LAND - a)TheRailwaylandrequiredforlayingthesidingwill belicensedtotheApplicant.ThelandoutsidetheRailwayboundaryshallbeacquiredbythe Applicant.The Railway Administration,however,may assisttheApplicantforacquisitionof land. All expensestowardsacquisitionof suchland,includingSupervisioncharges,shallbebornebytheApplicant.

b) TheRailwaylandrequiredfor thesidingwill be licensedto theApplicant.TheApplicantwill haveto payfor landlicensefeeattherateof 6% perannumofthemarketvalueofthelandoratsuchrateasmayberevisedfromtimetotime. Thislicensefeewill berevisedeveryyearwitha notionalincreasein landvalueof 7%P.a.oratsuchrateasmayberevisedfromtimeto timeoverthepreviousyear'smarketvalue.of landto arriveatthelandvalueof currentyear. The land outsidetheRailwayBoundariesshallbeacquiredbytheApplicantathiscostbypurchaseorotherwise.

c) Licensefeeof land: TheApplicantshallpaytotheRailwayAdministrationinadvanceonthefirstdayof AprileveryyearsuchsumofmoneyasmaybefixedbytheRailwayAdministrationfromtimeto timeasyearlylicensefeefortheuseandoccupationof landbelongingto theRailwayAdministrationuponwhichtheportionof thesaidsidingandworkscoloredredonthesaidplanshallbesit~ted,thefirstpaymentthereofto bemadeon the1st day

TheApplicantwill payin advanceto theRailwayAdmiriistrationthetotalestimatedcost of the work to be doneby the RailwayAdministrationincludingalloverheadchargesasperthe,extantrules.Aftercompletionoftheworkandcertificatiob.in writingby theRailwayEngineer,thecompletioncostof theworkwill bearrivedatwiththecostofmaterialsandlabourbasedonactualandoverheadchargesasperrates,fixedfromtimetotimeaddedtoit.In casethe completioncost is lowerthan'theamountdeposited,thedifferencewill"bepaidbackto theApplicantandvice versa.No interesthowever,shallbepayablebytheRailwayAdministrationonanysuchamountrefundableto theApplicant.If theamountactuallyexpendedbytheRailwayAdministrationfbrtheconstructionof thesidingexceedstheamountpaidinadvancebythepartytheApplicantshallpayto theRailwayAdministrationondemandtheexcessamountforthwithin casetheexcessamountis upto25%abovetheestimatedcost.If theexcessamountis morethan25%of theestimatedcost, a revisedestimatewill be suppliedby the 'RailwayAdministrationasandwhensuchexcessamountis knownandtheApplicantwill forthwithdeposittheexcessamount.soinvolved.
