1 Introduction

3.1 NETWORKING & Structured Cabling – Subcategory Ref 4.1 Inthissectiontherespondentsarerequiredtosubmitaproposalbasedontheirsitesurveytofulfillalltherequirementsofaunifiednetwork.Thesolutionprovidedshouldbeeasilyexpandableandabletointegratevoice,videoanddata.Thesolutionshouldofferthemeetthefollowingaswellasthehardwarerequirements;

3.1.1.3 RobustTheproposednetworkinfrastructureshouldbehighperforming,robustandbestofbreedabletoprovideunparalleledreliability,whilebeinginconspicuousandunobtrusive.
3.1.1.4 MeetIndustryStandardsTheActiveandPassivenetworkequipmentproposedshouldmeettheindustrystandardsandvendorsupport,suchasSiemensCAT6Cables,CiscoLayer2and3RoutesandSwitches.

3.3.1 DigitalVideoBroadcast(DVB)overInternetProtocol(IP)ProgrammingbyvideostreamencodedasaseriesofIPpacketstohotelguestrooms.Thevideostreamingcapabilityshouldbesupportedbythestructuredcablingprosedinitem3.1above.UtilizeonesatellitedishterminatedtotheDVB-IPunit,whichhasthecapabilityofVideoonDemand(VoD)andaportal.TheSmartVoDwillbeusedtostreamvideosthatmaybedemandedbyspecificclientswhilethePortalwillbeusedtobroadcastspecialmessages.e.g.specialmenus,breakingnewsetc.Alltheequipmentwillthenbeconnectedtotheunifiednetworkforstreamingtoeveryhotelunit.Thedeliverableshereare:

Thevendorshouldhaveaclearlydefinedinstallationandtrainingprogrammeaswellasofferserviceandsupportonacontinuousbasis.Theadministrativesafewouldbeinstalledinthemanagementofficeforusebythehotelfrontofficestafftostoreguestsvaluables,moneyandotherhighvalueitems.
3.6 HOTEL INTERCOM TELEPHONE SYSTEM – Subcategory Ref 4.6 Inthissectiontherespondentsaresupposedtoprovideasolutionforlowcost,telephonyforboththehotelroomsandadministrationofthehotel.Thereare146guestroomsanddetailsofadministration/frontofhousetelephonescanbeprovided.
3.7 STAFF BIOMETRIC SYSTEM – Subcategory Ref 4.7 Inthissection,therespondentsaresupposedtoprovideabiometricbasedsolutionforstaffloggingandtrackingandshouldofferamongothersthefollowingcapabilities:

3.9 INTELLIGENT CCTV SURVEILLANCE SYSTEMS – Subcategory Ref 4.9 Inthissection,respondentsaresupposedtoprovideanIPbasedintelligentsurveillancesystemscoveringallareasofthehotel.Thesolutionproposedshouldmeetamongothersthefollowingfeatures;

4 GENERALSERVICECONTRACTTERMS&CONDITIONS1 Guarantee:Theawardedvendorshallfullyguaranteeallworkmanshipandpartsfurnishedand
installedunderthiscontractagainstdefectforone(3)yearaftercompletion.DefectswillberepairedorreplacedatnochargetoLaashaHotel
2 AwardedvendorshallsupplyLaashaHotelwithallwarrantyinformationwhetheritbeexpressedorimplied.
3 Allequipment,partsand/orsuppliesusedshallbenewandoriginalequipmentmanufacturer(OEM).Thevendormustdeclarethemanufacturer,Model,Type,Seriesandotherspecificationontheirproposals
4 Theawardedvendorisresponsibleforproperlydisposingofanymaterialsremovedorreplaced.Inaddition,anyareasdisturbedshouldberestoredtotheiroriginalcondition.
5 LaashaHotelreservestherighttomakeallfinaldecisionstodeterminewhethertoproceedwithrepairorreplacementofanyequipment.
6 AllcontractsbetweentheawardedvendorandLaashaHotelwillbeforthepurposeofsettingpricesandservicestobeprovidedandthetermthattheyarevalid.Nominimalamountofworkwillbeguaranteed.
7 TheawardedvendorshallnotshutdownanyequipmentunlesspermissionisfirstobtainedbytheHotelManagement.
8 ItistheresponsibilityoftheawardedvendortokeeptheHotelManagementandProjectManagerinformedofthestatusofallworkinprogressonadailybasisincludingbutnotlimitedtoestimatedcompletiondate,partsdeliverydates,andaccruedandprojectedjobcosts.
5 EvaluationCriteria Allproposalsshallbeevaluatedbasedonthefollowingcriteria:
• Therespondentexperienceinperformingsimilarscopeofworkinhospitality.• Demonstrationofachievingthescopeaboveinwhole.• Demonstrationoffeasibility,reliability,security,administrationofthesolutionsabove.• Abilitytocutdownofenergyconsumptionofthesolutionproposed.Howsustainableisthe
solutionproposed.• Warrantyoftheproprietaryequipment’sproposedinthesolution(Network,CCTV,AccessControl,
SMARTLocks).• Overandabovemeetingthescopewhatotheradditionalfeatureswillthesolutionproposedmeet
tomakethehotela4starhotel.• Overallcostofthesolutionproposed.• Implementationtime.• Flexiblepaymentplans.• Innovativesolutions.
6 SubmissionRequirementsInterestedpartiesshouldcomplywiththefollowing:
• MUSThavedoneanextensivesitevisitbeforesubmittingtotheproposal• Mustprovideproofofhavingcarriedoutworksofsimilarmagnitudeatotherhotelsinthe
country.• MustfillintheStandardFormandDeclarationFormattachedtothisdocument,andattach
therequireddocuments.• Mustmaketheapplicationnon-refundablepaymentasinstructedinclause7

7 ApplicationGuidelines
7.1 Cost of Application:
Allinterestedpartiesmustmakeanon-refundablepaymentofKES7,000(orKES12,000iftherespondentisapplyingasaConsortium)payabledirectlyto:

7.2 Clarification of Documents:
7.2.1 AprospectivecandidaterequiringanyclarificationoftheRFPmaynotifytheProcuringentityinwritingorbyemailattheentity’saddressprocurement@fep-group.comTheProcuringentitywillrespondinwritingtoanyrequestforclarificationoftheRFPdocuments.
7.2.2 Theprocuringentityshallreplytoanyclarificationssoughtbythecandidatestoenablethecandidatestomaketimelysubmissionofitsproposal.
7.3 Amendment of the RFP Documents:
7.3.1 Atanytimepriortothedeadlineforsubmissionoftenders,theProcuringentity,foranyreason,whetheratitsowninitiativeorinresponsetoaclarificationrequestedbyaprospectivetenderer,maymodifythedocument.
7.4 Language of Bid Document:
7.4.1 Theproposalpreparedbythecandidate,aswellasallcorrespondenceanddocumentsrelatingtothetenderexchangebythecandidateandtheProcuringentity,shallbewritteninEnglishlanguage.AnyprintedliteraturefurnishedbythecandidatemaybewritteninanotherlanguageprovidedtheyareaccompaniedbyanaccurateEnglishtranslationoftherelevantpassagesinwhichcase,forpurposesofinterpretationofthetender,theEnglishtranslationshallgovern.
7.5 Sealing and Marking of Proposals: Thecandidateshallmake twosetsof theproposal, seal themanddulymarkonesetas“ORIGINAL”andtheothersetas“COPY.”Theenvelopesshallthenbesealedinanouterenvelope.Note:ProposalsnothavingtwosetsofdocumentsshallbedisqualifiedatProposalopening.

7.5.1 Theinnerandouterenvelopesshall:
(a)BeaddressedtotheProcuringentityattheaddressprovided:(b) Bear Category Ref. and Category description, subcategory ref andsubcategory description the candidatewishes and thewords, “DONOTOPENBEFORE,”(day,dateandtimeofclosing)
7.5.2 Theinnerenvelopes(“original”and“copy”)shallindicatethenameandaddressofthecandidate.However,theouterenvelopeshallnotbearthenameofthecandidate,asthismaybeconsideredascanvassing.
7.6 Deadline for Submission of Tenders:
TendersmustbereceivedbytheProcuringentityattheaddressspecifiedunderparagraphnotlaterthantheday,dateandtimeindicated.
The Procuring entity may, at its discretion, extend this deadline. This will be notifiedthrough the procurement entity’swebsite, inwhichcaseall rightsandobligationsof theProcuringentityandcandidatespreviouslysubjecttothedeadlinewillthereforebesubjecttothedeadlineasextended.
7.7 Opening of Proposals:
7.7.1 TheProcuringentitywillopenallproposalsinthepresenceoftenderers’representativeswhochoosetoattend,at(time,dayanddateofclosing)andinthelocationspecifiedintheInvitationtoprequalify.Thetenderers’representativeswhoarepresentshallsignaregisterevidencingtheirattendance.
7.8 Clarifications:
To assist in the examination, evaluation and comparison of tenders the Procuring entitymay,at itsdiscretion,askthecandidatesforaclarificationof itsproposal.Therequest forclarificationandtheresponseshallbeinwriting.
Toassistintheexamination,evaluationandcomparisonofproposals,theProcuringentitymayrequestcandidateswhomoveontothenextstageoftheprocesstosendcertaindocumentsandrelevantinformationbyemailtotheemailaddressprocurement@fep-group.com
7.8.1 AnyeffortbythecandidatestoinfluencetheProcuringentityintheProcuringentity’sevaluationofprequalificationdecisionsmayresultintherejectionofthecandidates’proposaldocuments.

7.9 Evaluation and Comparison of Proposals:
TheProcuringentitywillevaluateandcomparetheproposalswhichhavebeendeterminedto be substantially responsive. The Procuring entity shall use Evaluation Criteria andParameterstoevaluatetheapplications.
7.9.1 ToqualifyforPrequalification,thecandidatesshallhavethefollowing:a)Necessaryqualifications,capabilityexperiences,services,equipmentandfacilities.b)Legalcapacitytoenterintoacontractforprocurement.c)Shallnotbeinsolvent,inreceivership,bankruptorintheprocessofbeingwoundupandisnotthesubjectoflegalproceedingsrelatingtotheforegoing.d)Shallnotbedebarredfromparticipatinginpublicprocurement.
7.10 Contacting the Procurement Entity:
7.10.1 Nocandidateshallcontacttheprocuringentityonanymatterrelatingtoitsbidbetweentheproposalopeningandawardofcontract.
7.10.2 Anyeffortbyacandidatetoinfluencetheprocuringentityinitsdecisionsonevaluation,comparisonorapprovalmayresultintherejectionofthecandidatesbid.
7.11 Award of Contract:
Candidatesthatmakeitpasttheinitialvettingstagemayundergoamorethoroughvettingandevaluationprocess. Inaddition, theprocuringentitymayvisitorundertakeanyotheractivity to determine to its satisfaction whether a candidate and/or their proposal isqualified.Anegativedeterminationwillresultinrejectionofthecandidatesbid.
7.12 Notification of Approval:
TheprocuringentitywillnotifyallbiddersontheresultsoftheRFPexercise.
FEPHoldingsLtdreservestherighttoacceptorrejectapplicationseitherwhollyor inpartandisnotboundtogivereasonsforitsdecisions.
7.13 Corrupt or Fraudulent Practices:
TheProcuringentityrequiresthatcandidatesobservethehigheststandardofethicsduringtheprocurementprocessandexecutionofcontractswhenusedinthepresentregulations;thefollowingtermsaredefinedasfollows;
i)“corruptpractice”meanstheoffering,giving,receiving,orsolicitingofanythingofvalueto influence the action of a public official in the procurement process or in contractexecution;and

ii) “fraudulent practice” means a misrepresentation of facts in order to influence aprocurementprocessortheexecutionofacontracttothedetrimentoftheProcuringentity,andincludescollusivepracticeamongtenders(priortooraftertendersubmission)designedto establish tenderprices at artificial non-competitive levels and todeprive theProcuringentityofthebenefitsoffreeandopencompetition.
Theprocuringentitywillrejectacandidate’sprequalificationdocumentif itdeterminesthatthe candidate recommended for award has engaged in corrupt or fraudulent practices incompetingforthecontract.FurtheracandidatewhoisfoundtohaveindulgedincorruptorfraudulentpracticesrisksbeingblacklistedbyFEPHoldingsLtdanditssubsidiariesandwillnotbeconsideredforcurrentorfuturetenderconsiderations.
