Medicaid CMI Audit Actions

• SNFs are required to have Compliance Plan including Reimbursement Auditing

• What happens if you find overstated CMI assessments?

– Structural issue with correcting assessments included in CMI collections - No limit to how far back we may go to correct an MDS, but once CMI is final, modifications will not impact scores

– NY providers: We have been in contact with the Bureau of Long Term Care Reimbursement (“BLTCR”) and OMIG to clarify this issue. BLTCR instructed us as follows:

• Follow the Federal MDS correction policy; and

• Send a letter to BLTCR and OMIG identifying particular MDS & error/mistake

• Spring 2013 brought a intensive round of Medicaid audits by the OMIG

– Reports from colleagues indicate the OMIG used a more gentle approach than other audit initiatives presently being conducted

• New audit staff on this first round

• Zimmet anticipates that additional audit efforts will be not be as unforgiving

MICs

What are Medicaid Integrity Contractors (MICs)?

• Private companies that conduct audit-related activities under contract to the Medicaid Integrity Group (MIG), which is charged by the U.S. Department of Health & Human Services with carrying out the Medicaid Integrity Program (MIP).

• There are three primary MICs:– 1) Review MICs analyze Medicaid claims data to

determine whether provider fraud, waste, or abuse has occurred or may have occurred;

– 2) Audit MICs audit provider claims and identify overpayments; and

– 3) Education MICs provide education to providers on payment integrity and quality-of-care

Medicare RACs in NY

• Performance Recovery (aka: Diversified Collection

Services, Inc.)– This RAC is based in Livermore, CA

– Prior audit efforts in SNFs were based on automated claims data analysis

– 2013 brings “complex” review

• Medical records can be requested (ADRs) for both pre- and post-pay review

• RACs are allowed to go back 3 years from date of service

• Website lists SNF psych claims and high intensity RUGs as audit targets

– Beginning May 2013, this RAC will be responsible for all pre-pay Part B therapy services over the $3700 payment limitation

ADR Requests

• In April 2013 a new ADR limitation was set for RAC auditors

• Each limit is based on the provider’s Medicare claims volume from the previous calendar year

• In addition to a limit based on the Medicare claims volume, claim type will also factor into the limit. Recovery Auditors may select up to 75% of any claim type for review

• For SNFs, one additional documentation request represents a beneficiary’s entire episode of care– This includes medical records for all services rendered

from the date of admission to the final date of discharge.

RAC Prepay Review Demonstration

• Allows Medicare Recovery Auditors (RACs) to review claims before they are paid to ensure that the provider complied with all Medicare payment rules. The Ras are conducting prepayment reviews on certain types of claims that historically result in high rates of improper payments. These reviews will focus on seven states with high populations of fraud- and error-prone providers (FL, CA, MI, TX, NY, LA, IL)and four states with high claims volumes of short inpatient hospital stays (PA, OH, NC, MO) for a total of 11 states

• Demo will also help lower the error rate by preventing improper payments rather than the traditional "pay and chase" methods of looking for improper payments after they occur (began 9/1/12)

ZPICs

• Fraud and abuse arm of Medicare program

– Not a simple medical review to validate coverage and payment

– They are looking for reasons to deny claims and pursue fraud allegations

• 2012 saw increase in “on-site” audit visits by ZPIC s (FL, CA, LA, VA) although they are active in all states

ZPICs

• ZPICs stepped up audits activities in 2012, triggered by 2010 OIG report that Medicare overpayments were rampant

• ZPICs have “reason to believe” there are problems in your facility before they arrive at your door or send requests for records

– They know a LOT about you and are not on a random search for improper claims

• ZPICs have focused on Part A claims for therapy services (disproportionate RU RUG %) but no service is outside their authority to investigate

ZPIC Audit Findings

• Currently ZPICs are finding reasons to deny based on technical and clinical reasons which make your claims invalid (pre & post pay):– Incomplete or incorrectly signed and dated

CERTS, ORDERS, PLANS of CARE

– Missing treatment records, progress notes,

– Inadequate PLOF on therapy records (SNF cannot justify need for services)

– Medically unnecessary services or level of service provided

How Do ZPIC Auditors Differ?

• The primary mission of ZPICs is to identify fraud• No random audits• No specification regarding look-back periods• Can make unlimited document requests• Not paid on a contingency fee basis, although they do get

performance bonuses – De facto policy making???

• RACs must identify/correct improper payments, have some limits document requests and are paid on a contingency basis

• MACs educate providers, process and conduct billing, correct behaviors in need of change, prevent future inappropriate billing, and recover payments

ZPIC Power

• Because of their “mission” to uncover fraud, ZPIC findings can result in immediate suspension of payment– Apply error rates on reviewed claims to your

entire claims submission file for recoupment

– Demand overpayments be refunded

– DME providers can lose their Accrediting Organization (AO) certification withdrawn

– Cases may be forwarded to the Department of Justice for resolution• Results in legal action, penalties and possible

incarceration

Fiscal Intermediaries/MACs

• FIs & MACs must continue their contractual commitment to CMS to do medical review to determine if claims are being paid appropriately

• DATA DRIVEN (based on claims already submitted) to determine WHAT will be reviewed– FIs and MACs can set whatever criteria they

believe is valid to run data statistics for targeting facilities and specific claim types

• Carefully review the letter or the online notification to determine:– Who is asking?

– What do they want?

– When and Where must it be submitted?

• Assign staff for responsibility of “How” to comply– Gathering the clinical and financial records

– Organize record to “tell the story” with orders, certs and any other information to demonstrate appropriateness and accuracy of claim

– Make an exact copy of the record to retain at facility

– Consider clinical and/or legal assistance to review documentation prior to submission
