The Public Notice was published in the newspaper November 30, 1977. Persons may comment in writing on the proposed amendment within 30 days from the date of publication.

was informed today that no comments have been received ln response to the Public Notice. There have been no allegations that the discharge is causing appreciable harm to the balanced, indigenous community of shellfish, fish, and wildlife in the James River, and we do not expect comments on the amendment.

The permit amendment is a state action and no section 401 permit is required.

The permittee shall allow the head of the State Water Control Board> the Regional Administrator, and/or their authorized representatives, upon the presentation of credentials:

a. To enter upon the permit tee 9 s ,premises where an effluent source is located or in which any records are required to be kep.t unde.r the terms and conditions 0£ this permit; and

b.. At reasonable times tohave acces~ to and copy any records required to be kept- under the terms and conditions of this permit; to inspect any monitoring equipment or raonitoring method required in this permit; and to sample any discharge of pollutznts. ·

Transfer of Ownership or Control

Tnis permit cannot be transferred o~ assignedi, nor shall a new u;.,ner or successor be authorized to discharge from this facility until the following requirements are met:

a. Tne pero.ittee shall notify the succeeding o~--aer or successor of the existence of t:his permit by a -letter before· ·transfer of the facility, a. copy of which shall be forwarded to the Board and the Regional Administrator.·

Availability of Reoorts

Except for data determined to be confidential under Section 308 of the Act, all reports prepared in accordance with the terns of this permit shall be available for public inspect:ion at the offices of the Board and the Regional Administrator. As required by the Act, effluent data shall not be considered confidential. Comments shall include the name, address, and tefophone number of the writer, and shall contain a complete, concise statement of the factual basis for the comments. Only those comments received within this period wi11 be considered by the Board. The Board may, upon request or upon its own motion, decide to hold a public hearing if it determines that public response is significant.
