The Board of Commissioners for the Town of Erwin with Mayor Patsy Carson presiding, held its Regular Meeting in the Town Hall on Thursday, February 2, 2017 at 7:00 P. M. in Erwin, North Carolina.

Board Members present were: Commissioners William Turnage, Alvester McKoy, Randy Baker, Ricky Blackmon, and Thurman Whitman.

Board Members absent were: Commissioner Frankie Ballard.

Interim Town Manager Richard Hicks, Asst. Town Manager/Planner Snow Bowden and Town Clerk Cynthia Patterson were present.

Town Attorney Mac Hunter was present.

Mayor Patsy Carson called the meeting to order at 7:00 P. M.

Commissioner McKoy gave the invocation.

Those present recited the Pledge of Allegiance.

APPROVAL OF AGENDA

Commissioner McKoy made a motion to approve the agenda as is and was seconded by Commissioner Turnage. The Board voted unanimously.

CONSENT ITEMS

Commissioner Turnage made a motion to approve (Item A) Approval of Regular Minutes of 01/05/17 and (Item B) Financial Report Summary for December 2016 and (Item C) 2017 DOT Mowing Contract and was seconded by Commissioner Whitman. The Board voted unanimously.

A copy of the December 2016 Financial Report Summary and 2017 DOT Mowing Contract is incorporated into these minutes as Attachment #1

PRESENTATION OF THE FEBRUARY CITIZEN OF THE MONTH

Mayor Carson presented a plaque to Larry Smith for the February’s Citizen of the Month. Mr. Smith has been a lifelong resident of the Erwin Community. He worked for Erwin Mills from 1957-1963 and in 1964 began working with Central Carolina Bank where he was Vice President and Manager from 1980 until his retirement at the end of 1999.

MINUTES CONTINUED FROM FEBRUARY 2, 2017

NEW BUSINESS

HARNETT COUNTY CTP AMENDMENT

Hemal Shah with NCDOT Transportation Planning came forward and made a presentation to the board. They are amending the Harnett County CTP which was adopted in 2011, so the amendment is to include some new projects that Harnett County and surrounding municipalities wanted to include. This plan will serve as a guide in the development of the transportation system in Harnett County and the same is hereby recommended to the NC Dept. of Transportation for its subsequent adoption.

Commissioner Baker made a motion to approve the Resolution 2016-2107—004 Comprehensive Transportation Plan for Harnett County and was seconded by Commissioner Turnage. The Board voted unanimously.

A copy of the Resolution for Comprehensive Transportation Plan is incorporated into these minutes as Attachment #3

BUILDING INSPECTIONS PERMIT FEES

Town Planner/Asst. Town Manager Snow Bowden informed the board that staff brought inspections back in house on February 1, 2017 and will need to add to the Fee Schedule mechanical, electrical, plumbing and building permits.

Some changes have been made to the fee schedule which include commercial and home recovery fund. The permit fees that have been proposed are the same fees that Harnett County currently charge.

Commissioner Blackmon pointed out another change that needs to be made. Under Residential additions, Renovations, and Fire Damage Renovation building permit includes trades should be up to 2,000 square feet.

Commissioner Turnage made a motion to approve the proposed amendment to the 2016-2017 Fee Schedule which will include the change to Residential additions, Renovations, and Fire Damage Renovation building permit includes trades should be up to 2,000 square feet and was seconded by Commissioner Blackmon. The Board voted unanimously.

MINUTES CONTINUED FROM FEBRUARY 2, 2017

POLICE DEPT. BUDGET AMENDMENT BOA 2017-04

Interim Town Manager Richard Hicks informed the board that we are required by law once a law enforcement officer reaches a certain number of years of service as a retiree before age 62, we have to pay a supplemental amount to them each month. These payments have been included in the salaries and wages line item in this budget year and prior budget years. To better track and provide you with more detailed information on the cost, we are asking that the budget be amended to pay this from a separate line item in the budget.

Commissioner Blackmon made a motion to approve the Police Dept. Budget Amendment BOA 2017-04 and was seconded by Commissioner Baker. The Board voted unanimously.

CONSIDERATION OF LEASE RENEWAL – AMERICAN TOWER

Interim Town Manager Richard Hicks informed the board that a summary of the current lease that goes to 2029 you will actually bring in about $359,783.57. The last proposal from American Tower, they offered to extend that through year 2059 the actual escalation factor went from 2% to 3% at which you will go to $384,838.02. You would have picked up about $30,000 more with that escalation factor. They have offered an extension to the year 2059 with a 3.6% escalation factor and a $25,000 signing bonus. During the same time frame as your current lease you will bring in $400,866.75 which is $40,000 more than the existing lease.

Mr. Hicks advised the board that a contract will be brought back for approval at a later date which will include an extension to the year 2059, 3.6% escalation factor with a $25,000 signing bonus.

MANAGER’S REPORT

A day time Retreat will need to be scheduled soon for any long range Planning. Willhave dates at the March regular meeting for you to consider.

GOVERNING BOARD COMMENTS

Commissioner McKoy asked if the Town was going to do anything for the Little League team that won the Championship. Would be nice to have hotdog’s or something in recognition.

Mayor Carson recommended the board attend the Campbell Mini Medical Session. It’s a 6 week session and would think you would enjoy the experience. Also the Chamber of Commerce is in the process of what they will be doing this year. Coming up in May is the Spring Fling and wanted to make sure that the Police Dept., Public Works Dept. and Snow Bowden is very involved.

BUDGET ORDINANCE AMENDMENT BOA 2017-05

FISCAL YEAR 2016-2017

BE IT ORDAINED by the Governing Board of the Town of Erwin, North Carolina that the following amendments are made to the annual budget ordinance for the fiscal year ending June 30, 2017:

Section 1. This Budget Ordinance Amendment seeks to transfer $3,500.00 from Contingencyline item (10-4100-990) to Contracted Services line item (10-4350-450). This transfer will cover the expenses involved for the demolition of the property at 107 Holmes St.

Section 2. To amend the General Fund the revenues are to be changed as follows: Account Description Current Approp. Increase/Decrease Amended Appropriation

(HC PIN# 0597-78-8523.000)

The property owner at 114 Allen Drive wants to replace their existing mobile home with a Class A Manufactured Home. The current structure that is on this property is in bad shape, and it needs to be replaced. This Conditional Use Permit was presented at the October Planning Board meeting, and after some discussion about the property setbacks, it was decided that the applicant needed to have the two lots surrounding the property recombined into one lot. The Planning Board decided to table this decision until the necessary changes were made.

At the February Planning Board meeting, this permit application was tabled due to concerns with the recent survey by the property owners on both sides of 114 Allen Drive. We decided to have the public hearing for this property because we had already advertised the hearing in the newspaper and the mail due to the quick turnaround from the Planning Board meeting to the Town Board meeting.

PLANNING BOARD MEETING MINUTES

MONDAY, FEBRUARY 20, 2017 ERWIN, NORTH CAROLINA

The Town of Erwin Planning Board, with Chairperson William Corbett presiding, held its regular meeting in the Town Hall at 100 West F St. on Monday, February 20, 2017, at 7:00 PM.

Board members present were: Chairperson William Corbett, Nancy Jackson Terry Wicker, Rick West, In Town Alternates Elizabeth Pate, Out of Town Member Ray Rogers and Out-of-Town-Alternate Michael Shean.

Board members absent were: In Town Members Roger Chavis and Melinda Alvarado In Town Alternate Mike Manning and Out of Town Member Norman Avery.

Town Planner Snow Bowden and Town Clerk Cynthia Patterson were present.

Board Member Ray Rogers gave the invocation.

Those present recited the Pledge of Allegiance.

CONSENT ITEMS

Board Member Nancy Jackson made a motion to approve the minutes of October 17, 2016 and was seconded by Board Member Elizabeth Pate. During the discussion Board Member Terry Wicker asked to be abstained from this motion due to being absent from the October 17, 2016 meeting. Motion Unanimously Approved.

NEW BUSINESS

REPLACE EXISTING TRAILER WITH A CLASS A MANUFACTURED HOME AT 114 ALLEN DRIVE (HC PIN# 0597-78-8523.000)

Town Planner/Assist. Town Manager Snow Bowden informed the board that the property owners at 114 Allen Drive would like to replace their existing trailer with a Class A Manufactured Home. It’s a conditional use in that district and the trailer they currently have is beyond repair. At the last Planning Board meeting, there were three (3) separate parcels however Mr. McLean has recombined those parcels into one (1) lot. This property now meets all the setbacks.

Doris Grady came forward and addressed the Planning Board. Ms. Grady is speaking on behalf of her Aunt Sue Matthews which lives at112 Allen Drive. They had surveyors to come out to survey the land. The last surveyor to come out has placed a marker at her bedroom window on her side of the property. On the other side of the property which is 116 Allen Drive has a marker on part of their land also. The land in the back where a barn is located is also marked and this is Ms. Grady’s and her husband’s property. Ms. Grady stated that she has worked hard for this land and does not want anyone to come and take it.

Planning Board Member Rick West thanked Ms. Grady for speaking and it was also his impression that Mr. McLean owned the three (3) parcels of land so he could combine with no problem.

Planning Director Snow Bowden stated that Mr. McLean does own those parcels of land. There has been some questions about the survey. The surveyors are certified by the State of North Carolina and presented a plaque for approval and has to go by what the surveyor says. Mr. McLean does own both of those parcels. The houses were grandfathered in before zoning regulations and one house is right on the property line so technically that house does not conform to structure. Mr. McLean plans to put the Class A Manufactured Home where the existing trailer is right now. Will not have any issues with encroachment on either side of the property.

Almer Butler, the husband of Sandra Gilbert Butler who’s the property owner of 116 Allen Drive came forward and addressed the Board. Mr. Butler’s question is why there were more than one surveyor out there. There is an issue obviously and wanted to make sure we were paying taxes for property that is supposedly ours and don’t think it would be fair for you to assume one surveyor verses another one saying this right. Allow me the opportunity to get my own surveyor out there. Currently there is no house on this property however Mr. Butler is paying taxes on this property and does not want someone to just take it either.

Mr. Bowden informed Mr. Butler that he was only aware of one surveyor from Angier to survey the property.

Sue Matthews came forward and addressed the Board. Ms. Matthews stated that she has lived in Erwin for 51 years this past February 7th. When she moved to Erwin her mother was living and bought this property. When Mr. McLean move to Erwin he only had one lot and now he is going take all the land he wants in order to put what he wants there. This is not fair to the property owners that own this land to give over to them unless they ask for it. They have not asked for anything they are just taking what they want.

Planning Board Member Terry Wicker informed the Board that he was not comfortable with this contingent about surveyor lines and actual survey. Mr. Wicker thinks it’s reasonable to ask that this be postponed or tabled and have this survey issue checked out.

ORANIZATION MEETING TO APPOINT CHAIRPERSON AND VICE-CHAIRPERSON

Board Member Terry Wicker stated that due to two (2) of the members not present tonight make a motion to table this. Due to no second, this motion Failed.

Board Member Ray Rogers made a motion to appoint Board Member Nancy Jackson as Chairperson and was seconded by Board Member Rick West. Motion Unanimously Approved.

Board Member Nancy Jackson made a motion to appoint Board Member Ray Rogers as Vice-Chairperson and was seconded by Board Member Rick West. Motion Unanimously Approved.

ADJOURNMENT
