Introduction

ICMM & Eurometaux are not involved in thesetting up and management of consortia

For Minor Metals, Eurometaux is offering to facilitate the setting up of consortia via the use of its network and organisation of a firstexchange meetings

For more information on consortia for specificsubstances, we refer to:

Ni REACH ConsortiaTHE PRINCIPLES:• Open to all Nickel and inorganic Nickel compounds

producers or importers worldwide• Close involvement of main Downstream users• Support for Pre-registration, Classification under GHS,

Registration, Evaluation of dossier (Evaluation of substance and Authorisation in a later phase)

• Implementation of REACH in an anticipative, planned and responsible way

• Based on sound science and cost effectiveness

19

An 11 Steps approach– Step 1: Clarify issues of interpretation related to REACH scope– Step 2: Clarify status of Ni primary materials– Step 3: Organisation/Management aspects– Step 4: Members approval of REACH implementation plan– Step 5: Anticipate critical Pre-Registration, Registration and

Authorisation– Step 6: Pre-Registration phase– Step 7: Planning Registrations– Step 8: CSR on Ni and Ni Compounds– Step 9: CSR for primary materials and intermediates– Step 10: Authorisation phase– Step 11: Consortia in Authorisation

Which Consortia’s?

Given the different nature and content of the work to be done :

1. Consortium 1 : Nickel and Nickel compounds that underwent Ni RA

2. Consortium 2 : Other Inorganic Nickel compounds produced/imported in EU

3. Consortium 3 : Complex materials requiring different approaches : Ni matte (as “intermediate”), FeNi (as “special preparation”), …

Consortia funding principles

Consortia contract contains an outline to :• Define generic cost allocation principles• Identify type of resources required• Generic scheme for allocation of costs• Specific rules for specific situation of Nickel

Principles :• In line with REACH• Legally correct• Fair, transparent and non-discriminatory• Proportional to the costs made

Based on extensive experience with RA consortia (Zn, Cu, NI, …)

27

Nickel REACH Consortia: conclusions

• Solid basis from the Ni RA:– Content wise – Organisational

• Invitation to all other importers/(EU and non-EU) producers to join the Consortia

• Consortia contract is available on request• Terms are simple and proportional• We expect a pro-active attitude of all Consortia

members

37

Consortium Funding

• Fees for three types of activities:• Annual costs of secretariat, meetings, accounting and in house

technical expertise• Fees for future work – e.g. research projects, consultants for

dossier preparation and communications• Fee to use historical VRA asset• Separate structures for copper metal and intermediates

subgroups

• Fees are tonnage based, subject to a minimum

• ICA/ECI members receive significant discounts versus new consortium participants

• Latecomer’s fee for members who sign up after Feb 26th 2008

38

Registration dossiers

• Cu cathode: RA will provide 90% of information

• ECHA: developing easy transition format for finished RAs

• Cu-Intermediates:

• Registration dossier: all as transported isolated intermediates

Aluminium industry action points• Aluminium REACH Consortium set up 2004

• Cost sharing agreement• Non-disclosure agreement

• EAA REACH Task Force set up 2006• Develop guidance document for EU based aluminium plants

REACH Consortium

• The Consortium is concerned with aluminium metal (including powder), aluminium oxide & aluminium hydroxide produced in EU and EEA countries, and imported to this market;

• In addition the Consortium will also handle bauxite ore.• The Consortium will develop the Registration file with all

necessary documentation and through the lead company send this to the Agency before December 2010

• This includes proposal for classification and labelling, Chemical Safety Report and necessary SDS with exposure scenarios

• The European Aluminium Association acts as the secretariat for the Aluminium REACH Consortium and is supported by the International Aluminium Institute.

• The members are companies producing in Europe or exporting to this market

Participating Companies• Hydro Aluminium• RioTinto• Talum*• Alba• Dubal• Dadco (AOS)• AMAG• Rusal• Aluar• BHP-Billiton• Elkem Aluminium• Aluminium of Greece

• Corus• Trimet• Alcan Inc**• Alcoa• Glencore• Aluminium Konin• Companhia Brasileira de

Aluminio (CBA)• NLM• Slovalco• Kaiser Aluminium• European Aluminuim

Particulate Association• US Powder & Paste producers

* Non-IAI/EAA Member Company ** Lead Registrant

Guidance for aluminium plants

• REACH Task Force set up to develop guidance for aluminium plants on how to handle their obligations at plant level.

• REACH Guidance document sent out to European plants containing brief description of the different roles and obligations for a plant

• Contains template for substances inventory with decision points and model letter for communication up and down the production chain

Basics of the Zinc Consortium Agreement

The Consortium is a community of individual Parties, on a non-profit basis

Consortium Members join forces to comply jointly and timely withregistration obligations under REACH

They bear the costs jointly, according a set of cost-sharing formulae

Membership is open to all EU and non-EU potential Registrants

Group of companies, holding companies and Affiliates will enter the Consortium as one Member. However, each legal entity will have, if appropriate, to register their Substances to the EU-Agency

Late entrants will have to pay to the early Consortium Members the accrued costs from the beginning and a compensation (up to 36% if joining after July 2010)

Lifetime of the ConsortiumLifetime of the ConsortiumFor substances ≥ 1000 tonnes per annum per registrant the deadline for registration is December 2010 – this would be the end of the main phase of the Mn consortiumAt this time some tests (vertebrate animal studies) may still need to be conductedREACH foresees a potential need for updating of CSRsif/when new information becomes availableA smaller “core group” could be formed after 2010 to manage these aspects, as/if necessaryLower tonnages have longer phase-in deadlines (June 2013 for substances ≥ 100 tpa; June 2018 for ≥ 1 tpa)

Estimated costs (2008Estimated costs (2008--2010)2010)Total costs comprise three main expenses:– Consortium set-up and project management– Dossier Registration– Data/information acquisition and assessment

Consortium set-up and management:– Estimated overall budget = € 2,000,000. – This includes allowances for legal and technical/scientific

consultants, administration.– To be divided pro-rata on a substance turnover basis

Dossier/Substance Registration – A budget of € 1,000,000– To be divided pro-rata on a substance turnover basis

Estimated costs (2007Estimated costs (2007--2010)2010)Data/information acquisition and assessment:– For 1000 tpa substances with no surrogate data, costs to

acquire the required data are estimated to be up to € 2,000,000 per substance;

– For the registration of the 15+ Mn substances currently under consideration, total costs of € 7-10 million have been estimated.

Total Study/Test cost estimates are, therefore 7.000.000 € to 12.000.000 € for the period June 2007/December 2010

Cost estimates are unlikely to change significantly if further substances are included in the portfolio

Current activities• Identify additional potential registrants of precious metals and

rhenium under REACH;

• Update the Consortium Agreement in order to make it available toupcoming members by April 2008;

• Collect all available information and data on precious metals and rhenium to produce “substance profiles” and prepare specific work programmes;

• Identify the appropriate consultancies to work on each inventoryREACH requirements;

• Prepare upcoming Plenary Meeting: Toledo, 19th of June 2008;

• Guide members to an aligned and harmonised pre-registration.
