1. The Problem:Lack of Compliance

• Ordot Dump began during WWII

• 1950 - US Military to Turned Dump over to Gov Guam

• 1986 - US EPA issued first Administrative Order about pollution into Lonfit River

• 1990 – US EPA cessation of discharges order to Guam DPW

• 1997 – US EPA orders investigation

• 2004 – Govguam enters into Consent Decree with US District Court – Dump required to close by 2007

• 2005 - No Progress

• 2006 - No Progress

• 2007 - $2.9 million in stipulated penalties

• March 2008 - Federal Court/Chief Justice appoints Receiver based on following observations;

– Historical and present lack of commitment by leaders

– The problem of a highly dysfunctional, largely mismanaged, overly bureaucratic, and politically charged solid waste system is beyond correction by conventional methods.

RECEIVERSHPS FIRST TASKS

GBB’s initial steps included the following:• Organize the project team to undertake the

Receivership• Review the Consent Decree and all documents

previously filed with the Court (approximately 6,000 pages)

• Conduct initial review of the design and engineering work already completed

• Communicate with officials of the Court, U.S. EPA 9, and GovGuam

• Establish the Guam Solid Waste Receiver Website

GBB’s initial steps (continued):• Review the Management Audit

conducted for the Public Utilities Commission by the Georgetown Consulting Group

• Review the Public Auditor’s Audit of the Solid Waste Management Division

• Review the financial condition of GovGuam

• In-depth consultation with the Court prior to a conference Court attended on April 12-13, 2008 in Washington, D.C.

• Meeting on April 14, 2008, with Congresswoman Madeleine Bordallo’s key staff on potential federal financial assistance for Guam Solid Waste

New Account Management System Needed

• The Problem– SWMD collects weekly from 15,900 households (HH)– SWMD cannot match customer accounts with collection

addresses for 4,000 of these HH– Only 12,080 HH are invoiced for service

• Result: – 4,000 HH receive free service– 4,000 HH accounts don’t match with addresses – SWMD does not collect sufficient revenues to cover

costs of daily operations

• With new system– Registration for all customers– Verification of physical addresses– System to accurately track collections– New software for accurate billing

Administration• Continued to focus on overdue accounts

– Customer Service Representative make calls, send letters to customers 60 and 90 days behind in payments

– 1,534 trash carts repossessed for non-payment during reporting period

– 67% of those customers paid overdue balances and had service restored

• Implemented online billing and payment system– Customers can review accounts, receive and pay bills

online

– More than 2,000 customers have registered

• GSWA staff number 55, down 44% from 2008
