RENTAL INFORMATION(PLEASE REFER TO YOUR RENTAL AGREEMENT FOR ALL TERMS AND CONDITIONS)

RESERVATIONSMost reservations need to be made well in advance. A 20% payment is due at the time the reservation is placed. This is a non-refundableguarantee should you cancel the contract less than 10 days prior to your event.

PAYMENTPayment by personal check is due 10 business days prior to your event. We accept all major credit cards and cash.

RENTAL PERIODRental rates are based on the customer receiving rental items one day prior to the event, the event date, and one-day after the event aslong as the equipment is available for this period. Late returns will result in an extra charge.

CHARGESCustomer is charged for all rental items listed on the contract, whether or not they are used.

DELIVERYWe offer delivery and pick up on all orders at an additional charge. Unless other arrangements have been made, customer must be thereto check in and sign the rental contract. On pick-up we reserve the right to enter your yard to collect our property. Additional fees maybe assessed for staircases or elevators or any area that is not easily accessible. Set up and tear down service is also available at anadditional cost. Please schedule this service ahead of time so that we can allow for the time needed.

LOSS OR DAMAGEYour rental items were carefully counted prior to your receiving them. It is your responsibility to recount them upon receiving them.Please inform of us any discrepancies immediately. Loss or damage will result in a replacement charge.Your rental items will be recounted when returned and you will be notified of any shortages or damage.

LINEN DAMAGEExtra cleaning charges or complete replacement fees will result for damage to linens. This includes but is not limited to wax, ink, stains,glue, burn holes and tears. Please do not use pins, staples or adhesives on linens.

CLEANINGRental items are clean and ready for use when received. A linen bag has been included for your use. Please shake debris from linens andplace in linen bag for return.

Do not place linen in plastic garbage bags!Tableware should be rinsed and placed back in the same container it arrived in.

3. OpERATORS. No operators are {urnished, directly or indirectly with our rentalitems.

4. RECEIPTTNSPECTION OF RENTAL ITEMS. Customer hires the rental items onan "as is" basis. Cuslomer acknowledges that he has. or will, personally inspect the renialilems prior to its leaving Rental Center (regardless of point of delivery) and tinds it suitable for

hrs needs. Customer acknowledges receipt ol all ilems listed in this Bental Agreement andtitat the rental items are in good working order and repair and that he understands (without

turther instructions) its proper opbration and use.

5. WARNING. The use o{ false or fictitious idenlification to obtain the rental items orlhe tailure to relurn the rental items upon the Agreed Return Date o{ this Rental Agreementmay be considered a theft, resuiting in criminal prosecution- Your attention is direcled to

California Penal Code Section 484 and Cali{ornia Penal Code Section 4764 (relating to bad

6. POSSESSIOIiI/TITLE. Customers right 10 possession of the rental items terminates

on the Agreed Return Date indicated on the front of this Rental Agreement. Relenlion oJ

possession after this date constitutes a material breach of the Rental Agreement.

Time is of lhe essence of this Flental Agreemeni. Any extension of this Rental Agreement

must be agreed upon in writing. lltle to the rental items is and shall remain in Benlal Center. lfthe rental items are nol returned and/or levied upon for any reason whatsoever. BenlalCenter may retake said items wilhout further notice or legal process and use whalever forceis reasonably necessary to do so. Cuslomer hereby agrees to indemnily, deJend and hold

llental Center harmless from any and all claims and costs arising from such retaking andlorle\4r- lf rental items are levied upon, Customer shall notify Rental Center immediately.

7. RENTAL Pe RIOD/RATSPAYMENT. Rental period is for a maximum of twenty-four(24) hours unless a longer term is speciried in the Rental Agreement Agreed Beturn Date on

ihe front of this Rental Agreement. Hental charges begin immediately upon delivery of therenial items to the location directed by the Customer or upon rental items leaving Rental

Center, whichever happens {irst. Rental charges end upon return of lhe rental items to Rental

Center in an acceptable condition. No allowance will be made for Saturdays, Sundays,hoiidays, or lime in transit nor lor any period of time the rental items may not be in actual use.{hile in Customer's possession- lf the rental items are returned prior to the end of the miniumi'ental period, ihe rental due shall be {or the entire minimum rental period. Rental Center maylerminate r€ntal at any time and retake the rental items without further notice in case otvlolation by Customer o{ any terms or conditions of this renlalAgreement. Customer agreesio pay any collection costs and atlorneys fees incurred in collection of this account or anydispute arising under this Henlal Agreement. Customer agrees to pay a monthly servicecharge on all unpaid balances. Renlal rates are based upon single shift usage (8 hours per

day, 5 days per week). lf Customer makes grealer use ot the rental items it is agreed that theadditional u$age will be charged.

8. ORDINARY WEAR ANo TEAR. Cuslomer shall be responsible for all damage not

caused from ordinary wear and tear. "Ordinary wear and tead'shall mean only the normal

deterioration of the rental items caused by ordinary reasonable and proper use of the rental

items. Damage which is not "ordinary wear and tea/'includes, but is not limited to; damage

due lo overturning, overloading or exceeding rate capaciiies;

breakage; improper use; abuse; lack of cleaning; dirtying of rental items by paint, mud,plasler, concrele, rosin, or any other material.

L COMPLIANCE wlTH LAt/yS/uSE OF RENTAL ITEUS. Customer agrees not touse or allow anyone to use the rental items {or any illegal purpose or in any illegal manner orin an unsale manner. customer agrees at his sole cosl and expense to comply with allmunicipal, county, state and federal laws, ordinances and regulations which may apply tothe use of the equipment during the rental period. Customer further agrees to pay alllicenses, {ines, fees, permits or taxes arising from his use of the rental items, including any

subsequently determined to be due.

Customer shall nol allow any person who is not qualitied and who has not received and

understands salety and operating inslructions and who does not utilize all safety rental items

required, to operate the rental items or use the rental items. Customer shall not allow anyperson to use or operate the iental items when it is in need ol repair or when it is in anJnsatecondition or situa{ion; modify, misuse, harm or abuse the rental itemsi permit any repairs tothe rental ilems without Renlal Center's prior written permission; or allow a lien to be placed

upon the rental items.

Customer agrees to clean and visually inspect the rental items at least daily and toimmediatelydiscontinue use and notify Rental Center when rental items are found to need

repair or maintenance or is not properly functioning. Cuslomer acknowledges that Flental

Center has no responsibility to inspect the rental items while it is in Customer's possession.

10. RETURN OF RENTAL ITEMS. Cuslomer agrees to return to Rental Center, upon orbefore Rental Agreement Agreed Fleturn Date, the rental items in as good condition as when

received, ordinary wear and tear excepted. Customer shall be liable for all damaged to orloss of lhe rental items occuning because it was not returned during Renlal Cenler's regular

business hours. Customer shall be responsible ror all costs incurred by Rental Centerrecovering and relu,ning damaged rental items to Flenial Center's premises.

11. DISCLAIMEB OF WARRANTIES. Rental Cenler makes no warranty ofmerchantability or fitness for any particular use or purpose, eilher express or implied. Thereis no warranty or representation thal the rental items are fit for Cuslomer's particular intended

use, or that it is free of latent defects. Rental Center shall not be responsible to Cuslomer orany third party for any loss, damage or injury resulting lrom. or in any way attributable to theoperation ot, use ot, or any failure of the rental items. Rental Center shall nol be responsible

for any delect or tailure unknown to the Rental Center. Customers sole remedy for any iailureof or delect in the renial items shall be termination of the rental charges at the time ol {ailureprovided that Customer notities Rental Center immediately of such failure and returns therental items to Rental Center within tyventy{our (24) hours of such failure.

12. PUBCHASE ORDERS. The use ol Customer's purchase order number on thisRentalAgreement is for Customer's convenience and identification only.

13. SUBLETTINGAOCATION OF RENTAL ITEMS. Customer agrees not to sublet,

loan or assign lhe rental items. Customer shall not move the rental items lrom the address atwhich Customer represented it was to be used.

14. DEFAULT, Should Customer in any way tail to observe or comply with any provision

of this Rental Agreement, Bental Center may, at ils sole opiion, termjnate lhis Rental

Ag!'eement, retake the renlal items, declare any charges due and payable and initiate legalprocess to recover monies owed, and/or pursue any other legal rights and remediesavailable to Rental Center. Exercise ot any remedy available to Rental Center shall notconstitute an election ot remedies or a waiver of any additional remedies to which Rental

Center may be entitled.

15. RETAKING OF RENTAL ITEMS. lt tor any reason ii becomes necessary for Rental

Center to retake the rental items, Cuslomer authorizes Rental Center to retake the rental

items withoul further notice or turther legal process and agrees lhat Renlal Center shall not

be iiable lor any claims foriamage or irespass arising out of the removal of the rental items.

16. LEGAL FEES. ln the event an attorney is retairied to birlorce any provision of thisRental Agreement. lhe prevailing party in the dispute shall be entitled to recover reasonable

attorney's fees and court c-osts in such action, or proceeding, in an amount to be determined

by the court.

17. NOTICE OF NON-WAIVER/SEVERABILITY. Any failure of Rental Cenler to insist

upon sticl performance by Cuslomer as regards any provision ol this Rental Agreementshall not be interpreted as a waiver or Rental Cenlerb rights to demand strict compliance

wilh all other provisions of this Rental Agreement against Customer or any other person. Theprovisions ot this RentalAgreement shall be severable so that lhe unenforceability, invalidity

or waiver of any provision shall not effect any other provision.
