The paragraphs 2(iv) (v) (vi) of the circular are detailed below:(iv) A savings as well as current account shouldbe treated as inoperative / dormant if there are notransactions in the account for over a period oftwo years.(v) In case any reply is given by the accountholder giving the reasons for not operating theaccount, banks should continue classifying thesame as an operative account for one more yearwithin which period the account holder may berequested to operate the account. However, incase the account holder still does not operate thesame during the extended period, banks shouldclassify the same as inoperative account after theexpiry of the extended period.(vi) For the purpose of classifying an account as'inoperative' both the type of transactions i.e. debitas well as credit transactions induced at theinstance of customers as well as third partyshould be considered.     RBI/2008-09/138DBOD.No.Leg.BC.34/09.07.005/2008-09 August 22,2008To,AllScheduledCommercialBanks(Excluding RRBs)Dear Sir,Unclaimed Deposits I Inoperative Accounts in BanksPlease refer to our Circular DBOD.No.Com.BC.1 09/C.408/A-77 dated October 1, 1977wherein banks were advised that deposit accounts which have not been operated upon overa period, say two years should be segregated and maintained in separate ledger/s. Further,banks were also advised vide our circular no. DBOD.No.Leg.BC.45/C.466(1V)/89 datedNovember 15, 1989 that they should ensure that their branches follow-up accounts whichremained inoperative for a year or so by sending suitable advices to the customers and if thesaid letters are returned undelivered, they may immediately be put on enquiry to find out thewhereabouts of customers or their legal heirs in case they are deceased.2. In view of the increase in the amount of the unclaimed deposits with banks year afteryear and the inherent risk associated with such deposits, it is felt that banks should play amore pro-active role in finding the whereabouts of the account holders whose accounts haveremained inoperative. Further several complaints have been received in respect ofdifficulties faced by the customers on account of their accounts having been classified asinoperative. Moreover, there is a feeling that banks are undeservedly enjoying the unclaimeddeposits, while paying no interest on it. Keeping these factors in view, we have reviewed theabove instructions issued by us and advise banks to follow the instructions detailed belowwhile dealing with inoperative accounts:

    (i) Banks should make an annual review of accounts in which there are no operations(i.e. no credit or debit other than crediting of periodic interest or debiting of servicecharges) for more than one year. The banks may approach the customers and informthem in writing that there has been no operation in their accounts and ascertain thereasons for the same. In case the non operation in the account is due to shifting of thecustomers from the locality, they may be asked to provide the details of the new bankaccounts to which the balance in the existing account could be transferred.(ii) If the letters are returned undelivered, they may immediately be put on enquiry tofind out the whereabouts of customers or their legal heirs in case they are deceased.(iii) In case the whereabouts of the customers are not traceable, banks shouldconsider contacting the persons who had introduced the account holder. They couldalso consider contacting the employer / or any other person whose details are availablewith them. They could also consider contacting the account holder telephonically incase his telephone number / Cell number has been furnished to the bank. In case ofNon Resident accounts, the bank may also contact the account holders through emailand obtain their confirmation of the details of the account.(iv) A savings as well as current account should be treated as inoperative / dormant ifthere are no transactions in the account for over a period of two years.

    (v) In case any reply is given by the account holder giving the reasons for notoperating the account, banks should continue classifying the same as an operativeaccount for one more year within which period the account holder may be requested tooperate the account. However, in case the account holder still does not operate thesame during the extended period, banks should classify the same as inoperativeaccount after the expiry of the extended period.(vi) For the purpose of classifying an account as 'inoperative' both the type oftransactions l.e, debit as well as credit transactions induced at the instance ofcustomers as well as third party should be considered. However, the service chargeslevied by the bank or interest credited by the bank should not be considered.(vii) Further, the segregation of the inoperative accounts is from the point of view ofreducing risk of frauds etc. However, the customer should not be inconvenienced in anyway, just because his account has been rendered inoperative. The classification is thereonly to bring to the attention of dealing staff, the increased risk in the account. Thetransaction may be monitored at a higher level both from the point of view of preventingfraud and making a Suspicious Transactions Report. However, the entire processshould remain un-noticeable by the customer.(viii) Operation in such accounts may be allowed after due diligence as per riskcategory of the customer. Due diligence would mean ensuring genuineness of thetransaction, verification of the signature and identity etc. However, it has to be ensuredthat the customer is not inconvenienced as a result of extra care taken by the bank.(ix) There should not be any charge for activation of inoperative account.(x) Banks are also advised to ensure that the amounts lying in inoperative accountsledger are properly audited by the internal auditors / statutory auditors of the bank.(Xi) Interest on savings bank accounts should be credited on regular basis whetherthe account is operative or not. If a Fixed Deposit Receipt matures and proceeds areunpaid, the amount left unclaimed with the bank will attract savings bank rate ofinterest.

    3. Banks may also consider launching a special drive for finding the whereabouts of thecustomers / legal heirs in respect of existing accounts which have already been transferredto the separate ledger of 'inoperative accounts'.

    Unclaimed Deposits/Inoperative Accounts in Banka-Display list of Inoperative Accounts

    Please refer to our Circular DBOD.No.Leq.BC.34/09.07.005/2008-09 dated August22, 2008, wherein detailed instructions have been given to banks on dealing withunclaimed deposits / inoperative accounts. They have been advised to find thewhereabouts of the customers and their legal heirs. These instructions, inter alia,include i) annual review of accounts in which there are no operations, ii) operations insuch accounts to be allowed after due diligence and iii) no charge to be levied foractivation of inoperative account, etc.

    2. Keeping in view public interest, it has been decided that banks should, in additionto the instructions contained in the above mentioned circular, playa more pro-activerole in finding the whereabouts of the accountholders of unclaimed deposits/inoperative accounts. Banks are, therefore, advised that they should display the listof unclaimed deposits/inoperative accounts which are inactive / inoperative for tenyears or more on their respective websites. The list so displayed on the websitesmust contain only the names of the account holder(s) and his/her address in respectof unclaimed deposits/inoperative accounts. In case such accounts are not in thename of individuals, the names of individuals authorized to operate the accountsshould also be indicated. However, the account number, its type and the name of thebranch shall not be disclosed on the bank's website. The list so published by thebanks should also provide a "Find" option to enable the public to search the list ofaccounts by name of the account holder.

Banks should also give on the same website, the information on the process ofclaiming the unclaimed deposit/activating the inoperative account and the necessaryforms and documents for claiming the same. Banks are required to have adequateoperational safeguards to ensure that the claimants are genuine.

    4. Banks should complete action as above by June 30, 2012 and keep their websitesupdated at regular intervals.

    There is a system whereby companies have to compulsorily transfer unclaimed dividendsto a special government-fund so that private bodies may not take advantage of publicmoney not claimed by share-holders.

    Same system of compulsory transfer of money in , bank-accounts like 'inoperative','suspense' or in any other name or form should be there whereby such money may becompulsorily transferred to specially maintained accounts for customers of different banksat Reserve bank of India (RBI) after some specified period in a manner that claimantls maynot face difficulty in claiming such money later. Banks must compulsorily inform accountholders well in advance before transferring such money to RBI.

    In present era of multinational banks dominating Indian banking, such a step is muchneeded to avoid banks taking undue advantage of unclaimed deposits and money parked inaccounts named like 'Inoperative' or 'Suspense' etc.

    Make IS-digit account-numbers compulsory on cheque books

    Reserve Bank of India (RBI) has made it mandatory for all banks to provide I5-digitaccount-numbers to all account-holders of different types. System has become still moreimportant because fast switching over to electronic transfers through services like RTGSand NEFT etc. But many banks have failed to provide new I5-digit account-numbers intheir system especially in respect of savings accounts, what to talk about for printing atcheque-books resulting in wrong credit-debit and bouncing ofRTGS and NEFT.

    Public-sector Corporation Bank is amongst such banks despite the system having beenintroduced long back. RBI should direct all banks to compulsory switch on to I5-digitaccount-numbers immediately at the most in a month's time. Old cheque-books (includingfor savings accounts) should be replaced free-of-cost with new cheque-books with printedI5-digit code.

    Banks usually in their system generate personal ID apart from account-number for eachindividual operating a single or joint account. This personal individual ID should also beprinted on pass-books to make operations simple for banks. Presently bank-staffers have tounnecessarily spend extra time to first trace p ~ r s o n a l ID for aspects like issuing TDScertificates.

    Banks require separate forms for availing services like Net-banking or Mobile-Alert etc.ption to avail such service should be available in account-opening form itself. FOTInS to

    avail such services should be sent by Speed Post to all old account-holders also for theirknowledge about such services having been made available.
