The Department of Media and Audiovision of the Ministry of Culture submits the AnnualReport on Czech Cinematography with small modifications: considering the purpose the Report isto serve, the commentaries and evaluating communications have been deleted, and both the professional and general publics are presented more facts, statistics and overviews, as well as references to some websites. From the practical perspective, the brochure format has been changed.The information sources were the Czech Film Centre, National Film Archive, MEDIA Desk CZ,European Audiovisual Observatory, Union of Film Distributors, Czech Anti-Piracy Union andSeparate Department of Administration of State Funds of the Ministry of Culture.

The Department of Media and Audiovision of the Ministry of Culture appreciates any and allcomments on and new information for the 2007 Report.

INTRODUCTION

In the middle of 2006 after the veto of the President of the Czech Republic, the Chamber ofDeputies definitely rejected the governmental draft amendment to Act No. 241/1992 Coll., on theState Fund of the Czech Republic for Support and Development of the Czech Cinematography(hereinafter referred to as “Fund”), which amendment was particularly to strengthen the Fundresources. At the International Film Festival in Karlovy Vary, the representatives of political parties and Prime Minister promised to provide an extraordinary contribution of the state to the Fund.Following the discussions with the political representatives, a Working Group was establishedat the Ministry of Culture of the Czech Republic, aimed at formulating theses to describe the filmcommunity's expectations of an optimum shape of the state support, institutional assurance andoverall legal framework in the cinematography area, on the basis of which it would consequentlybe possible to draft a new cinematography law. The law should address all the areas of filmmaking, film production, film institutions and film education. On 14 November 2006, the FilmCouncil was established to associate 17 professional associations, 9 film festivals and 5 film institutions and schools. It aims at co-ordinating the preparation of the cinematography law andinforming its members on progress of such work.

In 2006, an amendment to Act No. 273/1993 Coll., on certain conditions of the production,dissemination and archiving of audiovisual works, was adopted. Commencing 1 January 2007, theamendment also imposes, among others, an obligation upon producers and distributors to forwardFile Sheets to the Ministry of Culture of the Czech Republic, which will maintain, apart from thedatabase of businesses engaged in the audiovision, also files of audiovisual works.

STATE SUPPORT FOR CINEMATOGRAPHY

The cinematography area is regulated by Act No. 241/1992 Coll., on the State Fund of the Czech Republic for Support and Development of the Czech Cinematography, and Act No. 273/1993Sb., on certain conditions of production, dissemination and archiving of audiovisualworks, on modifications and amendments to certain laws and some other regulations, as lateramended.

In the financial support area, the state support is realised through the State Fund of the CzechRepublic for Support and Development of the Czech Cinematography and selection procedure forsubsidy from the Ministry of Culture. In both the cases, individual subsidy areas are announcedevery year. Projects are assessed and potential supports are recommended by a panel of independentexperts.

In 2006, the total financial support from the state budget in the area of medias and audiovisionreached the amount of 91,616,590 CZK.

The state covers the membership fees in European organisations, such as Eurimages, European Audiovisual Observatory and MEDIA Programme.

In 2006, the members of the Subsidy Selection Commission of the Department of Media andAudiovision of the Ministry of Culture were as follows: MgA. Petr Bok, Mgr. STATE FUND OF THE CZECH REPUBLIC FOR SUPPORT ANDDEVELOPMENT OF THE CZECH CINEMATOGRAPHY

The State Fund of the Czech Republic for Support and Development of the Czech Cinema-tography (hereinafter referred to as the “Fund”) is a tool of the public support of film making (screenplay writing, film production and distribution) and technical development and modernisationof cinemas. The Fund also participates in co-financing cinematography promotion projects, e.g. festivals, meetings, showcases abroad etc.

The Fund was established pursuant to Act No. 241/1992 Coll., and is headed by the Ministerof Culture. The body deciding on the method and amount of financial means drawn for individualprojects is the Fund Board. At its meetings, the Fund Board complies with the Fund Act, Statuteand Rules of Procedure. The Fund Board is elected by the Chamber of Deputies on the motion ofthe Minister of Culture, and has 13 members at the most, elected for three-year term of office. In 2006, the Fund Board members were as follows: Tomáš Baldýnský - Board member, Katarína Bartošová-Benčičová, Mgr. Helena Bendová, MgA. Jiří Blažek, Mgr. Jana Dudková,Doc. MgA. Alois Fišárek, Josef Hanuš, Boris Masník academic painter, Prof. Ing. Jan Šuster - FundBoard Vice-Chairman (in the course of the year, he resigned from this position), PhDr. Miroslav Zelinský, CSc. The main financial resources of the Fund are revenues from commercial utilisationof the films to which the Fund exercises producer's copyrights (i.e. films produced in the Film Studio Barrandov and Film Studio Gottwaldov or Zlín and put into distribution in the period between 1 January 1965 and 31 December 1991) and levies on surcharge to the cinema admission fee.

In 2006, 172 applications for financial support in a total amount of 384,132,000 CZK (25th and 26th deadlines of applications) were filed. The Fund Board has decided to provide supports to 86 projects in a total amount of 112,114,000 CZK (24th and 25th deadline). Under Resolution No. 73, adopted by the Government of the Czech Republic on 17 January 1996,the Fund is an authority competent to handle Applications for Co-Production Statute under the European Convention on Cinematographic Co-Production, which was announced under No. 26/2000 Coll. In 2006, the Preliminary Co-Production Statute was awarded to 12 projects andafter work completion, the Definite Co-Production Statute was awarded to 3 projects.

INTERNATIONAL ORGANISATIONS

European Audiovisual Observatory

The European Audiovisual Observatory (EAO), having its registered office in Strasbourg, wasestablished in 1992 on the common initiative of the European Union countries. The EAO missionis to gather information on the European audiovisual industry, provide such information to expertsin the audiovision area and thus to contribute to a greater transparency of this sector in Europe.

The EAO monitors all the areas of the audiovisual industry, i.e. film, television,video/DVD and new media. With respect to each of these areas, it provides information on marketsand statistics, legislation and financing of audiovisual work production. It monitors and analyses theaudiovisual sector evolution in the member states.

The EAO associates 36 European countries, including the European Commission. It is financedby direct contributions of the member states and revenues from sales of its products and services.The Czech Republic became the EAO member in 1994. Within the membership fee, which is paidby the Ministry of Culture of the Czech Republic every year and which amounted to 13,893 € in2006, the Czech professionals have available legal regulations of the European countries and directives of the Council of Europe, periodical and non-periodical expert press in three languagemutations, regularly published Stastical Yearbook, IRIS monthly and its supplements.

Received information is also provided by the EAO to other co-operating European institutionswhich deal with issues of the audiovisual industry, EU MEDIA Programme and EURIMAGESFund.

Eurimages

The Eurimages International Fund was established to provide financial supports to film co-productions realised in European countries, their distribution and cinema networks presentingsuch films. The supports are designed for feature, documentary and animated film projects withthe minimum length of 70 minutes to be distributed in cinemas, to distributors presenting filmswith the Eurimages participation, and in the cinemas included in the Europe Cinemas network. At least 2 member states of the Fund must participate in any such co-production. Eurimages alsosupports (i) the distribution of European films beyond the borders of the country where the filmhas been produced, and (ii) cinemas. However, the supports for the distribution and cinemas onlyconcern the states which are not members of the MEDIA Programme, (and therefore, this part ofthe Eurimages Fund supports was only open to the Czech Republic until the end of 2002).

In 2006, the Fund had 32 members, the Czech Republic has been its member since 1994 andis represented by a national coordinator therein. The membership fee of the Czech Republic to theFund amounted to 194,042 € in 2006.

In 2006, the Eurimages Fund supported two projects with Czech participation: feature film,titled Oko (Eye), directed by Miloš Kohout and being made in Czech-Slovak co-production ofMagic Films (CZ) and Alef Film&Media Group (SK), and the first Czech-Irish- Slovak co-production - film, titled Lištičky (Foxes) and directed by Mira Forney. The film producer isPetr Oukropec, Negativ s.r.o. company.

MEDIA

The MEDIA Programme ranks among the support programmes of the European Union. It wasformed in 1991 and aims at increasing the competitiveness and circulation of European works inthe international audiovisual market. The Programme support is designed for independent European companies in the audiovision area. It is implemented through direct financing of the development of audiovisual works and financial supports for companies and organisations engaged in the dissemination of such works - film distributors, festivals, markets and cinemas.Financial support, which may only be applied for based on regularly announced calls for application submissions, can be obtained by any company or organisation whose project meets thecriteria set for granting any such support.

The Czech Republic joined the MEDIA Programme on 30 July 2002. The membership fee ofthe Czech Republic to the MEDIA Programme has been covered from the state budget since 2004as a part of the total membership contribution of the Czech Republic to the European Union. The Czech Republic has two representatives, delegated by the Ministry of Culture, in the SteeringCommittee of the MEDIA Programme.

At the national level, the contact between the MEDIA Programme and audiovisual professionalsis ensured by MEDIA Desk Czech Republic office, which is operated by Česká filmová komora,o. p. s. (Czech Film Chamber) pursuant to an agreement with the Ministry of Culture and European Commission. The office running is jointly financed by the Ministry of Culture and European Commission.

NATIONAL FILM ARCHIVE

The National Film Archive (NFA) is an allowance organisation of the Ministry of Culture. The NFA aims to gather, protect, make accessible, scientifically process and utilise audiovisualarchival documents on the national film production, film art origination and development, life ofthe Czech nation and significant world events.

From the film archiving standpoint, the NFA ranks among the ten oldest film archives in theworld (founded in 1943) and is the third film archive with the greatest increases of film materials.It has managed to save and preserve the greatest part of the national film heritage, more specifically, more than 60% of silent movies and 99% of sound feature recordings, which does nothave any analogy in the world.

As per the Foundation Deed, its core activities are as follows:

a) collecting, protecting, processing scientifically and utilising audiovisual (film andvideo) materials and written archival materials;

b) collecting and processing scientifically the heritage of significant personalities of theCzech cinematography;

c) creating the collection of current documentations related to the production and dissemination of audiovisual archival materials and making it accessible;

d) administering a special library; e) carrying out scientific research in the areas of film and film archiving; f) co-operating with domestic and foreign institutions in creating and disseminating

the film culture, selling and lending audiovisual materials;g) co-operating with member archives of FIAF (Fédération des archives du film);h) co-operating with the Czech Federation of Film Clubs; i) carrying out publishing activities in the film culture area, selling periodical press;j) making documentary film recordings. . The National Film Archive also runs the Ponrepo Cinema, viewing room, which is located in

BIO KONVIKT, a historically valuable refectory of the Convict, reconstructed in the 1990s.Admission is reserved for the Ponrepo Club members, and the annual membership card can bereceived in the cinema box-office. Selected performances are also accessible without any mem-bership card.

The National Film Archive exercises rights of the producer of Czech audiovisual works putinto distribution between 1 January 1950 and 31 December 1964. The NFA is headed by theDirector who manages the organisation's activities as the sole responsible manager, acts on behalfof the NFA with respect to all matters and as such, he is a statutory body. The Director is appointed and removed by the Minister of Culture of the Czech Republic.

In 2006, the costs for main activities amounted to 65,647,000 CZK, and the state contributionin the amount of 29,349,000 CZK represented 44.70% of costs.

CZECH FILM CENTRE

The Czech Film Centre was founded by the Association of Producers in Audiovision (APA).Its office was opened in September 2002 and its main aim is to make visible and systematicallypromote Czech films abroad. From 2002, the Czech Film Centre's activities were financed fromthe APA resources, through the grant of the State Fund of the Czech Republic for Support andDevelopment of the Czech Cinematography and selection procedure for subsidy of the Departmentof Media and Audiovision of the Ministry of Culture. In the same year, the Czech Film Centrebecame a member of the European Film Promotion, an international organisation. On 1 January 2004,the Czech Film Centre was transferred to Česká filmová komora o.p.s. (Czech Film Chamber), anallowance organisation. Since 2006, the Czech Film Centre has been financed from the financialresources of the Ministry of Culture and sponsors.

Its activities are structured in two directions: FILM PROMOTION, ensuring the promotion ofCzech films, and CZECH FILM COMMISSION, focused on services to the foreign production.

The FILM PROMOTION co-operates with significant European festivals and markets, such asBerlinale and Cannes. It publishes a number of information materials, regular bilingual Catalogueof Czech Films, DVDs with film trailers and interviews with film makers, and there are also publications on feature and documentary films in progress. It regularly publishes its newsletter inEnglish. Its website contains information on Czech films of the last years and other up-to-date activities of the Centre, e.g. seminars and presentations of Czech films abroad. Within the FINALPlzeň film festival, the FILM PROMOTION presents feature films in progress every year, wherethe film projects are introduced to both Czech and foreign film professionals. In 2005, the CzechFilm Centre, Documentary Film Festival and International Documentary Film Festival Jihlavadecided to present documentary films separately in order to ensure a peculiar room which suchfilms deserve. The presentation of documentary films in progress takes place in Prague in September.

The establishment of the CZECH FILM COMMISSION in January 2004 arose from an increasing demand for the source of information for foreign film makers, as well as from the needto solve issues concerning the Czech Republic as the place where films are being shot for the foreign production. The CZECH FILM COMMISSION creates centralised networks of contactsand information on all aspects of the film production in the Czech Republic. In 2005, it publishedits Production Guide with information on the film industry, film shooting locations and conditionsin the Czech Republic. The CZECH FILM COMMISSION aims at connecting the Czech film professionals with foreign producers and film makers, presenting high quality of the infrastructu-re and services, offered by the Czech film industry, providing relevant information on productionservices, facilities and conditions of the film production in the Czech Republic, presenting uniquelocations in the Czech Republic and communicating with the governmental and self-governmentalinstitutions and informing them on the evolution and potential needs of the film sector.

BASIC DATA ON FILM MARKET IN 1989 - 2006

VIDEO-DISTRIBUTION AND PIRACY

In the course of 2006, the digital technology of DVD videos took control over the Czech marketof film carriers in so far that an absolute majority of companies stopped distributing new films on analogue VHS carriers. The ratio of sold DVD videos (88%) to sold VHS videos (12%) confirms thatin our country, the digital technology absolutely dominates over the market of recorded film carriers.

Although the digital technology causes the number of sold pieces to increase every year, the revenues from sale drop due to the fact that at the same time in the Czech Republic, illegal copies aremade and authors' and distributors' rights are thus violated to an ever greater extent. For example, in2004 the distributors' revenues from DVD video sales to shops and video-lending libraries reached theamount of 729,646,000 CZK, but the distributors' revenues from the same field stopped as low as557,084,000 CZK.

The best selling films in 2006 were Harry Potter and the Goblet of Fire - 47,374 pieces, Ice AgeII - The Meltdown - 30,140 pieces, Pirates of the Caribbean 2: Dead Man's Chest - 24,747 pieces. The best selling new Czech film was the Holiday Makers - 21,596 pieces.

In 2006, the distribution companies successfully started to use a new sales method in the form ofspecial sales actions, where a DVD video appeared at a very low price as a complement to other goodsor even had the character of a present for the customer using a specific service or a present granted inthe customer contest.

GLOBAL PROBLEM OF PIRACY

In the Czech Republic, the digital audiovisual piracy emerged during 2000, however, its development occurred as late as 2002, particularly in connection with the expansion of DVDtechnology. Apart from the small spread of the relevant technology, the Czech market was also

protected by other facts, such as low foreign language knowledge of the customers, who moreoverpreferred dubbed films to subtitled ones, and the relatively small number of Czech or Slovak speaking inhabitants for whom it did not pay the pirates to produce relevant national versions.

Such a natural protection of our market however went to ruin when DVD emerged. Alongwith the DVD technology expansion, there is an increasing number of people who have not onlya DVD player, but also players of other formats, including, but not limited to, video compact discsand sometimes also CD-R or CD-RW. Common DVD players also enable playing films on VCDor, as the case may be, on a burned CD if it is burned in the VCD format. The customers' willingness to watch a foreign language film version or a subtitled film is greater, particularly inthe case of younger generation, which encourages the pirates in carrying out greater activities andextending the film supply.

As it is obvious from the graph, in 2006 the audiovisual piracy rate reached 38% and in thefirst half of 2007, it is expected to increase to almost 40%. The conventional analogue technologiesare not any longer attractive for the pirates.

In principle, the global digital piracy has two forms, one being the production and distributionof pirate pressed DVDs, and the other one consisting in transforming the film recordings into theDVD-R and CD-R formats and their distribution through the Internet. At present, the Czech marketis particularly affected by the Internet piracy form and DVD-R burning, however, the pressedDVDs represent a real threat. The larger accessibility of DVD technology and cheaper and fasterconnection to the Internet participate in increasing the piracy.

The fight against both these problems must be directed against the piracy source and causes.Just due to their substance, such activities must be global. The Motion Picture Association (MPA),which is a member of the Czech Anti-Piracy Union and which covers anti-piracy activities of thefilm industry all over the world, puts pressure through available procedures on the countries which

allow pirate DVDs to be robustly produced and distributed to other countries. It runs an international Internet search service which detects an illegal content at websites and individualcomputers connected to the net and automatically generates and distributes calls to remove anysuch content. The MPA also closely monitors the evolution of legal regulations applicable to theintellectual property protection both at the international level and in individual countries. WithinEurope, the MPA lobbies for the shape of directives to be adopted by the EU, which directives concern the piracy issue, as well as for an implementation of such directives in the legislations ofindividual states so as to set up better starting positions for the fight against piracy.
