AN ORDINANCE OF THE CITY OF BERWYN,COOK COUNTY, ILLINOIS, APPROVING A TAX

INCREMENT REDEVELOPMENT PLAN AND REDEVELOPMENTPROJECT FOR THE ROOSEVELT ROAD TAX

INCREMENT REDEVELOPMENT PROJECT AREA

WHEREAS, the City Council of the City of Berwyn, Cook County, Illinois, (the

"City"), has heretofore detennined that the stable economic and physical development of the City

is endangered by the presence of blighting factors as often manifested as follows: by progressive

and advanced deterioration and dilapidation of structures; by a lack of physical maintenance; by

obsolete and inadequate community facilities; by obsolete platting; and, by deleterious land use

and layout; all of which impair the value of private investments, threaten the tax base of the City

and the taxing districts having the power to tax real property in the City (the "Taxing Districts"),

and jeopardize the health, safety, morals and welfare of the public; and,

WHEREAS, the City Council has heretofore detennined that in order to promote and

protect the health, safety, morals and welfare of the public, -blighting conditions in the City need

to -be eradicated and redevelopment of the City undertaken in order to remove and alleviate

adverse conditions, encourage private investment, and restore and enhance the tax base of the

City; and,

WHEREAS; the City has heretofore caused to be conducted an eligibility study to

detennine whether the proposed Roosevelt Road Tax Increment Redevelopment Project Area (the

"Proposed Area") qualifies as a "redevelopment project area" pursuant to the Illinois Tax

Increment Allocation Redevelopment Act (the "TIF Act") 65 ILCS 5/11-74.4-1 et seq., which

study was conducted by Trkla, Pettigrew, Allen & Payne, Chicago, Illinois ("TPAp lt); and,

WHEREAS, the City has heretofore evaluated various lawfully available programs to

provide such assistance and has detennined that the use of tax increment allocation fmancing is

necessary to achieve the redevelopment goals of the City for the Proposed Area; and,

WHEREAS, the City has further caused the preparation of and made available for public

inspection a proposed redevelopment plan and project for the Proposed Area (the "Plan and

Project"); and,

WHEREAS, the Plan and Project sets forth in writing the program to be undertaken to

accomplish the objectives of the City and includes the following: estimated redevelopment

project costs for the Proposed Area; evidence indicating that the Proposed Area on the whole

has not been subject to growth and development through investment by private enterprise; an

assessment of the fmandai impact of the Proposed Area on or any increased demand for services

from any taxing district affected by the Plan and Project and any program to address such

fmancial impact or increased demand; the sources of funds to pay costs; the nature and tenn of

any obligations to be issued; the most recent equalized assessed valuation of the Proposed Area;

an estimate as to the equalized assessed valuation after redevelopment; the general land uses to

apply in the proposed Area; a commitment to fair employment practices and an affinnative

action plan; and, taken as a whole, the Plan and Project accordingly complies in all respects with

the requirements of the TIF Act; and,

WHEREAS, pursuant to Section 11-74.4-5 of the TIFAct, the City Council by ordinance

adopted the 22nd day of October, 1996, called a public hearing (the "Hearing") relative to the

Plan and Project and the designation of the Proposed Area as a redevelopment project area under

the TIF Act and fixed the time and place for such Hearing, being the 23rd day of December,

1996, at the City Hall, 6700 West 26th Street, Berwyn, Illinois; and,

WHEREAS, due notice in respect to such Hearing was given pursuant to section 11­

74.4-5 of the TIF Act, said notice, together with a copy of the Plan, and the name of a person

to contact for further information, being given to Taxing Districts and to the Department of

Commerce and Community Affairs of the State of Illinois by certified mail on November 6,

1996, by publication on November 24, 1996 and December 8, 1996, and by certified mail to

taxpayers within the Proposed Area on December 12, 1996; and,

WHEREAS, the City has heretofore convened a joint review board as required by and

in all respects in compliance with the provisions of the TIF Act which joint review board met

at the times and as required by the TIF Act and reviewed the public record, planning documents

and a form of proposed ordinance approving the Plan and Project; and,

WHEREAS, the City held the Hearing on December 23, 1996, at the City Hall, 6700

West 26th Street, Berwyn, Illinois; and,

WHEREAS: at the Hearing, any interested person or affected taxing district was

permitted to file with the City Clerk written objections and be heard orally in respect to any

issues embodied in the notice of said Hearing, and the City heard and determined all protests

and objections at the Hearing; and,

WHEREAS, the Plan and Project sets forth the factors which cause the Proposed Area

to be blighted, and the City Council has reviewed the information concerning such factors

presented at the Hearing and has reviewed other studies and is generally informed of the

conditions in the Proposed Area which could cause the area to be a "conversation area" as

defined in the TlF Act; and,

WHEREAS, the City Council has reviewed evidence indicating that the Proposed Area

on the whole has not been subject to growth and development through investment by private

enterprise and has reviewed the conditions pertaining to lack of private investment in the

Proposed Area to determine whether private development would take place in the Proposed Area

as a whole without the adoption of the proposed Plan and Project; and,

WHEREAS, the City Council has reviewed the conditions pertaining to real property in

the Proposed Area to determine whether contiguous parcels of real property and improvements

thereon in the Proposed Area would be substantially benefitted by the proposed Project

improvements; and,

WHEREAS, the City Council has made an assessment of any financial impact of the

Proposed Area on or any increased demand for services from any Taxing District affected by

the Plan and Project and any program to address such fmancial impact or increased demand;

and,

· .WHEREAS, the City Council has reviewed the proposed Plan and Project and also the

existing comprehensive plan for development of the City as a whole to determine whether the

proposed Plan and Project conform to the such comprehensive plan of the City.

NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Berwyn,

Cook County, Illinois, as follows:

Section 1. The City Council hereby makes the following findings:

(a) The Proposed Area is described in Exhibit A attached hereto and

incorporated herein as if set out in full by this reference. The street

location (as near as practicable) for the Proposed Area is described in

Exhibit B attached hereto and incorpo.~ated herein as if set out in full by

this reference. The map of the Proposed Area is depicted on Exhibit C

attached hereto and incorporated herein as if set out in full by this

reference.

(b) There exist conditions which cause the Proposed Area to be subject to

designation as a redevelopment project area under the TIF Act and to be

classified as a conservation area as defmed in Section 11-74.4-3 of the TIF

Act.

(c) The Proposed Area on the whole has not been subject to growth and

development through investment by private enterprise and would not be

reasonably anticipated to be developed without the adoption of the Plan

and Project.

(d) The Plan and Project confonns to the comprehensive plan for the

development of the City as a whole.

(e) As set forth in the Plan and Project and in the testimony at the public

hearing, ·the estimated date of completion is January 15, 2019, and the

estimated date of the. retirement of any obligation incurred to finance

redevelopment project costs as defmed in the Plan and Project is January

15, 2019.

(t) The parcels of real property in the Proposed Area are contiguous, and

only those contiguous parcels of real property and improvements thereon

which will be substantially benefitted by the proposed improvements, are

included in the Proposed Area.

Section 2. The Plan and Project which were the subject matter of the public hearing held

on the 23rd day of December, 1996, is hereby adopted and approved. A copy of the Plan and

Project is set forth in Exhibit D attached hereto and incorporated herein as if set out in full by

this reference.

Section 3. If any section, paragraph or provision of this Ordinance shall be held to be

invalid or unenforceable for any reason, the invalidity or unenforceability of such section,

paragraph or provision shall not affect any of the remaining provisions of this Ordinance.

Section 4. All ordinances, resolutions, motions or orders in conflict herewith be, and

the same hereby are, repealed to the extent of such conflict, and this Ordinance shall be in full

The south side of Roosevelt Road extending from Lombard Avenue west toHarlem Avenue.-

The Plan objectives to reduce or eliminate blighting conditions in the proposedredevelopment project area, to enhance the tax base of the City of Berwyn andother affected taxing districts by encouraging private investment in commercialdevelopment within the proposed redevelopment project area, to prevent therecurrence of blighting conditions, and to preserve and enhance the value ofproperties therein are not to be changed, all in accordance with the provisions ofthe Tax Increment Allocation Redevelopment Act, effective January 10, 1977, asamended. The City may issue obligations to finance Project costs in accordancewith the Plan, which obligations may also be secured by the special tax allocationfund and other available funds, if any, as now or hereafter permitted by law andwhich also may be secured by the full faith and credit of the municipality.

WHEREAS, it is desirable and in the best interest of the citiZens of the City of Berwyn,

Cook County, Illinois (the "City"), for the City to implement tax increment allocation fInancing

pursuant to the Tax Increment Allocation Redevelopment Act, 65 ILCS 5/11-74.4 et seq., as

amended (the "TIF Act"), with regard to a redevelopment plan and project (the "Plan and

Project") within the boundaries of the City and within a proposed redevelopment project area

(the "Area") described in Section 1(b) of this ordinance; and

WHEREAS, the City Council has heretofore by ordinance adopted and approved the

Plan and Project, which Plan and Project was identified in such ordinance and was the subject,

along with the Area designation hereinafter made, of a public hearing held on December 23,

1996, in the City Hall at 6700 West 26th Street, Berwyn, Illinois, and it is now necessary and

desirable to designate the Area as a redevelopment project area pursuant to the TIF Act, said

Area to include those contiguous parcels of real property and improvements thereon which will

be substantially benefItted by the Plan and Project; and,

WHEREAS, the Plan and Project set forth the factors which could cause the proposed

Area to become a "blighted area", as defined in the TIF Act, and the City Council has reviewed

the information concerning such factors presented at the public hearing and has reviewed other

pursuant to the Tax Increment Allocation Redevelopment Act, 65 ILCS 5/11-74.4 et seq., as

amended (the "TIF Act");

WHEREAS, the City has adopted a redevelopment plan and project (the "Plan and

Project", respectively) as required by the TIF Act and has designated a redevelopment project

area (the "Area") as required by TIF Act and has otherwise complied with all other conditions

precedent required by the TIF Act:

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE

CITY OF BERWYN, COOK COUNTY, ILLINOIS, as follows:

Section 1. Tax increment allocation financing is hereby adopted to pay redevelopment

project costs as defined in the TIF Act and as set forth in the Plan and Project, within the Area

as described in Exhibit A, attached hereto and incorporated herein, as if set out in full by this

reference. The street location (as near as practicable) for the Area is described in Exhibit B,

attached hereto and incorporated herein, as if set out in full by this reference. The map of the

Area is depicted on Exhibit C, attached hereto and incorporated herein, as if set out in full by

this reference.

Section 2. Pursuant to the TIF Act, the ad valorem taxes, if any, arising from the levies

upon taxable real property in the Area by taxing districts and tax rates determined in the manner

provided in 65 ILCS 5/11-74.4-9(c) of the TIF Act each year after the effective date of this

ordinance until the Project costs and any municipal obligations issued in respect thereto have

been paid shall be divided as follows:

(a) That portion of taxes levied upon each taxable lot, block, tract or parcel of real

property which is attributable to the lower of the current equalized assessed value

or the initial equalized assessed value of each such taxable lot, block, tract or

parcel of real property in the Area shall be allocated to and when collected shall

be paid by the county collector to the respective affected taxing districts in the

manner required by law in the absence of the adoption of tax increment allocation

financing.

(b) That portion, if any, of such taxes which is attributable to the increase in the

current equalized assessed valuation of each taxable lot, block, tract or parcel of

real property in the Area over and above the initial equalized assessed value of

each property in the Area shall be allocated to and when collected shall be paid

to the·City treasurer pursuant to Section 207A of the Illinois Revenue Act of1939,

as amended, who shall deposit said taxes into a special fund, hereby created, and

designated the" 1996 Roosevelt Road Redevelopment Project Area Special Tax

Allocation Fund" of the City, such taxes to be used for the purpose of paying

Project costs and obligations incurred in the payment thereof, pursuant to such

appropriations as may be subsequently made.

Section 3. If any section, paragraph or provision of this Ordinance shall be held to be

invalid or unenforceable for any reason, the invalidity or unenforceability of such section,

paragraph or provision shall not affect any of the remaining provisions of this Ordinance.

Section 4. All ordinances, resolutions, motions or orders in conflict herewith the same

hereby are, repealed to the extent of such conflict, and this Ordinance shall be in full force and

effect immediately upon its passage by the City Council and approval as provided by law.

IN ORDINANCES 96-8, 96-9 and 96-10 OFTHE CITY OF BERWYN, COOK COUNTY, n...LINOIS

WHEREAS, an January 28, 1997, the City Council of the City of Berwyn adopted the

following ordinances:

1. An Ordinance of the City Of Berwyn, Cook County, Illinois, Approving a Tax

Increment Redevelopment Plan and Redevelopment Project for the Roosevelt

Road Tax Increment Redevelopment Project Area. [Ordinance No. 96-8].

2. An Ordinance of the City Of Berwyn, Cook County, Illinois, Designating the

Roosevelt Road Redevelopment Project Area of Said City a Redevelopment

Project Area Pursuant to the Tax Increment Allocation Redevelopment Act.

[Ordinance No. 96-9].

3. An Ordinance of the City Of Berwyn, Cook County, Illinois, Adopting Tax

Increment Allocation Financing for the Roosevelt Road Redevelopment Area.

[Ordinance No. 96-10].

WHEREAS, the area designated pursuant to such ordinances as a "Redevelopment

Project Area" included a parcel of real estate identified by Pennanent Index Number 16-20-100-

038, the owners of which received all notices as required by law; and,

WHEREAS, upon review of said ordinances by the office of the Clerk of Cook County,

it was detennined that the lines drawn on the boundary map depicting said Redevelopment

Project Area did not include all of said parcel 16-20-100-038 and, consequently, must be

redrawn and correctly legally described.

10 hereinabove enumerated, is hereby corrected by replacing each boundary map and legal

description of the Roosevelt Road Redevelopment Project Area as set forth in each of said

Ordinances, with the boundary map and legal description in the exact form attached hereto.

Section II. That all ordinances or parts of ordinances in conflict with the provisions of

this Ordinance be and the same are hereby repealed.

Section III. That this Ordinance shall be in full force and effect from and after its

passage, approval and publication as provided by law.
