The holiday celebration is in full force. Sadly, the commercialization of this time of year is at an ALL TIME high, taking away from the true "Holiday Experience."
In our line of work, we often get stuck in the status quo, doing what we "always do." I would like to suggest that you get out and try to experience 1 or 2 new community events this year that
you normally would have passed over. It will not only give you more ammunition in selling our area, but it just might start a new family tradition.
As this month closes, we will not only be ending a year, but a decade. On top of all our duties to our family and friends, we have to adapt our business to the new demands of the age. I was fortunate enough to hear from Steve Murray (CEO-Real Trends) at the Florida REALTORS® CEO Symposium. Here's some information that will help you "set the sail" for 2020:
• Trust & convenience are the most expected traits from a consumer
• 92% of all Millennials sales, used a REALTOR® • 94% of Gen X sales, used a REALTOR® • 90% of ALL people use a REALTOR® in their real estate
transaction (up from 81%) • 4.5 to 5 million home deficit for the current population • Migration to Florida is coming from 7 states due to Tax
Laws
Mr. Yun (NAR Economist) confirmed, "we have been in the longest economic expansion in U.S. history with no sign of letting up." All of the indicators are in our favor for an explosive year in real estate. In Mr. Yun's words, "baring a trade war, we will continue to go up and to the right."
None of us "plan to fail, we FAIL to plan." As we think of our individual businesses' future, don't forget to take into account these areas: community, association, industry and educational involvement with some professional development. Being a well rounded professional provides a much more beneficial value proposition to the consumer, as well as your peers.
Let's close this year and start the decade #REALTORStrong.

Ethics Case Interpretations related to Article 1
Case #1-28: Disclosure of Existence of Offers to Prospective Purchasers
(Adopted November, 2002.)
Seller S listed her home for sale with REALTOR® B. The property was priced reasonably and REALTOR® B was confident it would sell quickly. The listing agreement included the seller’s authorization for publication in the MLS and authority to disclose the existence of offers to prospective purchasers.
Within days, REALTOR® B had shown the property to several prospective purchasers and one of them, Buyer Z, wrote a purchase offer at close to the asking price.
REALTOR® B called Seller S to make an appointment to present the offer. After hanging up with Seller S, REALTOR® B received another call, this time from REALTOR® A. REALTOR® A explained that he represented a buyer who was interested in making an offer on Seller S’s property. REALTOR® A explained that while his buyer-client was quite interested in the property, price was also a concern. He asked REALTOR® B if there were other offers on the property, indicating that his buyer-client would likely make a higher offer if there were competing offers on the table. REALTOR® B responded telling REALTOR® A, “That’s confidential information. Please tell your client to make his best offer.”
Taken aback by REALTOR® B’s comments, REALTOR® A shared them with his buyer-client, who chose not to make an offer and instead pursued other properties.
Buyer Z’s offer was accepted by Seller S later that evening and, sometime later, the transaction closed.
Several months afterward, Seller S and REALTOR® A met at a social event. REALTOR® A related his conversation with REALTOR®
Seller S asked REALTOR® A if he thought that REALTOR® A’s buyer-client would have made an offer on Seller S’s home absent REALTOR® B’s refusal to disclose whether there were other offers pending. REALTOR® A responded that it was impossible to tell for certain, but his buyer-client had certainly not been favorably impressed by REALTOR® B’s response to a seemingly routine question.
Seller S subsequently filed an ethics complaint against REALTOR® B alleging violation of Article 1 as interpreted by Standard of Practice 1-15. He noted that he had clearly authorized REALTOR® B to disclose to buyers and cooperating brokers the existence of pending offers and that REALTOR® B’s arbitrary refusal
to share information, he was authorized to share could have been the reason, or part of the reason, why REALTOR® A’s client had chosen not to make an offer on Seller S’s home.
REALTOR® B defended his actions indicating that while he agreed that he had an obligation to promote Seller S’s interests, his obligation to REALTOR® A and to REALTOR® A’s buyer-client was simply to be honest. He had not, in any fashion, misrepresented the availability of Seller S’s property. Rather, he had simply told REALTOR® A to encourage his client to make her best offer. “I’m not required to turn every sale into an auction, am I?” he asked rhetorically. “I feel that I treated all parties honestly and fairly,” he concluded.
The Hearing Panel did not agree with REALTOR® B’s reasoning, indicating that he had violated Article 1 as interpreted by Standard of Practice 1-15. They noted that Standard of Practice 1-15 requires REALTORS®, if they have the seller’s approval, to divulge the existence of offers to purchase on listed property in response to inquiries from either potential buyers or from cooperating brokers. REALTOR® B had not met that obligation and, consequently, the Hearing Panel concluded that REALTOR® B had violated Article 1.

MLS Statistics
Statistics developed by the REALTORS Association of Indian River County through its Multiple Listing Service and in conjunction with Florida REALTORS reflect the
following for October 2018/2019. The Residential closed sales of single-family detached homes totaled
266 units for October 2019. This compares to a total of 247 units in October 2018. The median price of single-
family detached homes sold by members of the REALTORS Association of Indian River County MLS for October 2019 was $246,687. This compares to a median
price of $235,150 for October 2018. Current active inventory of residential single-family detached homes
total 1,376 for October 2019. This compares to the active inventory of 1,490 for October 2018.
The Residential closed sales of condominium homes totaled 57 units for October 2019. This compares to a total of 64 units in October 2018. The median price of
condominium homes sold by members of the REALTORS Association of Indian River County MLS for October 2019 was $140,000. This compares to a median
price of $158,000 for October 2018. Current active inventory of condominium homes total 456 for October 2019. This compares to the active inventory of 418 for
October 2018.

2020 Great American REALTOR® Days
The Florida Legislature meets in session every year for 60 consecutive days. In 2020 the session will run Jan
14th through March 14th.
February 3-5, REALTORS® across Florida will converge in Tallahassee to meet with their Legislators to discuss
real estate legislation.

Gov. DeSantis & 2020 Budget Recommendations
Governor DeSantis recently released his 2020 budget
recommendations and there is plenty of good news included
for Florida REALTORS®.
The total recommendation for the FY 2020-2021 budget is
$91.4 billion which includes a variety of REALTOR®
priorities, such as high levels of environmental funding and
full funding for the housing trust funds.
Notable highlights of the governor’s budget
recommendations:
• Environment and water issues: $625 million for
environmental spending, which includes $322 million
for Everglades restoration projects, $22 million to
combat the harmful effects of algal blooms and red tide,
$150 million for various water quality improvements,
$50 million for beach nourishment and $50 million for
springs restoration.
• Housing trust funds: Full funding of the State and
Local Government Housing Trust Funds, which would
amount to $387 million for affordable housing
projects. This includes $119.8 million for the State
Apartment Incentive Loan (SAIL) Program and $267.2
million for the State Housing Initiative Partnership
(SHIP) Program.
• Unlicensed activity: $500,000 to fund unlicensed
activity enforcement relating to real estate.
• Mapping: Authorization for the Division of Emergency
Management to continue LIDAR (Light Detection and
Ranging) mapping the state.
Florida’s governor releases budget recommendations each
year in advance of the legislative session, which runs for 60
days and begins on January 14, 2020. Although the Florida
Legislature isn’t required to follow these recommendations,
they often serve as a useful framework that can be used to
develop and pass a balanced state budget.
Rule Change Should Push More Large Lenders to
Offer FHA Loans
Strict FHA lending rules scared lenders and many stopped
offering the loans altogether. But that may change because
HUD and DOJ have agreed to ease up a bit. The change comes
at an opportune time since a separate rule will allow more
condo buyers to use an FHA loan.
Fear of the FCA caused a number of larger lenders to stop
offering FHA loans altogether.
FEMA Postpones Flood Insurance Changes 1 Year
The Federal Emergency Management Agency (FEMA) has
postponed the roll-out date of Risk Rating 2.0 – its plan to
update and extend the National Flood Insurance Program
(NFIP). The original effective date of Oct. 1, 2020, has been
moved back one year to Oct. 1, 2021.
Risk Rating 2.0… Although the Risk Rating 2.0 program is
still being developed, it’s expected to change the way NFIP
calculates flood-insurance rates. As a result, it could save
some homeowners money and raise the coverage cost for
others.
Rather than levy premiums based on the dollar amount of
insurance a homeowner wants, NFIP could operate more like
traditional property insurance by weighing a roster of risk
variables. Currently, rates are generally based on the amount
of coverage a homeowner wants and the risk of flood their
home faces – largely whether the home is inside or outside a
FEMA-designated flood zone.

reports and display builder, Stats preset and customize from
the Matrix navigation menu, hover the stats tab and select any
of the property types. You will see how to save this statistic
for a quick access on the Home Page Stats Widget.
“Listing Input and Editing” – 1:30 - 3:30 PM – As
long as you have edit access in Matrix, you will be able to add
and edit your own listings. Use the tax integrating, integrating
image submitter to complete your listing. Learn to use the Fill
From Feature of an existing listing that you once had. Search
by listing number or search from a preexisting cross property
listing from which to fill from. Learn to upload photos and
attachments. Learn the rule on re-listing an expired and how to
change the status of a listing using the select from.
“ePropertyWatch” - Keep in touch with your clients.
Home valuation, forecast, mortgage information, nearby
trends and forecast analytics.
“School Links for Input in MLS”
When inputting data for schools, now you have the
option to indicate the school’s link, IRC, SLC,
BREVARD or out of area. The selected link will take
you directly to the school for that county. This was
changed due to School of Choice.
“Reporting NON-MLS Property as Sold Comps”
Listings must be entered into the MLS prior to the closing
with a valid listing agreement per MLS Policy Procedures
Section 1 of the MLS Rules and Regulations. Listings
may not be entered into the MLS database without a
valid listing agreement. Listings are no longer able to be
entered into the MLS for statistical or comparable
purposes only. The policy was approved by the MLS
Committee on November 25, 2019.
“ShowingTime” Online Scheduling Program
Save Time, reduce calls and generate more showings.
Provide service to your members by enabling them to
schedule showings through the MLS website 24/7. The
“Schedule a Showing” button is always on saving you
time, reducing calls and eliminating phone tag. All of
your history, showing instructions and agent profile will
be preserved in the software. Get Started Use the Quick
Link on the Home page to register for ShowingTime for
the MLS scheduling and management of listings for
agents. Learn to set up the appointment in the MLS using
ShowingTime. ShowingTime Support email:

“Sellers Waiver of Entry in MLS”
The “Sellers Waiver of Entry” form is an agreement
signed by the sellers and listing agent/broker to waive
RAIRC MLS entry of a listing for sale in IRC. This
procedure is used if the sellers do not wish to enter the
IRC property listing into the MLS until a certain date or
even for the entire listing period. Once the listing is to be
entered, the correct list date is the original listing date of
the agreement, not the seller waiver of entry date. This
date will appear in the history. Waiver of Entry” form can
be found in Form Simplicity under Board Realtors
Association forms. The form and agreement are sent to
the MLS to keep on file until the listing is inputted.
“CoreLogic “TRESTLE” Management program for
IDX and VOW RETS Feeds”
To set up an IDX RETS or VOW feed the IDX
provider/vendor needs to contact CoreLogic “Trestle”
directly for the RETS program agreement. The setup fee
is $200 and annual fee is $100. Billing is prepared and
handled directly by Trestle. Real Estate brokers will use
“Trestle” to receive listing data feeds from participating
multiple listing organizations and that clients will use
Trestle to manage their RAIRC IDX and VOW RETS

2019 REALTOR® HONOR SOCIETY
In Recognition of Professionalism through Education, Participation and Service
HISTORY
The REALTORS® Association of Indian River County
REALTOR® Honor Society was established in 1985 in order
to enhance and recognize the professional standards of the
Association membership through voluntary educational
offerings, participation at the local, state and national
Association levels and through service to the community.
During the first year, 40 members qualified as Charter
Members of the REALTOR® Honor Society. The Charter
members were awarded a special edition "Charter Member"
REALTOR® Honor Society Pin.
PURPOSE
The primary purpose of the REALTOR® Honor Society is to
encourage Association participation among REALTOR®
members in order that they might be better educated, active
members, to serve their clients and customers and in turn
bring credit to themselves and the real estate industry. This
program is designed to recognize and reward any member
who, on an annual basis, actively participates in Association
functions.
AWARDS
Certificates recognizing membership in the REALTOR®
Society will be presented at a REALTORS® Association of
Indian River County General Membership Meeting.
YEARLY QUALIFICATION
To maintain membership in the REALTOR® Honor Society,
members must re-qualify each year by obtaining a minimum
of 100 points. This is NOT a one-time qualification and is
designed to keep Association members active and involved.
QUALIFICATION PERIOD
The qualification period or application year will run from
October 1st to September 30th. All applications must be
submitted to the REALTORS® Association of Indian River
County, 3250 67th Street, Vero Beach, FL 32967.
POINT QUALIFICATION
A minimum of 100 points per year is needed in order to
qualify or maintain membership in the REALTOR® Honor
Society. Orientation and Education courses taken for post
license renewal are excluded. An application is attached. It
lists in detail the point breakdown by category. Points in
varying amounts are awarded for the following activities:

REGISTRATION:
We appreciate your cooperation in your timely arrival as the course will begin promptly as scheduled. Due to DBPR requirements, Registration Sign-In will begin 30 minutes PRIOR to the start of ALL scheduled courses.
REGISTRY DEADLINE: *2 Calendar Days PRIOR to the scheduled course or
event, by (Midnight) 11:59 PM.
Anyone registered after the deadline will be considered a LATE registry and will be REQUIRED to pay FULL PRICE prior to attending the course or event.
REGISTRATION CONFIRMATION: Anyone who registers for a course using the website, www.RAIRC.com, will receive a registration confirmation number. All students registered for an RAIRC CEU course or event will receive email confirmation 2 days prior to the scheduled course. If you have not received a confirmation email by this time, contact the Association to confirm you’re registered. If you register after this time, you will not receive an email confirmation. If you are not on the registration roster the day of class, you will be required to pay a Late Registry fee (see below for fee information).
