Dear Fellow Conservative,
The American Conservative Union Foundation is proud to present our ratings of the 2018 meeting of the North Carolina General Assembly. Like our Ratings of Congress, which date back 47 years, our state ratings are meant to reflect how elected officials view the role of government in an individual’s life. We begin with our philosophy i.e., conservatism is the political philosophy that sovereignty resides in the person, and then apply our understanding of government (its essential role is to defend Life, Liberty and Property).
Because our ratings are designed to educate the public about how consistently elected officials adhere to conservatism, we carefully examine the entire docket of legislation introduced in each state every year. We select the most meaningful bills and publish the results after the dust has settled. ACUF state ratings—launched in 2011 with ratings for five states—have become a nationally recognized resource for evaluating over 8,000 elected officials comprising each of America’s 99 state legislative chambers.
Each election cycle, citizens choose leaders whose vision for the state most closely matches their own, hoping that candidates’ promises will be kept. ACUF’s ratings measure whether those promises were fulfilled or forsaken. With nearly a decade of data on state legislators’ voting records and average scores for every legislative chamber, citizens in every state can assess how effectively their lawmakers have applied conservative philosophy to the role of government.
We at ACUF believe, as Ronald Reagan once said, that freedom is never more than one generation away from extinction. We hope that by providing this unique tool, these ratings will empower Americans to exercise their right to protect our unique American democracy from tyranny.

SELECTING THE VOTES
ACU researched and selected a range of bills before the North Carolina General Assembly that determine a member’s adherence to conservative principles. We selected bills that focus on Ronald Reagan’s philosophy of the “three-legged stool”: 1) fiscal and economic: taxes, budgets, regulation, spending, healthcare, and property; 2) social and cultural: 2nd amendment, religion, life, welfare, and education; and 3) government integrity: voting, individual liberty, privacy, and transparency. This wide range of issues are designed to give citizens an accurate assessment that conveys which of North Carolina’s elected leaders best defend the principles of a free society: Life, Liberty and Property.

1. SB 470 Preventing Misuse of Asbestos Trust Funds through Tort Reform. This bill is designed to protect the long-term solvency of asbestos trust funds by preventing plaintiffs’ attorneys from abusing the legal system and ensuring those who develop diseases related to asbestos will have access to the funds. Under the bill, plaintiffs’ attorneys must disclose to the court if they are “double-dipping” by filing and winning claims against multiple trust funds and employers. ACU supports protecting asbestos trust funds from abuse (which has depleted some funds to only pennies on the dollar, harming those with legitimate claims) and supported this bill. The Senate passed the bill on May 30, 2018 by a vote of 42-5.
2. HB 514 Permitting Municipalities to Establish Charter Schools. This bill permits four towns in the state to establish their own charter schools, which allows for more school choice. The bill also provides enrollment priority to their own residents, ensuring that their own tax revenues are used appropriately. ACU recognizes that less-advantaged communities need improvements, but to the extent that additional resources are required, costs should be borne by the entire state and not just a handful of communities. ACU supports improving educational outcomes by expanding school choice and supported this bill. The Senate passed the bill on June 4, 2018 by a vote of 27-18.
3. HB 374 Reducing Environmental Regulatory Barriers. This bill implements numerous regulatory reforms and limits certain burdensome regulations of stormwater, wastewater and solid waste. Furthermore, the bill directs the Environmental Management Commission to review local water regulations and report which municipalities go above and beyond the requirements of state law. ACU supports reducing consumer and business costs through regulatory reform and supported this bill. The Senate voted to override the governor’s veto of the bill on June 7, 2018 by a vote of 34-11.
4. HB 86 Reducing Regulatory Barriers on Cryptocurrencies. This bill amends the state’s 2016 Money Transmitter Act to reduce costly regulatory barriers that were indirectly placed on cryptocurrencies, such as Bitcoin. ACU supports the free competition of currencies, opposes the Federal Reserve’s monopoly control over money and supported this bill. The Senate advanced the bill on June 13, 2018 by a vote of 47-0 and later passed it without a recorded vote.
5. HB 933 Forcing Health Benefit Plans to Accept Pre-Existing Conditions. The Robinson (ACUF Lifetime 12%) amendment to a bill permitting nonprofit organizations to offer health benefit plans in the state prevents such plans from denying enrollment, limiting benefits or raising premiums on the basis of a pre-existing condition. While ACU sympathizes with those who have pre-existing conditions, we oppose health care and insurance mandates which drive up the cost of health care for everyone and opposed this amendment. The Senate voted to table (defeat) the amendment on June 13, 2018 by a vote of 32-14. (A “Yes” vote supported the ACU position.)
6. HB 933 Lowering Health Care Costs by Providing an Alternative to Obamacare. This bill is designed to reduce the costs of health care by permitting nonprofit organizations to offer health benefit plans. Under the bill, such plans are not subject to the array of Affordable Care Act regulations that restrict traditional health insurance policies. In addition, the bill provides licensing reciprocity to psychologists licensed in other states. ACU has long opposed Obamacare, which has led to skyrocketing health care costs and resulted in thousands of individuals losing their doctors and insurance, and supported this bill. The Senate passed the bill on June 14, 2018 by a vote of 37-7.
7. HB 1055 Reducing State Costs by Streamlining Teacher Retirement Options. This bill streamlines the cafeteria of retirement plans offered to teachers in order to reduce costs and the complexity of the retirement system. ACU supports reducing taxpayer costs and reforming the state’s pension system in order to gain a sound fiscal footing and supported this bill. The Senate advanced the bill on June 14, 2018 by a vote of 30-14 and later passed it without a recorded vote.
8. SB 677 Protecting the Right to Hunt and Fish. This bill establishes a ballot referendum to enshrine the right to hunt, fish and harvest wildlife in the North Carolina Constitution, declaring the right cannot be infringed upon, subject only to reasonable rules and regulations. ACU supports the right to hunt and fish through traditional methods and supported this bill. The Senate passed the bill on June 25, 2018 by a vote of 41-6.

9. SB 325 Strengthening Ballot Integrity. This bill is designed to reduce voter fraud by reforming early voting and requiring county boards of elections to report their efforts to improve the accuracy of their voter lists, including removing voters who have moved or passed away. ACU supports efforts to strengthen ballot integrity and reduce voter fraud and supported this bill. The Senate voted to override the governor’s veto of the bill on June 26, 2018 by a vote of 34-12.
10. SB 99 Implementing a More Fiscally Sound Budget. This budget bill proposes $600 million less than the governor’s budget, provides corporate and personal income tax cuts in 2019, while still granting pay raises to teachers and law enforcement. Under the bill, the state’s rainy day fund is bolstered and the year-over-year increase in spending is less than the growth of inflation plus population. Additionally, the bill reforms the criminal justice system by allowing offenders age 17 and younger to remain in the juvenile justice system, an issue for which the ACU Foundation Center for Criminal Justice Reform is a leading advocate. ACU supports providing tax relief and reining in spending and supported this bill. The Senate voted to override the governor’s veto of the bill on June 27, 2018 by a vote of 34-13.
11. SB 75 Establishing a Constitutional 7 Percent Income Tax Cap. This bill establishes a ballot referendum to amend the North Carolina Constitution and lower the cap on the state income tax from 10 percent to 7 percent. Reducing tax burdens increases economic growth, which increase family prosperity, as illustrated by the ACU Foundation’s Family Prosperity Index. ACU supports pro-growth tax reductions and supported this bill. The Senate passed the bill on June 28, 2018 by a vote of 34-13.
12. SB 824 Directing the Enactment of the Constitutional Voter ID Requirement. This bill implements the state’s voter ID constitutional amendment, which was approved by voters in the November election, but whose details were left to the legislature. Under the bill, voters must show valid forms of photo identification when casting ballots, including driver’s licenses, college IDs, military IDs, and state or local government employee cards. If registered voters lack valid IDs, the state shall provide voter identification cards, which expire after 10 years. Voters may also cast provisional ballots, which can only be counted once valid forms of identification are provided. ACU supports efforts to strengthen ballot integrity and reduce voter fraud and supported this bill. The Senate voted to override the governor’s veto of the bill on December 18, 2018 by a vote of 33-12.

3. SB 711 Permitting the Consumption of Raw Milk. The Riddell (ACUF Lifetime 93%) amendment to the farm bill permits the dispensing of raw milk for personal use or consumption through “herdshare” agreements (in which consumers purchase shares and receive portions of the herd’s profit). However, the sale of raw milk to consumers remains unlawful in the state. ACU supports the expansion of individual liberties and the right to consume raw milk and supported this amendment as a step in the right direction. The House passed the amendment on June 13, 2018 by a vote of 63-48.

10. HB 374 Reducing Environmental Regulatory Barriers. This bill implements numerous regulatory reforms and limits certain burdensome regulations of stormwater, wastewater and solid waste. Furthermore, the bill directs the Environmental Management Commission to review local water regulations and report which municipalities go above and beyond the requirements of state law. ACU supports reducing consumer and business costs through regulatory reform and supported this bill. The House voted to override the governor’s veto of the bill on June 27, 2018 by a vote of 75-45.
11. SB 75 Establishing a Constitutional 7 Percent Income Tax Cap. This bill establishes a ballot referendum to amend the North Carolina Constitution and lower the cap on the state income tax from 10 percent to 7 percent. Reducing tax burdens increases economic growth, which increase family prosperity, as illustrated by the ACU Foundation’s Family Prosperity Index. ACU supports pro-growth tax reductions and supported this bill. The House passed the bill on June 28, 2018 by a vote of 73-44.
12. SB 824 Directing the Enactment of the Constitutional Voter ID Requirement. This bill implements the state’s voter ID constitutional amendment, which was approved by voters in the November election, but whose details were left to the legislature. Under the bill, voters must show valid forms of photo identification when casting ballots, including driver’s licenses, college IDs, military IDs, and state or local government employee cards. If registered voters lack valid IDs, the state shall provide voter identification cards, which expire after 10 years. Voters may also cast provisional ballots, which can only be counted once valid forms of identification are provided. ACU supports efforts to strengthen ballot integrity and reduce voter fraud and supported this bill. The House voted to override the governor’s veto of the bill on December 19, 2018 by a vote of 72-40.
