EMPANELMENT OF DOMESTIC SHIP BROKERS /LINERS/ FREIGHT FORWARDERS/ NON-VESSEL OPERATING COMMON CARRIERS (NVOCC) FOR MAKING SHIPPING ARRANGEMENTS FOR SEA CONSIGNMENTS (FCL & LCL)/BREAK BULK/OVER DIMENSIONAL CARGO (ODC)/DANGEROUS OR HAZARDOUS CARGO ETC. FROM VARIOUS COUNTRIES IN RESPECT OF IMPORT REQUIREMENTS OF THE COMPANY RINL/VSP.

1.0 INTRODUCTION : 1.1 Rashtriya Ispat Nigam Limited (RINL), Visakhapatnam Steel Plant (VSP) is the first

shore based Integrated Steel Plant in India and is amongst the leading Steel Producers of the World. RINL / VSP achieved a turnover of approx. Rs. 10,400 Crores during the Financial Year 2014-15 and is in the process of gradually increasing its Liquid Steel capacity to 16.0 Million Tonnes by the Year’ 2025 from the existing capacity of 6.3 Million Tonnes per Annum.

1.2 RINL/ VSP, is sourcing various items of Refractories, Consumables, Spares, Bearings, Sea Water Magnesite, Gunning Mass etc. from overseas from time to time. Most of the imports are affected against the delivery terms FOB.

2.0 Objective:

2.1 The objective of this empanelment process is to create a panel of domestic /

International Ship Brokers /Liners/NVOCC/ Freight Forwarders who will be

approached for providing containers for import of overseas sourcing of various

items for a period of three years.

3.0 Others:

3.1 Sealed applications are invited from the experienced, reputed, resourceful and bonafide Sole Proprietors / Partnership firms / Companies capable of undertaking the work as defined at para 13 below.

3.2 The Applications against this Empanelment Notification along with all enclosures and supportive documents shall be submitted in a sealed cover on or before 31st May 2016 at 10.30 hrs duly super scribing `Applications for Empanelment’ and Empanelment Notice No. & date shall be addressed to :

Dy. General Manager (MM) – T&S, Block – A, 3rd Floor, Materials Management Department, Main Administration Building, Visakhapatnam Steel Plant, Visakhapatnam – 530 031.

The Applications received on or before 31st May 2016 at 10.30 hrs shall be considered for the First Empanelment which is expected to be finalized within one or two months’ time.

3.3 The notice / documents for empanelment shall be available round the year at RINL/VSP’s website www.vizagsteel.com. After finalization of the First empanelment, the process of subsequent empanelment shall be taken up by RINL / VSP twice in a year w.e.f July and January. Applications received upto 31st May and upto 30th Nov shall be considered for the empanelment during the respective period.

3.4 Separate empanelment (Break Bulk / FCL / LCL / ODC) shall be made for each category based on the eligibility of the applicants.

EMPANELMENT DOCUMENT

1.0 Applications are invited from experienced, reputed, resourceful and bonafied

Proprietor/ Firms / companies capable for making shipping arrangements for sea

consignments (FCL & LCL)/Break bulk/Over dimensional Cargo (ODC)/Dangerous or

Hazardous Cargo etc. from various countries in respect of import of various items of

Refractories, Consumables, Spares, Bearings, Sea Water Magnesite, Gunning Mass

etc against the import requirements of RINL/ VSP from overseas suppliers from

time to time from any sea port(s) abroad in the world to Chennai/Visakhapatnam

sea Port(s) in India.

2.0 ELIGIBILITY :

2.1 The applicant for empanelment shall be Domestic Proprietor/ Firms /

companies having office anywhere in India equipped with modern telecommunication facilities, infrastructure and qualified supporting staff having minimum one person with Graduation and minimum two years’ experience as a regular employee in a Shipping / Ship Broking/liner/NVOCC/Freight forwarder Company. (A Self attested letter with above certification/documents should be submitted)

2.2 The foreign Ship Brokers/Liners/NVOCC / freight forwarder willing to be

empanelled shall be in business of transportation of containers in India directly or through any Indian Associate. If the Ship Brokers/Liners/NVOCC / freight forwarder are operating directly in India, they must have a permanent office anywhere in India. (A Self attested letter with above certification/documents should be submitted)

2.3 The applicant must have experience in break bulk and / or container shipment

fixation as a domestic Ship Brokers/Liners/NVOCC / freight forwarder or appointed directly by Ship owner undertaking vessel agency work for containers during the Financial Years 2014-15, and 2015-16 (up to December 2015) of the current financial year and willing to offer containers on behalf of their owners. Necessary documentary evidence in support of experience shall be submitted in respect of break bulk/ODC and/ or minimum 50 (fifty) containers (LCL/FCL) in respect of containerized cargo import to Indian ports during the Financial Years 2014-15, and 2015-16 ( up to December 2015) of the current financial year.

3.0 MODE OF COLLECTION OF APPLICATION DOCUMENT :

Application Documents (ANNEXURE – I & II ) can be downloaded free of cost from RINL / VSP’s official website www.vizagsteel.com. No modification / alteration to the application document is allowed. In case any modification / alteration is noticed in the submitted application documents, the said application shall be summarily rejected and RINL/VSP shall have no liability, whatsoever, in this matter. In case, any difficulty in downloading the application document, the same can be obtained from the office of DGM(MM) –T&S, at the address mentioned above on the request by an application on the applicant’s letter head.

4.0 MODE OF SUBMISSION OF APPLICATION :

4.1 The application shall be submitted in a sealed envelope containing the following

i) Terms and conditions of empanelment duly signed by authorized signatory

as a token of acceptance. (ANNEXURE – I).

ii) Invitation to tender duly signed by authorized Signatory as a token of acceptance (ANNEXURE - II).

iii) Proper authority in favor of the authorized signatory (on the Company’s letterhead)

iv) Filled in Application Form signed by authorized signatory on each page with all supporting documents and information super scribing the applicant’s name, company’s name, Tender No i.e RINL/T&S/SEA/EMPANELMENT/16-19/001 DATE: 02.05.2016 & Name of the Tender i.e., “EMPANELMENT OF DOMESTIC SHIP BROKERS /LINERS/ FREIGHT FORWARDERS/ NON-VESSEL OPERATING COMMON CARRIERS (NVOCC) FOR MAKING SHIPPING ARRANGEMENTS FOR SEA CONSIGNMENTS (FCL & LCL)/BREAK BULK/OVER DIMENSIONAL CARGO (ODC)/DANGEROUS OR HAZARDOUS CARGO ETC. FROM VARIOUS COUNTRIES IN RESPECT OF IMPORT REQUIREMENTS OF THE COMPANY RINL/VSP”.

4.2 The application shall be addressed to Dy. General Manager (MM – T&S) ,

RINL VSP and dropped in the box situated at the office in Room No.423 Administrative Building, 3rd Floor, A-Block, Transport & Shipping Section, Visakhapatnam Steel Plant, Visakhapatnam-530031, AP, India. If the applicant has not submitted the Application Form as prescribed above, the same shall be liable for rejection.

4.3 Application can also be sent through post / courier service in the above

mentioned address. However, Rashtriya Ispat Nigam Limited, is not liable under any circumstances for non / delayed receipt of applications sent by post or otherwise and application received after the closing date and time will not

be considered.

4.4 Last date and time of submission of application is 10.30 hrs 31.05.2016. The applications will be opened immediately thereafter in the presence of authorized representatives of the applicants, who intend to attend the same. The application shall remain valid for acceptance up to 90 days from the date of opening of tender. No extension of time shall be allowed for submission of application under any circumstances. Applicant(s) withdrawing his / their offer within 90 days shall not be eligible for participating in the next tender for empanelment.

5.0 GENERAL :

5.1 By submitting an application, the Applicant shall deem to have understood

the requirement of the job and shall deem to have satisfied themselves of their capacities to undertake and perform the job to the satisfaction of RINL / VSP.

5.2 RINL / VSP reserves the right to accept or reject any or all the applications or

cancel the empanelment process at its sole discretion without assigning any reason whatsoever.

5.3 All the data / information furnished by the Applicant shall be treated in strict

confidence and shall be used only for the purpose of registration on RINL / VSP’s panel of Ship Brokers / Liners/NVOCC/Freight forwarders.

5.4 Copies of PAN card and Service tax registration certificate should be

submitted. 5.5 Copies of certificates if any having registered with any federations like

International Federation of Freight Forwarders Associations (FIATA), Multimodal Transport Operator (MTO), etc and also any accreditations like ISO 9001 Certification etc. are to be submitted along with the empanelment document.

ANNEXURE - I TERMS AND CONDITIONS OF EMPANELMENT

(1) All terms thereof entered into between the Company and the empanelled parties

shall be governed and regulated by the relevant laws / Govt. guidelines for the time being in force in India.

(2) No guarantee is given as to any definite volume of work which will be entrusted to the empanelled parties at any time or throughout the period of the empanelment.

(3) The representative of the empanelled party shall, if asked for, obtain and

communicate such information as may be relevant for chartering/obtaining containers and also ensure that no misrepresentation is made and shall be guided by the principles of honesty and fair dealing.

(4) The representative of the empanelled parties shall give information relating to

estimated ocean freight for containers/break bulk/ODC/Hazardous Cargo as and

when required for certain specific loading port(s) abroad to Chennai /

Visakhapatnam port(s).

(5) The empanelled party shall offer a containers space in a vessel, if they are duly authorized by the Owners and they shall not give any counter offer to Ship Owners unless authorized by RINL / VSP.

(6) The empanelled party shall be conversant with general shipping practices, customs

procedures, documentation and the general market conditions, have a general idea of the law of contracts and its implications with regard to International Maritime Transport, be familiar with general Charter Party provisions and Bills of lading for various types of seaborne trade and generally keep abreast of developments in shipping and chartering.

(7) The empanelled party shall correspond directly with their foreign associate in all

matters relating to Quantity i.e tonnage/TEU (Twenty-foot equivalent unit) offers. They shall render necessary post fixture services in an efficient and diligent manner to ensure smooth performance of the contract, always creating an environment of mutual cordiality between Owners and Charterers.

(8) The empanelled party shall conclude and execute LOA/Agreement with RINL / VSP

to the entire satisfaction of RINL / VSP. In case the empanelled party is unable to execute the work in a satisfactory manner or in accordance with the terms of the empanelment, RINL / VSP shall have the right to stop the work and de-empanel the party as per conditions enumerated at Clause (10) below. The decision of RINL / VSP in this regard shall be final.

(9) PAYMENT TERMS : Payment shall be governed in line with the concluded LOA/Agreements with the empanelled parties.

(10) TAXES AND DUTIES: The Statutory Taxes and duties prevailing during the empanelment period shall be applicable. Any variations in the statutory taxes and duties during the tenure of the empanelment shall be to the account of RINL/VSP.

(11) For the purpose of container requirement for import of consignments, RINL shall float

enquiry with shipping terms among the empanelled parties at the discretion of RINL /VSP.

(12) PERIOD OF EMPANELMENT:

Empanelment shall remain valid for a period of 3 (three) years from the Date of registration with RINL / VSP. The empanelled Ship Brokers / Liners/NVOCC/Freight forwarders may be de-empanelled for the following reasons: Quoting without Authorization Any willful misrepresentation of facts RINL / VSP may cancel the empanelment at its sole discretion without assigning

any reason whatsoever. Non-performance or unsatisfactory performance of the concluded

LOA/Agreements

The period of de-empanelment shall be for a maximum of 6 (six) months. Once de-empanelled, the party shall have to apply afresh for empanelment. Such re-empanelment will be considered as new empanelment and all rules and conditions applicable will be as in respect of new applicant.

( 13) SCOPE OF WORK :

13.1 The empanelled Ship Brokers /Liners/NVOCC/ Freight Forwarders are to make

shipping arrangements for sea consignments i.e., (FCL&LCL)/Break bulk/Over dimensional Cargo(ODC)/Dangerous or Hazardous Cargo as per the requirement of RINL VSP as and when enquiries are floated, within the framework of policy of the Govt. Of India.

13.2 The empanelled Ship Brokers /Liners/NVOCC/ Freight Forwarders may also be

required to furnish estimate of ocean freight for carriage between any port(s) in the world and Chennai / Visakhapatnam as and when asked for by RINL VSP.

13.3 The empanelled Ship Brokers /Liners/NVOCC/ Freight Forwarders shall

actively coordinate with charterers and liners for settlement of demurrage /

storage charges that might arise after execution of shipment within the time periods stipulated in the charter party.

13.4 The empanelled party shall regularly update the position of the vessel carrying

the sea consignments relating to RINL / VSP and other details as required by RINL / VSP.

13.5 The LOA (Letter of Acceptance) / agreement will be entered for all bookings

made. The party shall arrange to provide the signed copy of agreement as per the prescribed RINL format at the time of finalization of shipping arrangement.

(14) OTHERS TERMS AND CONDITIONS:

14.1 Empanelment of a Ship Broker / Freight Forwarder shall be cancelled in the event of

his quoting without authority accorded by the principals, Letter of authority of the

principals is to be submitted with every bid submitted by the party.

14.2 There is no guarantee of quantum of work during the tenure of empanelment.

14.3 Enquiry will be sent to the empanelment parties at the discretion of RINL /VSP.

14.4 Enquiry may be referred to TRANSCHART empanelled brokers and INSA (Indian

National Ship owners’ Association) members also.

14.5 RINL VSP may conduct credibility survey wherever felt necessary.
