2011/12, NOT TO GRANT HIM THE SAME UP TO AND INCLUSIVE OF 30/12/2011. The Board of Appeal at its Meeting held on 17th January, 2011 considered appeal dated 14th December, 2010 from Trainer Nirad Karanjawala in the above connection. The Board of Appeal, having considered all documents, papers, proceedings etc. in the captioned matter as also the submissions (oral and written) made by Trainer Nirad Karanjawala/his Spokesman, Mr.Adi Copper, and after having deliberated on the matter at length and having applied their minds to the same, came to the conclusion that there is no merit in his Appeal and accordingly decided to reject his Appeal and uphold the order of the Stewards of the Club. The Board of Appeal also decided to forfeit his deposit. Accordingly, the Decision of the Stewards of the Club stands, in that (i) Since Trainer Nirad Karanjawala was granted a stay on the abovementioned punishment, his punishment would now come into effect from 8.00 p.m. on 20th January, 2011 to 20th January, 2012 i.e. his current Trainer’s license shall stand suspended w.e.f. 20th January, 2011 (8.00 p.m.) till the end of the Mumbai Meeting 2010/2011. Thereafter, should he apply for a Trainer’s license under the Rules of this Club, for the Season 2011/2012, the same shall not be granted to him up to and inclusive of 20th January, 2012. ii) Also, as imposed by the Stewards of the Club, there shall be a suspended sentence of two years over the next five years i.e. if he was found guilty of any act of misconduct or found guilty of committing irregularities and breaches of the Club’s Rules and procedures or flouting the Rules of Racing / Notifications, etc. of the Club, within the next five years commencing from 21st January, 2012, then the aforesaid suspended sentence of punishment of two years would immediately come into force and effect and which aforesaid punishment would be in addition to any other punishment which the Stewards may impose on him for any subsequent act of his as regards the aforesaid. iii) As voluntarily agreed by him before the Stewards of the Club, he would have to clear the debits of Rs.1,12,000/- in the account of Mr.Parvez Dulha Khan, which is the amount the Club had suffered monetary loss owing to his acts of misfeasance. SUBJECT : POSITIVE REPORT IN RESPECT OF ch g “AMARETTO” (PLACED 2ND) IN RACE NO.158 – THE GOOL S.POONAWALLA MILLION (GR.3) RUN ON SUNDAY, 23RD JANUARY, 2011: The Stewards of the Club at their meeting held on Sunday, 13th February, 2011 interviewed Tr.C.D.Katrak regarding the positive report dated 9th February, 2011 from The Racing Laboratory, Hong Kong Jockey Club, in respect of the sample of urine taken from his charge AMARETTO (Placed 2nd) in Race No.158 – The Gool S.Poonawalla Million (Gr.3) run on Sunday, 23rd January, 2011, which read as under :-

“THE ANALYSIS HAS SHOWN THE PRESENCE OF BOLDENONE” At this meeting, Tr.C.D.Katrak was handed over a copy of the above report. He was requested to inform to the Sr.Veterinary Officer of the Club, in writing, within five days of opening the envelope that identifies the sample i.e. latest by 18th February, 2011, whether he wished the split sample of his charge AMARETTO to go to HFL Sport Science, England, C.V.R.L., Dubai or L.C.H., France,, for Confirmatory Analysis and also the name of the Witnessing Analyst, if any, failing which the Stewards shall treat the report of the Primary Laboratory as conclusive. Further, he was required to arrange the presence of the Witnessing Analyst at the Lab conducting the Confirmatory Analysis within 30 days of him nominating the name. In case he was unable to arrange within this period the Witnessing Analyst after having nominated the name, the Confirmatory Analysis will proceed without the Witnessing Analyst.

Tr.C.D.Katrak was also asked to conduct his own enquiries and to lead evidence, if any, to prove mitigating circumstances, within 15 days and to also attend the enquiry to be held by the Stipendiary Stewards and the Sr.Veterinary Officer of the Club, as and when he would be required to. RE : ENQUIRY INTO THE RUNNING AND RIDING OF “ARABIAN POWER” IN RACE NO.163 – THE ALLAIRE PLATE (DIV.II) RUN ON 27TH JANUARY, 2011 : The Stipendiary Stewards reported that they had questioned Trainer Vijay Kasbekar and Jockey T.S.Jodha in the above connection. Tr.Kasbekar stated that he had instructed the Jockey to be in 2nd or 3rd position but if the horse goes to the front then to ride from the front. He had questioned the Jockey after the race and the Jockey had explained that he had ridden out the horse to the best of his ability and had also used the whip and done his best. Jockey T.S.Jodha confirmed the instructions. The video recording of the race was viewed and it was pointed out to Jockey T.S.Jodha that he was feeble in his riding effort in the last 100 metres and had lost a certain race, the verdict being a neck. The Jockey explained that he had concentrated on the horse in front of him i.e. SECRET TALK as he thought SECRET TALK was the horse to beat and he did not realize that EMERALD QUEEN was moving very fast on the wide outside. Trainer Vijay Kasbekar expressed his dissatisfaction with the Jockey’s riding in the last 50 metres as he felt that the Jockey had lost a certain race. Not being satisfied with the explanation tendered by Jockey T.S.Jodha, the matter was reported to the Stewards. The Stewards at their meeting held on Sunday, 13th February, 2010 interviewed Trainer Vijay Kasbekar and Jockey T.S.Jodha in the above connection and having heard them and viewing the video recording of the race, decided to give Jockey T.S.Jodha the benefit of the doubt in the subject case. However, he was severely cautioned and told to ride out all his mounts vigorously past the post in the future. RE : ENQUIRY INTO THE POOR PERFORMANCE OF “CRESCENDO” IN RACE NO.93 – THE ROSMINI PLATE RUN ON 30TH DECEMBER, 2010 : The Stipendiary Stewards reported that they had questioned Trainer Vijay Kasbekar in the above connection. It was pointed out to Trainer Kasbekar that there were three common horses in this race who had finished behind CRESCENDO in the previous race i.e. Race No.37 but had all finished ahead of CRESCENDO this time. Trainer Vijay Kasbekar said that CRESCENDO is not a genuine horse and has performed inconsistently in the past also. Further, the mare was examined the next day by the Club’s Veterinary Officer and was diagnosed to have a stifle problem and was treated for the same. This was confirmed by the Club’s Veterinary Officer who had treated the horse with Phenylbutazone on 31st December, 2010 and 1st January, 2011. In view of the above, the explanation tendered by Trainer Vijay Kasbekar was noted. RE : ENQUIRY INTO THE RUNNING AND RIDING OF “SUN KISSED” IN RACE NO.143 – THE BOOKIES DELIGHT PLATE (DIV.I) RUN ON 20TH JANUARY, 2011 : The Stipendiary Stewards reported that they had questioned Trainer Imtiaz A.Sait and Jockey D.S.Rahore in the above connection. Trainer Imtiaz A.Sait stated that this filly has a soft mouth and the Jockey was unable to settle her in the initial part of the race. As regards the Jockey’s riding in the final stages of the race, he said that he had questioned the Jockey immediately after the race and the Jockey had informed him that the filly had nothing left and was tired and he had accepted the explanation of the Jockey. Jockey D.S.Rathore stated that the filly was extremely keen in the initial part of the race, however, in the final stages, she had nothing left in her. The matter was reported to the Stewards for such action as deemed fit. The Stewards at their meeting held on Sunday, 20th February, 2011 considered the above report. They interviewed Trainer Imtiaz A.Sait and Jockey D.S.Rathore and having heard them and viewing the video recording of the race, decided to give Jockey D.S.Rathore the benefit of the doubt in this case. However, he was severely cautioned to be more careful and to ride out all his mounts past the post in the future. RE : OBJECTION – RACE NO.211 – THE SHAMAAL PLATE (DIV.I) RUN ON 17TH FEBRUARY, 2011 – JOCKEY B.PRAKASH, RIDER OF “TAMARAI” – CARELESS RIDING :

The Stewards of the Club at their meeting held on Sunday, 20th February, 2011 interviewed Jockey B.Prakash in the above connection and having heard the submissions made and viewing the video recording of the race, were not satisfied with the explanation tendered by him and held him guilty of careless riding on his mount TAMARAI in the above race. In that, negotiating the final bend he had shifted out to take a gap and in doing so, took the ground of GAME CHANGER (N.G.McCullagh) who received interference and in turn shifted out and jostled with RIVER GEM (S.K.Jadhav). However, taking cognizance of the explanation tendered by Jockey B.Prakash the Stewards took a lenient view in the matter and decided to only fine him a sum of Rs.15,000/- instead of suspending his Jockey’s license. RE : JOCKEY C.RAJENDRA REPORTED TO THE STEWARDS FOR IMPROPER USE OF THE WHIP ON HIS MOUNT “REIN IN SPAIN” IN RACE NO.196 – THE ELLE CUP RUN ON 13TH FEBRUARY, 2011: The Stewards of the Club at their meeting held on Thursday, 24th February, 2011 interviewed Jockey C.Rajendra for improper use of the whip on his mount REIN IN SPAIN in Race No.196 and having heard him and viewing the video recording of the race, the Stewards were not satisfied with the explanation tendered by him in the subject case. However, since he had already been fined by the Stipendiary Stewards for using the whip in excess of the prescribed limit on his mount, the Stewards decided not to initiate any further action in the matter. However, he was severely cautioned that on a repetition of a similar offence, his Jockey’s license may be suspended. ENQUIRY INTO THE RUNNING AND RIDING OF “ARISTOS” IN RACE NO.188 – THE R.N.KANGA GOLD TROPHY RUN ON SUNDAY, 6TH FEBRUARY, 2011 : The Stewards at their meeting held on 6th February, 2011 had interviewed Trainer J.S.Dhariwal and Jockey C.D.Hayes in the above connection at which time Jockey C.D.Hayes had stated that his mount was lugging-in in the early part of the race and then lugged out and he found his mount uncomfortable and therefore he did not ride out his mount. In view of the above, the Stewards had directed the Club’s Sr.V.O. to examine the horse again the next day and to submit a report. The Sr.V.O. reported that ARISTOS was examined again in the morning on 7th February, 2011 at the stables and was found to be sound. Subsequently the horse was sent for X-Ray examination by the Trainer on 7th February, 2011. The Stewards at their meeting held on Sunday, 27th February, 2011 interviewed Trainer J.S.Dhariwal and Jockey C.D.Hayes. Trainer Dhariwal said that even after the X-Ray Report, the horse was trotting sound and he working very well. He said that the horse has raced in the past in the same condition and except for Race No.188, he has never shown any problem in a race and has won races in the same condition.

Trainer J.S.Dhariwal was informed that in view of the X-Ray Report, it was now up to him to decide whether he would like to continue to race the horse in the same condition. However, if he does so, it would be at his own risk and if the horse shows any discomfort in the race and the Jockey does not ride out the horse, he along with the Jockey, will be liable for severe action. RE: ENQUIRY IN TO THE RUNNING AND RIDING OF “VIBGYOR” COUPLED WITH THE DRIFT IN ODDS IN RACE NO 257 – THE ICEBREAKER PLATE – RUN ON 13TH MARCH 2011 – TRAINER MANSOOR SHAH Trainer Mansoor Shah was questioned with regard to the performance of his charge VIBGYOR coupled with the drift in odds, which nearly doubled at race time and the horse performed poorly. The Sr. VO has reported that VIBGYOR had broken a blood vessel during the race. When questioned, Trainer Shah explained that the horse had won well last time out in Race no 194 over 1400 metres and in that respect he had fancied his horse. Further, he said that at a Handicap weight of 50 kg his horse had a chance. He added that his horse was running in a higher Class this time whereas MISSCHEVIOUS TROT was running in a lower Class. He said that VIBGYOR was running 200 metres more this time and that it was too hot at the race time which may have contributed to the horse breaking a blood vessel. When informed about the drift in odds from about Even Money around one hour before the start of the First race to 21/ 10 at race time, Tr.Mansoor Shah stated that he had fancied the horse and added that the horse had broken a blood vessel for the first time and how could he be aware that the horse would break a blood vessel in this race. He said that a lot of betting came on OH CALCUTTA and that could be the reason for the drift in odds for his horse. To a further question, Trainer Shah stated he had informed the Owner that VIBGYOR had a chance, however, he was not sure whether the Owner had backed the horse or not. Trainer Mansoor Shah added that even last time the odds on VIBGYOR had drifted from around 2 to 1 to 3 to 1 and longer and the horse had won the race. He re-iterated that MISSCHEVIOUS TROT had reached Class I on its performance and was now running in a lower Class and that MISSCHEVIOUS TROT had won on merits. The Work and Medication Log books were scrutinized. The horse was regular in work and was sufficiently worked. Further, his pattern of work prior to Race No 194 when the horse won and prior to this race was practically same. The explanation tendered by Trainer Mansoor Shah was noted. RE: APPEAL PREFERRED BY TRAINER JAYANTILAL K GOR AGAINST THE FINE OF RS.5000/- IMPOSED BY THE STIPENDIARY STEWARDS WITH REGARD TO SNAPPING OF THE NOSE BAND AND DISPLACEMENT OF BRIDLE DURING THE RACE ON HIS CHARGE “POLARISER” IN RACE NO 194 RUN ON 13TH FEBRUARY 2011. The Stewards of the Club at their meeting held on 20th March 2011 heard the Appeal preferred by Trainer Jayantilal K Gor and having viewed heard his submission and also having viewed the video recording of the backing in of the horse, decided to reject the Appeal. Further, he was severely warned for giving misleading evidence. RE : ENQUIRY INTO THE RUNNING AND RIDING OF “LIVING THE DREAM” IN RACE NO.257 – THE ICEBREAKER PLATE RUN ON 13TH MARCH, 2011 : Trainer Dallas Todywalla and Jockey J.Chinoy were questioned in the above connection. Trainer Dallas Todywalla stated that this was a 4 horse field, as such, he had instructed Jockey J. Chinoy to sit in 2nd/3rd position, give chance in the straight and in the last part to ride out because if this horse goes to the front, he starts loafing and does not take interest in the race. When asked about his observation, he said he was very upset with the start of the race as his horse had received interference from VIBGYOR, drawn 3 and his horse was forced out at the start. Thereafter, the Jockey had nicely settled the horse in the 3rd position along the rails and at the right time, he made his move in the straight. The only mistake the Jockey committed was that he did not keep a straight course at about 200 mtrs, otherwise he took no exception to the Jockey’s riding. Jockey J. Chinoy confirmed the instructions. He was asked as to why he waited till 350 mtrs. to which he said that the Trainer had told him to give the horse a chance in the straight, if this gelding hits the front, he does not respond well and loses interest in the race and therefore he waited after entering the straight and made his move from 350 mtrs. He added that when his horse shifted out at 200 mtrs. he had immediately tried to correct the horse and brought the horse on an even keel and rode out and was placed second. After viewing the previous runs of this horse, the explanation tendered by Trainer Dallas Todywalla and Jockey J. Chinoy was noted.

RE: APPEAL FROM JOCKEY DASHRATH SINGH AGAINST THE DECISION OF THE STEWARDS OF THE CLUB IN RESPECT OF SUSPENSION OF HIS JOCKEY’S LICENSE W.E.F. 17TH MARCH 2011 TO 27TH MARCH 2011 (BOTH DAYS INCLUSIVE) FOR CARELESS RIDING ON HIS MOUNT “DEVILITTO” IN RACE NO 230 RUN ON 27TH FEBRUARY 2011 – JOCKEY DASHRATH SINGH WAS GRANTED A STAY ON THE PUNISHMENT: The Board of Appeal at its meeting held on 19th March 2011 rejected Appeal from Jockey Dashrath Singh in the above connection. Since Jockey Dashrath Singh was granted a stay on his punishment till 20th March 2011 his punishment would now come into effect from 24th March 2011 up to 4th April 2011 (both days inclusive). RE : EQNUIRY INTO THE RUNNING AND RIDING OF “OCEAN TRAIL” IN RACE NO.221 – THE COUNT THE STEPS PLATE (DIV.I) RUN ON 20/02/2011 The Stipendiary Stewards reported that they had questioned Trainer S.K.Sunderji and App.P.Trevor in the above connection. Trainer S.K. Sunderji stated that he had instructed the Jockey to be in 2nd/3rd position. However, he lost the chance of winning the race at the start itself as explained in his complaint. The horse was fractious in the gate and as the start was effected, the horse had put his head down and lost ground and therefore his jockey, P. Trevor, was unable to follow the given instructions. He stated that he had strongly fancied the filly in this race. When questioned, App. P. Trevor confirmed the instruction and stated that when he lost ground at the jump out, he could not follow the Trainer’s instructions and he had gradually improved his position and did his best in the straight and the filly was gaining ground in the last part. When questioned about the security in his yard, Trainer S.K. Sunderji explained that the security in his stable is excellent as his Owner Mr. Wadhawan has provided video cameras in the Security Yard. Further, he has also provided Private Security Guards and therefore there is no chance of any foul play in his stable. He also opined that if something was done to the filly, she would not have responded in the final furlong as it can be noticed that she was gaining ground. On viewing the video recording of the race, it was evident that the filly had put her head down on a couple of occasion and she had put her head down and lost some ground when the start was effected,. Thre previous starts of the filly were viewed and it was noticed that in Race No. 9, which was the first race of the filly during the Mumbai Season, the filly was fractious in the gate and while jumping out, she lost about a length. In her next run in Race No. 47, the filly was provided a handler at the request of the Jockey and she jumped out well and in the race in question, the filly was fractious in draw No. 8 and lost about 2 lengths at the start. The explanation tendered by the Trainer and Jockey was noted. RE :ENQUIRY INTO THE COMPLAINT LODGED BY TRAINER S.K.SUNDERJI IN RESPECT OF THE START IN RACE NO.221 – THE COUNT THE STEPS PLATE (DIV.I) RUN ON 20/02/2011 WHERE HIS CHARGE “OCEAN TRAIL” HAD LOST GROUND AT THE START : The Stewards of the Club at their meeting held on Sunday, 20th March, 2011 considered a note dated 25th February, 2011 from the Starter and having heard Trainer S.K.Sunderji and App.P.Trevor as also the Starter and having viewed the video recording of the start of the race, decided that the incident of the horse putting his down just when the start was given and losing ground at the start was accidental and no action was called for in the matter.

RE: MERCY PETITION FROM JOCKEY DASHRATH SINGH IN RESPECT OF SUSPENSION OF HIS JOCKEY’S LICENSE W.E.F. 24TH MARCH 2011 TO 4TH APRIL, 2011 (BOTH DAYS INCLUSIVE) FOR CARELESS RIDING ON HIS MOUNT “DEVILITTO” IN RACE NO 230 RUN ON 27TH FEBRUARY 2011 : Mercy Petition dated 28th March, 2011 from Jockey Dashrath Singh in the above connection was referred to the Board of Appeal and the Board of Appeal having considered the same, decided to reject the mercy petition. Accordingly, the suspension of his Jockey’s licence as mentioned above,stands. RE : ENQUIRY INTO THE RUNNING AND RIDING OF “STAR MOUNTAIN” IN RACE NO.279 – THE COLOURS OF HOLI TROPHY (DIV.I) RUN ON 20TH MARCH, 2011 : The Stipendiary Stewards reported that they had questioned Trainer Adil Dajee and Jockey R.Shelar in the above connection. Trainer Adil Dajee informed that he had instructed Jockey R.Shelar to be in 3rd/4th/5th position, gradually improve and to do his best in the straight and had also informed the Jockey not to use the whip unnecessarily. Jockey R.Shelar confirmed the instructions.When asked about the positioning of his horse in the early part, he stated that his horse had jumped out awkwardly towards the outside and to save the interference to the outside drawn horse, he had immediately tried to correct the filly. Thereafter, he settled her and gradually improved. It was pointed out to Jockey R.Shelar that after correcting his mount he should have made his move, this being a 1000 metres race, to which he stated that he wanted to avoid any further interference to the favourite horse which was on his outside as he felt that if he had got into the horse at that stage she may shift out and cause interference again. He was asked that after entering the straight when two horses took the lead of over 12 lengths, he should have tried to improve his position. Further, after traveling about 200 metres, in the straight he had gone behind the other runners and had used the whip only in the last part when the race was nearly over. Jockey R.Shelar stated that after entering the straight the filly was hanging in and therefore the horse had shifted in. Further, the horse on the inside who was running in front of him had also come out and therefore it appears on the video recording as though he went behind the front runner. Jockey Shelar was informed that in that case, he should have kept the whip in the right hand to prevent the horse from shifting in to which he replied that this horse had some problem in the mouth which he had informed the Stipendiary Steward immediately after the race when he was called for questioning. He stated that the filly was not holding the bit throughout the race and kept her mouth open. He said next day in the Race Day Report it had been reported that the filly had wolf tooth on both side. When questioned, Trainer Adil Dajee said that considering the Jockey’s explanation that the filly was not holding the bit and as certified by the Veterinary Doctor that the filly had a wolf tooth on both sides, he accepted the explanations of Jockey R.Shelar. He further informed that his stable had fancied the filly in this race to at least run on board. When asked as to why he had not done dentistry before the race, he said that about a month back the Veterinarian had noticed a wolf tooth, however, it had not erupted fully and the filly did not show any problem in work and therefore he had not got the filly examined again. He was informed that since he was aware that the wolf tooth was at initial stage and this could have an effect on the running of the filly in future, he should have got the wolf tooth removed before racing the filly again. The matter was reported to the Stewards for such action as deemed fit. The Stewards at the meeting held on Sunday, 3rd April, 2011 interviewed Trainer Adil Dajee and Jockey R.Shelar in the above connection and having heard the submissions made by them and having viewed the video recording of the race :-

i) The Stewards were not satisfied with the explanation tendered by Jockey R.Shelar and held him guilty of incompetent riding on his mount STAR MOUNTAIN in the above race. In that, this being a 1000 metres race, he did not make sufficient efforts to be in close touch with the front runners and he was not vigorous in his riding effort in the straight. However, considering that the horse was at longer odds the Stewards took a lenient view and decided to suspend his Jockey’s license for 23rd April, 2011 (permitted to ride work/mock race). Further, he was severely cautioned for the future. ii) The Stewards were also not satisfied with the explanation tendered by Trainer Adil Dajee in the subject case and held him guilty of being negligent in the discharge of his duties as a Trainer. In that, he admitted that a month before the race his Veterinarian had noticed a wolf tooth which had not erupted fully and yet he did not consider it necessary to have the filly examined again for her mouth before accepting to race her in this race. Therefore, the Stewards decided to suspend his Trainer’s license for 23rd April, 2011. RE : APPEAL FROM JOCKEY NEERAJ RAWAL IN RESPECT OF SUSPENSION OF HIS JOCKEYS LICENSE W.E.F. 23/03/2011 TO 08/04/2011 (BOTH DAYS INCLUSIVE) IMPOSED ON HIM BY THE STEWARDS OF THE DELHI RACE CLUB FOR UNSATISFACTORY RIDING ON HIS MOUNT “LILLY” IN RACE NO.131 RUN AT D.R.C. – JOCKEY NEERAJ RAWAL WAS GRANTED A STAY ON THE PUNISHMENT UNTIL HIS APPEAL WAS HEARD : The Stewards of the Club at their meeting held on Monday, 4th April, 2011 considered appeal 14th March, 2011 from Jockey Neeraj Rawal in the above connection. The Stewards interviewed Jockey Neeraj Rawal who was represented by his Spokesman Mr.Nosher Cama, Mr.Magan Singh, trainer of the horse LILLY and having considered all the submissions made including Jockey Neeraj Rawal’s grounds of appeal and having viewed the video recording of the race and having deliberated the matter, decided to allow the appeal. RE : ENQUIRY INTO THE COMPARATIVE PERFORMANCE OF “TOMORROWS DREAMS” IN RACE NO.256 – THE RONALDO PLATE (DIV.II) RUN ON 13/03/2011 WHICH HE WON AS COMPARED TO ITS EARLIER RUN IN RACE NO.175 RUN ON 5TH FEBRUARY, 2011 WHERE HE WAS UNPLACED : The Stipendiary Stewards reported that they had questioned Trainer H.J.Antia in the above connection. Trainer Antia explained that in Race No.256 it was the fifth run of the horse. In the first run i.e. Race No.80 the horse ran unplaced. However, in the 2nd run i.e. Race No.91 over 1400 metres, the horse finished 3rd and was just ¾ lengths from the winner. Thereafter the horse ran in Race No.151 over 1600 metres and finished 1 ½ lengths from the winner despite not so good ride by the Jockey. Subsequently, the horse ran in Race No.175 on the Derby Weekend over 1600 metres and the company was tough and the horse finished 10th. He said that in the race in question i.e. Race No.256 which was over 1200 metres, the field was poor as compared to last time and he had selected this race for that reason even though he was aware that he would be shortening the trip by 400 metres. He said that there were two common horses BEMISAAL & EXCELLTASTIC who he beat in both the races and in his opinion the horse has not improved all that much. He further added that the work pattern of the horse was same. The explanation tendered by Trainer H.J.Antia was noted. RE : ENQUIRY INTO THE RUNNING OF HORSES UNDER THE CHARGE OF TRAINER H.J.ANTIA DURING THE CURRENT MUMBAI MEETING 2010/11 : The Stewards of the Club at their meeting held on Monday, 4th April, 2011 considered the evidence obtained by the Stipendiary Stewards in the above enquiry. Trainer H.J.Antia was questioned regarding the running pattern of his horses i.e. declaring ordinary Jockeys on his horses, using bandages and the horses being available at longer odds and running nowhere and the same horses winning next time out, well fancied with a better rider and without bandages. Trainer H.J.Antia explained that most of his horses have soundness problem and he has to gradually nurse them along into peak condition and normally good Jockeys do not always accept such rides and therefore he puts up his stable riders and the moment the horse peaks in condition and shows some spark in a race they accept the ride and since he does not hide anything and it is the racing public who open his horses as favourites and he obliges them by winning as public favourite and many of his favourites have obliged irrespective of the bandages. As regarding the use of bandages, he explained that he uses ordinary crepe bandages with sponge as a support to the horse and he removes them when he feels that the horse has come right and in his opinion the bandages do not have any effect on the

performance of the horse. He cited a few cases where his horses had performed better with bandages than what they had performed subsequently without bandages. The Stewards having considered all papers and proceedings before them and having heard the explanation given by Trainer H.J.Antia and having deliberated the matter at length, held the view that there was no clinching evidence to charge Trainer H.J.Antia of any malpractice, as such they decided to give him the benefit of the doubt in the present case. However, Trainer H.J.Antia was warned to be more careful with regard to the running pattern of his horses in the future and not to use the race track as a training facility. ENQUIRY INTO THE COMPARATIVE PERFORMANCE OF “SEA DIAMOND” IN RACE NO.318 RUN ON 9TH APRIL, 2011 WHICH THE MARE WON AS COMPARED TO HER PREVIOUS RUNS WHERE SHE WAS UNPLACED : The Stewards at their meeting held on 10th April, 2011 interviewed Trainer H.J.Antia in the above connection. Trainer Antia stated that this was a poor set of horses as compared to Race No.255, except for UNSTOPPABLE who had placed second in its previous run, the other horses had no form. Race No.255 was won by MYSTIC TEMPLE, clocking 59.50 seconds and MYSTIC TEMPLE is a winner of two races this season. The horses who had finished 2nd, 3rd, 4th and 5th in Race No.255 viz. HOTTIE, GLORIOUS MISS, RISING GLORY and NATIONAL IKON have all won or placed in Class IV subsequently and even WILD IMAGINATION who had placed tenth has subsequently lost a race by half length in a higher Class whereas his horse SEA DIAMOND ran in a lowest Class (0 to 19). Also, in Race No.255 it was big field of 20 horses and his horse was drawn-17. Further, his horse SEA DIAMOND had clocked 1 Minute 1.46 seconds in Race No.255 and today the horse has won in more or less same timing. The explanation tendered by Trainer H.J.Antia in the subject case was noted. However, his attention was drawn to the Calendar Notification with regard to inconsistent running of horses and he was warned to be more careful in the future. SUBJECT : POSITIVE REPORT IN RESPECT OF b f “HAUNTING FANTASY” (WINNER) IN RACE NO.280 – THE FORBES BREEDERS’ JUVENILE FILLIES CHAMPIONSHIP (GRADE 3) RUN ON SUNDAY, 20TH MARCH, 2011 : The Stewards of the Club at their meeting held on Saturday, 16th April, 2011 interviewed Tr.Karthik G. regarding the positive report dated 14th April, 2011 from Racing Laboratory, The Hong Kong Jockey Club, in respect of the sample of urine taken from his charge HAUNTING FANTASY (Winner) in Race No.280 – The Forbes Breeders’ Juvenile Fillies Championship (Gr.3) run on Sunday, 20th March, 2011, which read as under:-

“THE ANALYSIS HAS SHOWN THE PRESENCE OF FORMESTANE”

At this meeting, Tr.Karthik G. was handed over a copy of the above report. He was requested to inform to the Sr.Veterinary Officer of the Club, in writing, within five days of opening the envelope that identifies the sample i.e. latest by 21st April, 2011, whether he wished the split sample of his charge HAUNTING FANTASY to go to The HFL Sports Science, England, C.V.R.L., Dubai or L.C.H., France,, for Confirmatory Analysis and also the name of the Witnessing Analyst, if any, failing which the Stewards shall treat the report of the Primary Laboratory as conclusive. Further, he was required to arrange the presence of the Witnessing Analyst at the Lab conducting the Confirmatory Analysis within 30 days of him nominating the name. In case he was unable to arrange within this period the Witnessing Analyst after having nominated the name, the Confirmatory Analysis will proceed without the Witnessing Analyst. Tr.Karthik G. was also asked to conduct his own enquiries and to lead evidence, if any, to prove mitigating circumstances, within 15 days and to also attend the enquiry to be held by the Stipendiary Stewards and the Sr.Veterinary Officer of the Club, as and when he would be required to.

RE: ACCEPTANCE OF “AGAIN GALLOP” IN RACES SCHEDULED FOR 09/04/2011 DESPITE THE HORSE BEING ON VETERINARY BAN: Trainer Janardhan has been fined Rs.1000/- for accepting with his charge AGAIN GALLOP in a race on Saturday, 9th April, 2011 without having the horse passed fit to race by the Club’s VO. The horse was struck out at Acceptance stage. ENQUIRY INTO THE COMPLAINT LODGED BY MR.KHUSHRO K.JALNAWALA AGAINST MR.NIRAD KARANJAWALA/TRAINER JAYANTILAL K.GOR : The Stewards of the Club at their meeting held on Saturday, 23rd April, 2011 considered the evidence obtained by the Stipendiary Stewards in the above enquiry. The Stewards heard the submissions made by Mr.Nirad Karanjawala and his Spokesman Mr.Dallas Todywalla as also by Mr.Khushro K.Jalnawala and his Spokesman Mr.Narendra Lagad, Trainer Jayantilal K.Gor and his Clerk Mr.Sainath. At this meeting, Mr.Nirad Karanjawala admitted his guilt and apologized for the same. The Stewards having considered all the papers and proceedings before them and having heard all persons concerned, a) Held Mr. Nirad Karanjawala guilty of an extremely serious breach of the Rules of Racing in that a disqualified person interfered in the training of race horses and as a consequence was guilty of Gross Misconduct. He admitted before the Stewards having interfered with the management of the horses owned by Mr. K Jalnawala in the charge of Trainer Jayantilal K.Gor, during the period of his suspension by giving instructions through the Clerk Mr. Sainath. The instructions covered the Track Work, horses to be Entered, Scratched and Declared in races and also choosing the Jockey to be declared on ENCHANTED in Race no 176 and giving the said Jockey instructions as to how to ride in the race. The Stewards noted that in an earlier enquiry in respect of his actions in the matter of the Sale of b c (2005) Libor – Diamond Dreams (MOUNTAIN KING) it was decided that he would be ineligible for grant of Trainer’s License up to inclusive of 20th January 2012. Further in the said Enquiry, the Stewards had also imposed on him a suspended sentence of 2 years i.e. if he were again found to be guilty of committing irregularities and breaches of the Club’s Rules and Procedures or flouting the Rules of Racing / notifications etc. of the Club, within the next five years, then the aforesaid suspended sentence of punishment of two years would ipso facto come into force and effect. Further, as intimated to him vide this Office letter dated 13th December 2010, the Stewards informed him that as per the previous order cited above the suspended sentence of two years ipso facto comes in to effect i.e. he shall not be granted a Trainer’s License, should he apply, for a further period of two years starting from 20th February 2012 to 20th February 2014. b) The Stewards were not satisfied with the explanation tendered by Trainer Jayantilal K.Gor in the subject case and held him guilty of breach of the Rules of Racing as a consequence guilty of gross misconduct. In that, he had allowed Mr.Nirad Karanjawala, a suspended Trainer, to interfere in the management of his horses by accepting instructions from him which were sent through his Clerk Mr.Sainath. Further, he had totally disregarded the directions of the Owner and declared Jockey Towfeeq R.Shaikh on ENCHANTED in Race No.176 when he was specifically told not to declare the said Jockey. The Stewards also held him guilty of tendering false and misleading evidence in the enquiry. The Stewards noted that Mr.Jayantilal K.Gor was holding a Trainer’s license under the Rules of this Club for the last 16 years and therefore did not accept his contention that this was an act of ignorance since he was illiterate and unaware of the Rules of Racing. In view of the above, the Stewards decided that should Mr.Jayantilal K. Gor apply for a Trainer’s license for the Season 2011/12, the same will be granted to him, however, his Trainer’s license shall stand suspended w.e.f. 21st July, 2011 to 21st August, 2011 for breach of the Rules of Racing as a consequence guilty of gross misconduct. c) The Stewards were also not satisfied with the explanation tendered by Trainer Jayantilal K.Gor’s Clerk, Mr.Sainath in the subject case. However, considering that he was new to racing, the Stewards decided to give him the benefit of the doubt in the subject case and severely warned him for the future.

ENQUIRY INTO THE COMPARATIVE PERFORMANCE OF “STUD OF GOLD” IN RACE NO.349 – THE GOLD DUST PLATE (DIV.II) RUN ON 23RD APRIL, 2011 WHICH THE GELDING WON AS COMPARED TO ITS SIX PREVIOUS RUNS DURING THE CURRENT MUMBAI MEETING WHERE IT WAS UNPLACED : The Stewards at their meeting held on Sunday, 24th April, 2011 considered the Stipendiary Stewards note in the above connection. They interviewed Trainer H.J.Antia and having heard the submissions made by him and having viewed the video recording of Race No.349 as also the previous runs of STUD OF GOLD during the current Mumbai Meeting, were not satisfied with the explanation tendered by Trainer H.J.Antia for the reversal of form shown by his horse STUD OF GOLD in Race No.349. In that, the Stewards noted that prior to Race No.349, STUD OF GOLD ran six times during the current Mumbai Meeting 2010/1, in all the races the horse was ridden by mediocre Jockeys and was available at longer odds and finished unplaced. Further, there were two common horses in Race No.349 and the previous Race No.312 viz. BEMISAAL and RAJDOOT who had placed 3rd and 4th respectively in Race No.312 and his horse STUD OF GOLD had finished more than 10 lengths behind RAJDOOT and in Race No.349 STUD OF GOLD finished more than 5 lengths of both the common horses, thus showing marked improvement over its previous run. Also, the Stewards noted that there was a change in the running pattern of the horse i.e. in all the previous runs, STUD OF GOLD was settled behind, contrary to his style of running whereas in Race No.349, Jockey S.Zervan settled the horse nicely in 3rd/4th position and the horse won the race. Therefore, the Stewards decided :-

a) that should Mr.H.J.Antia apply for a Trainer’s license for the Season 2011/12, the same will be granted to him, however, his Trainer’s license shall stand suspended w.e.f. 21st July, 2011 to 20th August, 2011;

b) to fine him a sum of Rs.25.000/- ENQUIRY INTO THE COMPARATIVE PERFORMANCE OF “CONZTANZA” IN RACE NO.312 – THE WINNING HEART PLATE (DIV.II) RUN ON 4TH APRIL, 2011 WHICH THE FILLY WON AS COMPARED TO HER SIX PREVIOUS RUNS DURING THE CURRENT MUMBAI MEETING WHERE SHE WAS UNPLACED : The Stewards of the Club at their meeting held on Saturday, 23rd April, 2011 considered the evidence obtained by the Stipendiary Stewards in the above enquiry. Having heard the submissions made by Trainer Mansoor Shah and having viewed the video recording of Race No.312 as also the previous runs of the horse during the current Mumbai Meeting, the Stewards were not satisfied with the explanation tendered by Trainer Mansoor Shah for the reversal of form shown by his horse CONZTANZA in Race No.312. In that, the Stewards noted that prior to Race No.312, CONZSTANZA ran six times during the current Mumbai Meeting 2010/11, in all the races available at 15/1 and above and was unplaced, in the last two starts, having finished more than 15 lengths behind the winner and subsequently the horse was ridden by Jockey S.Zervan in Race No.312 and won well fancied. Therefore, the Stewards decided :-

a) that should Trainer Mansoor Shah apply for a Trainer’s license for the Season 2011/12, the same will be granted to him, however, his Trainer’s license shall stand suspended w.e.f. 21st July, 2011 to 29th July 11;

b) to fine him a sum of Rs.25.000/- RE : ENQUIRY INTO THE RUNNING OF RACE NO.310 – THE WINNING HEART PLATE (DIV.I) RUN ON 4TH APRIL, 2011 : The Stipendiary Stewards reported that they had enquired into the running of the above race. It was observed that Jockey Harish, the rider of EVANGILIST and App.A.Sandesh, the rider of SIZZLING LOVE had settled their mounts in the rear position in 1200 metres. Having interviewed Trainer Mansoor Shah and Jockey Harish (EVANGILIST) AND Trainer Himmat Singh and

App.A.Sandesh (SIZZLING LOVE), it was found that both the Jockeys had ridden as per their instructions. Having viewed the video recording of the race and having scrutinized the betting sheets, the Stipendiary Stewards took no exception to the running and riding of any horse in the above race. RE : ENQUIRY INTO THE RUNNING OF RACE NO.317 – THE K.J.K.IRANI PLATE RUN ON 4TH APRIL, 2011 : The Stipendiary Stewards reported that they had enquired into the running of the above race. Having viewed the video recording of the race and having scrutinized the betting sheets, the Stipendiary Stewards took no exception to the running and riding of any horse in the above race. RE : JOCKEY D.S.RATHORE REPORTED TO THE STEWARDS FOR INDISCIPLINE, IN THAT HE WAS IN BREACH OF THE APPRENTICE JOCKEYS CONTRACT WITH THE CLUB : The Stewards of the Club at their meeting held on Sunday, 24th April, 2011 interviewed Jockey D.S.Rathore and Trainer Dallas Todywalla, in the above connection. Having heard the submissions made by Jockey D.S.Rathore as also by Trainer Dallas Todywalla and having deliberated the matter, the Stewards were not satisfied with the explanation tendered by Jockey D.S.Rathore in the subject case and held him guilty of indiscipline i.e. for breach of Apprentice Jockeys contract with the Club wherein it is mandatory to seek prior permission from the Stewards in case he wished to ride at any other centre which he failed to do and rode in races at D.R.C. without permission. However, keeping in mind that Jockey D.S.Rathore admitted his guilt and apologized for the same, the Stewards took a lenient view in the matter and decided that should he apply for a Jockey’s license for the Season 2011/12, the same will be granted to him, however, his Jockey’s license shall stand suspended w.e.f. 21st July, 2011 to 20th August, 2011 (both days inclusive) (permitted to ride work/mock race) for indiscipline. RE : MERCY PETITION FROM MR.MOHAMMED SALIM NAIK IN RESPECT OF EXCLUSION IMPOSED ON HIM FROM 6TH MARCH, 2003 TO 5TH MARCH, 2013 FOR ACCEPTANCE OF ILLEGAL RACE BETS AT THE MUMBAI RACE COURSE ON 13TH OCTOBER, 2002 DURING PUNE OFF-COURSE RACES : The Stewards of the Club at their meeting held on Saturday, 23rd April, 2011 considered Mercy Petition from Mr.Mohammed Salim Naik in the above connection and having deliberated on the matter, decided reject the same. SUBJECT : CONFIRMATORY REPORT IN RESPECT OF b f “HAUNTING FANTASY” (WINNER) IN RACE NO.280 – THE FORBES BREEDERS’ JUVENILE FILLIES CHAMPIONSHIP (GRADE 3) RUN ON SUNDAY, 20TH MARCH, 2011 : The Stewards of the Club at their meeting held on Sunday, 1st May, 2011 interviewed Trainer Karthik G. regarding the Confirmatory Analysis Report dated 28th April, 2011 from Equine Forensic Unit, C.V.R.L. Dubai, in respect of the sample of urine taken from HAUNTING FANTASY (Winner) in Race No.280 – The Forbes Breeders’ Juvenile Fillies Championship (Grade 3) run on Sunday, 20th March, 2011, which read as under :-

“The analysis has confirmed the presence of FORMESTANE in this sample.” A copy of the above report was handed over to Tr.Karthik G. and he was asked to continue his own enquiries and to lead evidence, if any, to prove mitigating circumstances, within 15 days and to also attend the enquiry to be held by the Stipendiary Stewards and the Sr.Veterinary Officer of the Club, as and when he would be required to.

Further, as per the Medication Rules, the Stewards of the Club decided to disqualify HAUNTING FANTASY (Winner) in Race No.280 – The Forbes Breeders’ Juvenile Fillies Championship (Grade 3) run on Sunday, 20th March, 2011 and to revise the order of placing of the above race as under :-

SUBJECT : POSITIVE REPORT IN RESPECT OF ch g “WESTERN CHALLENGE” (UNPLACED) IN RACE NO.333 – THE AHU PLATE RUN ON SATURDAY, 16TH APRIL, 2011 : The Stewards of the Club at their meeting held on Sunday, 1st May, 2011 interviewed Trainer Robert D,Mellow regarding the positive report dated 27th April, 2011 from the Equine Forensic Unit, C.V.R.L.,Dubai, in respect of the sample of urine taken from WESTERN CHALLENGE (Unplaced) in Race No.333 – The Ahu Plate run on Saturday, 16th April, 2011 which read as under :-

“THE ANALYSIS HAS CONFIRMED THE PRESENCE OF INDOMETHACIN IN THIS SAMPLE” At this meeting, Tr.Robert D’Mellow. was handed over a copy of the above report. He was requested to inform to the Sr.Veterinary Officer of the Club, in writing, within five days of opening the envelope that identifies the sample i.e. latest by 6th May, 2011, whether he wished the split sample of his charge WESTERN CHALLENGE to be sent to The HFL Sports Science, England, The Hong Kong Jockey Club Lab, or L.C.H., France,, for Confirmatory Analysis and also the name of the Witnessing Analyst, if any, failing which the Stewards shall treat the report of the Primary Laboratory as conclusive. Further, he was required to arrange the presence of the Witnessing Analyst at the Lab conducting the Confirmatory Analysis within 30 days of him nominating the name. In case he was unable to arrange within this period the Witnessing Analyst after having nominated the name, the Confirmatory Analysis will proceed without the Witnessing Analyst. Tr.Robert D’Mellow was also asked to conduct his own enquiries and to lead evidence, if any, to prove mitigating circumstances, within 15 days and to also attend the enquiry to be held by the Stipendiary Stewards and the Sr.Veterinary Officer of the Club, as and when he would be required to. RE :RACE NO.349 THE GOLD DUST PLATE (DIV.II) RUN ON 23RD APRIL, 2011 The Stipendiary Stewards had questioned Trainer Mansoor Shah after the race with regard to the poor performance of his charge INSITE SOUL. The Trainer stated that the horse should have not run such a poor race and the reason that he could think of was that the horse may have bled internally and he had requested for the horse to be scoped. On a report from the Sr. VO that on scoping, the horse was found to have suffered EIPH of Grade 3 and which may have had a bearing on the performance of the horse, the enquiry was closed. Being a second time bleeder, INSITE SOUL has been stopped from racing for the stipulated period of eight weeks and until passed fit by the Club’s V.O. ENQUIRY INTO THE COMPLAINT LODGED BY MR.KHUSHRO K.JALNAWALA AGAINST MR.NIRAD KARANJAWALA/TRAINER JAYANTILAL K.GOR : The Stewards of the Club at their meeting held on Saturday, 23rd April, 2011 considered the evidence obtained by the Stipendiary Stewards in the above enquiry. The Stewards heard the submissions made by Mr.Nirad Karanjawala and his Spokesman Mr.Dallas Todywalla as also by Mr.Khushro K.Jalnawala and his Spokesman Mr.Narendra Lagad, Trainer Jayantilal K.Gor and his Clerk Mr.Sainath. At this meeting, Mr.Nirad Karanjawala admitted his guilt and apologized for the same. The Stewards having considered all the papers and proceedings before them and having heard all persons concerned, a) Held Mr. Nirad Karanjawala guilty of an extremely serious breach of the Rules of Racing in that a disqualified person interfered in the training of race horses and as a consequence was guilty of Gross Misconduct.
