COUNCIL OF MINISTERS REGUALTION TO PROVIDE FOR THE ESTABLISHMENT OF THE

ETHIOPIAN INDUSTRIAL INPUTS DEVELOPMENT ENTERPRISE

This Regulation is issued by the Council of

Ministers pursuant to Article 5 of the Definition of

Powers and Duties of the Executive Organs of the

Federal Democratic Republic of Ethiopia Proclamation

No. 691/2010 and Article 47 (1) (a) of the Public

Enterprises Proclamation No.25/1992.

1. Short Title This Regulation may be cited as the "Ethiopian

Industrial Inputs Development Enterprise

Establishment Council of Ministers Regulation No.

• 328/2014".

2. Establishment

1/ The Ethiopian Industrial Inputs Development

Enterprise (hereinafter the "Enterprise") is

hereby established as a Public Enterprise.

3. Supervising Authority The Ministry of Industry shall be the supervising

authority of the Enterprise.

4. Head Office The Enterprise shall have its head office in Addis

Ababa and may have branches elsewhere in

Ethiopia or in abroad as may be necessary.

5. Purposes The purposes for which the Enterprise is established

are:

1/ to establish, administer and transfLir, whenever

necessary, enterprises which ensure supply of

industrial input;

2/ to supply industrial inputs by manufacturing domestically and abroad;

3/ to supply industrial inputs by purchasing from

the local and international market;

4/ to export industrial inputs which are in excess

of the domestic industry consumption;

5/ to work jointly with enterprises which are

engaged in producing and supplying industrial

inputs and raw materials;

6/ to implement strong supply chain management

to ensure dynamic and efficient industrial inputs delivery;

7/ to work in collaboration with local and international governmental and non-

governmental institutions having similar

objectives;

8/ in line with the directive and policy guidelines

issued by the Ministry of Finance and

Economic Development to sell and pledge

bonds and to negotiate and sign loan

agreements with local and international

financial sources;

9/ to engage in any other related activities

necessary for the attainment of its purposes.

6. Capital

The authorized capital of the Enterprise is Birr

3,900,612,520 (Three Billion Nine Hundred Million

Six Hundred Twelve Thousand Five Hundred

Twenty Birr) of which Birr 1,306,042,415 (One

Billon Three Hundred Six Million Forty Two

Thousand Four Hundred Fifteen Birr) is paid up in

cash and in kind.

7. Liability The Enterprise shall not be liable beyond its total

assets.

8. Duration

The Enterprise is established for indefinite duration.

9. Repealed Regulations The Merchandise Wholesale and Import Trade

Enterprise Establishment Council of Ministers

Regulation No. 103/1992 is hereby repealed.

10. Transfer of Rights and Obligations

The rights and obligations of the Merchandise

Wholesale and Import Trade Enterprise established

under Council of Ministers Regulation No.

103/1992 are hereby transferred to the Enterprise.

11. Transitory Provision Notwithstanding Article 9 of this Regulation the

Enterprise shall continue to engage in the

objectives of the Merchandise Wholesale and

Import Trade Enterprise until the Ethiopian

Trading Enterprise established by the Council of

Ministers Regulation No. 285/2013 properly

engages in its purposes.

12. Effective Date This Regulation shall come into force on the date

of publication in the Federal Negarit Gazette.
