INSTRUCTIONS TO TENDERER

1.01 Sealed and super scribed items rate tenders are invited from reputed experienced licensed Electrical

Contractors having experience in M. S. E. D. C. Ltd., State Electricity Board/Company, P.W.D., etc

1.02 The scope of work covered under the tender shall comprise of PROVIDING & FIXING OF CABLE

JOINTING KITS SUITABLE FOR 11 KV & 22 K.V. X.L.P.E./PILC CABLE at Rasta Peth Division as

per the instructions of concerned Executive Engineer / S.D.O.’s after receipt of order from the Office

and completing of all formalities.

1.03 The earnest money to be deposited with tender. Tenders submitted without earnest money shall be

summarily rejected.

1.04 Payment of earnest money as indicated in clause 1.03 shall be accepted in the form of cash / demand

draft in favour of Executive Engineer, Rasta Peth Division, Pune payable at any Scheduled Bank,

Pune. The Earnest Money Deposit will be forfeited in case successful tenderer fails to pay security

deposit and execute the contract agreement within the prescribed period. Payment of Earnest Money

by “Cheque” shall be not been accepted.

1.05 The tenders must be filled in prescribed forms only for one manufacturer. Separate tenders should be

filled for separate manufactures. The blank tender form will be available at the cost of

Rs. 250/- + VAT in cash at RRaassttaa PPeetthh DDiivviissiioonn,, Block No: 103, Rasta Peth Administrative Building

1.06 Tenderer must return the tender form together with the specifications and the rates with NAME OF THE

MANUFACTURER duly filled in Schedule - “A”, “B” and “C” duly signed. Any tender not bearing the signature of

tenderer on all the documents accompanying the tender is liable to be rejected.

1.07 The Offer is to be submitted in two envelopes super scribed as 'Envelope I' and 'Envelope II ' in

Tender Box in due time.

1992 amended from time to time from manufacturer for cable jointing kits suitable for 11 KV & 22 KV

XLPE / PILCA cable, and LT jointing kits offered and deviation from the prescribed specification.

Test reports, literate, drawings etc. also be submitted.

4. Experience certificate regarding satisfactory completion of work for providing & fixing of cable

jointing kits suitable for 11 KV & 22 KV XLPE / PILCA cable, and LT jointing kits cable in at least one

Indian Electricity Distribution Companies/SEB’s in any one year.

5. Details of Sample Kits Submitted. [If applicable]

6. Also submit the attested documents as detailed below.

a) Valid Electrical contractor licenses.

b) Valid Income Tax Clearance Certificate/ PAN No/Last 3 years Income Tax paid Certificate.

c) Solvency certificate of 50% of value of tender issued by National Bank valid for the current

year 2008-09.

b) Envelope II:

The envelope II should contain the tender document with price (rate) offered in Schedule -”A”, “B”

and “C” duly signed with seal.

1.08 The tenderer will have to submit SOLVENCY CERTIFICATE from any Nationalized Bank to the

extent of 50% of value of the tender.

1.09 The tenderer shall be deemed to have studied the specifications and drawings and all other documents

attached to the tender papers, on his having filled in tender.

1.10 The tender duly completed sealed and super scribed with the subject of tender and due date of opening

on the face of cover will be received up to 14.00 Hrs. on the due date and opened on the same day, if

possible in the said Office in the presence of tenderer or the representatives who may choose to remain

present.

1.11 It shall be definitely understood that the MSEDCL does not accept any responsibility for the correctness

or completeness of the Schedule “A”, “B” and “C” for given part and this schedule is liable to

alterations by commissions, deductions or addition in the item or quantities at the discretion of the

Executive Engineer or his authorized representative and contractor would be bound to execute all the

quantities actually ordered / encountered during execution at the corresponding tender prices.

1.12 The rates in the Schedule -”A”, “B” and “C” shall be quoted in figures. All the entries by the tenderer

should be in ink. Erasing and over writings are not permissible. The tenderer should initiate all

corrections and insertions.

1.13 The contractor on award of the contract will have to pay a SECURITY DEPOSIT for work contract at

the rate of 5% of the value of contract by cash or Bank Guarantee for the same value in the prescribed

MSEDCL’s format.

1.14 The undersigned reserves the right to accept or reject any part or all tenders without assigning any

reasons. Further the undersigned reserve the right to bifurcate the tender order and work to more than

one contractor

1.15 The Sale Tax VAT on material or on transfer of property in goods involved in the execution of work

contract or any other tax on raw material or on furnished any fabricated material of works shall not be

separately paid. The rates for the several items of work indicated in attached schedule are deemed to

include all local and general taxes excise duty etc. royalties and any other incidental charges payable by

the contractors at any instant of works. Tenderer should attach a certified photocopy of sales tax

registration under works contract. The work contract tax as specified by the Government will be

deducted directly from contractor’s bills at appropriate rates

1.16 The rates quoted shall remain open/valid for 12 months.

1.17 Tenders which do not fulfill any or all the conditions or are found incomplete in any respect are liable

for rejection.

1.18 All taxes and dues (present or future) payable to government and or local authorities in respect of these

works shall be the responsibility of Agency except road reinstatement charges and the Agency will

have to indemnify MSEDCL against liabilities on account of such levies or taxes Income tax, Works

Contract Tax / Service Tax at appropriate rate will be deducted from the contractors bill at the

prevailing rates and applicable surcharges thereon of the gross value of the bill as per instructions laid

down in Government of India Notification unless the necessary exemption certificate from the income

tax department authorized for the purpose in produced will in time.

1.19 The tenderer on placement of the work order enumerating the contract conditions shall within the

prescribed period have to execute a written agreement on the prescribe standard form as per

MSEDCL’s Rules. The regular stamp fees etc. necessary for completing the agreement shall have to be

borne by the Tenderer.

1.20 This instruction to tenders shall also form part of the contract.

IMPORTANT

1. Initially while opening the tenders, the envelope No. 1 i.e. Qualifying Bid will be opened first. The price

bids of only those bidders who are qualified in the Qualifying Bid will be opened later. For qualification,

all the documents duly attested as mentioned in Clause 1.07 above are required. The price bids of bidders

who have submitted all the valid documents as per clause 1.07 above shall only be qualified for opening of

price bids.

2. In envelope No. 2 i.e. Price Bid tender document with price offered in Schedule - “A”, “B” and “C” duly

signed with seal.

GENERAL TECHNICAL REQUIREMENT:

1.1 As cable termination kit shall be suitable for termination of the cable on indoor switchgear or outdoor

installation as per requirement. The type of cable will be XLPE insulated. The cable termination jointing kits

shall be as per defined in I.S.I.-13573.

1.2 Proper stress control, stress grading and non-tracking arrangement in the termination and joint shall be

offered by means of proven methods, details of which shall be elaborated in the offer. Detailed sectional

views of the assemblies shall be submitted along with the offer. In case of heat shrinkable cable accessories,

stress control tubing, shall have volume resistively of minimum 1,00,00,000 Ohms- meter for both termination

and straight through joints. Also relative permittivity shall be minimum 15. Tenderer shall furnish

documentary evidence conforming adherence to these along with the offer. Further, impedance of stress

control tubing shall not change over a range of temperature from O degree C to 125 Degree C. The impedance

also remains constant in spite of the difference in stress, which will exist within the sleeve due to hearting

effect within the conductors and the temperature of the environment. Tenderer must submit graph-showing

effect on the impedance value of stress control humbling due to temperature variations and thermal ageing,

with his offer. In case of tapex cast resin type straight through joints, encapsulation of joints is done by

specially developed resin system, which is compatible with the material used for bonding. The jointing kit

shall be with aluminum crimping type ferrules, semi-conductor self bonding tape, the self amalgamating tape

[or EPR or equivalent] stress grading pad etc. The straight through joints should be absolutely impervious to

the entry or water. The manufacturer shall use the proven technologies and design to ensure a construction,

which will prevent entry of water or any other liquid inside the straight through joint and cable. Proven

technologies such as resin injection, hydrophobic sealants etc. shall be deployed in the critical areas. In all

type of kits offered, the external leakage insulation between high voltage conductor and ground as specified

in I.E.E.E. –48 / 1975 amended up to time to time shall be of non-tracking erosion resistant and weather

resistant flexible sleeve.

1.3 For 3-core cable, the gripping tubing [termination boot] for the cable where the trifurcation takes place shall

be considered as a part of the kit.

1.4 The kit offered shall provide for total environmental sealing of the cable crutch and at the lug end.

1.5 Termination and jointing system shall be suitable for use with standard aluminum conductor fittings [cable

lugs and ferrules] of compressed crimping type.

1.6 The termination of straight through jointing kit of heat shrinkable type kit, the joint shall include heat

shrinkable duel wall tubing, which shall be insulating from inside and semi conductor from outside.

Tenderer shall specifically give compliance to this along with the offer.

1.7 For straight through joint the kit shall also include tubular Sleeve in line connectors for solder less crimping of

cable connector. The connector shall be of aluminum alloy A 6 drop forged type or other equivalent or better

material.

1.8 Material used for construction of a joint/termination shall perfectly match with the dielectric, chemical and

physical characteristics of the associated cable. The material and design concepts shall incorporate a high

degree of operating compatibility between the cable and the joints.

1.9 The kit offered shall be suitable for the following sizes of cables.

1.11 The tenderer shall quote unit rates for insulating tape, lugs, nuts and bolts of various sizes and special tools

required for erection and commissioning, if any, in the offer. These prices shall be kept valid for at least of

one year after placement of order/s. These rates shall not be considered for evaluation of the offer.

1.12 The tenderer shall indicate the required net dimensions of the indoor cable, joints for various cable sizes, in

the form of Length X Breadth X Depth in m.m.

1.13 The tenderer shall specifically bring out the precautions to be observed in execution of the jointing /

termination work to avoid any loss or damage to the cable, the kit, the personnel or the installation. An

instruction booklet shall be supplied with each kit. Detailed instructions with suitable illustrative drawings

shall be included in the instruction booklet to enable proper jointing work.

1.14 The kit which requires lesser skill for the cable jointing which can be done in shorter time and guarantee a

reliable and long operating life and reduced or no waiting time for erection shall be given preference.

1.15 Type Test:

1.16 The jointing kits offered, shall be fully type tested at CPRI as per the relevant standards. The tenderer shall

furnish four sets of the type test reports along with the offer. Offers without type test reports will not be

considered. For any change in the Design/type already type tested and the design/type offered against this

specification, the purchaser reserve the right to demand repetition of type tests without any extra cost in

presence of purchaser’s representative.

1.17 Type tests shall be carried out as per the test sequence given in I.S.: 13573 or VDE-0278 at C.P.R.I. Laboratory

as amended from time to time. The test report will have to be submitted for the test carried out.

2 ACCEPTANCE & ROUTING TESTS:

2.1 The supplier shall carry out all acceptance and routing tests as stipulated in the relevant standards in

presence of purchaser’s representative.

2.2 The purchaser reserves the right to insist for witnessing the acceptance/routing testing of the brought out

items.

GENERAL CONDITIONS OF CONTRACT

1.01 The original tender Booklet purchased from the office of the Executive Engineer, Rasta Peth Division, Pune as

notified for any particular work shall alone be accepted as a valid tender on submission tenderer.

1.02 All works shall be measured not by standard measurements and according to the rules and customs and

usual method used in MSEDC and more particularly as mentioned in the item wise detailed technical

specifications contained in these documents.

1.03 All tenders except and unless exempted in writing by Executive Engineer, Rasta Peth Division, shall

accompany as solvency certificate from the revenue department concerned within whose jurisdiction the

tenderer resides or bankers certificates (Nationalized) of his financial stability for 50% of value of tender.

1.04 The work should be carried out within stipulated period given by concern Engineer-in-charge from the date

of handing over of site and material.

1.05 If it is found quality of work as well as performance is found unsatisfactory the contract is liable for

termination without giving any notice and at the entire risk of contractor. The security deposit paid in such

cases shall be forfeited.

1.06 The contractor shall not entrust the work on sub contract, transfer or assign the contract or any part thereof to

any other party. In case if it is not followed it will be treated as breach of contract and will be terminated at

contractors risk and cost.

1.07 The contractor should have his own experienced workmen, tools and tackles required to carry out the job.

The workers employed for the job should be well conversant with the work. In case of any accident to the

workers or outsiders the total responsibility lives with the contractors.

1.08 In case of any damage or loss to the MSEDCL’s materials, receipts and appropriate cost of the same will be

recovered from the contractor bill or security deposit.

1.09 Bill for the purpose of accepting bills the work carried out during the last month will be considered. The bill

should be submitted in triplicate to the concerned Engineer –in-charge for recording the measurement and for

onward transmission to Executive Engineer. The part payment will be made by this Office within stipulated

period subject to availability of funds from the receipt of measurements recorded bill from the concerned

Sub/Dn.`s Dy. Executive Engineer duly accepted by the contractor.

1.10 In case the contractor fail to carry out work in stipulated time penalty at the rate of ½% per delayed week or

part thereof subject to maximum 10% of the contract value of work done will be recovered from the bill.

1.11 The contract or any part thereof shall not be subject to change without the permission of accepting authority.

1.12 The contractor shall be responsible for and shall pay all the Compensation Act 1923 (hereinafter called the

said Act for injuries caused to the workman).

1.13 The contractor shall comply with all the laws and statutory regulations dealing with employment of labour

such as payment of wages Act 1936, the minimum wages act 1938, The Workmen’s Compensation Act, 1923,

The Industrial Dispute Act, 1947, the Maturity Benefit Act, 1938, The Provident Fund Registration Act etc. in

the employment of his Labour land obtain licenses, wherever required and maintain all the required and

prescribed records in the connection. Besides the above this work contract will be governed by General

Terms and Conditions of M.S.E.D. Co. Ltd. He has to comply all R.T.O., B & C, P.M.C. & P.C.B. & M.E.S.

Rules & especially for road cutting walls.

1.14 In any or type of dispute undersigned decision will be final and binding on you.

1.15 Legal dispute, if any will be under jurisdiction of Pune court of law.

1.16 Bankruptcy: - If the contractor shall become bankrupt or insolvent, or have a receiving order made against

him, or compound with his creditors, or being a company or corporation commence to be would up, not

being a member’s voluntary winding up for the purpose of amalgamation or reconstruction, or carry on is

business under a receiver for the benefit of its creditors or any of them, the employer shall be liberty (a) to

terminate the contract forthwith by notice in writing to the contractor or to the receiver or liquidator or to any

person in whom the contract may become vested or (b) to give such receiver, liquidator or other person the

option of carrying out the contractor subject to his providing a guarantee for the due and faithful

performance of the contract up to amount agreed.

1.17 Termination of contract: - Either party by giving the order party a notice writing 15 days in advance of its

intentions to do so may terminate the agreement but without dishonoring any commitment entered in to

prior to the date of termination notice and no party shall leave its commitment unfinished without

indemnifying the other party of possible damages, the contract shall also stands cancelled for any reason.

Such as legal processes act of state etc. which disable any of the parties hereto from functioning further.

1.18 Details: - Confidential: -The contractor shall treat the contract and everything contained therein as private

and confidential. In particular, the contractor shall not publish any information, drawings or photograph

concerning the works and shall not use the site of the purpose of advertising except with written consent of

CONDITIONS OF THE WORKS

01) The work should be strictly carried out as per the M. S .E. D. C. L.’s method of constructions.

02) Time period: - The work should be completed with in 24 Hrs from work order issued by concerned Dy.

Executive Engineer or his authorized representative.

03) The Executive Engineer concerned/Testing or any other Officer Authorized by Dy. Executive Engineer will

supervise the work.

04) No tools, tackles and plants will be provided by M.S.E.D.C. Ltd.

05) The line shut down for erection of lines / repairs of cable faults will be arranged by our Dy. Executive

Engineer under Rasta Peth Division Pune after written request from the contractor but this will be normally

arranged on Thursday.

06) The problem of labour their lodging, Companying, medical aid payment, accident compensation etc. will be

entirely contractor’s responsibility and Company will not be party to it.

07) Besides all the terms and conditions incorporated in the tender, MSEDCL’s General Terms and Conditions of

the contract shall be applicable to the tenderer.

08) Any dispute between contractor and Engineer-in-charge will be settled by Executive Engineer, Rasta Division

and his decision will be final.

09) Guarantee: - The cable joint shall be guaranteed for a period of 12months from the date of erection.

10) The permission from R.T.O. for the transportation of heavy and lengthy material if required will have to be

arranged by the contractor. The Company will not take any responsibility towards any accident / damage to

the poles or to anyone’s property while transporting the material.

11) The contractor shall not be entitled to any claim for extra executed due to change or alteration unless the same

has been ordered in writing by Executive Engineer Pune and the payment thereof will be decided mutually.

12) In the event of any dispute arising out of the validity of the claim or as to the amount to be paid or allowed in

respect thereof the decision of the undersigned shall be final and binding.

13) Any allied work while fixing the jointing kits on urgent basis if agency is agreed to carry out the work as and

when required by S.D.O.& such work will be carried out in presence of co’s representative. The rates for these

allied work are as per schedule rates of CE, PZ, Pune.

13) MEASUREMENTS AND TERMS OF PAYMENT

13.01. Measurement of work completed shall be taken jointly by the authorized representative of the

company and contractor. Company’s will give intimation week in advance to the contractor for

recording the measurement and if the contractor or his representative fails to join the Co’s

representative, the former will record the measurements and the contractor shall have to accept these

measurements as correct and binding on him.

13.02. On the basis of joint measurements, payment will be made to the contractor by the Executive Engineer,

Rasta Peth Division according to the procedure and as far as possible within 2 months of recording the

measurements subject to availability of funds.

13.03. Payment will be made as per tender rate for all the works done according to the specifications and

measurements.

13.04. All materials and work for which payment is made in part or full shall become the sole property of the

Co. but this provision shall not relieve the contractor of his responsibility for the care and protection of

the materials and works at his own cost or of his liability to make good the damage, if any unless and

until the whole work is deemed to have been completed and handed over to the Co.

13.05. The bill for the work carried out should be submitted to the concerned Dy. Executive Engineer for

onward transmission to the Executive Engineer, Rasta Peth Division duly countersigned and having

check by Dy. Executive Engineer for passing in the following manner :

a. When bill amount reaches Rs. 50,000/-

b. Bill for one month for works carried out 100% payment will be made after receipt of bill duly

recorded .

14. Due to exigency of works if any extra item is used with the permission of Executive Engineer, Rasta Peth

Division the cost of thereof will be decided by Executive Engineer, Rasta Peth Division, Pune.

15. Before commencement of the work, material to be used should be got approved from the Co’s representative

i.e. Dy. Executive Engineer of the concerned Sub - Division.

16. Submission of tender offer by contractor implies that

a. Tenderer has read all the terms and conditions.

b. Tenderer has made himself acquainted / familiar with site conditions, where proposed

work is to be carried out.

c. Tenderer has made himself conversant with technical specification drawings enclosed for

the proposed work to be carried out.

17. Any risk that will be involved due to on registration of yourself, your labours under regulations of the

employment and Welfare Act 1969 lies on your part.

18. All the works under this tender would be subject to M.S. Electricity Dist. Co’s General conditions of contract

for work as stipulated in the Booklet.

19. Special attention is invited to the requirements that corrections / overwriting must be initialed and dated by

the Tenderer and that all pages should bear full signature of the Tenderer at the feet of each page, so also

rates should be quoted in words and figures.

20. Any amount or amounts due on account of damages or compensation for default or breach of contract by the

tenderer in which case instead of deduction of the said amount / amounts shall retained and the Co. shall

have the right or lean on amount / amounts so retained or withheld. Any amount / amounts which become

/ becomes payable by the contract to the Co. under a particular contract may be deducted by the Co. from

any amount due or being due by the Co. the contractor or under the same or any other contract.

21. All tenders / quotations, disputes or differences arising under out of or in connection with the contract, if

concluded shall be subject to the exclusive jurisdiction of Pune Court.

22. Income Tax at the appropriate rate will be deducted from your bill.

23. ½% penalty per delayed week will be levied, but maximum upto 10% of work order value will be levied.

24. Rates will be valid for 12 months.

25. In case of your failure to co-up in execution of any of the work order, the same will be got done through other

agencies even at higher rates and the difference in amount shall be recovered from your bills with MSEDCL’s

offices in Maharashtra or any other means available.

26. The inspection fee for inspection of line will be borne by Company, however contractor has to rectify the

defects pointed out by the Electrical Inspector. No extra payment will be allowed for said work.

27. The requirement of the jointing kits as & when required will be issued by the Dy. Executive Engineer /

Assistant Engineer / authorize representative of the concerned sub - division ... indicating execution period

proportionate to work involved. The execution period will be counted from the date of handing over of site.

28. Rates should be inclusive of all taxes. No separate Work Contract Tax/Service Tax /VAT will be allowed, if

applicable. It should be noted that no consideration will be given by this Office of on account of payment of

Work Contract tax /Service Tax /VAT to Government and it will be entire responsibility of contractor.

29. 10% checks for the kits used / works executed shall be exercised by the division office if necessary.

30. The contractor will have to transport the jointing kits at work site at his own cost. No extra payment will be

made by the MSEDCL to the contractor.

31. In case due to urgency if contractor has to supply any materials, the contractor will require to submit his bills

/ excise gate pass.

1. In this agreement words and expressions shall have the same meanings as are respectively assigned to them in the

2. In consideration of the payments to be made by the Employer to the Contractor as hereinafter mentioned,

the Contractor hereby with the Employer to execute the Contract and to remedy defects therein in conformity

in all respects with the provisions of the Contract.

3. The Employer hereby convenience to pay the Contractor in consideration of the execution of the Contract

and the remedying of defects therein, the Contract Price of such other sum as may become payable under the

provisions of the Contract at the times in the manner prescribed by the Contract IN WINTENN whereof the

parties hereto have caused this Agreement to be executed in accordance with their respective laws the day
