First Read of Proposed Revisions to Policies: IJNDB - Use of Technology Resources in Instruction and JICH – Drug and Alcohol Use By Students

BACKGROUND:

The Governing Board will review and consider revisions to the following policies:

IJNDB – Use of Technology Resources (First Read) – General Counsel and Administration are recommending revisions to this policy, in accordance with Arizona School Boards Association(“ASBA”) recommendations, and to reflect the provisions of A.R.S. §15-1046, regarding student data privacy. The recommended revisions also include reference to the Children’s Internet Protection Act (“CIPA”), 20 U.S.C. 9134 and 47 U.S.C. 254. The Governing Board has not revised this policy since its adoption.

JICH – Drug and Alcohol Use By Students – (First Read) General Counsel and Administration are recommending revisions to this policy to align with the ASBA model. The recommended revisions include reference to Arizona’s Medical Marijuana Act, A.R.S. 36-2801 et seq., and the federal Safe and Drug-Free Schools and Communities Act, 20 U.S.C. 7101 et seq. The Governing Board has not revised this policy since its adoption.

It is recommended that the Governing Board approve the Award of the Hohokam Lead Based Paint Remediation Services in the amount of $212,510.00 to Sagebrush Restoration, LLC. using their City of Mesa S.A.V.E. Contract 2017125.

BACKGROUND:

The Governing Board Awarded Sagebrush Remediation Services the Asbestos Abatement portion of the work on November 5, 2019 in the amount of $219,903.00. With the decision to keep 6 of the original buildings, additional environmental testing had to take place to ensure all generated waste was properly disposed of. Lead Based Paint testing results confirmed that the tongue and groove overhangs around each of the buildings contained lead based paint. The current design calls for the tongue and groove canopies to remain. It has been determined that the best course of action is to remove the lead based paint throughout. Since Sagebrush already has remediation crews on the campus and in the interest of time, in lieu of seeking competitive pricing we have opted to use the City of Mesa S.A.V.E Cooperative Contract. The original 2016 Bond Budget for the Hohokam ES Environmental Remediation and Demolition is $1,000,000.00. The asbestos and lead remediation costs are within the current budget. Demolition costs for the 5 buildings to be demolished are not expected to exceed $500,000.

RECOMMENDATION:

It is recommended that the Governing Board approve recommended revisions to Policy CFD, School Based Management (School Councils) and Policy JLCD, Administering Medicines to Students. As set forth below, the Governing Board has considered revisions to these policies previously, and therefore has met the requirements of Governing Board Policy BGB, Policy Adoption, which requires two meetings prior to adoption, unless waived.

BACKGROUND:

CFD – School Based Management (School Councils) – (Second Read) After meeting with Cabinet and Principals, Administration presented Policy CFD to the Board at its April 11, 2019 meeting. During that meeting, Board members gave feedback, which Administration has reviewed with Principals, Assistant Principals, and parents. As a result, additional proposed revisions to the policy include:

Adding tax credit to the authority delegated to site council, pursuant to A.R.S. § 43-1089.01(E);

Adding delegation of authority for site councils to provide input to a school’s continuous improvement plan; and

Revising the requirement for a community member so that all schools must have one community member on site council, rather than requiring one for high schools and two for all elementary and middle schools.

JLCD – Administering Medicines to Students – (Second Read) Administration presented recommended revisions to Policy JLCD to the Board at its June 11, 2019 meeting. The proposed revisions are pursuant to A.R.S. §15-157, and ASBA recommendations. Since the June 11, 2019 Board meeting, Administration has had additional discussions with SUSD lead nurses, who have consulted with the Arizona Department of Health, and have conducted training with SUSD nurses. Administration is recommending revisions to the policy as previously presented. The Governing Board last revised this policy on April 11, 2006.

SCHOOL - BASED MANAGEMENT CFD

(School Councils)

The Governing Board may delegate to a school council the responsibility to develop a

curriculum and may delegate any additional powers that are reasonably necessary to

accomplish decentralization.

The Board authorizes the establishment of a school council at each school site. The

school council shall follow regulations promulgated by the Board. The authority

extended to the school council(s) is to:

Provide input to the design of curricular and instructional strategy/enrichment

models that promote the District mission/goals statement.

Determine how tax credit contributions that are not designated for a specific

purpose are used at the school site.

Provide input on matters that support the school’s continuous improvement plan.

A shared "vision" for curricular and instructional models and the involvement of a

variety of the members of the school and community who will be most affected by the

results are essential.

Site council input is limited only by the requirements that it be consistent with and

fulfill the mission/goal statements, beliefs, and adopted Board policies of the District

and comply with the laws and regulations of the state of Arizona and the United States.

This shared decision making shall not supersede Board/Superintendent decision-

making responsibilities unless waived by the Board.

Membership

The school council at each school shall take into consideration the ethnic composition

of the local community and initially shall be composed of:

Three (3) parents or guardians of students enrolled in the school who are not

employed by the District in the school of proposed membership.

Three (3) Teachers.

One (1) non-certified employee.

At least one (1) community member.

One (1) student if the school is a high school.

The Principal of the school.

Initially, each of the above school council members shall be selected in the manner and

by the procedure specified in A.R.S. 15-351. The school council shall then adopt written

guidelines that specify the number of school council members and the methods for the

selection of school council members. Thereafter, representatives shall be selected by

their groups in the manner determined. There must be an equal number of teachers

and parents/guardians of pupils enrolled in the school on the council and they shall

constitute a majority of the council members. The principal will serve as chairperson of

the school council unless another person is elected by a majority of the school council

members.

JLCD MEDICINES / ADMINISTERING

MEDICINES TO STUDENTS

Under certain circumstances, when it is necessary for a student to take medicine during school hours, the District will cooperate with the family physician and the parents if the following requirements are met: ● A. There must be a written order from the physician stating the name of the medicine, the dosage, and the time it is to be given. ● B. There must be written permission from the parent to allow the school or the student to administer the medicine. Appropriate forms are available from the school office. ● C. The medicine must come to the school office in the prescription container or, if it is over-the-counter medication, in the original container with all warnings and directions intact. All medication, except emergency medications as below, will remain in the school health center. The Governing Board directs the Superintendent to prescribe and enforce regulations and procedures for the emergency administration of auto-injectable epinephrine by a trained employee of the School District pursuant to section A.R.S. 15-157 and subsequent to the adoption of rules by the State Board of Education on or before January 1, 2014 pertaining to annual training in the administration of auto-injectable epinephrine, recognition of anaphylactic shock symptoms and the procedures to follow when anaphylactic shock occurs and the requirements of A.R.S. 15-203(A)(40). The Governing Board recognizes that the prescribed annual training is optional during any fiscal year in which a school does not stock epinephrine auto-injectors at the school during that fiscal year. A school district or charter school may accept monetary donations for or apply for grants for the purchase of epinephrine auto-injectors or may participate in third-party programs to obtain epinephrine auto-injectors at fair market, free or reduced prices. Exceptions: A. Students who have been diagnosed with anaphylaxis may carry and self-administer emergency medications including auto-injectible epinephrine provided the pupil's name is on the prescription label, on the medication container or device and annual written documentation from the pupil's parent or guardian is provided that authorizes possession and self-administration. The student shall notify the school nurse, Administrator or office secretary as soon as practicable following the use of the medication.

B. For breathing disorders, handheld inhaler devices may be carried for self administration provided the pupil's name is on the prescription label, on the medication container, or on the handheld inhaler device and annual written documentation from the pupil's parent or guardian is provided that authorizes possession and self-administration.

C. Mature students with insulin dependent diabetes may be allowed to carry their insulin and any necessary syringes, needles insulin pens or insulin infusion pumps with them at all times. Parents, the school nurse and school administration shall agree that the student’s maturity level is such that they are safe to administer their own insulin without supervision of the school nurse.

D. Students with diabetes who have a diabetes medical management plan provided by the student's parent or guardian, signed by a licensed health professional or nurse practitioner as specified by A.R.S. 15-344.01, may carry appropriate medications and monitoring equipment and self-administer the medication. District employees may volunteer to be a student's diabetes care assistant, subject to approval by the student's parent or guardian, in an emergency situation as described in 15-344.01. The Superintendent may develop regulations for implementing this provision. The District reserves the right, in accordance with procedures established by the Superintendent, to circumscribe or disallow the use or administration of any medication on school premises if the threat of abuse or misuse of the medicine may pose a risk of harm to a member or members of the student population. The Governing Board directs the Superintendent to prescribe and enforce regulations and procedures for the emergency administration of naloxone hydrochloride or any other opioid antagonist approved by the United States Food and Drug Administration by an employee of a school district pursuant to Section 36-2267, Administration of opioid antagonist; exemption from civil liability; definition, which, in part states the following:

A. A person may administer an opioid antagonist that is prescribed or dispensed pursuant to section 32-1979 or 36-2266 in accordance with the protocol specified by the physician, nurse practitioner, pharmacist or other health professional to a person who is experiencing an opioid-related overdose.

B. A person who in good faith and without compensation administers an opioid antagonist to a person who is experiencing an opioid-related overdose is not liable for any civil or other damages as the result of any act or omission by the person rendering the care or as the result of any act or failure to act to arrange for further medical treatment or care for the person experiencing the overdose, unless the person while rendering the care acts with gross negligence, willful misconduct or intentional wrongdoing.

C. "Person" includes an employee of a school district or charter school who is acting in the person's official capacity.
