6 August 2015 Ref: E24192Klet Jason Gao Managing Director Ausbao Pty Ltd Level 4, 507 Kent St Sydney 2000 DEVELOPMENT APPLICATION SUPPORTING LETTER PROPOSED RESIDENTIAL DEVELOPMENT 1, 1A, 3 & 5 AVON ROAD AND 4 & 8 BEECHWORTH ROAD, PYMBLE, NSW Ausbao Pty Ltd (‘the client’) commissioned Environmental Investigation Services (EIS) 1 to undertake an additional Environmental Site Assessment (ESA) and prepare a Remedial Action Plan (RAP) for the proposed residential development at 1, 1A, 3 & 5 Avon Road and 4 & 8 Beechworth Road, Pymble. This letter forms part of the Land and Environment Court of NSW (L&E Court) Proceedings No.10834 of 2013. The proceedings relate to the refusal by the Planning Assessment Commission (PAC), as delegate of the Minister for Planning (Minister), of the Major Project Application (MP 10_0219) for a multi-unit residential development at 1, 1A & 5 Avon Road and 4 & 8 Beechworth Road, Pymble (Site). On 5 December 2014, the Land and Environment Court ordered that a Concept Plan approval be issued in respect of the development of the Site, and the PAC issued the Concept Plan Approval on 19 December 2014. The proceedings No.10834 of 2013 relating to the Major Project Application were stood over following the Court's order regarding the Concept Plan and the PAC's subsequent issue of the Concept Plan Approval. EIS have previously undertaken a Stage 1 ESA (Ref: E24192KrptRev1.2 dated December 2012) and a Preliminary Stage 2 ESA (Ref: E24192Krpt2 dated 22 May 2015) and these should be read in conjunction to this letter. The EIS 2015 stage 2 ESA concluded that the site can be made suitable for the proposed development provided that the following recommendations are implemented to address the data gaps and to minimise/better manage/characterise the risks: 1. Address the data gaps identified as part of an additional ESA; 2. DEVELOPMENT APPLICATION SUPPORTING LETTER

PROPOSED RESIDENTIAL DEVELOPMENT

1, 1A, 3 & 5 AVON ROAD AND 4 & 8 BEECHWORTH ROAD, PYMBLE, NSW

Ausbao Pty Ltd (‘the client’) commissioned Environmental Investigation Services (EIS)1 to undertake

an additional Environmental Site Assessment (ESA) and prepare a Remedial Action Plan (RAP) for the

proposed residential development at 1, 1A, 3 & 5 Avon Road and 4 & 8 Beechworth Road, Pymble.

3. Prepare a Validation Assessment (VA) report on completion of remediation.

The additional ESA investigation EIS are currently undertaking aims to address the data gaps

identified in the EIS 2015 report. Fieldwork for the additional ESA has commenced and based on the

findings an RAP will be prepared for the proposed development. Following the RAP implementation

and subsequent successful Validation Assessment (VA) the site can be deemed suitable for the

proposed development.
