There have been no allegations that the discharge is causing appreciable harm to the balanced, indigenous community of shellfish, fish, and wildlife in the James River, and we do not expect comments on the amendment.

The permit amendment is a state action and no section 401 permit is required.

a. The "daily average" discharge means the total ·discharge by weight during a calendar month divided by the number of days in the month L~at the production or con:crrercial facility was operating.
