People with mobility impairment

1. DEFINITIONS

Disabled people

Although the special protection system of the disabled people was settled in the Constitution, there was no

definition there for "disabled people".

The first definition of disabled people was presented in Law 53/1992 (art.1,par.1). This definition suffered some

alterations in 1999 (Ordinance 102/1999 art.1 par.1) and in Law 519/2002 there is the following definition:

"The disabled people are those people for which the social environment, un-adapted to their physical, sensorial,

psychic or mental deficiencies, prevents them totally or limits their equal chance to access the social life, according

to their age, gender, material, social and cultural factors, being in need of special protection measures to support

their social and professional integration".

The socio-medical criteria for establishing the categories of disabled people (adults) are stated in the Disposition of

the Health and Family Minister nor. 726/1 October 2002.

These categories are:

I. People with congenital , neonatal disabilities, from childhood or as a teenager

1. People with mobility disabilities

- with posture disorder and/or gesture disorder of high or grave intensity, needing prosthesis, orthopedic means,

special movement means, also dwelling and workplace adaptation or the reorganization of the production process

in order to facilitate their integration into the social life.

Oste-articulation disorders – accentuated or grave depending on intensity and autoserving capabilities

Muscle disorders

Colagenosys - accentuated or grave depending on intensity and autoserving capabilities

2. People with somatic disabilities (physical, visceral or system)

- Chronic disease of skin

- Cardio-vascular disease - accentuated or grave depending on intensity and autoserving capabilities

- Renal disease

- Blood disease

- HIV and other similar

- Metabolic chronic diseases

- Endocrine diseases

3. People with hearing disabilities - accentuated hearing disability

(who have major difficulties of communication; related also to neurological disorders)

4. People with sight disability – accentuated disability, grave disability with loss of spatial orientation

5. People with mental and psychic disability

(no development or regression or psychic deficiencies; neuropsychic diseases with high or grave intensity, which

impose special protection measures)

- accentuated or grave disability depending on the disorder intensity, on the need of supervision.

6. People with neuro-motive disability, with posture and gesture disorder of accentuated or grave intensity,

imposing protective measures depending on the disease

- accentuated or grave depending on the intensity of disorder regarding standing, walking, equilibrium, gesture,

secondary psychic effects, capacity of autoserving, need of care.

II. People with disability, disregarding age, status and date of becoming disabled

1. People with mobility impairment and neuro-motive disability, with accentuated or grave difficulties to

stand, walk or gesture

- Mobility disorders – accentuated or grave depending on intensity and autoserving capabilities

- Rheumatic disorders - accentuated or grave depending on the intensity of disorder regarding standing, walking,

gesture, visual, capacity of autoserving, need of care.

- Colagenosys - accentuated or grave depending on the intensity of disorder regarding nutrition, gesture, breathing

and renal

- Neurological disorders – grave disability

2. People with somatic disability (physic, visceral or systemic)

(disabled after adolescence, during professional activity and life, with accentuated or grave deficiencies)

- Renal diseases - accentuated or grave depending on the intensity of disorder

- After kidney transplant – grave in the first 12 months

- After heart transplant – after 6-12 months

- After liver transplant – accentuated or grave depending on the intensity of functional and nutrition disorder

- Cancer

- Nutrition disorders

- SIDA or similar – accentuated or grave

Disability grades

The disability grades relate to the intensity of the individual functional deficit and by correlation with the psycho-

social functioning according to the age.

It must be taken into account that it is not the disease that determines the disability grade, but the intensity of the

functional disorder caused by the disease, together with the evolution, effects to the social activity and personal

factors.

The disability grades are: grave, accentuated, medium and easy.

Other specifications:

1. People with easy and medium disability don't have access to the facilities provided by the law. Medical expertise

commissions for disabled people give certificates for registering within a certain category of disability.

2. People with medium disability have access, if conditions are met, to retirement on "age limit" according to Law

19/2000 regarding the public system of pension and other social insurance rights.

3. The evaluation of the disability severity concerns only the functional disorders generated by the disability and its

direct consequences.

4. Regarding people with multiple disabilities, registering within a category will take into consideration the

dominant disability.

5. Regarding people with disability and other disorders it will be taken into account only the disability.

6. The people with disability acquired before working (before paying insurance as employee) can retire on "age

limit" at request, depending on the disability level.

a) 15 years less for retirement if they accomplished at least 1/3 of paying period for those with grave

disability

b) 10 years less for retirement if they accomplished at least 2/3 of paying period for those with

accentuated disability.

c) 10 years less for retirement if they accomplished the full paying period for those with medium disability.

Insured people with sight disability (blind) can retire earlier if they accomplished 1/3 of paying period.

The retirement is approved by the Territorial Pension House on the basis of the level of disability registered by the

medical expertise commissions.

Mobility impaired

Mobility impaired people are those people with posture disorder and/or gesture disorder of high or grave intensity,

needing prosthesis, orthopedic means, special movement means, also dwelling and workplace adaptation or the

reorganization of the production process in order to facilitate their integration into the social life.

The data presented in this chapter is reported by the National Authority for Disabled People.

The data is for the last quarter of 2002 (31.12.2002).

Public utility buildings

1. DEFINITION

We couldn't find any definition of the "public building". The study of the documents revealed that the public

building represents all civil buildings not being buildings dedicated to live in.

The main legal resource regarding the public utility buildings and regulations for disabled people is the 'Normative

for adapting civil buildings and its urban space to the needs of disabled people'.

This paper settles the minimum quality conditions according to the needs of users (disabled people) from the civil

buildings (living buildings and public buildings) according to the Law 10/1995 (Law of quality in constructions).

The minimum quality conditions settled by this normative must be accomplished and maintained at the same

parameters during the entire existence of building.

The categories of users whose needs are considered in this material are:

a) people with mobility impairment and mechanics deficiencies of members

with walking difficulties (people who cannot move without help and cannot cross big level differences).

in the wheelchair (people with relative movement autonomy).

with moving the arms difficulties (people who hardly use their superior members, having a limited action range)

b) people with deficiencies of ocular system

week sight (people with a limited sight and/or who perceive only high contrasts or contours)

without sight, blind people (people depending only on acoustic or tactile information-Braille system)

c) people with hearing deficiencies

with weak hearing (people depending on hearing devices, optical equipments and collective hearing devices).

2. TYPES OF PUBLIC BUILDINGS

The Romanian Normative NP 051-2000 refers to public buildings in terms of:

Building accessibility issues

An important role in the process of making chances equal for all is played by the creating of accessibilities in the

physical environment.

This process supposes removal of the barriers which stop free movement in the environment and presumes

creation of accessibilities to the following society areas like: living spaces, public institutions, public transportation,

streets etc.

According to the article 11 par 1 from Urgent Ordinance no 102/1999 the public institution buildings, as well as the

cultural, sportive or entertainment buildings, the buildings built from public funds, public transportation, public

phones as well as the access routes will be made accessible to the disabled people.

All the work to make buildings accessible will be carried out in stages, and the costs will be paid by the ministries,

central public administrative authorities and local public administration authorities.

According to the Urgent Ordinance no 102/1999 the stages will be the following:

- until 31 December 2003 all public institution buildings , cultural and sportive buildings , entertainment buildings,

shops and restaurants buildings , offices of service providers as well as the access routs will be made accessible for

the disabled people.

- until 31 December 2002 all public phones will be changed according to the requirements of the 'Normative for

adapting civil buildings and its urban space to the needs of disabled people' (see following tables).

- until 31 December 2003 all the parking spaces will be arranged, reserved and signaled using international signs;

minimum 4% of the total parking spaces but not less than 2 places will be reserved for disabled people's

transportation; during 180 days from the Urgent Ordinance 102/1999 all parking spaces of public institutions will

be arranged as well according to the previous requirements.

- until 31 December 2010 all public transportation stations will be transformed to meet the requirements of

accessibility for disabled people.

- until 31 December 2005 the local public administrative authorities have the obligation to install audio-video

signaling systems for disabled people at the pedestrian road-crossing, as well as panels in the public transportation

vehicles and on public roads.

- starting with1 January 2004 all enterprises doing urban or inter-urban public transportation must acquire special

adapted transportation vehicles in order to allow access of disabled people.

- until 31 December 2010 all active public transportation vehicles will be adapted to allow access for disabled

people; during 2 years since the Urgent Ordinance 102/1999 all producers of public transportation vehicles must

start producing public transportation vehicles adapted to allow access for disabled people.

Other dispositions regarding accessibilities:

- it is forbidden parking other vehicles on the special places signaled using the international sign for disabled

people

- until 31 December 2001 at least 4% of the living spaces built using state budget funds will be designed according

to the 'Normative for adapting civil buildings and its urban space to the needs of disabled people'.

- the 'mimic and gesture' language and the specific language of people with hearing disabilities are officially

recognized starting with the Law 519/2002.

- the public institutions will provide, when necessary, authorized interprets of 'mimic-gesture' language and special

language of people with hearing disabilities for relating with people with hearing disabilities.

2. PROBLEMS AND BUILDING SPECIFICATION SET FOR THEIR REMOVAL

The Romanian legislation regarding disabled people is currently pretty adjusted to the needs of people having

difficulties when accessing private or public spaces and buildings.

The 'Normative for adapting civil buildings and its urban space to the needs of disabled people' applies to design

new living buildings, public buildings and their urban space, according to the current legislation and it has

recommendation value in case of modernization, redesign, consolidation or repairing of existing buildings.

The normative will be taken into account by people who design technical projects regarding civil buildings, by the

territorial or central administrative institutions, including other individuals or companies who initiate investments in

the building activity, as well as by the experts.

Depending on the importance of the investment to be design, there will be adopted parameter values at the level

imposed but not at lower values than specified in the current normative.

When modernizing, redesigning, consolidating or repairing existing buildings, if the normative specifications can't

be respected, there will be adopted compensatory protection measures.

1. Access, circulation

a) in the crowded rooms (conferences, theatres, cinema halls, sportive buildings) there will be a separate building for disabled people

b) in front of the access door there will be a free space of min 1.50 x 1.50 m

c) the distribution areas for many vertical and/or horizontal circulations will have:

• surface - min 6.00 m2

d) in front of the circulating routes there will be a maneuver space of min 1.50 x 1.50 m

2. Sanitary spaces

a) all public buildings will have in each sanitary space for public minimum a WC cabin (with international sign) adapted to the needs of disabled people in wheelchair, equipped with flush toilet, washbasin, mirror, accessories, horizontal and vertical grips.

b) in front of the WC cabin there will be a maneuver space of min 1.50 x 1.50 m.

c) the width of circulation space in the cabin will be of min 0.90 m.

d) heights and distances to install sanitary objects:

• flush toilet - height = 0.48 m – 0.53 m

• flushing lever - height = 1.20 m, distance 0.12 m lateral from flush toilet

• vertical grip - distance = 0.30 m - 0.35 m away from the flush toilet

5. Swimming pools

a) where there are more than one basin, at least one must be accessible to old people and disabled people

b) the pool will have the depth adapted to the needs of disabled people

c) the pool's margins will have rounded corners

d) the access to the pool will be made accessible using non-movable ramps (max 5% inclination)

e) the access to the pool will be made accessible by using:

• autonomous chair, mounted on an electric device or/and

f) the pool will have a horizontal grip (hand-rail) of Φ 4-5 cm

g) the 'grill' around the pool must have holes of max 1.5 cm

h) there will be provided audio-video signaling systems

6. Elevated stalls (sportive halls, show arenas, reunions etc)

a) the access to the places provided for people with mobility impairments must be an easy one, using a continuous route horizontally or using ramps of max 8% inclination (recommended 5%).

b) the circulation will be supervised using visual and audio signaling (and/or by Braille system)

c) the circulation routes for blind people (width of min 0.90 m) will be marked differently from the rest of the floor using different structure, color and sound of floor coverings.

d) along the ramps there will be provided horizontal spaces for rest and maneuver (1.50 x 1.50 m) at max 6.00 m (respectively 10.00 m) distance

e) direction changes will be provided with horizontal platforms of 1.80 x 1.80 m.

f) the circulation routes will have double hand-rails at height=0.90 m and height=0.60 m.

g) the places provided for disabled people will be of min 2 places (1 place for every 50 people).

h) dimensions and placement of places for disabled people:

• fixed places for semi-ambulant (people with partial mobility impairment, capable of moving without wheelchair). These places must have the height of 0.48-0.53 m (with arm resting bars). The placement should be at the end of rows or behind them on a horizontal surface (recommended position in order not to affect other people's view – these chairs are normally taller than others)

• places for wheel-chairs – a horizontal platform of 1.10 x 1.40 m (min 0.90 x 1.40 m) with a free area in front or behind of 1.00 m (min 0.90 m) for maneuver. The placement should be at the end of rows if the inclination < 5% or behind or in front of rows if the inclination > 5%.

i) the number of reserved places will be divisible by 2 (including the people taking care of the disabled one).

j) the existent buildings will provide (according to different situations) the places for disabled people by replacing other places.

7. Buildings in tourism (hotels, motels, restaurants)

7.1 Rooms

a) the width of the room will be of min 3.00 m

b) there will be provided a min width of the circulation route of 0.90 m

c) the space between the bed and the short wall of the room will be of 1.20 m

d) there will be provided space for a complete rotation of the wheel-chair in every room of min 1.50 x 1.50 m

e) the dimensions of the closets will be of:

• width – 0.30 m – frontal access – wheel-chair

• for every 50 rooms there will be provided at least 1 adapted room

7.2. Bathroom

a) the bathroom will be accessible directly from the bedroom and from the lobby

b) the door will be sliding-type or with exterior opening

c) the height for sanitary objects to be installed:

• shower basin – 0.80 x 0.80 m

• free space for maneuver along the shower basin – 0.80 x 1.35 m

• shower – height = max 1.40 m, at 0.30 m from the wall

• shower lever – height = max 1.10 m

• shower chair – height = 0.48 – 0.53 m

• horizontal grip – height = 0.90 m

• bathtub – height – 0.50 m

• free space along the bathtub – width = 0.80 m

• mobile chair for the bathtub – height = 0.50 m

7.3. Eating room (restaurant)

a) there will be provided an easy access for disabled people, without effort and with safety measures

c) there will be provided a min free rotation (maneuver) space of 1.50 x 1.50 m (at the entrance and at the main circulation routes)

d) there will be provided the min needed space for the wheel-chair (circulation and maneuver at the table) of 0.80 x 1.35 m.

8. Educational buildings

8.1. Common spaces (lobby, circulation routes, sanitary rooms)

a) the width of the staircases/ramps will be:

• for one circulation flow: 0.90 n

• for two circulation flows: 1.10 m

• for three circulation flows: 1.60 m

• for 4 circulation flows: 2.10 m

• for 5 circulation flows: 2.50 m

b) the hand-rail will be placed at:

• height = 0.90 – 1.00 – adults that can move by themselves

• height = 0.60 – 0.75 – children and people in wheel-chair

c) the doors will have a width of:

• min 0.95 m – exterior doors

• min 0.85 m – interior doors (for rooms < 30 mp) but

o min 0.95 m – for rooms <= 100 people

o min 1.40 (0.80-0.60) – for rooms > 100 people

d) the door lever will be placed at 0.75 m height

e) the corridors will have a width of 0.90 – 1.00 m

f) every sanitary room will have a cabin adapted for disabled people

g) the electric equipment will be placed like:

• switches – height=1.00 m

• outlets – height = 0.40 – 1.00 m

h) in the educational buildings (schools) without elevators, the classrooms being attended by disabled children will be placed at the ground floor.

8.2. Classrooms, amphitheatres

a) there will be provided an easy access for disabled people, without effort and with safety measures

b) the space provided for the wheel-chairs must have the following dimensions:

• at the end of the row, near the major circulation in the classroom/amphitheatre, across the circulation route through the rows – inclination of 0-5%

o for frontal access: 1.00 x 1.50 m

o for lateral access: 1.00 x 2.00 m

• in front or behind the rows for inclination > 5%

o horizontal space: 1.00 x 1.50 m

c) the furniture for semi-ambulant mobility disabled people:

• 1 place for every 50 students but

o minimum 2 places

e) the educational buildings will have adequate furniture and equipment for every category of disabled people (chairs, tables, typing machines, stereos, Braille materials etc).

8.3. Libraries

a) the circulation will be organized in order to provide easy movement for disabled people in wheel-chairs, in every direction, without effort and with safety measures; also there will be provided a minimum maneuver space of 1.50 x 1.50 m

b) the furniture will be placed like:

• information bureau – height = 0.80 m

• fixed shelves for books:

o frontal access – height = 0.70 – 1.30 m

o lateral access – height = 0.40 – 1.40 m

• mobile shelves for books at a height of 0.40 – 1.40 m

• study tables – height = 0.80 m

c) the space needed for a wheel-chair at tables will be of min 0.80 x 1.35 m.

9. Commercial spaces with auto-servicing

a) the access and circulation must be carried out using safety measures, providing maneuver spaces in each room of min 1.50 x 1.50 m

b) the space of crossing in front of the cash registers will have a width of 0.90 – 1.00 m

c) the dimensions of the specific furniture will be:

• shelves for products: height = 0.40 – 1.40 m

• shelves for trays (sliding): height = 0.80 m, width = 0.60 m

The National Authority for Disabled People has a few units functioning under its direct coordination. These are the

National Institute for Prevention and Against Social Exclusion of Disabled People and the Regional Departments of

the National Authority for Disabled People.

Conclusions and recommendations (national context)

Urban built environment poses many difficulties to mobility impaired people when coming to access different types

of services needed. One said that only disabled people know their problems. We came to think this is true. The

accessibility of buildings for disabled people must be viewed as a complex problem, with implications both on the

disabled people's side and on the environment on the other side. It would be simple to take into account only the

buildings – go enlarge the corridors, build some ramps, make the door frame larger etc. It must be considered also

the route to the building – which architectural elements allow or forbid the access TO the building. And more, is

the disabled person capable of going out – in terms of equipment (wheel-chair, balconies, special adapted car etc)?

This project isn't focused on the life conditions of disabled people. But when considering accessibility to buildings

someone must consider also the living standard of disabled people. In Romania, wheel-chair can be very expensive

for a person unable to work and receiving only the social aid. So, making buildings more accessible will not help a

lot people who can't go out of their home. Also, special adapted cars with people with mobility impairment are very

expensive, even for people without disabilities so the parking spaces don't help disabled a lot. We don't want to

presume that people with disabilities earn less money than others. This issue will be clarified in the later stages of

this project. But the first grasp on the situation indicates that disabled people are disadvantaged in terms of

income.

Back to the accessibility of building for disabled people.

First, there is the legislation level. The meetings with the representatives of National Authority of Disabled People

and the materials gathered showed an extensive concern of the legislative bodies for the issues regarding disabled

people. The latest book published by the State Secretary Constantin Stoenescu from the State Secretary for

Disabled People* stands for an complete study of the current legislative situation, including the description of the

special protection system for disabled people, disabled people's right, accessibilities, special protection institutions

and an exhaustive list of applicable legislative acts regarding disabled people.

Then there is the law enforcement level. Here things aren't so clear. For example the laws about the social aid

provided for the disabled people is applied well, having good results (as shown in the table 2.3. About the laws

that regard establishment and functioning structure of the governmental institutions dealing with disabled people

things are also going well. Institutions exist and function, providing disabled people with the needed counselling

and help in various situations. About the buildings and their accessibility for the disabled people there is more to

say. Technical specifications do exist. They are enforced in the laws. But there is a gap between the requirements

and the results. Go visit Bucharest or any other city in Romania and you will notice the lack of ramps at entrances,

to say at least. There are no small ramps when crossing a road, for people in wheelchairs.

But there are parking spaces for disabled people. Almost in every parking space. And other cars are parked in

those places, not disabled people's car. What about audio and visual signs at crossings? They do exist in one or

two places in Bucharest. This is not enough. Of course these brief conclusions are drawn from little experience.

More extensive conclusions will arise after the following stages of the project. If reading the chapter regarding

Buildings accessibilities issues someone will notice that the final date for making all public buildings accessible for

disabled people is 31 December 2003. But the rhythm of buildings becoming accessible isn't visible. We hope that

this final date will mark the beginning of better days for disabled people, specially for the mobility impaired ones.
