    1.1. Description of the waterway corridor 2:

    The Waterway Corridor 2 (Northern corridor across Dong Thap Muoi and Long Xuyen quadrangle): - First point: Starting from Ho Chi Minh City at Km 0+000; - End point: Confluence Rach Gia – Ha Tien and Tam Ngan canal at Km 253+000. - The routes length 253 Km. - Construction Area: Ho Chi Minh City, Provinces: Long An, Tien Giang, Dong

    1.2. Description of Sub-project Resettlement of Nguyen van Tiep canal: - Objective: dredging, upgrading for boat running flow of Nguyen Van Tiep (Cai be

    district – Tien Giang province) with length 6,5 km to class III, LAD 3m, bottom with 26m and navigation aids installation for all route;

    - First point: At Km 94+000 bordering My Thanh Bac commune, cai Lay district, Tien Giang province;

    - End point: At Km 100+500 bordering Doc Binh Kieu commune, Thap Muoi district, Dong Thap province;

    - Construction area: Hau My Bac commune Cai be district, Tien Giang.

    CCRROOSSSS--SSEECCTTIIOONN DDRRAAWWIINNGG

    The expanded scope of dredging construction is limited by safe line (demarcation stake), taking into account the limits of construction safety is 2m. The expanded scope will carry out measurements to inventory land, assets (houses, works, crops, plants) to determine ownership, legal status to make the damage inventory list as the basis for allowance and compensation calculation, and specific solution for each households. Resettlement works are carried out according to Resettlement Policy Framework (RPF) of the Project that has been agreed between Government of Vietnam and World Bank. Apart from what is stipulated in RFP, will follow the current regulations of the State in resettlement works.

    2. Potential Resettlement Impacts:

    2.1. Description of Resettlement Impacts: a. Impacts for loss of land: The area of land is mainly along Nguyen Van Tiep canal, resettlement width from 10-20m as from the edge of the canal include: Residential land (TCNT) and land near residential (LKTC), the land for producing rice and aquaculture is no damaged. There are 118 PAPs that have been lost land (has achieved 55% total of PAPs).

    b. Impacts for structure loss: Damaged house are mainly house along the canal, most of them are lightweight material houses with wooden frame, thatched roofs and a few semi- permanent house with plank wall and iron sheet roof. PAPs totals are 143 households, make up 66% of PAPs, in there, 64 relocated PAPs that lose the house to have to relocate to a new place, 52 re-organized PAPs, the remaining 27 households are been partial. c. Impact for structure loss: - Loss of access road 3.4 Km of 11.05 Km along the Nguyen Van Tiep canal are compensated by rebuilding new road. This work was approved the investment by the MOT and done with the canal dredge of the civil bidding package NW-1. - Low voltage line length 1 Km be compensated for relocation from the compensation scope to ensure safety for canal dredge construction. Design and estimated of relocated power lines is done simultaneously with resettlement works to approve the implementation funds.

    - There are 14 small business households (selling groceries and beverages) is affected the income by resettlement works;

    :

    - There are 64 households have to relocate: 5 households of house loss and land loss; There are 59 households who built houses on the scope of state management land (land of waterway corridor, traffic) and households live other people’s land are lost house. After consultation about the resettlement works, they want to receive money support to self-resettlement, not required on resettlement

    areas. Therefore will not have the construction investment of resettlement site in this area.

    3. Brief description of socio-economic characteristics of PAPs: Cai Be is plain district of Tien Giang province, conditions of socio-economic development in average. Survey of socio-economic investigation in FS phase and update the DMS have results as follow:

    3.1.2. Occupation of the surveyed PAPs: Because of this is the agricultural production with main force rice plants so PAPs mainly farmers and employees make up 77.5% of households. The number of PAPs small business make up 7.4%. The number of PAPs workers make up 4.6%. The number of PAPs free-works such as employees took materials handling, construction workers… make up 10.2%.

    3.1.5. Living conditions: The entire region have been supplied electricity and water for the center of Cai Be district make up 95% of households, the remaining households use rain-water, canal-water and well-water, contact information is good, most households have toilets, there’s no more toilets on the canal. Outlook for the living conditions in this area is average.

    3.2. Statistics for all affected assets: Major assets affected have residential land and agricultural land along Nguyen Van Tiep canal with 46,819.50 m2; Housing (permanent, semi-permanent and temporary) with 5,680.16 m2; Constructions and crops.

    3.3. Economic production systems and use natural resources: - Economic production systems in the resettlement area is mainly private, non-work

    state and community - Use of mainly natural resources are land and water to serve agricultural

    production with short-term rice, growing fruit trees, perennial (eucalyptus) on the land around the house and waterway safety corridor

    3.4. Statistics of common ownership natural resources (if any):

    Without this natural resource.

    3.5. The economic activities of all relocated PAPs: - The relocated PAPs have no production land, economic activities are mainly

    employees in the field of agriculture such as plant care, protection, harvesting, harvest rice and rent drying rice ...

    - Some PAPs make free-works, for any employable to do. Income is uncertain, life is not stable.

    3.6. Social Organization and Social Networks: The social organizations was established include: the farmers society; Young people society; Fatherland Front; Women association; The veterans society; Red Cross society; The study encouragement society; The elderly people society; The former teachers society; The disabled sponsor and orphans society. Most organizations have social networks in all communes and hamlets.

    3.7. Place of state management grassroots and social welfare: At Cai Be district, the communes have built the social security works such as school, medical station, house of culture not far from residential areas. Travels by waterway are very convenient on Nguyen Van Tiep canal and road traffic is developing with rural roads along the Nguyen Van Tiep canal and PR941 connecting Cai Be district with Thap Muoi district so it narrowed distance travel for people to approach convenient with the social security works inside and outside the locality.

    3.8. Provide details of any women's own households and ethnic minorities affected by the project and their principal socioeconomic status: a/. The household live in Hau Quoi hamlet, Hau My Bac B commune, Cai Be district. This is the relocated household (loss 100%house), has no production land, the house located on Nguyen Van Tiep canal shore. The household has all 1 person with career as selling beverages, life is very hard.

    Head of household: Nguyen Thi Beo (MS: TG-CB-HMBB-HQ-10):

    Talking directly with head of household show that they were fully informed about the Nguyen Van Tiep canal dredging and know to remove their house to other places. Aspirations of the households that would be self-resettlement, they desire full compensation money to self-buy land to product and rebuild house. Requirements of households that are received helping by local governments for loan procedure to breed and product to stabilize their lives. b/. Head of household Nguyen Thi Anh Nguyet (MS: TG-CB-HMBB-HQ-72)The household live in Hau Quoi hamlet, Hau My Bac commune, Cai Be district. This is the relocated household (loss 100%house), has no production land, the house located on Nguyen Van Tiep canal shore. The household has all 2 persons with career as selling beverages, life is very hard.

    :

    Talking directly with head of household show that they were fully informed about the Nguyen Van Tiep canal dredging and know to remove their house to other places. Aspirations of the households that would be self-resettlement, they desire full compensation money to self-buy land to product and rebuild house. Working with People’s Committee of Hau My Bac B Commune show that Nguyen Thi Beo and Nguyen Thi Anh Nguyet households are facing difficulties so local government combine with Women Association will care and help families, in case they could not find another place, the local government will be based on the decision No.167/QD-TTg of the Prime Minister on policies to support poor households on house, particularly in the province to settle for households residing in Hau My Bac B residential areas under My Trung hamlet, Hau My Bac B commune, Cai be district. - To buy a house lot with size (5x17 = 75m2) with 25 - 30 million VND dependence

    on resettlement foundation, paying 5 - 10year period with interest rate 0%.

    Therefore, with amount supported by local with 70 million VND/household with have land: 2.7 million VND/person with have no land (stay temporary) but not less than 10 million VND/household, the PAPs will have favorable conditions to stabilize their lives. In case of PAPs non self-find another place, the DRC will consider each specific case and the disposition of resettlement in favor of the PAPS to stabilize their lives, those are taking full advantage of the number home foundation in Hau My Bac B residential areas for resettlement arrangement.

    4. Compensation rates as applicable to the sub-project: 4.1. Legal documents: - Decision No.36/2009/QD-UBND dated 31th December, 2009 of PPC Tien Giang

    issued regulation on compensation, assistance and resettlement when the State recovers land for national defense, security, national benefit; public benefit, economic development in Tien Giang Province;

    - Decision No.37/2009/QĐ-UBND dated 3rd December, 2009 of PPC Tien Giang issued price table of solid at Tien Giang;

    - House and structure compensation price is based on Decision No.15/2008/QĐ-UBND dated 14th April, 2008 of PPC Tien Giang;

    - Crops and plants compensation price is based on Decision No.02/2008/QĐ-UBND dated 9th January, 2008 off PPC Tien Giang.

    Hau My Bac B commune is located along province road, travel conditions are favorable compared to other communes, there are advantages in geographic location highest. So choose this place to survey the unit price of compensation is sufficient basis to reflect the full market price for the damaged area of Cai Be district. The survey results market price compared to compensation unit price in sub-projects as follow: - Residential land: 275,000 – 400,000 VND/m2, Average market price 340,000

    VND/m2, but compensation price for residential land is 300,000 – 400,000 VND/m2; have no LURC will be calculated with 400,000 VND x 99.5% = 398,000 VND/m2. Thien Ho bridge area, range of 35m from the edge of the road will be calculated with 2,500,000 x 99,5% = 2,487,500 VND/m2. Currently, the housing market has deteriorated to purchase land in this area should not change much so calculated compensation price for residential land have been approved.

    - Land near residential: Survey the market price of Rice land from 150,000 – 275,000 VND/m2, average 215,000 VND/m2. Land near residential will be calculated with 95,000 – 160,000 VND/m2 (land for perennial crops) and supported by 50% compensation price for residential land with 150,000 – 200,000 VND/m2 plus with compensation price for residential land 245,000 – 295,000 VND/m2 higher compensation price for rice land

    Price calculation of land compensation has been carried out public consultation and consent farmers should not complain about land price. The compensation prices for structure, crops and plants has been provided so far in 2008 until now there is not a new price and actual unit price has been announced and no complaints in process of setting up sub-project resettlement as well as SRP Cai Lay district was approved dated 17th June, 2010.

Resolving households’ comments: Comments from the households were replied by representative DRC Cai Be as follow: - The level of compensation for the removal of graves will be for all costs of

    In additional, Decision No.36/2009/QD-UBND dated 31th December, 2009 of PPC Tien Giang issued regulation on compensation, assistance and resettlement when the State recovers land for national defense, security, national benefit; public benefit, economic development in Tien Giang Province and Decision No.37/2009/QĐ-UBND dated 3rd December, 2009 of PPC Tien Giang issued price table of soil at Tien Giang to solve the problems existing in the resettlement works such as: Land compensation, allowance policy and other related issues. Thereby solving the comments and questions of households. During DMS, the mission go on to explain question of PAPs should have minimized the complaints. PAPs majority agreed with the compensation and allowance plan was made, looking forward to receiving money to stabilize their live.

    DRC Cai Be carried out consultant for relocated PAPs in January 2010, the result as follows: a. Selection of the resettlement form: 100% of self-resettlement household. b. Selection of a new area: 100% of households bought land near the old area. c. Living at new area: 100% of households advantages of electricity, water, market,

    travel. d. New job: Continues to old job (employees and field). e. Family life: 28% of households realize their life will improve more; 11% recognize

    equivalent with the old area; 52% of households think that life will take difficult but can overcome

    f. Expectation: 63% of households ask loans for production/business; 11% of households required support to register population and award the right of land use after they has bought the land to build houses.

    Through consultations that households are prepared to find out where resettlement after they receive the compensation. Because land price in these areas aren’t high and easily find so buying land near clear away area isn’t difficult for PAPs. However, for the resettlement work is favorable, households need to the participation of government and mass organizations at the local to arrange in the arrange in the Commune’s resident areas if they request and resolve the population registration procedures, award the land use right certificate to households to help them stabilize their lives soon. Households are interesting for loan problems to production, business, they proposed the government to help them to contact with credit organizations and resolvable needed procedures for borrowing credit funds. DRC Cai Be continues to monitor the stability of PAPs and will set up the life rehabilitation allowance plan after conducting compensation payment for relocated PAPS to submit DPC for approval.

    9.2. Resettlement monitoring and the livelihood restoration plan of relocated PAPs, including PAPs no moving house but income-generating activities were severe affected by the construction:

    9.2.1. Resettlement monitoring plan: The consultant will supervise resettlement work, selection of consultant implemented as procurement regulation of WB for Package CS-D4i: Integrated Project Implementation Audit Service (IPIA). Resettlement monitoring content in TOR has been approved by WB.

    9.2.2. The livelihood restoration plan of relocated PAPs: Through the damage investigation results determine the number of households being affected to their income are relocated PAPs and loss of the entire house and have no agricultural land. Because these households are not farmers or business household, therefore they should not be enjoyed to rehabilitation support in RFP such as: Agricultural expansion support or training supports. Local government should apply allowance policies for poor people, the man credited with the revolutionary. They shall consult the PAPs after compensation to propose appropriate allowance method for each household having difficulty because they have to find new housing and income to stabilize life. There are 64 PAPs under Hau My Bac B commune. The livelihood restoration plan will be sent to WB for review in November 2010 before PPC for approval.

    SRP of Cai Be district has been tested on the implementation of RPF that has been agreed between the GOV and WB applied in Tien Giang province including 2 districts: Cai Be and Cai Lay, in which: SRP Cai Lay was approved and paid compensation for PAPs.

    Proposes WB to approve SRP soon to create favorable conditions for compensation payment timely, limited complaint due to prolonged compensation affect the preparation construction and carry out the livelihood restoration plan.
